The purpose of this hearing was to examine U.S. policy toward the 55-nation Organization for Security and Cooperation in Europe (OSCE). The Commission hearing focused on how the Administration has been using the OSCE to promote U.S. interests in the OSCE region, particularly as a tool for advancing democracy.

The witnesses and Commissioners discussed how the Helsinki Accords is based on mutual monitoring, not mutual evasion of difficult problems and how this concept can be an effective tool for the U.S. foreign policy apparatus. In particular, the hearing covered situations in Central Asia where corruption threatens the development of democratic institutions.

  • Summary of the OSCE Rule of Law Seminar

    From November 28 to December 1, 1995, the participating States of the Organization for Security and Cooperation in Europe (OSCE) convened a seminar on the rule of law. The meeting was organized by the Warsaw-based OSCE Office for Democratic Institutions and Human Rights (ODIHR). Thirty-eight of the 53 fully participating States attended, along with representatives from two Non-Participating Mediterranean States, six international organizations, and 25 non-governmental organizations. Over the course of two days, a number of emerging democracies described the constitutions and other legislative provisions that had been adopted in their countries to provide for the rule of law, at least on paper. Western participants, for their part, generally spoke of the specific and concrete challenges faced in their countries in actually implementing safeguards for the rule of law. In general, the participation of East-Central European and former Soviet countries—most of which attended this meeting—was more active than at the 1991 Oslo meeting, and Western participants, for their part, avoided the West-West bickering that marred the earlier seminar. At the end of the meeting, the rapporteurs produced summaries of the discussions.

  • Religious Liberty: The State Church and Minority Faiths

    Samuel G. Wise, Director for International Policy at the US Helsinki Commission, presented the second briefing in a series focusing on religious liberty in the participating states of the Organization for Security and Cooperation in Europe. This particular discussion was intended to evaluate the relationship between state churches or traditional religious and freedom of religion for minority faiths in the OSCE region through an analysis of the effects of certain historical legacies on individual states. Witnesses testifying at the briefing – including Father Kishkovsky, Ecumenical Officer of the Orthodox Church in America; Father George Papaioannou, Pastor of St. George Greek Orthodox Church; Gerard Powers, Foreign Policy Advisor for the U.S. Catholic Conference; Lauren Homer, Founder of Law and Liberty Trust; and Lee Boothby, Vice President of the Council on Religious Freedom – focused on the issue of minority and majority in society as it relates to religion and the potential for this issue to result in conflict. The historical origins of these tensions, especially in Eastern Europe, were particularly emphasized. 

  • Religious Liberty in the OSCE: Present and Future

    Speaking on behalf of Congressman Christopher H. Smith and Senator Alfonse M. D’Amato, chairman and co-chairman of the Helsinki Committee, the Committee’s Director for International Policy, Samuel G. Wise, addressed the improvements made by the countries of the OSCE in religious liberty since the demise of communism. Observed deficits in this particular subject were also evaluated, including acts of OSCE governments perpetrating religious intolerance and discrimination against people of faith by passing laws favoring certain religions, turning a blind eye to harassment, and establishing bureaucratic roadblocks to prevent religious minorities from practicing their faith. Each panelist – including Dr. Paul Marshall, Senior Fellow of Political Theory for the Institute for Christian Studies; Dr. Khalid Duran, Senior Fellow for the Institute for International Studies; and Micah Naftalin, National Director for the Union of Councils for Soviet Jews – spoke to the overall factors affecting religious freedom in the OSCE, including: respect for other freedoms such as freedom of speech and religion, ethno-cultural tensions, and the relevance of old prejudices. These ideas were presented in the context of moving towards a more comprehensive respect for religious freedom among OSCE member states in the future.

  • Turkey-U.S. Relations: Potential and Perils

    The hearing examined both the potential mutual benefits of closer relations with Turkey, and the peril of unconditional support for a government unable to resolve crises that threaten the existing political order and regional stability. Turkey, a NATO ally and OSCE participating State is poised as a unique strategic and economic partner astride the Middle East, Central Asia, the Caucasus, and the Balkans. Turkey stood by the United States in Korea, against Saddam Hussein during the Gulf War, and in its aftermath in Operation Provide Comfort. Turkey also supported our efforts to bring peace to Bosnia.  The potential benefits of closer cooperation are obvious. At the same time, however, a complex and profound crisis increasingly divides Turkey's citizens along national, ethnic, and religious lines, threatening the existing social and political order. Extremist violence and terrorism is polarizing Turks and Kurds, Islamic groups, both secular and anti-secular proponents. While the rights of all Turkish citizens under the mantle of combating terrorism, Kurds bear the brunt of such repression.

  • Trade and Investment in Central Europe and the NIS

    This briefing was the tenth in a series of briefings covering topics such as U.S. assistance to Central and East Europe and the NIS, and free trade unions. Topics of discussion included the economic aspects of efforts to develop institutional networks between the Central and Eastern European countries and the OSCE and the Western European multilateral structures and the progress that has been made by countries in developing association agreements with the European Union. Witnesses testifying at this briefing – including Harriet Craig Peterson, President of Cornerstone International Group and Thomas Price, Coordinator for OSCE Affairs for the State Department – evaluated regional issues associated with infrastructure, environment, energy, and border procedures that needed to be addressed to produce a smoother flow of goods from an economic perspective.

  • U.S. Assistance to Central and Eastern Europe and the NIS: An Assessment

    This briefing discussed the successes achieved and the difficulties encountered on the road to democratic reform and stabilization are reflected throughout Central and Eastern Europe, and evaluated the impact of these factors in the scope and tenor of U.S. assistance programs. Such programs involve assistance to countries throughout the region in democratic institution building, market reform and restructuring, health care improvement, energy efficiency, environmental policy, and housing sector reform. Witnesses testifying at this briefing addressed the relevance of the crisis in Chechnya, continued conflict in the Balkans, and tensions in various parts of East-Central Europe to United States Interests in the region. They focused on the goals of U.S. assistance to the NIS and East-Central Europe and the effectiveness of current programs in furthering those goals.

  • U.S. HELSINKI COMMISSION DELEGATION TO BOSNIA-HERZEGOVINA

    The Commission delegation travelled to the Bosnian capital of Sarajevo to assess the situation in Bosnia-Herzegovina as the third winter of the conflict in that country approached. Specifically, the delegation was interested in local observations of the prospects for peace, international policies to enhance those prospects quickly and effectively, and the continuing humanitarian crisis that continues in the meantime. These objectives were part of a larger Commission effort to document the tragic events which had transpired in Bosnia-Herzegovina and other parts of the former Yugoslavia since that federation began its violent disintegration, and to raise public awareness of the severe violations of CSCE principles and provisions that resulted. Following its visit to Sarajevo, the Commission delegation travelled to Albania at the invitation of President Sali Berisha. The visit offered the opportunity for the Commission to observe firsthand the vast changes which had taken place in Albania since the elections of 1992, which ousted the communists from power after nearly 50 years of ruthless repression and isolation. It also was intended to show support for Albania during a time of crisis and conflict in the Balkans and, at the same time, to encourage Albania to make continued progress and avoid making mistakes which could damage Albania's image abroad. During the last stop on the trip, the delegation visited Turkey to examine issues of mutual concern to the United States and Turkey, including human rights issues, the Kurdish situation, conflict in the Balkans and the Middle East peace process.  

  • Status of Media Freedom in Democracies

    This briefing detailed the progress of media freedom in newly democratic states, especially within Eastern Europe. The role of the media in the democratization process and methods for promoting freedom of the media were examined as well. Witnesses testifying at the hearing – including David Webster, Chairman of the  Trans-Atlantic Dialogue on European Broadcasting and Sandra Pralong, President of Democracy Works – detailed several major values that a free media promotes in the democratic process, including peaceful social change, education of the democratic electorate, dissenting opinions about the government and society in general, and transparency of political corruption.

  • Report: The Belarusian Presidential Election

    Belarus, with an area of over 80,000 square miles, is located in east central Europe, between Latvia, Lithuania and Poland on'the West and Northwest, with Russia on the East and Northeast, and Ukraine to the South. Of the approximately 10.3 million population, 78 percent are Belarusian, 13 percent Russian, 4 percent Polish, and 3 percent Ukrainian. A small Lithuanian population is concentrated near the Lithuanian border. Part of the Russian Empire since the second and third partitions of Poland in the latter half of the 18th century, Belarus enjoyed brief independence following the Bolshevik revolution. In November 1918, the Red Army entered Minsk and established the Belarussian SSR. During the Cold War era, Belarus was a quiescent, almost completely Russified Soviet republic. Popular discontent was stirred up in 1986 by the radioactive winds of the Chemobyl nuclear reactor disaster in neighboring Ukraine. and Moscow's incompetence in dealing with the· crisis. A year later, exposure of the mass graves of Stalin's victims at Kuropaty added to anti-Moscow .feelings. Unexpected and uncharacteristic mass strikes and public protests met President Gorbachev's April 1991. prices increases -- only a month after the March 1991 "Referendum on the Union," in which 83 percent of Belarusian voters favored preservation of the USSR.

  • Russia and its Neighbors

    Dennis Deconcini (D-AZ) and other legislators discussed Russia’s relations with its neighboring countries. More specifically, concerning democratic reform, the hearing contrasted the economic criteria of privatization, the rate of inflation, currency emission, and subsidies to enterprises with Moscow’s policies vis-à-vis its neighbors. Of course, Russia’s neighbors are referred to as the New Independent States, and, as Deconcini argues, it is problematic when Russia militarily or economically coerces its neighbors to enter into unwanted, yet inevitable, political, security, or economic relationships.

  • Focus On Serious Challenges Facing the Ukraine

    David Evans, senior advisor at the Commission, addressed the economic, political, and regional challenges Ukraine faces and emphasized Ukraine’s geo-strategic importance, especially as a bulwark against any potential Russian imperialism.  Evans was joined by Dr. Irini Isakova and Adrian Karatnycky, who highlighted Ukraine’s lack of economic reform and its continuing economic decline since claiming independence in 1991. The panelists focused on Ukraine’s regional issues and domestic and foreign regarding internal divisions, including serious challenges for Ukrainian-Russian relations regarding Crimea.

  • Russia and NATO: Moscow’s Foreign Policy and the Partnership for Peace

    This briefing examined what role Russia would play in the Partnership for Peace and NATO. It also looks at human rights concerns as well as military, security, and economic relations bewteen Russia and the West. Several complexities of this situation in the context of the post-communist period were addressed. Witnesses testifying at the briefing – including Lawrence DiRita, Deputy Director of Foreign and Defense Policy for the Heritage Foundation and Dr. Phillip Petersen, Principle Researcher for the Potomac Foundation – evaluated the Partnership for Peace Framework, which worked towards establishing partnerships with a number of European country, including those of the former Soviet Union. The role of Russian policy in this partnership was an especially debated topic.

  • CSCE to Examine Repression against Evangelicals in Former Soviet Union

    Chris Smith, ranking Republican on the Commission on Security and Cooperation in Europe, addressed both the opportunities for democratic, economic, and social reforms in Eastern Europe and the former Soviet Union, and the difficulties of achieving these reforms presented by renewed tensions based on nationality and religion. The rise of extreme nationalism was cited as a key factor in the rise of religious intolerance in this region. Witnesses testifying at the briefing – including Boris Pechatkin and Edward Zawistowski of the Russian-American Institute for Adaption, and Lauren Homer, Director of Law and Liberty Trust – addressed the difficulties that have been encountered in ending religious prosecution following the fall of the Soviet Union. The impact of a breakdown of law and order in the countries of Eastern Europe was evaluated as a mechanism for religious injustice.

  • CSCE Implementation Meeting on Human Dimension Issues

    Against a backdrop of savage conflicts in Bosnia-Herzegovina, Nagorno Karabakh, and Georgia, attendant refugee crises throughout the region, and a wave of sometimes violent racism and xenophobia even in long-established European democracies, the participating states of the Conference on Security and Cooperation in Europe (CSCE) met in Warsaw, Poland in 1993 for the first biannual Implementation Meeting on Human Dimension Issues As specified by the 1992 Helsinki Document, the meeting included a thorough exchange of views on the implementation of Human Dimension commitments, consideration of ways and means of improving implementation, and an evaluation of the procedures for monitoring compliance with commitments. The dramatic unfolding over the course of the meeting of the showdown within the Russian government-- culminating in the shelling of the Russian Parliament building by government troops-- served as a sober reminder to participants of the vulnerability of democracy in transition and the importance of shoring up Human Dimension compliance.

  • Ethnic Violence in Trans-Caucasia

    Chairman Dennis DeConcini addressed rising ethnic violence in Armenia, Azerbaijan and Georgia and emphasized this region as more violent than other post-Soviet states. He referred to the continuing violence in Abkhazia, a separatist region in Georgia, and the rising concerns about further deterioration of stability in the region and Russia’s role in the conflict. Witnesses - Dr. Paul Henze, Ross Vartian, Mourad Topalian, Ambassador Hafiz Pashayev, and Ambassador John Maresca - highlighted the conflict between proponents of self-determination and governments insisting on territorial integrity and the difficulty of negotiating with sides that see completely different situations.

  • The Yugoslavia Conflict: Potential for Spillover in the Balkans

    This hearing reviewed the potential for spillover in the Yugoslav conflict. In particular, the hearing examined the aggression in Bosnia- Herzegovina and the possible effects of this on its own ethnic communities and on those of neighboring countries. The economic decline that followed the disintegration of Yugoslavia provided additional hardships for the large refugee population in the region. The Commissioners examined how the U.S. should respond, and whether current policies, such as sanctions on Serbia and Montenegro, are effective.

  • U.S. Human Rights Policy: Joint Hearing with House Foreign Affairs Subcommitee on International Security, international Organizations and Human Rights

    This hearing examined the best ways to promote commitments made in the Charter of Paris agreement. The Commissioners and witnesses reviewed developments in the Balkans and Serbia’s continued territorial aggression.  They also discussed the practice of developed democratic countries selectively applying human right policies. The Commissioners stressed the need for continual assistance to democratically developing countries.  They also highlighted the need for additional pressures on  those countries that disrespect universal human rights to encourage them to change their behaviors.   The distinguished witnesses and Commissioners discussed ways in which the U.S. can strength the United Nation’s ability to promote and protect human rights, as well as how the U.S. can make greater use of regional bodies, like the CSCE, in conflict resolution.

  • Human Rights Policy Under the New Administration

    The purpose of this hearing was to examine the euphoria of the post-Cold War age in regards to the lack of confidence and political drive on how to promote commitments made in the Charter of Paris agreement. The hearing reviewed the actions made in the Balkans and Serbia’s continual territorial aggression and also developed democratic countries selectively applying human right policies. The Commissioners stressed the need for continual assistance to democratically developing countries, but to those countries that disrespect universal human rights should have additional pressures applied to change this behavior. The distinguished witnesses and Commissioners discussed ways in which the U.S. can help play a role in strengthening the United Nation’s ability to promote and protect human rights, as well as how the U.S. could use greater use of regional bodies similar the CSCE in conflict resolution.

  • Migrant Farmworkers in the United States (Part 1)

    At the 1992 Helsinki Summit, previously limited references to migrant workers were expanded, and the heads of state or government mandated the newly established Office for Democratic Institutions and Human Rights to convene a seminar on migrant workers.  In the context of this expanded OSCE focus, the Helsinki Commission organized five days of public briefings examining: farm labor economics, demographics and living conditions, health and safety concerns, farmworker children's issues, and possible strategies for addressing problems facing farmworkers, their families and their employers. Those briefings were held on July 20, 1992; October 9, 1992; February 19, 1993; March 1, 1993; and April 8, 1993. The Commission subsequently published the briefing transcripts along with materials for the records submitted by the panelists. In addition, the Commission held a briefing on April 21, 1993, to hear from participants in that first OSCE seminar on migrant workers. The first four briefings were published on the Commission website in May 1993. In addition, the Commission held a briefing on April 21, 1993, to hear from participants in that first OSCE seminar on migrant workers. The first four briefings were published on the Commission website in May 1993.​ Since the 1960s, the federal government has established numerous service programs to help meet the needs of migrant farmworkers. From the early days, migrants have been considered a uniquely federal responsibility, primarily because of their interstate movement, which makes it hard for the workers and their families to qualify for local assistance and disrupts other services like schooling for the children. As these programs have evolved, many have come to serve nonmigrant seasonal farmworkers as well.  The programs to meet health, education, housing, job training, and other needs of migrant and seasonal farmworkers (MSFWs) have developed seperately. There are approximately 10 MSFW-specific service programs, and farmworkers also draw upon the assistance of numerous other general programs such as food stamps or Medicaid. The four largest federal programs are Migrant Education, administered by the Department of Education; Migrant Health and Migrant Head Start, both administered by the Department of Health and Human Services; and the Department of Labor's special job training programs for MSFWs under section 402 of the Job Training Partnership Act.
