Good afternoon. I am Congressman Alcee Hastings from the United States. I am honored to be here today with a number of my colleagues from the US Congress, including the Chair of this Forum - Congresswoman Barbara Lee. I am pleased that this week’s event offers the opportunity for us to work together in the international arena on an issue of great importance - minority political participation.

I am pleased that the Independent Expert on Minority Issues, Gay McDougall invited me to present on a minority political participation effort I recently initiated that I believe will be useful for today’s discussion in developing recommendations for this forum’s final document.

As the Chair and co-Chair the US Helsinki Commission over the past few years, I have been tasked with the responsibility of monitoring and supporting 56 European and North American countries’ efforts to uphold the Helsinki Accords and related commitments, including fostering equal rights and combating intolerance and discrimination.

A series of hearings we held in the US Congress on these issues including existing inequalities and discrimination faced by Black Europeans and other visible minorities throughout the OSCE, led to a call for action. Instrumental to those hearings were the testimonies of UN representatives Gay McDougall and Joe Frans that assisted in identifying patterns of concern in the OSCE region.

Following those hearings, I introduced the first US bill calling for transatlantic government partnerships to combat racism and discrimination and partnered with UN Working Group of People of African descent head Joe Frans and current and former EU Parliamentarians Harlem Desir, Claude Moraes, and Glyn Ford to begin an initiative that would support the needed involvement of minorities in the policymaking arenas to effectively address these issues. I’m happy to see a number of my colleagues here today.

The resulting event was the “Black European Summit: Transatlantic Dialogue on Political Participation.” The Summit took place over two days in April (15-16) at the European Parliament in Brussels, Belgium. For the first time a small group of political and intellectual minority leaders from more than ten countries exchanged information on barriers to political participation and the roles of minority policymakers in representing minority interests, including promoting equal rights in the United States and Europe.

Following the event, participants adopted the Brussels Declaration which addressed the importance of and strategies for increasing racial and ethnic minority political participation. Materials on each of these initiatives have been made available today.

What did we learn? Whether a Parliamentarian, Mayor, or City Counselor, we had much in common.

First, the majority of our political and legal systems do not accurately reflect the racial and ethnic diversity of our societies.

Second, we have often not been sufficiently included in the development and/or implementation of government policies, even when the stated goal was to combat racism and discrimination.

Third, institutionalized processes are often at fault, yet, despite stated commitments to democracy, there continues to be a lack of political will from government, political parties and other actors to include us.

Fourth, the lack of political knowledge of our communities often made it difficult to garner the necessary support to effectively address these issues.

We noted that often times, political participation was defined as whether minorities had the right to vote or be elected. While this is one aspect of participation, there are many others.

Policymaking via obtaining positions in the government and/or with political parties, grassroots advocacy, and an understanding of the political process such as how laws are drafted are also of great importance.

We discussed simple solutions governments, political parties, and non-governmental organizations can employ such as advertising employment opportunities in minority communities, requiring that at least a percentage of persons interviewed for a position are minorities, and providing minority fellowships and internships for teenagers and college students in Parliament, government agencies, and other organizations are initial steps.

Financing degrees for minorities in relevant fields such as law, international relations, political science, or even economics is another. Tapping minorities in the private sector for public-private policy initiatives such as the development of energy and trade policies are also necessary.

We determined that government agencies, parliamentarians, and other government officials can also foster strong relationships with minority communities through educational information sessions on political rights and even regular face to face meetings that allow minorities to be in on the decision-making of policies that impact them. This could be small regular monthly meetings or even town hall sessions.

The need for increased support for minorities currently in political careers was deemed essential. Mentorship opportunities for current elected officials and those seeking elections, establishing support networks such as our Congressional Black Caucus, and having procedures in place to address workplace discrimination were noted.

In discussing the realm of possible solutions, we agreed to make the initial Summit an annual event and to continue the dialogue. Moving forward we plan to address the following issues, which are also detailed in the final Brussels Declaration:

1. Political education for minority communities, including advocacy,
2. The development of physical and electronic support networks for minority elected officials,
3. Youth and community outreach, including the development of targeted professional development and hiring strategies in the political arena, and
4. Opportunities for self-organization and other empowerment initiatives.

Importantly, we believe these efforts must be applied to all levels of national, regional, and local government to ensure that our societies are fully participatory.

In the interest of time, I will conclude here. I would urge that many of the concrete steps I detailed be included in the Final Document of this forum. I look forward to answering any questions regarding the Summit, US initiatives, and other thoughts on concrete strategies regarding minority political participation during the discussion.

In her first appearance before Congress, ODIHR Director Ambassador Ingibjörg Sólrún Gísladóttir will discuss the organization’s flagship work in international election observation; countering anti-Semitism and other forms of intolerance; and helping governments to combat human trafficking, protect human rights defenders, and better implement their commitments to fundamental freedoms including assembly and religion. The OSCE, the world’s largest regional security body, is based on a comprehensive concept of security that recognizes that respect for human rights and functioning democratic institutions underpin regional peace and security. ODIHR provides support, assistance, and expertise to participating States and civil society to promote democracy, rule of law, human rights, and tolerance and non-discrimination. ODIHR observes elections at the invitation of participating States, reviews legislation, and advises governments on how to develop and sustain democratic institutions. The office also works closely with the OSCE’s field operations and organizes Europe’s largest annual human rights meeting, bringing together annually hundreds of government officials, international experts, civil society representatives and human rights activists.  

  • Helsinki Commission to Hold Hearing on Deteriorating Human Rights Situation in Crimea

    WASHINGTON—The Commission on Security and Cooperation in Europe, also known as the Helsinki Commission, today announced the following hearing: LIFE UNDER OCCUPATION The State of Human Rights in Crimea Tuesday, January 28, 2020 10:00 a.m. Cannon House Office Building Room 210 Live Webcast: www.youtube.com/HelsinkiCommission Nearly six years into Russia’s illegal occupation of Crimea, the human rights situation there continues to deteriorate.  Russian authorities have restricted freedom of speech and assembly, suppressed civil society activity, persecuted religious and ethnic minorities, muzzled dissent, and continue to implement an aggressive process of “Russification” toward residents of the peninsula.  The hearing will feature Oleg Sentsov, a Ukrainian writer and filmmaker who was sentenced to 20 years in jail by a Russian court on trumped-up charges of terrorism in 2014. In 2018, Sentsov became a worldwide symbol of defiance and courage when he launched a hunger strike on behalf of all Ukrainian political prisoners being held by Russia. He and other witnesses will discuss the Russian Government’s continued assault on Crimea’s vulnerable minorities, as well as its blatant disregard for basic rights.   • Public Diplomacy, Democracy, and Global Leadership

    For more than a century, the United States has advanced shared human rights, economic, and security policy goals in the transatlantic relationship by cultivating people-to-people ties through public diplomacy initiatives.  As democracies around the world face new challenges emanating from demographic shifts, technological advancements, and evolving security threats, the need for public diplomacy initiatives that cultivate leaders who espouse democratic principles, including inclusive and representative governance, grows more relevant. The U.S. Helsinki Commission convened a hearing to focus on U.S.-led public diplomacy international exchange initiatives that strengthen democratic institutions by targeting young and diverse leaders, encouraging civic engagement, and fostering social inclusion and cohesion in the OSCE region. Presiding over the hearing, Chairman Alcee L. Hastings (FL-20) stated, “This year, under my leadership, the Helsinki Commission has held events on the importance of international election observation, good governance, and focused on democratic backsliding in particular countries as part of our continued commitment to the underlying principles of the Helsinki Final Act.  Common to all of these issues is the role good leaders can play in ensuring free and fair elections; laws that are equitable, transparent, and enforced; and laying the groundwork to ensure protections and rights for all in their constituencies […] for the long-term stability of our nation and the transatlantic partnership.”  In his opening remarks, Chairman Hastings also noted that he planned to introduce legislation to support of leadership exchanges and knowledge-building between diverse transatlantic policymakers, and to encourage representative democracies. He also announced a February program for young OSCE parliamentarians to strengthen their political inclusion and advance peace and security efforts. Chairman Hastings was joined by Commissioners Rep. Emanuel Cleaver, II (MO-05) and Rep. Marc Veasey (TX-33). Rep. Veasey raised the importance of metrics in assessing the impact of leadership programs and soft diplomacy, while Rep. Cleaver stated, “For the first time since the end of World War II, the extreme right is actually winning seats in the German Parliament,” highlighting increased security risks related to public diplomacy programs operating in countries that have seen an increase in hate crimes and racial prejudice. Witnesses included Cordell Carter, II, Executive Director of the Socrates Program at the Aspen Institute; Stacie Walters Fujii, Chair of the American Council of Young Political Leaders; and Lora Berg, Counselor for Inclusive Leadership at the German Marshall Fund of the United States. Carter reviewed the Aspen Institute’s public policy programming on transatlantic relations and discussed the importance of promoting democratic values, including efforts to strengthen the capacity of congressional staff and encourage dialogues around the United States on being an “inclusive republic.”  He concluded by asking Congress to create more opportunities for public discourse on issues that threaten the stability of democracies around the world. Fujii discussed the importance of international exchanges in supporting democracies and the work of American Council of Young Political Leaders (ACYPL). ACYPL was founded in 1966 to strengthen transatlantic relationships by promoting mutual understanding among young political leaders in Western Europe and the former Soviet Union.  Critical aspects of the program include offering international leaders the opportunity to come to the U.S. to observe campaigning, polling stations, election returns, and the response of the American people to elections, complemented by follow-on educational conversations about democratic processes in their countries.  Berg highlighted the importance of public diplomacy initiatives in advancing inclusive leadership and observed that nations gain in richness and capacity when diversity is reflected in leadership. She also noted that inclusive leadership not only plays an important role in promoting social harmony, but it also helps to ensure economic growth, stating that “the places with the highest social cohesion are the most reliable for investment.” Berg explained that the GMF’s Transatlantic Inclusion Leaders Network (TILN) grew out of work she engaged in while working for the Department of State. TILN is an innovative network of young, diverse leaders across the United States and Europe supported by the Helsinki Commission and State Department.    Berg argued for the expansion of U.S. Government-supported public diplomacy inclusive leadership initiatives targeting youth and diverse populations in western democracies, including through public-private partnerships, the creation of a public diplomacy officer position in Europe to foster Europe-wide next generation transatlantic leadership, and increased political participation measures domestically and abroad for diverse populations.   

  • Helsinki Commission to Review Role of Professional Exchanges in Strengthening Democratic Institutions

More than 500 heads of state, 100 Members of Congress, and thousands of professionals have participated in U.S. Government-sponsored exchanges, including the State Department’s International Visitor Leadership Program, while public and private organizations have hosted similar programs to bring leaders together.    Witnesses at the hearing will explore the origins and role of professional exchanges and other public diplomacy programs that strengthen relationships with U.S. allies in the face of shared challenges including eroding trust in democratic institutions, demographic shifts, technological advancements, and evolving security threats.   • U.S. Helsinki Commission Hosts Staff Briefing on World’s Biggest Data Set of Hate Crime Statistics

    On Wednesday, October 23, 2019, the U.S. Helsinki Commission hosted a congressional staff briefing on addressing hate crimes in Europe and the United States. The event was moderated by Dr. Mischa Thompson, Director of Global Partnerships, Policy and Innovation at the U.S. Helsinki Commission. The Commission’s guest speaker, Cristina Finch, the Head of the Tolerance and Non-Discrimination Department at the OSCE Office for Democratic Institutions and Human Rights (ODIHR) provided an overview of hate crimes statistics in Europe and North America. She described the efforts that the Organization for Security and Cooperation in Europe (OSCE) has made to address hate crimes and hate incidents in the region. Finch also discussed the commitments made by the 57 OSCE participating States to document, investigate, and prosecute hate crimes, as well as the tools and best practices available to assist countries in meeting their commitments. ODIHR’s Annual Report on Hate Crime combines official government reports submitted by 33 OSCE participating States with an additional 108 reports from 135 civil society organizations. In 2018, 5,258 hate crime incidents were reported to ODIHR. As Finch described it, this volume of information makes the report “the world’s biggest data set on hate crime.” The full 2018 Hate Incidents data set will be published on November 15, 2019. According to Finch, accurate recording of hate crimes by the police remains a serious issue. “In many countries police do not record hate crimes as a specific category in a systemic way,” she noted. “This means that information is missing, which impedes investigation, prosecution, prevention and policy making.” Other serious obstacles to publishing accurate data exist. For example, estimates indicate that 90 percent of hate crimes are not reported by victims to the police at all. Promoting safe, inclusive, and equitable societies is a priority of the Helsinki Commission for the 116th Congress. Commission efforts on inclusion have included briefings, hearings, legislation, and inter-parliamentary initiatives in the U.S. Congress and Europe.  Additionally, Helsinki Commission Ranking Member Sen. Ben Cardin serves as the OSCE Parliamentary Assembly’s Special Representative on Anti-Semitism, Racism, and Intolerance and has called for increased efforts to address hate crimes in the region.

  • Hastings and Cardin Condemn Mob Attack on Budapest Community Center

    WASHINGTON—Following Wednesday’s mob attack on Aurora, a small Jewish community center that provides office space to civil society groups in Budapest, Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) and Ranking Member Sen. Ben Cardin (MD) issued the following statements: “Wednesday’s mob attack on Aurora is an alarming escalation of violence toward minorities and civil society groups in Hungary. This second attack by paramilitary-style extremists in less than a month sends a frightening message: Authorities cannot, or will not, protect you,” said Chairman Hastings. “A decade ago, far-right extremists in Hungary orchestrated dozens of violent attacks, murdering six Hungarians including five-year-old Robert Csorba. The Government of Hungary must not allow such a tragedy to occur again.” “The Hungarian Government may boast of a ‘zero-tolerance for anti-Semitism’ policy abroad, but in reality, in Budapest they traffic in anti-Semitic tropes, honor fascist-era leaders and ideologues, and stoke hatred of migrants and Muslims,” said Sen. Cardin, who also serves as the OSCE Parliamentary Assembly Special Representative on Anti-Semitism, Racism, and Intolerance. “Actions speak louder than words. I hope that available photographs of the mob will aid law enforcement in the investigation and prosecution of the perpetrators, and I commend the district’s newly elected mayor for visiting Aurora and seeking to ensure its safety.” Marom, a Hungarian Jewish association, established and runs Aurora Community Center, an umbrella organization that provides office space to small civil society groups including the Roma Press Center, migrant aid, and Pride Parade organizers. In Wednesday’s attack, the mob burned a rainbow flag and branded a para-military logo onto the premises. On September 26, the center also was attacked and vandalized by extremists. Under the Orbán government, the conditions for independent nongovernmental organizations (NGOs) in Hungary have deteriorated. Over the past two years, Hungarian authorities have accused Marom of administrative violations ranging from mismatched dates on official documents to, most recently, lacking an appropriate agreement with the center’s landlord. In 2018, Hungary passed a law establishing a 25 percent tax on organizations which engage in “propaganda activity that portrays immigration in a positive light.” It is a tax on government-disfavored speech. Hungary also adopted amendments to its "law on aiding illegal migration" that make handing out know-your-rights leaflets punishable by up to one year in prison. In 2017, Hungary adopted a Russian-style "foreign agent" law which, according to the U.S. Department of State, “unfairly burdens a targeted group of Hungarian civil society organizations, many of which focus on fighting corruption and protecting human rights and civil liberties.” The bill was proposed by the far-right wing party Jobbik. In 2014, armed police carried out raids on 13 civil society organizations, seizing computers and documents for alleged financial misconduct. No charges were ever brought against the NGOs. Between 2008 and 2010, at least six people were murdered, many others were injured, and whole communities were terrorized in a series of attacks by right-wing extremists.  Maria Balog was shot in her own home in a middle-of-the-night raid that also wounded her 13-year-old daughter. Jeno Koka was shot as he got in his car to go to work. Five-year-old Robert Csorba and his father were killed by sniper fire while attempting to escape an arson attack on their home.

  • Remembering Rep. Elijah E. Cummings and His Global Legacy in the Security Sector

    By Nida Ansari, Policy Advisor and State Department Detailee and Dr. Mischa Thompson, Director of Global Partnerships, Policy, and Innovation “These measures are critical in enhancing the efficiency and effectiveness of the U.S. armed forces by addressing the under-representation of women and ethnic minorities and creating a diverse military that fully represents our nation’s citizens […] for the sake of our country, we can and must do better.”  – Congressman Elijah E. Cummings Rep. Elijah E. Cummings, a stalwart voice in the U.S. Congress, passed away on October 17, 2019. Representing Baltimore, Maryland, his many legislative initiatives included groundbreaking work to advance diversity and inclusion in the security sector alongside Helsinki Commissioners and other global changemakers. In 2008, Rep. Cummings and other Members of Congress joined forces with then-Helsinki Commission Co-Chairman Sen. Ben Cardin to establish the Military Leadership Diversity Commission (MLDC). Rep. Cummings’ goal was to increase the number of people of color and women in flag officer rank by focusing on military recruitment, retention, and promotion.  The 2011 MLDC final report, “From Representation to Inclusion: Diversity Leadership for the 21st-Century Military,” proposed 20 recommendations to develop policy goals and metrics to manage and sustain diversity at the U.S. Department of Defense.  Following the release of the report, Rep. Cummings, Sen. Cardin, and other Members of Congress held a 2012 Congressional Military Diversity Forum with MLDC Chairman General Lester Lyles, where the general raised the urgency of implementing the report’s recommendations to maintain force levels in concert with increasing diversity in the United States. Helsinki Commission efforts—including legislation by Helsinki Commission Chairman Rep. Alcee Hastings and Sen. Cardin on the incorporation of women in combat divisions and on increasing diversity in the intelligence and national security workforces—have complemented and built upon Rep. Cummings’ work. Rep. Cumming’s efforts also were integral to the 2013 launch of the Mission Critical: Inclusive Leadership for the Security Sector program, led by the German Marshall Fund and supported by Helsinki Commission leadership.  Findings from the MLDC underpin the initiative, which brought together militaries, Members of Congress, staff of the Department of Defense, other government officials and experts from Europe and the United States to review and take stock of diversity and inclusion best practices in the security sector. “There must be an assigned and qualified individual on the command level to oversee military issues including discrimination, racial profiling, and hazing. In particular, the military needs to have a more effective response against hazing cases to better identify and respond to dangerous situations.  Women, minorities, and every single soldier should be able to achieve their goals when joining the military.”  – Congressman Elijah Cummings, Mission Critical 2013 As part of the inaugural Mission Critical event in 2013, Congressman Cummings highlighted lessons learned from the MLDC and the need to address discrimination and other problems, including hazing, in militaries to increase diversity and ensure the success of missions critical to national security.  Efforts to address these and other issues have continued at subsequent Mission Critical events, most recently in June 2019. Continuing to build upon the MLDC foundation, the event focused on diversity and inclusion issues related to personnel, the future of security, and technology in the security sector.  Speakers echoed the sentiments of Rep. Cummings years before. Then-German Federal Minister of Defense Ursula von der Leyen stressed the value of religious diversity in the armed forces, sharing how she was working to get the Bundeswehr’s military chaplaincy to include Jewish rabbis and Muslim imams instead of only the traditional Protestant and Roman Catholic chaplains.  Tjorven Bellmann of the German Federal Ministry of Foreign Affairs raised the importance of recruitment methods that appeal to young people from diverse backgrounds. He also noted that discrimination in the military remains a barrier for racial minorities, women, LGBT+, and other groups.  Nida Ansari, a State Department detailee to the Helsinki Commission, discussed U.S. Government inclusion efforts around faith communities. Ursula von der Leyen’s elevation to the Presidency of the European Commission offers hope for highly-placed advocacy of inclusive policies and concrete strategies beyond the security sector and broader dissemination of practices shared during Mission Critical. Congressman Cummings’ vision of a more inclusive security sector, and more inclusive societies generally, at home and abroad will not soon be forgotten.  Signs of progress include examples like General Lori Robinson, whose distinguished career included serving as the first woman to command a major Unified Combatant Command when she led United States Northern Command (USNORTHCOM) and the North American Aerospace Defense Command (NORAD) from May 2016 to May 2018.  The rarity of her example, however, only underlines the work that Mr. Cummings well knew was still required.   • 2019 Human Dimension Implementation Meeting

    From September 16 to September 27, OSCE participating States will meet in Warsaw, Poland, for the 2019 Human Dimension Implementation Meeting (HDIM), organized by the OSCE Office for Democratic Institutions and Human Rights (ODIHR).  As Europe’s largest annual human rights conference, the HDIM brings together hundreds of government and nongovernmental representatives, international experts, and human rights activists for two weeks to review OSCE human rights commitments and progress. During the 2019 meeting, three specifically selected topics will each be the focus of a full-day discussion: “safety of journalists,” “hate crimes,” and “Roma and Sinti.” These special topics are chosen to highlight key areas for improvement in the OSCE region and promote discussion of pressing issues. Human Dimension Implementation Meeting 2019 Since the HDIM was established in 1998, the OSCE participating States have a standing agreement to hold an annual two-week meeting to review the participating States’ compliance with the human dimension commitments they have previously adopted by consensus. The phrase “human dimension” was coined to describe the OSCE norms and activities related to fundamental freedoms, democracy (such as free elections, the rule of law, and independence of the judiciary), humanitarian concerns (such as refugee migration and human trafficking), and concerns relating to tolerance and nondiscrimination (such as countering anti-Semitism and racism). Each year, the HDIM allows participating States to assess one another’s implementation of OSCE human dimension commitments, identify challenges, and make recommendations for improvement. The HDIM agenda covers all human dimension commitments, including freedoms of expression and the media, peaceful assembly and association, and religion or belief; democratic elections; the rule of law; tolerance and non-discrimination; combating trafficking in persons; women’s rights; and national minorities, including Roma and Sinti. Unique about the HDIM is the inclusion and strong participation of non-governmental organizations. The United States has been a stout advocate for the involvement of NGOs in the HDIM, recognizing the vital role that civil society plays in human rights and democracy-building initiatives. OSCE structures allow NGO representatives to raise issues of concern directly with government representatives, both by speaking during the formal working sessions of the HDIM and by organizing side events that examine specific issues in greater detail.   • The State of Diversity and Inclusion in Europe

    The U.S. Helsinki Commission convened the hearing, “The State of Diversity and Inclusion in Europe: Race, Rights, and Politics” one week ahead of the OSCE’s annual Human Dimension Implementation Meeting (HDIM), which included a focus on hate crimes and Roma populations, and the European Union’s first ever Anti-Racism and Diversity Week held in the European Parliament.    Helsinki Commissioner Representative Gwen Moore (WI-04) chaired the hearing and was joined by Helsinki Commissioners: Chairman Alcee L. Hastings (FL-20), Rep. Steve Cohen (TN-09), Rep. Emanuel Cleaver, II (MO-05), and Rep. Marc Veasey (TX-33).  Against the backdrop of recent European elections that included numerous xenophobic political parties, Chairman Hastings highlighted the importance of the hearing given the rise in prejudice and xenophobic violence in both Europe and in the United States including from far-right extremists.  Rep. Moore reiterated the necessity of the hearing given “numerous reports from Europe of hate crimes and acts of extremism, racial profiling in cities and at borders, and discrimination at work and in the schools, with the OSCE reporting close to 6,000 hate crimes in the region over the last year, and a recent European parliamentary study concluding that people from ethnic or racial minorities in the EU experience higher risks of economic hardship, poorer-quality housing, residential segregation, unemployment, and assault.”  She also raised concerns regarding Americans being impacted by disparate treatment and related violence in Europe, following reports that U.S. military personnel and diplomats serving in Europe, students studying abroad, and tourists have been the targets of discrimination, including hate crimes. Panel 1 The first panel consisted of Members of the European Parliament who lead the Anti-Racism and Diversity Intergroup: MEP Romeo Franz (Germany), MEP Dr. Pierrette Herzberger-Fofana (Germany), MEP Evin Incir (Sweden), MEP Samira Rafaela (Netherlands), and Coordinator Alfiaz Vaiya of the Intergroup.  MEP Dr. Herzberger-Fofana described how Afro-German victims are often excluded from the discourse on Nazis and the Holocaust, and the need for recognition and restitution, stating, “We owe more to our ancestors than to allow their memories and sacrifices to be erased from the common conscious.”   MEP Franz stated that despite the adoption of anti-discrimination legislation by all EU states, 80 percent of the Roma community lives below their respective country’s poverty line due to anti-gypsyism and institutionalized racism. “Europe was based on that fundamental belief that all people are born equal, regardless the color of the skin, religion, or ethnicity. And that is what must be defended and promoted by its leaders,” said MEP Franz. MEP Incir called for those who believe in equal, democratic societies to stand together to counter global nationalist movements being led by right-wing extremist organizations, while MEP Rafaela discussed the importance of representative politics in preserving democracies and the need to address current tensions in the transatlantic relationship. Mr. Vaiya concluded the first panel, stating, “In a majority of the 28 [EU] member states, we see far-right political parties in government [and] working with the current U.S. administration and other far-right political parties and leaders across the world.”  Mr. Vaiya went on to say, “Jewish people, whether it’s Muslims, whether it’s LGBTI people, whether it’s people who are Roma or black […] The shared threat is the same.  It’s the populism, it’s the racism, it’s the fascism.  It may be specific to each individual community, but we have to understand that threat is together.” Panel 2 The second panel consisted of Councilor Irene Appiah (Hamburg, Germany), Vice-Chair Domenica Ghidei Biidu (Netherlands) of the European Commission Against Racism and Intolerance (ECRI), and MPs Olivier Serva and Daniele Obono (France). Vice-Chair Biidu recognized the U.S. as a partner and peer in combating racism and intolerance and urged the U.S. to engage in counter-populistic rhetoric and hate speech, foster constructive and peaceful relationships with Muslim countries and between Muslim countries and Israel, assist in the fight against anti-Semitism, safeguard irregular migrants, and seek observer status in the plenary meeting of ECRI.  Remarking on the vibrant Afro-descent population in Germany, Councilor Appiah called for Germany and other countries to provide statistical data on minorities and the African diaspora to assist in the fight against racism.  In discussing French diversity resulting from colonialism and African enslavement, MP Obono highlighted the need for statistics on race to address continuing racial disparities.  In addressing continuing disparities between French territories in the Caribbean and France, MP Serva called for teaching of the history of slavery in the French overseas territories, increasing minorities in French media, equality data, and addressing brain drain in the territories.  Other points discussed included complacency from both left and right parties in protecting western democracies, Russian exploitation of societal divisions, including utilizing racial prejudice, to disrupt democracy, and the need to strengthen efforts to address online hate while protecting free speech.   Witnesses also participated in meetings and other events during the week, such as the Transatlantic Minority Political Leadership Conference.

  • Responding to Hate

    In the past year alone, places of worship in Christchurch, Colombo, Pittsburgh, and Poway were targets of hate-based violence, resulting in the tragic loss of more than 300 lives.  Effectively countering hate crimes requires a comprehensive effort bringing together government institutions, criminal justice systems, civil society actors, and international organizations.  Religious actors and interfaith institutions play an important role in promoting safe and inclusive societies and reducing violence, hostility, and discrimination. The U.S. Helsinki Commission convened a hearing on Tuesday, July 16, 2019 that examined the role of religious actors in responding to hate domestically in the United States and throughout the OSCE region. The hearing, titled “Responding to Hate: The Role of Religious Actors,” focused on how faith-based institutions can promote safe and inclusive societies and reduce violence, hostility, and discrimination. Helsinki Commissioner Rep. Gwen Moore (WI-04) chaired the hearing and was joined by other commissioners including OSCE PA Special Representative on Anti-Semitism, Racism, and Intolerance and Helsinki Commission Ranking Member Sen. Ben Cardin (MD), Rep. Richard Hudson (NC-08), Rep. Sheila Jackson Lee (TX-18), Rep. Brian Fitzpatrick (PA-01), and Rep. Steve Cohen (TN-09). Rep. Moore opened the hearing by stating, “All of us have something to gain from those who look different, pray differently, and may come from a different place. And we must not wait until tragedy strikes, again and again and again, to learn the value of mutual respect. We must seize every opportunity to denounce hate-motivated violence, and in doing so we protect the value of freedom of expression, the hallmark of democracy.” She also paid homage to six Sikh worshippers killed near her district in Oak Creek, Wisconsin seven years ago. In his opening remarks, Sen. Cardin recounted his side event at the 28th Annual Session of the OSCE PA earlier in July, titled, “Countering Hate: Lessons from the Past, Leadership for the Future,” where he called on parliamentarians to act now to prevent a repeat of the past where bigotry and violence resulted in the deaths of millions under Nazi rule. Witnesses at the hearing described how religious actors and interfaith institutions can work together to further human rights and protections for all, domestically and throughout the OSCE region. Witnesses also shared strategies to prevent and respond to hate, ignorance, and violence targeting our societies, including places of worship. Father James Martin shared a video testimony about his response to the Pulse nightclub shooting, which at the time was the largest mass shooting in U.S. history, taking 49 lives. He noted that the LGBT community received an outpouring of love and support the in the aftermath of the tragedy, with the notable exception of the Catholic church. Father Martin said, “Why am I bringing this up? Because when it comes to the role that religious actors and organizations can play in combatting hate crimes, the most effective thing they can do is to get their own houses of worship in order. Racism, sexism, and homophobia still exist in many Christian denominations – my own included.” He ended his testimony by underlining that “the most important thing that religious actors and organizations can do to combat hate crimes is not only to fight the hatred on the outside, but on the inside as well.” Imam Gamal Fouda also testified by video and remarked on New Zealand’s response to the tragic shooting that targeted and killed Muslims at the Al Noor Mosque and Linwood Islamic Centre in Christchurch, where he is the imam. “New Zealand set a good example to the whole world for how to look after your people, how to actually support all your people. And we all stand together against hate, hate speech, and hate crimes,” he said. He said the power of New Zealand was demonstrated in the wake of the Christchurch shooting and called for more education on the strength of diverse and inclusive societies. “We have to stand together looking at the diversity in our communities as something that is strengthening our community,” he said. “It is the secret of the power of our community to see different colors and different languages.” Rabbi Jeffrey Myers, victim, witness, and survivor of the 2018 attack on the Tree of Life Synagogue in Pittsburgh, PA—the worst attack on a synagogue in the history of the United States—stated, “The metaphor of America as a melting pot, is a beautiful image, but sadly, it is not true, [because …we] do not know our neighbors. We live in silos, with no bridges connecting them. Many choose to live in their own private silos, not wanting ‘others’ to enter their silo.” He believes that the key to addressing hate—what he referred to as the “H-word”— is to learn to build bridges. “Some people just don’t know how to build a bridge. This is where religious leaders like me make a difference…I’m a bridge builder. When the Muslim community extended an olive branch to me, I responded by offering an olive tree,” he said. Reverend Aaron Jenkins testified on the power of developing partnerships and relationships across different sectors of society to adequately tackle the issue of hate and hate crimes wherever they occur. He remarked, “Any plan to address hate must engage faith actors within and across their faith traditions in respectful and meaningful ways. We cannot wait until the next hate crime happens.” He stated that partnerships, resources, and relationships were needed to address the problem. Radia Bakkouch spoke about the situation in France and Coexister’s “belief in the concept of ‘faith for good’ and the practice of interfaith cooperation in empowering young people to address violence and exclusion.” She stressed the importance of defending pluralistic societies and highlighted the importance of building coalitions to address the rise in hate-based violence taking place in France and elsewhere in Europe. Usra Ghazi detailed federal hate crimes statistics, highlighting that hate crimes historically and consistently are underreported. This, she said, is partly due to a lack of a standardized reporting processes and “strained relationships between bigotry-impacted communities and law enforcement entities.” Ghazi shared that many members of the Muslim, Arab, and Sikh communities affected by anti-Muslim discrimination, hate, and violence in the United States have opted to keep low profiles rather than report these events. She stressed, “Due to the rise of hate crimes and hate speech against Muslim and Sikh Americans, these communities by necessity have had to organize outreach efforts to humanize themselves while raising cultural and religious literacy among their neighbors and governments.” Ghazi also shared positive examples of how discriminated communities are building their civic health, getting more involved in elections, and running for office at record rates. “We now have Muslim and Sikh mayors of American cities, as well as officials from these faiths in a range of governmental positions. These efforts help to ensure that our cities, counties and states are truly representative of the rich diversity of American communities.” Alina Bricman’s video testimony concluded the hearing. She presented an overview of the first-ever report of Young Jewish Europeans: perceptions and experiences of antisemitism, released July 4, 2019. Findings included that “44 percent of young Jewish Europeans have faced anti-Semitic harassment, that’s almost 1 in 2 Jews; […] and 25 percent identified as too scared to display Jewish-affiliated ornaments or accessories.” To address the problem, Bricman recommended investing in education (such as anti-racist and anti-bias training) that emphasizes the importance and strength of diversity and diverse communities, supporting civil society, and depoliticizing anti-Semitism and racism by having leaders engage responsibly in the public arena where it is not viewed as a left or right issue.

  • Leading through Change

    From June 23-29, 2019, 29 young leaders from across Europe and the United States participated in the eighth annual Transatlantic Inclusion Leaders Network (TILN) workshop held in Brussels, Belgium.  Hosted by the German Marshall Fund of the United States (GMF) in partnership with the U.S. Helsinki Commission, U.S. State Department, and other stakeholders, TILN brought leaders together to learn from one another, expand their leadership skills, and offer a more inclusive vision for the world. As part of the workshop, TILN leaders joined the German Marshall Fund’s Brussels Forum Young Professionals Summit and engaged with senior U.S. and European officials on issues ranging from BREXIT and trade to migration. As elected officials and civil society leaders under the age of 35, TILN participants focused on tools to strengthen democratic practices in the lead up to elections in Europe and the United States.  Ensuring respect and protections for rights across political, cultural, religious, and other differences was a central aspect of discussions.  Participants also highlighted the need for increased strategies to address barriers to political participation, including increasing hate speech and physical threats directed towards elected officials and candidates.  The importance of inclusive intergenerational workforces and leadership was also raised as a key aspect to ensure economic stability on both sides of the Atlantic and strengthen transatlantic ties.      Following the workshop, TILN alumni convened workshops in the Netherlands, Germany, and Italy. The Transatlantic Inclusion Leaders Network (TILN) “inspires, informs, and connects diverse young leaders to excel in elected office and other leadership roles, advance inclusive policies, and engage with transatlantic policymakers.” Participants are from diverse U.S. and European communities, including the Balkans, with a proven commitment to advancing diversity and inclusion best practices in their policymaking and society.   • Helsinki Commission Chairman Condemns Mob Attacks on Roma in Europe

    WASHINGTON—Following reports of a mob attack against the Roma community and a police station in Gabrovo, Bulgaria, Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) today issued the following statement: “I am very disturbed by the increasing frequency of mob attacks on Roma in Europe—most recently in Bulgaria, but also in Italy, France, and the Czech Republic. Governments must do more to counter the corrosive effects of hate-mongering and protect their most vulnerable communities from bias-motivated crimes. “The violence in Bulgaria is particularly concerning. As they say in the horror movies, ‘the call is coming from inside your house.’ An attack on a government institution like a police station is an attack on democracy itself.” Reports indicate that earlier this week, an anti-Roma group attacked the police station in Gabrovo when officers refused to turn over three Roma to the mob following an altercation at a local shop. Some Romaní homes were subsequently destroyed. The attack comes on the heels of recent anti-Roma rhetoric at the highest levels of the Government of Bulgaria. In February, Bulgarian Defense Minister and Deputy Prime Minister Krasimir Karakachanov proposed offering free abortions to limit the Roma birthrate. In early April, a mob attacked 70 Roma, including children, in a suburb of Rome, Italy. Prosecutors have opened an investigation into the attack.  Similar attacks on Roma in the town of Dvorec in the Czech Republic forced a Romani family to leave the area. Three Romani children were subsequently attacked in the Czech village of Lipník nad Bečvou. In France in late March, false kidnapping accusations against Roma circulated on social media were associated with gang attacks on Roma in France. Local police issued statements to quell the disinformation. 

  • Chairman Hastings Introduces Bill to Protect and Promote Rights of People of African Descent Worldwide

    WASHINGTON—Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) yesterday introduced H.R.1877, the African Descent Affairs Act of 2019. The bill would establish a U.S. strategy to protect and promote the human rights of people of African descent worldwide. “The vestiges of colonialism and slavery continue to negatively affect people of African descent around the world, resulting in continuing racial bias and discrimination,” said Chairman Hastings. “We must reverse these disturbing trends and facilitate the full and equal participation of people of African descent in our societies, promote knowledge of and respect for the diverse heritage, culture, and contributions of people of African descent, and strengthen and implement legal frameworks that combat racial discrimination.” The African Descent Affairs Act would establish an Office of Global African Descent Affairs at the U.S. State Department to develop global foreign policy and assistance strategies beyond the African continent. The bill also would create a fund to support antidiscrimination and empowerment efforts by civil society organizations; require annual State Department human rights reports to include a section on discrimination faced by people of African descent; and create similar initiatives at the United States Agency for International Development.  Previous State Department initiatives such as the Office of Global Women's Issues, the Special Envoy to Monitor and Combat Anti-Semitism, and special programs focusing on disability, LGBTQ+ and other communities helped aid other vulnerable populations around the world and inspired Chairman Hastings’ measure. “Across the globe we find racial disparities between those of African descent and other populations in education, employment, health, housing, justice, and other sectors. At the same time, hate crimes and racial profiling targeting black populations are increasing; this affects not only local populations, but also our diverse American military, diplomats, and students traveling abroad,” said Chairman Hastings. “A global strategy ensures we are monitoring whether countries around the world are providing equal protections and opportunity to all within their borders, and also strengthens black communities as they engage with their governments to address these issues.” In 2008, Chairman Hastings first drew attention to continuing issues of racism and discrimination in Europe and North America at a Helsinki Commission hearing on racism in the 21st century. Over the past decade, the Helsinki Commission has continued to highlight the challenges faced by diverse populations on both sides of the Atlantic, most recently through a September 2018 briefing on race, rights, and politics in the European Union.

  • Chairman Hastings Recognizes Black European Fight for Inclusion

    WASHINGTON—As the world commemorates the International Decade for People of African Descent, Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) yesterday introduced H.Res.256, recognizing the achievements and contributions of people of African descent and black Europeans in the face of persistent racism and discrimination. H.Res.256 encourages the celebration of the collective history and achievements of those of African descent in Europe. It supports efforts by the European Parliament, the OSCE Parliamentary Assembly, the Parliamentary Assembly of the Council of Europe, and the U.S. Congress to promote racial equality and combat racial discrimination. It also encourages European governments and members of civil society and the private sector to work with black European communities to implement national strategies to address inequality and racism, and urges the U.S. government to support such efforts. “While the presence of blacks in Europe can be traced to enslavement, colonization, military deployments, voluntary or forced migration, the movement of refugees and asylum seekers, or educational and other professional exchanges, the story of Europeans of African descent and black Europeans still remains largely untold, rendering many of their past and present contributions unseen or forgotten,” said Chairman Hastings. “This is unacceptable.”   The resolution endorses recommendations to overcome racial disparities in Europe made at the 2018 People of African Descent Week. Yesterday, the European Parliament passed a similar resolution recognizing that African descendants have long been a part of the fabric of Europe, and seeking to address findings on discrimination and harassment documented in the European Union’s Fundamental Rights Agency report, “Being Black in the EU.” The European Parliament resolution calls on EU Member State governments to acknowledge and address the impact of enslavement, forced labor, racial apartheid, massacre, and genocide in the context of European colonialism and the transatlantic slave trade, and for the EU to develop strategies to address structural racism and underrepresentation in EU institutions. In 2008, Chairman Hastings first drew attention to the racism and discrimination faced by black Europeans during a Helsinki Commission hearing. In 2009, Chairman Hastings co-hosted the Black European Summit in Brussels, bringing together black and minority political and intellectual leaders to discuss barriers to political participation and strategies for inclusion. Over the past decade, the Helsinki Commission has continued to highlight the challenges faced by black and minority populations in Europe, most recently through a September 2018 briefing on race, rights, and politics in the European Union.

  • Chairman Hastings Welcomes Release of Country Reports on Human Rights

    WASHINGTON—Following yesterday’s release by the State Department of the Country Reports on Human Rights Practices for 2018, Helsinki Commission Chair Rep. Alcee L. Hastings (FL-20) issued the following statement: “I welcome the release of this year’s Country Reports on Human Rights Practices. These reports, mandated by law and prepared by the Department of State, exemplify Congress’ intent to keep human rights front and center in U.S. foreign policy. As members of Congress consider foreign assistance and military aid, as we build alliances and take the measure of our foes,  these reports help ensure that democracy and fundamental freedoms are given full consideration.” The annual Country Reports on Human Rights Practices cover internationally recognized individual, civil, political, and worker rights, as set forth in the Universal Declaration of Human Rights and other international agreements. The State Department must submit these reports to Congress on an annual basis, in accordance with the Foreign Assistance Act of 1961 and the Trade Act of 1974, which require that U.S. foreign and trade policy take into account countries’ performance in the areas of human rights and workers’ rights.

  • Fighting Racism and Xenophobia against People of African Descent

    By Erika Schlager, Counsel for International Law and Dr. Mischa Thompson, Senior Policy Advisor From September 10 to September 21, 2018, the OSCE participating States held their annual Human Dimension Implementation Meeting (HDIM) in Warsaw, Poland.  Organized by the OSCE Office for Democratic Institutions and Human Rights (ODIHR), HDIM is Europe’s largest annual human rights conference, bringing together hundreds of government and nongovernmental representatives, international experts, and human rights activists for two weeks to review OSCE human rights commitments and progress.  During the 2018 meeting, three specially selected topics were the focus of a full-day discussion: freedom of the media; the rights of migrants; and combating racism, xenophobia, intolerance, and discrimination.  As part of its efforts to fight racism and xenophobia, ODIHR, with U.S. support, organized a workshop for activists addressing racism and xenophobia against people of African descent. During the two-day event, 18 participants of African descent from Europe and North America focused on the OSCE and other international human rights instruments that address discrimination. U.S. participants included Johnetta Elzie, who led calls for justice following the police killings of unarmed African-American men, including in Ferguson and Baltimore, and David Johns, who called for police to address hate crimes targeting transgender African-Americans.  The group discussed efforts by civil society to collect and report hate crimes data to ODIHR, coalition-building among diverse groups, strengthening advocacy in international fora, and building information exchanges in various countries.  The discussion also touched on the International Covenant on the Elimination of All Forms of Racial Discrimination and International Decade for People of African Descent (2015-2024). Activists at the HDIM On September 20, the HDIM agenda focused specifically on racism, xenophobia, intolerance and discrimination. Workshop participants were invited to join government representatives and NGOs to discuss a broad set of challenges in both formal sessions and during side events. Canadian NGOs advocated for expunging marijuana drug charges disproportionately impacting Black men as part of legalization efforts in their country. Polish activists reiterated concerns that police are not adequately investigating hate crimes and, in some cases, have arrested undocumented migrants when they came to police to report a hate crime. A Hungarian participant sought support to address negative perceptions of refugees following the adoption of laws imposing criminal penalties on Hungarians who assist asylum seekers. A French participant spoke of discrimination impacting Black Muslims and the need to address racial and religious bias.  One participant questioned when a Swedish national plan addressing anti-black racism or “Afrophobia” would be implemented. A defamation case launched against European Parliamentarian Cecile Kyenge for calling the Italian political party The League “racist” led participants to question how racial prejudice and discrimination could be addressed if activists faced retribution for simply naming the problem.  Participants also expressed concern about a forecasted decline in diversity in the European Parliament that will follow a post-BREXIT loss of UK parliamentarians, at a time when political parties espousing “anti-foreigner” views are predicted by some to increase in power. Several countries responded to issues raised by the participants during the meeting. A representative for Sweden thanked civil society members for participating in HDIM and highlighted the government’s recent increase in funds and national plans to address racism, stating plans to address “Afrophobia are underway.” A U.S. representative indicated support for civil society participation in the meeting, calling civil society “brave,” and admonished the excessive use of force by law enforcement, particularly when linked when racial discrimination. The representative detailed the legal proceedings taken against the city of Ferguson by the U.S. Department of Justice that have resulted in implicit bias, community policing, mental health sensitivity, and other training to improve relations between police and the African-American community in Ferguson. Canada thanked participants for sharing their experiences and reiterated its commitment to addressing racism and discrimination.  Recommendations from participants in the September 20 session included: Increasing the representation of people of African descent in OSCE institutions and leadership positions Adopting national action plans to improve the situation of people of African descent, including implementing the International Convention on the Elimination of All Forms of Racial Discrimination and the International Decade for People of African Descent Collecting disaggregated data on hate crimes and discrimination in housing, education, employment, and other sectors impacting people of African descent Targeting programs for refugees and migrants of African descent, including an increased focus on integration Training initiatives to improve police interaction with African descent populations, including migrant and refugee populations Increasing support for civil society and work in partnership with civil society  

  • A Truly Inclusive Society

    While the United States has an exemplary system of integration, empowerment, and protection from discrimination, individuals with intellectual disabilities like Down Syndrome have recommended numerous further improvements to U.S. law. This briefing explored best practices developed federally and locally in the United States to empower and integrate individuals with intellectual disabilities. Sara Hart Weir discussed how perceptions of the disabled community impair equality in many facets of society including education, housing, and financial independence, and discussed changes to the law that are still needed 30 years after the Americans with Disabilities Act. For instance, 80-year-old legislation named the “Fair Labor Standards Act of 1938” has unfairly permitted corporations to pay disabled employees less than minimum wage. This longstanding law was recently challenged by the National Down Syndrome Society through the TIME Act. Ms. Weir also supported continued work to build upon the recently adopted ABLE Act, which allows individuals with Down syndrome to save for their futures without losing benefits. She highlighted that many individuals with Down syndrome still face the choice between limiting their hours to part-time work or losing their much-needed Medicaid benefits. New, comprehensive legislation will be needed to address this problem if individuals with Down syndrome will be fully incorporated into the economy.   Kayla McKeon, the first registered lobbyist with Down syndrome, relayed the need for legal changes and social acceptance at an institutional level, stating, “To me, having Down syndrome is who I am but it has never stopped me for achieving my own hopes, dreams, and passions. What I want for my life and all individuals with disabilities is for us all to be treated just like everyone else. I want to live the American Dream.” The Special Olympian and lobbyist recalled being educated alongside her peers and receiving additional help as needed, as well as independence when needed. She is now attending college while working as the Manager of Grassroots Advocacy at the National Down Syndrome Society. Dr. Sheryl Lazarus, Director of the TIES Center, underscored the importance of including children with disabilities in educational settings alongside their peers, stating, “Early inclusion supports later inclusion. Early segregation almost ensures that there will be segregation later in life.” Dr. Lazarus encouraged teachers raise their expectations of disabled students’ cognitive abilities by promoting coursework such as math, reading, and social studies, not just self-care. She encouraged training and the availability of educational resources to ensure all teachers feel confident they can include children with disabilities in their classrooms. She noted that “the behavior of adults must change” to ensure that children with disabilities can reach their full potential. John Cronin, co-founder of John’s Crazy Socks, recounted that his disability “never held [him] back.” The Chief Happiness Officer of his $6 million company, he assists with public relations, merchandising, and same-day shipping to customers—who include presidents, prime ministers, and movie stars.  His passion drives his 8-hour work day, and he wants the world to know what tremendous feats people like him can accomplish. John’s Crazy Socks competes with corporate giants such as Amazon, yet the company is set apart by its social mission: to raise money for its partners and to demonstrate that hiring individuals with disabilities is a smart business decision. John’s Crazy Socks emphasizes employees’ abilities rather than disabilities and matches those abilities to the needs of the company. More than half of John’s Crazy Socks employees are differently-abled. Mark Cronin, CEO of John’s Crazy Socks, underscored that John’s Crazy Socks employees are paid above minimum wage, even though the law permits him to pay below minimum wage: “Our colleagues do not do minimum work, so we do not offer minimum pay.” He explained, “Employers will learn that those with differing abilities are an asset, not a liability. And the employers who learn this lesson the fastest, will be at an advantage and find greater success.”

Almost three decades ago President Bush signed into law the Americans with Disabilities Act (ADA), which provides individuals with disabilities access to the same employment opportunities and benefits available to people without disabilities; encourages employers to make reasonable accommodations; requires state and local governments to make all services and programs available to individuals with disabilities; prohibits places of public accommodation from discriminating against individuals with disabilities; and directs businesses to make reasonable modifications when serving individuals with disabilities. In so doing, the ADA has broken down many barriers blocking the full participation of individuals with disabilities in their communities and economies across the United States.
