Cardin Calls for Human Rights to Be Included in U.S.-China Dialogue

U.S. Senator Benjamin L. Cardin (D-MD), Chairman of the Commission on Security and Cooperation in Europe (U.S. Helsinki Commission), today released the following statement in response to the inaugural Strategic and Economic Dialogue between the U.S. and China:

“The significant dialogue that the United States started this week with China is a positive step in strengthening the relationship between the United States and China. I am pleased the agenda covered crucial issues such as the global economic crisis, climate change, non-proliferation and regional stability.  However, I am disappointed that human rights issues were not given higher priority.

“Negotiations on climate change are particularly significant because any global solution must include the intense collaboration and effort of China and the United States, which together produce more than 40 percent of global carbon emissions. Together, we can help create a framework that will make a positive impact on the harmful effects of climate change by holding all nations to a common standard, yet taking the needs of each country into account.

“Discussing respect for basic human rights, which are fundamental to both a climate change and economic solution, is also essential. To not press China – undeniably one of our chief partners in tackling global problems – on human rights protections is a missed opportunity. It is our responsibility to champion collective values, especially those that are so essential and connected: basic political rights, labor protections, and freedoms of speech and religion.

“The United States must make an unambiguous commitment to human rights – not as a personal belief of any political leader or simply an Administration policy, but as a moral obligation of our country towards international law and universal principles.  I will continue to press President Obama and his administration to unabashedly champion the cause of human rights in China, particularly as our countries collaborate to craft joint solutions for the 21st century.”

  • Introduction of Resolution on Anti-Semitism and Related Violence

    Mr. President, I am pleased to sponsor Senate Concurrent Resolution 7, expressing the sense and concern of the Congress regarding the recent spike in anti-Semitic violence that occurred in many participating States of the 55-nation Organization for Security and Cooperation in Europe (OSCE). It is incumbent upon us to send a clear message that these malicious acts are a serious concern to the United States Senate and American people and that we will not be silent in the face of this disturbing trend. The anti-Semitic violence we witnessed in 2002, which stretched the width and breadth of the OSCE region, is a wake-up call that this old evil still lives today. Coupled with a resurgence of aggressive nationalism and an increase in neo-Nazi “skin head” activity, myself, and other Commissioners on the Helsinki Commission, have diligently urged the leaders of OSCE participating States to confront and combat the evil of anti-Semitism. Attacks on members of the Jewish community and their institutions have ranged from shootings, fire bombings, and physical assaults in places as different as London, Paris, Berlin and Kiev. Vandals have struck in Brussels, Marseille, Bratislava, and Athens. Anti-Semitic propaganda has been spread in Moscow, Minsk and elsewhere as hatemongers have tapped into technology, including the internet, to spread their venom. Yet while we witnessed a significant rise in violence last year in Europe, acts of vandalism have also occurred in the United States, so with encouraging our colleagues in other parliaments to act, we must be mindful that no country is immune. As OSCE participating States, all member nations, including the United States, have pledged to unequivocally condemn anti-Semitism and take effective measures to protect individuals from anti-Semitic violence. Through the OSCE, which was the first multilateral institution to speak out against anti-Semitism, all of today’s member states share in that heritage. Thankfully, many OSCE states that I mentioned have responded appropriately, vigorously investigating the perpetrators and pursuing criminal prosecution. In short, manifestations of anti-Semitism must not be tolerated, period, regardless of the source. Mr. President, as Co-Chairman of the Commission on Security and Cooperation in Europe, I can report that the OSCE Proto Ministerial Council, through the persistent efforts of the United States, addresses the phenomenon of anti-Semitism and called for the convening of a meeting specifically focused on this timely issue. I introduce this resolution to put the United States Senate on record and send an unequivocal message that anti-Semitism must be confronted, and it must be confronted now. If anti-Semitism is ignored and allowed to grow, our societies and our civilizations will suffer. As the resolution sets forth, elected and appointed leaders should meet the challenge of anti-Semitic violence through public condemnation, making clear their societies have no room for such attacks against members of the Jewish community or their institutions. Mr. President, I ask unanimous consent that the text of the resolution be included in the Record following my remarks. Thank you, Mr. President. SENATE CONCURRENT RESOLUTION 7--EXPRESSING THE SENSE OF CONGRESS THAT THE SHARP ESCALATION OF ANTI-SEMITIC VIOLENCE WITHIN MANY PARTICIPATING STATES OF THE ORGANIZATION FOR SECURITY AND COOPERATION IN EUROPE (OSCE) IS OF PROFOUND CONCERN AND EFFORTS SHOULD BE UNDERTAKEN TO PREVENT FUTURE OCCURRENCES Mr. Campbell (for himself, Mr. Smith, and Mrs. Clinton) submitted the following concurrent resolution; which was referred to the Committee on Foreign Relations: S. Con. Res. 7 Whereas the expressions of anti-Semitism experienced throughout the region encompassing the participating States of the Organization for Security and Cooperation in Europe (OSCE) have included physical assaults, with some instances involving weapons or stones, arson of synagogues, and desecration of Jewish cultural sites, such as cemeteries and statues; Whereas vicious propaganda and violence in many OSCE States against Jews, foreigners, and others portrayed as alien have reached alarming levels, in part due to the dangerous promotion of aggressive nationalism by political figures and others; Whereas violence and other manifestations of xenophobia and discrimination can never be justified by political issues or international developments; Whereas the Copenhagen Concluding Document adopted by the OSCE in 1990 was the first international agreement to condemn anti-Semitic acts, and the OSCE participating States pledged to ``clearly and unequivocally condemn totalitarianism, racial and ethnic hatred, anti-Semitism, xenophobia, and discrimination against anyone as well as persecution on religious and ideological grounds;'' Whereas the OSCE Parliamentary Assembly at its meeting in Berlin in July 2002, unanimously adopted a resolution that, among other things, called upon participating States to ensure aggressive law enforcement by local and national authorities, including thorough investigation of anti-Semitic criminal acts, apprehension of perpetrators, initiation of appropriate criminal prosecutions, and judicial proceedings; Whereas Decision No. 6 adopted by the OSCE Ministerial Council at its Tenth Meeting held in Porto, Portugal in December 2002 (the "Porto Ministerial Declaration") condemned "the recent increase in anti-Semitic incidents in the OSCE area, recognizing the role that the existence of anti-Semitism has played throughout history as a major threat to freedom;" Whereas the Porto Ministerial Declaration also urged “the convening of separately designated human dimension events on issues addressed in this decision, including on the topics of anti-Semitism, discrimination and racism, and xenophobia;” and Whereas on December 10, 2002, at the Washington Parliamentary Forum on Confronting and Combating anti-Semitism in the OSCE Region, representatives of the United States Congress and the German Parliament agreed to denounce all forms of anti-Semitism and agreed that "anti-Semitic bigotry must have no place in our democratic societies:" Now, therefore, be it Resolved by the Senate (the House of Representatives concurring), That it is the sense of Congress that-- (1) officials of the executive branch and Members of Congress should raise the issue of anti-Semitism in their bilateral contacts with other countries and at multilateral fora, including meetings of the Permanent Council of the Organization for Security and Cooperation in Europe (OSCE) and the Twelfth Annual Session of the OSCE Parliamentary Assembly to be convened in July 2003; (2) participating States of the OSCE should unequivocally condemn anti-Semitism (including violence against Jews and Jewish cultural sites), racial and ethnic hatred, xenophobia, and discrimination, as well as persecution on religious grounds whenever it occurs; (3) participating States of the OSCE should ensure effective law enforcement by local and national authorities to prevent and counter criminal acts stemming from anti-Semitism, xenophobia, or racial or ethnic hatred, whether directed at individuals, communities, or property, including maintaining mechanisms for the thorough investigation and prosecution of such acts; (4) participating States of the OSCE should promote the creation of educational efforts throughout the region encompassing the participating States of the OSCE to counter anti-Semitic stereotypes and attitudes among younger people, increase Holocaust awareness programs, and help identify the necessary resources to accomplish this goal; (5) legislators in all OSCE participating States should play a leading role in combating anti-Semitism and ensure that the resolution adopted at the 2002 meeting of the OSCE Parliamentary Assembly in Berlin is followed up by a series of concrete actions at the national level; and (6) the OSCE should organize a separately designated human dimension event on anti-Semitism as early as possible in 2003, consistent with the Porto Ministerial Declaration adopted by the OSCE at the Tenth Meeting of the OSCE Ministerial Council in December 2002.

  • Commission Surveys Bush Administration's Policy Toward the OSCE

    By Orest Deychakiwsky & Janice Helwig CSCE Staff Advisors The United States Helsinki Commission held a hearing October 10, 2002 to examine U.S. policy toward the 55-nation Organization for Security and Cooperation in Europe (OSCE). The hearing reviewed the United States’ goals and longstanding human rights concerns in the OSCE region and how the Vienna-based organization can serve as a forum to advance those goals and address human rights violations. In his opening statement, Commission Chairman Senator Ben Nighthorse Campbell (R-CO) affirmed the importance of the relationship between the Helsinki Commission and the Department of State. He also declared the Commission’s ongoing interest in how the Administration uses the OSCE to effectively promote U.S. interests in the OSCE region. Chairman Campbell stressed that to be effective in our policy goals, “the various components of the U.S. foreign policy apparatus – the State Department, U.S. embassies in the field and the U.S. Mission to the OSCE – must be mutually reinforcing.” Chairman Campbell addressed corruption and organized crime as major impediments to democratization efforts in the OSCE region and cited specific recent developments in Georgia, Belarus and Ukraine as warranting monitoring by the United States. Commission Co-Chairman Rep. Christopher H. Smith (R-NJ) began his opening statement by arguing that “without a doubt the events of this past year have only underscored the importance of protecting human rights, and developing democratic institutions and the rule of law.” He spoke out against those leaders, particularly in Central Asia, that use the fight against terrorism to crack down on political opposition, religious groups, and others accused of being extremist. Rather, allowing citizens to express their religious, political or ethnic views helps prevent the rise of dissent and disillusionment that terrorists can use to garner support. “The United States must demonstrate in word and deed that this country has not abandoned human rights for the sake of the fight against global terrorism,” Smith concluded. “We need to reassure the world that it is just the opposite: human rights are more important than ever.” Smith drew particular attention to the issue of human trafficking as an increasing problem in “virtually all OSCE states.” Commissioner Ranking Member Rep. Steny Hoyer (D-MD), in his opening statement, argued that the OSCE has been an effective body for working on human rights issues. He cited the Central Asian countries as some of the most egregious human rights violators in the OSCE region and noted that raising human rights issues in these countries may be more difficult now as they are needed allies in the global struggle against terrorism. Hoyer pointed out that the U.S. must also uphold its own domestic commitments under the OSCE commitments and concluded by saying that in the future he hopes the OSCE will continue to hold participating States accountable for failures to meet their commitments under the Helsinki Final Act. Commissioner Senator George V. Voinovich (R-OH), in his opening remarks, spoke of the alarming rise of anti-Semitism in the OSCE region and raised possible steps to combat this trend. He commended the role of OSCE monitoring missions in promoting fair elections in Kosovo and Macedonia, while also calling for continued vigilance in addressing the problems of “organized crime, corruption and trafficking in human beings, arms and drugs.” A. Elizabeth Jones, Assistant Secretary of State of European and Eurasian Affairs, enumerated the ways in which the U.S. is using the OSCE as an instrument in the global struggle against terrorism. In her testimony, Jones said, “To ensure continuing OSCE attention to combating terrorism, we have proposed establishing an annual security review conference to assess progress and to review OSCE activities in the security dimension.” She noted that the OSCE’s monitoring missions play a valuable role in bringing security and stability to the OSCE region. Changing focus, Jones maintained that the core of U.S. policy toward the OSCE would continue to be in the field of human rights. She highlighted the important role of the various OSCE monitoring missions in publicizing human rights abuses and bringing the issues to the attention of the international community. Jones continued, “unless respect for fundamental rights and freedoms strengthens in Central Asian states, we can look forward to a bleak future.” Assistant Secretary Jones singled out Belarus as a particular area of concern due to its recent “policy of gutting the OSCE mission there by refusing to renew visas” while also noting that “the Lukashenka regime has continued to perpetrate massive human rights abuses.” Jones also outlined the State Department’s efforts to determine the details of President Kuchma’s authorization of the sale of advanced radar equipment to Iraq and outlined possible actions against the Ukrainian president. Lorne W. Craner, Assistant Secretary of State for Democracy, Human Rights and Labor and the Helsinki Commission’s Executive Branch Commissioner testified that the State Department had allocated “a substantial portion of the Human Rights and Democracy Fund...for hard-hitting democracy and human rights programs in numerous OSCE countries.” Craner noted that the countries of the former Soviet Union have posed the greatest challenges to the OSCE. He specifically cited Russia and its continued justification of aggression in Chechnya as part of the war on terrorism. Craner concluded by noting the progress in some of the Central Asian countries in meeting international norms on human rights, fundamental freedoms and elections. However, he also delineated several instances of corruption, repression and intimidation throughout the various Central Asian states, instances that have hindered the full realization of these norms. The second panel of witnesses began with a statement by Catherine A. Fitzpatrick, CIS Program Director, International League for Human Rights, who discussed her views on OSCE shortcomings and what can be done to address them. She argued that without binding treaties, without troops, without clout and capital, there are still two very great levers that the OSCE has.” Fitzpatrick specifically cited the OSCE’s validation of human rights victims’ concerns through “publicity of human rights reporting” and “withholding legitimacy and approval through its response to elections.” She continued with several proposals for using these levers coupled with “nuts and bolts human rights monitoring.” Among her specific recommendations were: requiring the OSCE to publicize its reports; suggesting that the OSCE’s missions advocate more forcefully on human rights at the ground level; beginning a very concerted campaign against torture; and decreasing funding for election training and observation. Elizabeth Anderson, Executive Director (DC) of the Europe and Central Asia Division of Human Rights Watch suggested two ways to strengthen the OSCE. First, she advocated the bolstering of human dimension activities by increasing the public reporting of the OSCE missions and improving the “implementation of recommendations” made to the OSCE by their missions and monitoring teams. Second, Anderson said the “integration of the human dimension with the other aspects of the organization’s work also needs to be strengthened.” She also noted the importance of coordination between the OSCE and other multilateral bodies, particularly international financial institutions. The final witness, Robert Templar, Asia Program Director of the International Crisis Group, noted with regard to Central Asia, the OSCE has struggled to do meaningful human rights work in countries which have “little interest in opening up their political and economic systems.” He also cited low staffing, low budgeting and lack of long-term strategy as hindering the OSCE’s work in the region. He suggested that the OSCE increase activities in the economic and security dimension, such as police and border service training, to show Central Asian states that the OSCE is not simply a human rights and democracy promoting organization that has little interest in their respective countries’ security or economic success. Templar advocated the creation of OSCE projects to tackle cross-dimensional issues and to work in conjunction with present undertakings in human rights and democracy. Finally, he advocated more comprehensive training for OSCE mission staff, not just in Central Asia, but rather in all OSCE missions. The United States Helsinki Commission, an independent federal agency, by law monitors and encourages progress in implementing provisions of the Helsinki Accords. The Commission, created in 1976, is composed of nine Senators, nine Representatives and one official each from the Departments of State, Defense and Commerce.   • U.S. Policy Toward the OSCE - 2003

    The purpose of this hearing was to examine U.S. policy toward the 55-nation Organization for Security and Cooperation in Europe (OSCE). The Commission hearing focused on how the Administration has been using the OSCE to promote U.S. interests in the expansive OSCE region, particularly as a tool for advancing democracy. In addition the hearing touched on the anticipated OSCE Human Dimension Implementation Review. In light of the September 11th terrorist attacks, the hearing discussed the link between state repression and violence and the role of building democracy  in U.S. national security interest. The witnesses and Commissioners discussed how the Helsinki Accords is based on mutual monitoring, not mutual evasion of difficult problems and how this concept can be effective tool for the U.S. foreign policy apparatus. In particular, the hearing covered situations in Central Asia and in authoritarian countries within the OSCE that are not putting forth meaningful reform.

  • Parliamentary Forum: Combating Anti-Semitism in the OSCE Region

    This briefing, which Commissioner Christopher Smith (NJ – 04) presided over, was a follow-up to an earlier Commission conference in Berlin, which focused on the rising tide of anti-Semitic violence and, subsequently, catalyzed so much of what the Commission had been doing on the issue of rising anti-Semitism. The conference in Berlin took place in July of 2001. The “Parliamentary Forum: Combating Anti-Semitism in the OSCE Region” briefing was held on International Human Rights Day, and was part of an ongoing effort by the Commission to address anti-Semitic violence, more specifically necessitated by vandalism against Jewish cemeteries, synagogues, cultural property, mob assaults, firebombing, and gunfire. Witnesses and participants of the briefing included members of the German Bundestag.

  • U.S. Delegation Pursues Broad Agenda at Berlin Parliamentary Assembly Session

Gore CSCE Staff Advisor The United States delegation to the 11th Annual Session of the Parliamentary Assembly of the Organization for Security and Cooperation in (OSCE PA) hosted by the German Bundestag in Berlin, July 6-10, 2002, contributed to the work of the meeting through the introduction of measures on topics ranging from anti-Semitic violence in the OSCE region to developments in Southeastern Europe and the deteriorating situation in Belarus. Attended by nearly 300 parliamentarians from over 50 countries, the OSCE PA unanimously adopted the Berlin Declaration on the political, economic and the human rights aspects of the central theme of the Session: “Confronting Terrorism: a Global Challenge in the 21st Century.” The U.S. Delegation was headed by Commission Co-Chairman Rep. Christopher H. Smith (R-NJ) with Commissioner Senator George V. Voinovich (R-OH) serving as Vice Chairman. Other Commissioners participating were Ranking Member Rep. Steny H. Hoyer (D-MD), Rep. Benjamin L. Cardin (D-MD), OSCE PA Vice President Rep. Alcee L. Hastings (D-FL), Rep. Robert B. Aderholt (R-AL), and Rep. Joseph R. Pitts (R-PA). Other delegates from the House of Representatives were Rep. Joseph M. Hoeffel (D-PA), Rep. Janice D. Schakowsky (D-IL), Rep. Thomas G. Tancredo (R-CO), and Rep. Jo Ann Davis (R-VA). Although OSCE PA President Adrian Severin attempted to register and seat a Belarus Delegation with “provisional” badges, following a raucous debate the Assembly denied seating members of the National Assembly. The debate expressed continued concern from many parliamentarians about the severe irregularities in Belarus’ 2000 parliamentary elections. Commissioners Smith, Hoyer and Cardin took an active part in the debate. Mr. Severin’s motion was defeated in a close vote. The matter is expected to be revisited at the Assembly’s Winter Session scheduled to be held in Vienna in February 20-21, 2003. The opening ceremonies included addresses by OSCE PA President Adrian Severin, President of the German Bundestag Wolfgang Thierse, Chancellor of the Federal Republic of Germany Gerhard Schröder and the Chairman-in-Office of the OSCE Foreign Minister of Portugal Antonio Martins da Cruz. Mr. da Cruz responded to questions from the floor, a procedure that has become the norm for the OSCE PA annual sessions. Several senior OSCE Officials, including the OSCE Secretary General, Ján Kubiš, the High Commissioner on National Minorities, Rolf Ekéus, and the Representative on Freedom of the Media, Freimut Duve, also briefed the parliamentarians. During the various sessions, delegates heard from such notables as Minister of Defense Mr. Rudolf Scharping, Minister of Economy Dr. Mr. Werner Müller, and Minister of Foreign Affairs Mr. Joseph Fischer. The 2002 OSCE PA Prize for Journalism and Democracy was shared between Austrian TV-journalist Friedrich Orter and Belarusian TV-journalist Pavel Sheremet. The prize is awarded by the Assembly to journalists who, through their work, “have promoted OSCE principles on human rights, democracy and the unimpeded flow of information.” This represents the seventh annual prize. The PA reported that “Dr. Orter has promoted OSCE Principles on human rights and democracy through his comprehensive and impartial reporting in the Balkans and lately in Afghanistan. Mr. Sheremet has shown admirable courage in his independent and reliable reporting on the lack of free expression in Belarus and on violations of human rights, including disappearances of opposition politicians and journalists.” The U.S. delegation had a private meeting with the OSCE Chairman-in-Office Antonio Martins da Cruz. Matters discussed included the field operations, the developing memorandum of understanding with the PA and the OSCE response to terrorism. The delegation also had a private meeting with the delegation from the Russian Federation. Members of the U.S. delegation played a leading role in debate in each of the Assembly’s three General Committees: Political Affairs and Security; Economic Affairs, Science, Technology and Environment; and Democracy, Human Rights and Humanitarian Questions. In addition to U.S. amendments to the committee resolutions, several free-standing resolutions were adopted that were sponsored by members of the U.S. delegation concerning critical topics. They included: “Anti-Semitic Violence in the OSCE Region” and “Roma Education” by delegation Chairman Mr. Smith; “Human Rights and the War on Terrorism” by Smith and co-sponsor Dragoljub Micunovic of Yugoslavia; “Southeast Europe” by delegation Vice Chairman Senator Voinovich; and, “Belarus” by Mr. Hoyer. Other free-standing Supplementary Items were adopted on “Moldova,” “Combating Trafficking in Human Beings,” “The Impact of Terrorism on Women,” and “The Prohibition on the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and their Destruction.” A Supplementary Item on “Peace in the Middle East: the protection of the Holy Basin of Jerusalem” was tabled pending consultations among interested parties. Mr. Cardin was a key negotiator in the effort to table the draft item. The resolution condemning the increasing rate of anti-Semitism throughout the OSCE region called upon the participating States to make vigorous public statements against anti-Semitism and to ensure aggressive law enforcement and thorough investigation of anti-Semitic acts. As further emphasis on this matter, the United States and the host German Parliament co-sponsored a seminar on anti-Semitism in the OSCE. (See Digest, Volume 35, no. 15, August 6, 2002, “Berlin Forum Highlights Disturbing Rise in Anti-Semitism”) Addressing the discrimination faced by Roma, the U.S. resolution focused on the concerns of under-education and inadequate schools. All OSCE States were called upon to rectify these problems and to eradicate segregated schools and the mis-diagnosis of Romani children which erroneously assigns them to “special schools” for those with mental disabilities. Expressing concern about states which compromise human rights in the struggle against terrorism, the “War on Terrorism” resolution called on States to adhere to the rule of law, avoiding xenophobic reactions against Muslims since the attacks of September 11, 2001. The language addressing past developments in Southeast Europe commended the ongoing presence and constructive work of the OSCE and called upon the OSCE to lead in the fight against organized crime, corruption and trafficking in human beings, narcotics and arms. The resolution also encouraged the use of regional mechanisms, especially the Stability Pact. The Assembly adopted the resolution expressing concern about the state of democracy and the rule of law in Belarus, restrictions on basic freedoms and harassment of political opposition, media and religious minorities. The Government of Belarus was called upon to live up to its OSCE obligations, cease the human rights abuses, and cooperate with the OSCE and its institutions. Mr. Hoyer reported to the Assembly on the activities of the Ad Hoc Committee on Transparency and Accountability which he chaired. The committee developed guidelines on the relationship between the Parliamentary Assembly and the Vienna-based, 55-nation OSCE. On July 10, the final day of the Session, the Assembly elected Mr. Bruce George, MP (United Kingdom) as its new president for a one-year term, succeeding Mr. Severin who has served the Assembly for the past two years. Mr. George, Chairman of the British House of Commons Defense Committee, has been an active member of the OSCE Parliamentary Assembly since its first gathering in Budapest in 1992. Recently a Vice-President of the Assembly, he has served the Assembly as Rapporteur and Chair of the General Committee on Political Affairs and Security and as Vice-Chairman and chaired the Assemblýs Working Group on the Rules of Procedure. German Minister of Foreign Affairs Joschka Fischer addressed the Berlin Session. As an indicator of the evolution of the OSCE, Fischer said, “The OSCE has ceased to be a conference of governments a long time ago and has become an international organization which deeply penetrates our societies. Where governments come upon their limits, parliaments can often act with greater independence. During the ten years the OSCE Parliamentary Assembly has existed it has shown how important impulses and support can be given to the work of the Organization ... The Parliamentary Assembly has at its disposal a political potential which should be further utilized in the Organization.” The United States Helsinki Commission, an independent federal agency, by law monitors and encourages progress in implementing provisions of the Helsinki Accords. The Commission, created in 1976, is composed of nine Senators, nine Representatives and one official each from the Departments of State, Defense and Commerce.

  • Turkey: What Can We Expect After the November 3 Election?

    This briefing addressed the November 3 elections, which were held during a rather turbulent time in Turkey. Turkey’s Justice and Development Party (AKP) led by Recep Tayyip Erdogan, a former mayor of Istanbul, won an unprecedented 34.27 percent of the votes in Turkey’s legislative election while the Republican People’s Party (CHP), led by Deniz Baykal, received 19.39 percent of the votes and won 178 seats in the next Parliament. Witnesses testifying at this briefing – including Abdullah Akyuz, President of the Turkish Industrialist’s and Businessmen’s Association, U.S. Representative Office; Sanar Yurdatapan, Musician and Freedom of Expression Advocate; and Jonathan Sugden, Researcher for Turkey with Human Rights Watch – addressed the massive recession face by Turkey and the concern of another war with Iraq. The effect, if any, on the rise of Islamist parties in Turkish politics is yet another concern. All of this following the recent snub by the European Union regarding Turkish accession, and increasingly bleak prospects for a resolution of the Cyprus impasse.

  • Prospects for Change in Turkey

    Mr. Speaker, I wish to extend my congratulations to the people of Turkey for their elections held on November 3. Witnessing the peaceful change of government is a change that is significant for both Turkey's citizens and for their neighborhood. Many of Turkey's neighbors need to see that such a transfer of power is possible, for the people of these countries have for too long suffered under the illusion that they must live with their repressive regimes that maintain power through undemocratic means.   It is also important to keep in mind that the Turks, seen by some as a model for the countries of Central Asia, are not new kids on the block--former President Demirel was an original signer of the 1975 Helsinki Final Act. As Co-Chairman of the Commission on Security and Cooperation in Europe (the Helsinki Commission), I have followed closely the developments in Turkey . With a particularly keen interest in the protection of human rights which has such an impact on the lives of individual men, women and children, I continue to be concerned about the ongoing use of torture, violations of religious freedom and threats to civil society.   Through the ballot box, the Justice and Development Party, known as the AKP, received 34.3 percent of the vote, giving them a clear majority of 363 seats in the 550-seat Turkish Grand National Assembly. This entitles the AKP, led by former Istanbul Mayor Recep Tayyip Erdogan, to govern without sharing political power. He will not be without challenges to his authority though.   On November 8, the anniversary of the death of the Turkish reformer Kemal Ataturk, General Hilmi, Ozkok issued a statement vowing "to protect the republic against all types of threats, especially fundamentalism and separatist activities,'' reiterating strongly the military's view of itself as the historical guarantor of Turkey's secular system. Mr. Speaker, while the transition appears peaceful, it is not without its strains and stresses, even with the potential of the military stepping in like it has done repeatedly in the past. We can only hope that is not the outcome of this transition.   As an original participating State of the Organization for Security and Cooperation in Europe (OSCE), Turkey has accepted a broad range of human rights obligations. As head of the U.S. delegation to the OSCE Parliamentary Assembly, I have worked with my parliamentary colleagues from Turkey to encourage protection for these commitments. With a new government not obligated to continue the ways of the old, there is a welcome opportunity for such initiatives to be undertaken.   There are a few specific matters that I urge the incoming government to address without delay. Four Kurdish members of the Grand National Assembly have been in prison since March 1994. I call upon the new government to free Layla Zana, Hatip Dicle, Orhan Dogan, and Selim Sadak and remove the trumped-up charges from their records. They were convicted for, among other things, speaking their mother tongue in and out of the parliament building. As Mr. Erdogan himself has said, such convictions should not stand.   Also, past efforts to return the hundreds of thousands of internally displaced Kurds to their homes in southeastern Turkey have proven ineffectual. The government should take concrete steps to ensure that refugees are allowed to return to their own homes in safety and dignity, which may well require the clearing of land mines and repairing of villages.   Mr. Speaker, without reciting the lengthy list of Turkey's human rights violations, including the use of torture, it is fair to say that Turkey's record of implementation of OSCE human dimension commitments remains poor. While progress has been made, the authority of police officials must be checked by the rule of law. All claims of torture must be seriously investigated, no matter where the investigation leads. It is important that anyone who commits torture--especially police, the security forces or other agents of the state--must be taken to court and tried for high crimes. The Forensic Medical Association should be allowed to carry out its professional responsibilities and act without fear in its attempts to document torture. Victims of torture should be paid due recompense by the state.   I am very concerned about the continuing difficulty no-governmental organizations face throughout Turkey, particularly the Human Rights Foundation of Turkey. The Human Rights Foundation exists in an uncertain environment, with arbitrary shutdowns and having its officials harassed, intimidated or arrested. Property has been seized and not returned.   Religious freedom in Turkey, whether for Muslims or other religious communities, had suffered from heavy-handed government involvement and control. The government allows Turkish Muslims to only attend state-approved mosques, listen to state-funded Imams, and receive religious education from state-funded schools. The Directorate of Religious Affairs, which regulates all of Turkey's 75,000 mosques and employs Imams, has been criticized for only promoting Sunni branch of Islam. I would encourage the new government to bring to a close its regulation of all religious institutions.   The wearing of headscarves has also been regarded as quite controversial since it is seen as a religious totem in a secular state. Women who choose this expression of religious conviction are denied the ability to attend state-run universities and work in public building, including schools and hospitals. The public sharing of religious belief in Turkey with the intent to persuade the listener to another point of view is severely curbed for both Muslims and Christians. A number of evangelical Protestant groups throughout Turkey have reported being targeted because of their religious free speech, which contradicts OSCE commitments on religious liberty and freedom of expression.   Turkey's Office of Foundations has contributed its own difficulties for faith communities, as it has closed and seized properties of "official'' minority religious groups and unrecognized faith communities. Several religious groups, most notably the Armenian Apostolic and Greek Orthodox churches report difficulties, particularly on the local level, in repairing and maintaining existing buildings or purchasing new buildings. The continued closure of the Orthodox seminary on Halki Island remains a concern.   Furthermore, religious groups not considered "official minorities'' under the Lausanne Treaty are provided no legal route to purchase or rent buildings to meet, and are thereby forced to hold meetings in private apartments. In response, provincial governorships, after receiving a letter from the Ministry of Internal Affairs last year, have initiated efforts to close these meeting places, leaving the smaller Protestant communities without any options. The lack of official recognition is an insurmountable hurdle for minority religious groups wishing to practice their faith as a community.   Turkey is at a critical crossroads. I am hopeful that the new government will take this opportunity to move forward, and craft policies which are consistent with OSCE commitments and protective of all peoples living in Turkey.

  • Human Rights and Inhuman Treatment

    As part of an effort to enhance its review of implementation of OSCE human dimension commitments, the OSCE Permanent Council decided on July 9, 1998 (PC DEC/241) to restructure the Human Dimension Implementation Meetings periodically held in Warsaw. In connection with this decision - which cut Human Dimension Implementation Meetings from three to two weeks - it was decided to convene annually three informal supplementary Human Dimension Meetings (SHDMs) in the framework of the Permanent Council. On March 27, 2000, 27 of the 57 participating States met in Vienna for the OSCE's fourth SHDM, which focused on human rights and inhuman treatment. They were joined by representatives of OSCE institutions or field presence; the Council of Europe; the United Nations Development Program;  the United Nations High Commissioner for Refugees;  the International Committee of the Red Cross; and representatives from approximately 50 non-governmental organizations.

  • U.S. Policy Toward the OSCE - 2002

    The purpose of this hearing was to examine U.S. policy toward the 55-nation Organization for Security and Cooperation in Europe (OSCE). The Commission hearing focused on how the Administration has been using the OSCE to promote U.S. interests in the OSCE region, particularly as a tool for advancing democracy. The witnesses and Commissioners discussed how the Helsinki Accords is based on mutual monitoring, not mutual evasion of difficult problems and how this concept can be an effective tool for the U.S. foreign policy apparatus. In particular, the hearing covered situations in Central Asia where corruption threatens the development of democratic institutions.

  • Concerning Rise in Anti-Semitism in Europe

    Mr. Speaker, I thank my good friend for yielding me time, and I rise in very strong support of H. Res. 393. I want to commend its sponsor and all of the Members who are taking part in this very important debate.   Mr. Speaker, yesterday, along with the gentleman from Maryland (Mr. Cardin), who is on the floor and will be speaking momentarily, we returned back from the OSCE, the Organization for Security and Cooperation in Europe, Parliamentary Assembly.   Every year, parliamentarians from the 55 nations that comprise the OSCE meet to discuss issues of importance. This year the focus was on terrorism, but we made sure that a number of other issues, because certainly anti -Semitism is inextricably linked to terrorism, were raised in a very profound way.   Yesterday, two very historic and I think very vital things happened in this debate. I had the privilege of co-chairing a historic meeting on anti -Semitism with a counterpart, a member of the German Bundestag, Professor Gert Weisskirchen, who is a member of the Parliament there, also a professor of applied sciences at the University of Heidelberg, and we heard from four very serious, very credible and very profound voices in this battle to wage against anti-Semitism.   We heard from Abraham Foxman, the National Director of the Anti -Defamation League, who gave a very impassioned but also very empirical speech, that is to say he backed it up with statistics, with information about this rising tide of anti-Semitism, not just in Europe, but in the United States and Canada as well.   He pointed out, for example, according to their data, 17 percent of Americans are showing real anti -Semitic beliefs, and the ugliness of it. Sadly, among Latinos and African Americans, it is about 35 percent. He pointed out in Europe, in the aggregate, the anti -Semitism was about 30 percent of the population.   Dr. Shimon Samuels also spoke, who is the Director of the Wiesenthal Center in Paris. He too gave a very impassioned and very documented talk. He made the point that the slippery slope from hate speech to hate crime is clear. Seventy-two hours after the close of the Durban hate-fest, its virulence struck at the strategic and financial centers of the United States. He pointed out, “If Durban was Mein Kampf, than 9/11 was Kristalnacht, a warning.”   “What starts with the Jews is a measure, an alarm signaling impending danger for global stability. The new anti -Semitic alliance is bound up with anti -Americanism under the cover of so-called anti –globalization.”   He also testified and said, ``The Holocaust for 30 years acted as a protective Teflon against blatant anti -Semitic expression. That Teflon has eroded, and what was considered distasteful and politically incorrect is becoming simply an opinion. But cocktail chatter at fine English dinners,'' he said, ``can end as Molotov cocktails against synagogues.   ``Political correctness is also eroding for others, as tolerance for multi-culturism gives way to populous voices in France, Italy, Austria, Denmark, Portugal, and in the Netherlands. These countries' Jewish communities can be caught between the rock of radical Islamic violence and the hard place of a revitalized Holocaust-denying extreme right.   “Common cause”, he concluded, “must be sought between the victimized minorities against extremism and fascism.”   I would point out to my colleagues one of those who spoke pointed out, it was Professor Julius Schoeps, that he has found that people do not say “I am anti -Semitic;” they just say ”I do not like Jews”, a distinction without a difference, and, unfortunately, it is rearing itself in one ugly attack after another.   I would point out in that Berlin very recently, two New Jersey yeshiva students, after they left synagogue, they left prayer, there was an anti -American, anti -Israeli demonstration going on, and they were asked repeatedly, are you Jews? Are you Jews? And then the fists started coming their way and they were beaten right there in Berlin.   Let me finally say, Mr. Speaker, that yesterday we also passed a supplementary item at our OSCE Parliamentary Assembly. I was proud to be the principal sponsor. The gentleman from Maryland (Mr. Cardin) offered a couple of strengthening amendments during the course of that debate, and we presented a united force, a U.S. force against anti-Semitism.   I would just point out this resolution now hopefully will act in concert with other expressions to wake up Europe. We cannot sit idly by. If we do not say anything, if we do not speak out, we allow the forces of hate to gain a further foothold. Again, that passed yesterday as well.   Mr. Speaker, I urge Members to become much more aware that this ugliness is rearing its ugly face, not just in the United States, but Canada, in Europe, and we have to put to an end to it. Hate speech and hate crimes go hand in hand.   Mr. Speaker, I urge support of the resolution.   United States Helsinki Commission--Anti -Semitism in the OSCE Region   The Delegations of Germany and the United States will hold a side event to highlight the alarming escalation of anti -Semitic violence occurring throughout the OSCE region.   All Heads of Delegations have been invited to attend, as well as media and NGOs.   The United States delegation has introduced a supplementary item condemning anti -Semitic violence. The Resolution urges Parliamentary Assembly participants to speak out against anti-Semitism.

  • Joseph Limprecht, U.S. Ambassador to Albania

    Mr. Speaker, we have received the news that United States Ambassador to Albania, Joseph Limprecht, died suddenly of a heart attack on Sunday, May 19, 2002, while hiking with his wife and colleagues in northern Albania.   Although I did not have the opportunity to meet Ambassador Limprecht, I did correspond with him on an issue of mutual concern--the trafficking of Albanian women and children into sexual slavery in Europe.   With porous borders and more than its share of criminals, Albania is used by traffickers as a key transit point to Italy. As a source country, young Albanian women are lured into the hands of traffickers and even kidnaped from their home towns or villages. The Ambassador was well aware of this tragedy and pressed for greater law enforcement to stop trafficking networks as well as greater assistance to the victims. Indeed, in keeping with the point of my correspondence with him, the Ambassador made sure U.S. assistance would go to a shelter for repatriated Albanian trafficking victims similar to one created for women found in Albania and waiting to be repatriated to their country of origin.   Beyond that, the Ambassador worked hard in the three years he spent in Albania in helping the country recover from its many ills, in particular the civil strife which tore the country apart in 1997. Given Albania's vulnerability to militant Islamic infiltration, I am sure that the war on terrorism was in the forefront of his duties in recent months.   Ambassador Limprecht was a member of the Senior Foreign Service, having served with the U.S. Foreign Service since 1975, with postings in Germany, Pakistan and Uzbekistan as well as in Washington. In the 1980s, he served in the office which handled what was then the Conference on Security and Cooperation in Europe and now the OSCE, and worked with the staff of the Helsinki Commission which I had just joined and now serve as Co-Chairman.   My deepest condolences go to the Ambassador's wife, Nancy, their daughters Alma and Eleanor, friends and colleagues.

  • HEARING FOCUSES ON RUSSIAN-CHECHEN WAR

Aderholt (R-AL) chaired the hearing. Commissioners Rep. Joseph R. Pitts (R-PA) and Rep. Alcee L. Hastings (D-FL) also participated. Testifying before the Commission were Steven Pifer, Deputy Assistant Secretary for European and Eurasian Affairs at the U.S. Department of State; Ms. Aset Chadaeva, a pediatric nurse and former resident of Chechnya; Andrei Babitsky, Radio Liberty correspondent and author of Undesirable Witness; and Anatol Lieven, Senior Associate at the Carnegie Endowment for International Peace. “The United States Government is committed to doing all that we can to bring about an end to this conflict and to relieve the suffering of the civilian population,” testified Secretary Pifer. He asserted that the issue of Chechnya has been raised frequently by U.S. government officials with their counterparts, and President George W. Bush discussed it with President Vladimir Putin last November. “We anticipate it will come up at the summit in Moscow and St. Petersburg in two weeks,” Pifer said. “We seek a political settlement that will end the fighting, promote reconciliation, and recognize the territorial integrity of the Russian Federation [as well as] accountability for human rights abuses committed by all sides, and unimpeded access to the displaced by humanitarian organizations,” Pifer elaborated. Referring to U.S. concern about links of some Chechen forces with international terrorist groups, Secretary Pifer stated that the United States Government has called on Chechen President Aslan Maskhadov and other moderate Chechens to disassociate themselves from terrorists. On this point, Pifer noted the United States Government’s efforts to train and equip Georgian military units to deal with terrorist elements in the Pankisi Gorge adjacent to Chechnya’s southern border. Pifer testified that the United States has been the largest single provider of humanitarian aid to the North Caucasus. Since 1999 the U.S. Government has contributed more than 30 million dollars to relieve war-related suffering in the region. Ms. Chadaeva presented gripping testimony based on her work as a nurse in the Chechen town of Aldi on February 5, 2000, when Russian contract soldiers conducted a “cleansing operation” that left sixty civilians dead. “They threw grenades into basements where people were hiding,” Chadaeva said. “They executed unarmed men, women, old people and children. The victims ranged in age from a one-year-old baby to an eighty-two-year-old woman. They killed a woman who was eight months pregnant and her one-year-old son. All my patients who had been wounded during the bombings, who were getting well, were killed and their bodies burned.” Asked if the soldiers intended to kill their victims or if the casualties were the result of random grenades, Chadaeva replied, “these people were killed by being shot in the head...the soldiers knew exactly whom they were killing.” Concluding her description of wanton killing of Chechen civilians by Russian forces, Ms. Chadaeva asked “Is it really necessary to have millions of victims to call such behavior genocide? Isn’t the death of 100,000 Chechens since 1994 in the two Russian-Chechen wars sufficient reason for effective international action to end the conflict and the agony of the Chechen people?” Andrei Babitsky briefly described the fate of people killed for unknown reasons in Chechnya their bodies found bearing signs of torture. They were killed, he said, “as part of the anarchy and arbitrary rule which is now the order of the day in Chechnya.” The Radio Liberty correspondent then described the efforts made by Russian authorities, to prevent information about the war, especially human rights violations and atrocities against non-combatants, from reaching the general public. Moscow had succeeded in creating a “ghetto” of the war zone, he asserted, “shut off from the sight and influence of the outside world.” The main issue, Babitsky contended, is not how individual Russian journalists view the war. Most reporters agree with the official position that Moscow is waging an “anti-terrorist” and “anti-separatist” operation. “The main issue is that the Russian military and the Kremlin have banned reports on killings, torture and kidnaping of civilians by the Russian military,” Babitsky said. “The lack of information about Chechnya is one of the most effective ways to create a situation in which killers and kidnappers in epaulets can operate without legal accountability.” Regarding assertions by Moscow of Chechen involvement with Al Qaeda and the Taliban, Babitsky noted that during a recent visit to Afghanistan, neither he nor other Russian journalists found any Chechen fighters, despite a concerted search. Anatol Lieven observed that the United States now recognizes the presence of international Islamic militant forces in Chechnya and Georgia, whereas earlier, “this was downplayed or even ignored altogether by wide sections of U.S. officialdom, the media and public opinion.” The prevention or elimination of lawless areas and quasi-states in the Muslim world – of which Chechnya between 1996 and 1999 was one – is now recognized as a vital U.S. national interest, since such areas can all too easily become safe havens for Al Qaeda or allied groups,” Lieven continued. Nevertheless, Lieven stated, “while extremists and terrorists have established a strong presence in Chechnya, they have been able to do so because of the legitimate grievances and the great suffering of the Chechen people...The initial appearance of these forces – as in Afghanistan – was due to the brutal Russian military intervention of 1994-96; and the way in which they were able to carve out a powerful position for themselves in 1996-99 owed an enormous amount to the destruction, brutalization, and radicalization left behind by that war.” Summing up, Lieven suggested that U.S. goals should be the destruction or exclusion of the radicals followed by a sharp reduction of the Russian military presence, free elections for a Chechen administration, and the restoration of autonomy. Moscow had succeeded in creating a “ghetto” of the war zone, he asserted, “shut off from the sight and influence of the outside world.” The main issue, Babitsky contended, is not how individual Russian journalists view the war. Most reporters agree with the official position that Moscow is waging an “anti-terrorist” and “anti-separatist” operation. “The main issue is that the Russian military and the Kremlin have banned reports on killings, torture and kidnaping of civilians by the Russian military,” Babitsky said. “The lack of information about Chechnya is one of the most effective ways to create a situation in which killers and kidnappers in epaulets can operate without legal accountability.” Regarding assertions by Moscow of Chechen involvement with Al Qaeda and the Taliban, Babitsky noted that during a recent visit to Afghanistan, neither he nor other Russian journalists found any Chechen fighters, despite a concerted search. Anatol Lieven observed that the United States now recognizes the presence of international Islamic militant forces in Chechnya and Georgia, whereas earlier, “this was downplayed or even ignored altogether by wide sections of U.S. officialdom, the media and public opinion.” The prevention or elimination of lawless areas and quasi-states in the Muslim world – of which Chechnya between 1996 and 1999 was one – is now recognized as a vital U.S. national interest, since such areas can all too easily become safe havens for Al Qaeda or allied groups,” Lieven continued. Nevertheless, Lieven stated, “while extremists and terrorists have established a strong presence in Chechnya, they have been able to do so because of the legitimate grievances and the great suffering of the Chechen people...The initial appearance of these forces – as in Afghanistan – was due to the brutal Russian military intervention of 1994-96; and the way in which they were able to carve out a powerful position for themselves in 1996-99 owed an enormous amount to the destruction, brutalization, and radicalization left behind by that war.” Summing up, Lieven suggested that U.S. goals should be the destruction or exclusion of the radicals followed by a sharp reduction of the Russian military presence, free elections for a Chechen administration, and the restoration of autonomy. However, he concluded, “before it can embark on any such path the U.S. needs to think very seriously about the correct balance between sympathy for Chechen suffering, respect for Russian security and sovereignty, and America’s own vital interests in this region, in the context of the wider war against terrorism.” An un-official transcript of the hearing and written statements submitted by Members and witnesses are located on the Helsinki Commission’s Internet web site. The United States Helsinki Commission, an independent federal agency, by law monitors and encourages progress in implementing provisions of the Helsinki Accords. The Commission, created in 1976, is composed of nine Senators, nine Representatives and one official each from the Departments of State, Defense and Commerce.

  • International Cooperation In The War On Terrorism

    Sen. Ben Nighthorse Campbell, Rep. Chris Smith, and witnesses discussed the OSCE’s efforts to coordinate counter-terrorism activities among its 55 member states, along with the level that these states are fulfilling their commitments to comply in the fight against terrorist activities and organizations. More specifically, the hearing focused on the financial and diplomatic dimensions of the war on terrorism, along with the European Union’s role in its efforts to fight terrorism in the OSCE region and the world over. This hearing took place with the recent U.S.-EU counter terrorism cooperation summit in mind.

  • U.S. Policy in Central Asia and Human Rights Concerns

    This briefing addressed U.S. policy in Central Asia and human rights concerns in the region in advance of the President of Uzbekistan’s visit to Washington, which had drawn attention to the deepening engagement of the United States in the region. Questions about Washington’s leverage presently and in the foreseeable future as well as the prospects for improving the dismal human rights situation in the region were discussed. Witnesses testifying at the briefing – including Lawrence Uzzell, Director of the Keston Institute; E. Wayne Merry, Senior Associate of the American Foreign Policy Council; and Nina Shea, Commissioner of the U.S. Commission on International Religious Freedom – presented numerous examples of the human rights violations that occur in Central Asian countries like Uzbekistan and pointed to the inheritance of imperial policies of commodity exploitation, ecological damage, and extremely bad demographics as several of the motivating factors of these violations.

  • Anti-Terrorism Conference Held in Bishkek

    By Janice Helwig Policy Advisor The Organization for Security and Cooperation in Europe (OSCE) – together with the United Nations Office for Drug Control and Crime Prevention (UNODCCP) – organized the Bishkek International Conference on Enhancing Security and Stability in Central Asia from December 13-14, 2001 to discuss ways in which the Central Asian countries can contribute to the global fight against terrorism. The conference was a step in implementing the OSCE Action Plan for Combating Terrorism, adopted by the OSCE participating States at the Bucharest Ministerial Meeting earlier in December. The meeting culminated with the adoption of a political declaration and an action program outlining areas where international assistance is particularly needed. (All documents are available on the OSCE website at www.osce.org) The conference also gave State authorities a chance to share experiences and ideas with each other; Spain and the United Kingdom, in particular, discussed lessons they had learned in combating terrorism in their countries. OSCE States had the opportunity to exchange views with countries not normally included in OSCE meetings, such as Pakistan, Iran, India, and China. The goal of the conference was to progress from discussion to action by identifying concrete areas for international assistance to Central Asia in fighting terrorism. The success of the conference depends on whether OSCE States and international organizations follow up on the areas identified and come forward with projects and funding. Kyrgyz President Askar Akaev opened the meeting, and Kyrgyz Foreign Minister Imanaliev also participated. In addition to OSCE participating States, then Chairman-in-Office Romanian Foreign Minister Mircea Geoana attended the conference, as did representatives from several OSCE Institutions – including High Commissioner on National Minorities Rolf Ekeus, Director of ODIHR Gerard Stoudmann, OSCE Secretary General Jan Kubis, and OSCE Parliamentary Assembly Vice-President Ahmet Tan. In addition to UNODCCP, several other international organizations participated, including the Organization of Islamic Conference (OIC), and the International Organization for Migration (IOM). President Akaev stressed the importance of international support for a neutral Afghanistan that will no longer be a haven for extremism, drugs, or terrorism. Kyrgyzstan and other Central Asian states had been pointing out the potential for violence, terrorism, and extremism to spill over from Afghanistan for several years, he noted, but the international community had taken no preventive steps. International efforts to combat terrorism now need to be more proactive. Poverty must be addressed throughout the region in order to minimize the possibility of its being exploited by terrorists to gain followers. All Central Asian states asked for technical and financial assistance, particularly to fight drug trafficking and organized crime, which are often sources of funding for terrorist organizations. The U.S. delegation was co-headed by Stephan M. Minikes, U.S. Ambassador to the OSCE, and Steven Monblatt, Deputy Coordinator in the State Department Office of the Coordinator for Counter Terrorism. Other members of the delegation included representatives from the State Department’s Bureaus of Democracy, Human Rights, and Labor, and of International and Law Enforcement Affairs, as well as a representative of the CSCE. Ambassador Minikes summed up the U.S. position in his closing statement, “We must ensure that our societies are ones in which terrorists cannot thrive, that our societies are ones in which human rights are respected, and in which rule of law, freedom of expression, tolerance, and democracy strengthen stability. As so many noted in Bishkek, societies of inclusion, with economic opportunities for all, pluralistic debate, a political commitment to conflict resolution, and where integration does not mean losing one's identity, are those where extremists have the least chance of generating sympathy and support from the moderate majority.” Other OSCE States discussed the importance of a concerted international effort against terrorism that includes fostering human rights, the rule of law, and economic development. The delegations of the United Kingdom and Spain shared their experiences fighting terrorism. The UK underscored that, based on lessons learned in Northern Ireland, respect for rule of law and human rights must be the basis for any approach to fighting terrorism; otherwise, authorities lose the moral high ground and the support of moderates. In addition, free political debate is essential to provide a peaceful alternative for dissenting views and prevent terrorists from gaining the support of those who share their views but not their methods. ODIHR Director Stoudmann stressed the need for caution as new procedures and legislation are put in place to combat terrorism; government authorities should not, above all, use terrorism as an excuse to rid themselves of opposition or dissent, he suggested. He offered ODIHR’s services in reviewing draft anti-terrorism legislation to ensure that international standards are upheld. In the political declaration, states participating in the conference pledged to work together against terrorism in full conformity with their OSCE commitments and fully respect human rights and the rule of law. They rejected the identification of terrorism with any particular religion or culture. They also noted that, as a neighbor to Afghanistan, the Central Asian region has been exposed to specific challenges and threats to security and therefore needs particular assistance in combating terrorism. The program of action outlined the following priorities for concrete programs: Promoting ratification and implementation of international conventions related to combating terrorism; Enhancing cooperation between both national and international agencies involved in combating terrorism and in fighting crime; Adopting national anti-money laundering legislation and create corresponding structures; Increasing cooperation in the protection of human rights and in strengthening rule of law and democratic institutions; Assisting judicial systems through training and strengthening independence; Fostering political dialogue, including through political parties, civil society, and free media; Addressing economic problems, including through programs to attract investment; Assisting Central Asian states in controlling their borders, particularly with regard to drug trafficking; and Encouraging joint training and operational activities among the countries of Central Asia.

  • Human Rights in Central Asia

    Mr. Speaker, on Friday, December 21, Kazakhstan's President Nursultan Nazarbaev will be meeting with President Bush. Sometime in January, Uzbekistan's President Islam Karimov is likely to arrive for his visit. The invitations to these Heads of State obviously reflect the overriding U.S. priority of fighting international terrorism and the corresponding emphasis on the strategic importance of Central Asia, which until September 11 had been known largely as a resource-rich, repressive backwater.   As Co-Chairman of the Commission on Security and Cooperation in Europe, I have chaired a series of hearings in recent years focused on human rights and democratization in the Central Asian region.   Clearly, we need the cooperation of many countries, including Afghanistan's Central Asian neighbors, in this undertaking. But we should not forget, as we conduct our multidimensional campaigns, two vitally important points: first, Central Asian leaders need the support of the West at least as much as we need them.   Unfortunately, Central Asian presidents seem to have concluded that they are indispensable and that we owe them for allowing us to use their territory and bases in this fight against the terrorists and those who harbor them. I hope Washington does not share this misapprehension. By striking against the radical Islamic threat to their respective security and that of the entire region, we have performed a huge service for Central Asian leaders.   Second, one of the main lessons of September 11 and its aftermath is that repression of political opposition and alternative viewpoints is a key cause of terrorism. Secretary of State Colin Powell and National Security Adviser Condoleezza Rice have declared that the war on terrorism will not keep the United States from supporting human rights. I am hopeful the administration means what they have said. But given the sudden warming of relations between Washington and Central Asian leaders, I share the concerns voiced in many editorials and op-eds that the United States will downplay human rights in favor of cultivating ties with those in power. More broadly, I fear we will fall into an old pattern of backing repressive regimes and then being linked with them in the minds and hearts of their long-suffering peoples.   In that connection, Mr. Speaker, on the eve of President Nazarbaev's meeting with President Bush and in anticipation of the expected visit by President Karimov, as well as possible visits by other Central Asian leaders, I want to highlight some of the most glaring human rights problems in these countries.   To begin with, corruption is rampant throughout the region, and we should keep this in mind as the administration requests more money for assistance to Central Asian regimes. Kazakhstan's President Nazarbaev and some of his closest associates are under investigation by the U.S. Department of Justice for massive corruption. Not surprisingly, to keep any information about high-level misdeeds from the public, most of which lives in dire poverty, the Nazarbaev regime has cracked down hard on the media. Family or business associates of President Nazarbaev control most media outlets in the country, including printing houses which often refuse to print opposition or independent newspapers. Newspapers or broadcasters that try to cover taboo subjects are harassed by the government and editorial offices have had their premises raided. The government also controls the two main Internet service providers and regularly blocks the web site of the Information Analytical Center Eurasia, which is sponsored by Kazakhstan's main opposition party.   In addition, libel remains a criminal offense in Kazakhstan. Despite a growing international consensus that people should not be jailed for what they say or write, President Nazarbaev on May 3 ratified an amendment to the Media Law that increases the legal liability of editors and publishers. Furthermore, a new draft religion law was presented to the Kazakh parliament at the end of November without public consultation. If passed, it would seriously curtail the ability of individuals and groups to practice their religious faith freely.   Uzbekistan is a wholesale violator of human rights. President Karimov allows no opposition parties, permits no independent media, and has refused even to register independent human rights monitoring groups. Elections in Uzbekistan have been a farce and the Organization for Security and Cooperation in Europe (OSCE) rightly refused to observe the last presidential “contest,” in which Karimov's “rival” proclaimed that he was planning to vote for the incumbent.   In one respect, however, Karimov is not lacking, brazen gall. Last week, on the eve of Secretary Powell's arrival in Tashkent, Uzbek authorities announced plans to hold a referendum next month on extending Karimov's tenure in office from five years to seven. Some members of the tightly controlled parliament urged that he be made “president for life.” The timing of the announcement could have had only one purpose: to embarrass our Secretary of State and to show the United States that Islam Karimov will not be cowed by OSCE commitments on democracy and the need to hold free and fair elections.   I am also greatly alarmed by the Uzbek Government's imprisonment of thousands of Muslims, allegedly for participating in extremist Islamic groups, but who are probably “guilty” of the “crime” of attending non-government approved mosques. The number of people jailed on such dubious grounds is estimated to be between 5,000 and 10,000, according to Uzbek and international human rights organizations. While I do not dismiss Uzbek government claims about the seriousness of the religion-based insurgency, I cannot condone imprisonment of people based on mere suspicion of religious piety. As U.S. Government officials have been arguing for years, this policy of the Uzbek Government also seems counterproductive to its stated goal of eliminating terrorists. Casting the net too broadly and jailing innocent people will only inflame individuals never affiliated with any terrorist cell.   In addition, Uzbekistan has not only violated individual rights, but has also implemented policies that affect religious groups. For example, the Uzbek Government has consistently used its religion law to frustrate the ability of religious groups to register, placing them in a “Catch-22". By inhibiting registration, the Uzbek Government can harass and imprison individuals for attending unregistered religious meetings, as well as deny property purchases and formal education opportunities. As you can see, Mr. Speaker, Uzbekistan's record on human rights, democratization and religious freedom is unacceptable.   I am not aware that Kyrgyzstan's President Askar Akaev has been invited to Washington, but I would not be too surprised to learn of an impending visit. Once the most democratic state in Central Asia, Kyrgyzstan has gone the way of its neighbors, with rigged elections, media crackdowns and repression of opposition parties. At a Helsinki Commission hearing I chaired last week on democratization and human rights in Kyrgyzstan, we heard from the wife of Felix Kulov, Kyrgyzstan's leading opposition figure, who has been behind bars since January 2001. Amnesty International and many other human rights groups consider him a political prisoner, jailed because he dared to try to run against President Akaev. Almost all opposition and independent newspapers which have sought to expose high-level corruption have been sued into bankruptcy.   With respect to the proposed religion law the Kyrgyz Parliament is drafting, which would repeal the current law, significant concerns exist. If the draft law were enacted in its current emanation, it would categorize and prohibit groups based on beliefs alone, as well as allow arbitrary decisions in registering religious groups due to the vague provisions of the draft law. I encourage President Akaev to support a law with strong protections for religious freedom. Implementing the modification suggested by the OSCE Advisory Panel of Experts on Religious Freedom would ensure that the draft religion law meets Kyrgyzstan's OSCE commitments.   Mr. Speaker, this morning I had a meeting with Ambassador Meret Orazov of Turkmenistan and personally raised a number of specific human rights cases. Turkmenistan, the most repressive state in the OSCE space, resembles North Korea: while the people go hungry, megalomaniac President Saparmurat Niyazov builds himself palaces and monuments, and is the object of a Stalin-style cult of personality. No opposition of any kind is allowed, and anyone who dares to express a view counter to Niyazov is arrested. Turkmenistan is the only country in the OSCE region where places of worship have been destroyed on government orders; in November 1999 the authorities bulldozed a Seventh-Day Adventist Church. Since then, Niyazov has implemented his plans to provide a virtual bible for his benighted countrymen; apparently, he intends to become their spiritual as well as secular guide and president for life.   Turkmenistan has the worst record on religious freedom in the entire 55-nation OSCE. The systematic abuses that occur almost weekly are an abomination to the internationally recognized values which undergird the OSCE. Recent actions by Turkmen security agents against religious groups, including harassment, torture and detention, represent a catastrophic failure by Turkmenistan to uphold its human rights commitments as a participating OSCE State. In addition, last January, Mukhamed Aimuradov, who has been in prison since 1995, and Baptist pastor Shageldy Atakov, imprisoned since 1999, were not included in an amnesty which freed many prisoners. I hope that the Government of Turkmenistan will immediately and unconditionally release them, as well as all other prisoners of conscience.   Rounding out the Central Asian countries, Tajikistan also presents human rights concerns. A report has recently emerged concerning the government's religious affairs agency in the southern Khatlon region, which borders Afghanistan. According to reliable sources, a memorandum from the religious affairs agency expressed concern about “increased activity” by Christian churches in the region, calling for them to be placed under “the most stringent control.” Tajik Christians fear that this statement of intolerance could be a precursor to persecution. Keston News Service reported that law enforcement officials have already begun visiting registered churches and are trying to find formal grounds to close them down. Additionally, city authorities in the capital Dushanbe have cracked down on unregistered mosques.   Mr. Speaker, as the world focuses on Central Asia states with unprecedented energy, I wanted to bring these serious deficiencies in their commitment to human rights and democracy to the attention of my colleagues. All these countries joined the Organization for Security and Cooperation in Europe soon after their independence from the Soviet Union a decade ago. By becoming OSCE participating States, they agreed without reservation to comply with the Helsinki Final Act and all subsequent agreements. These documents cover a wide range of human dimension issues, including clear language on the human right of religious freedom and the right of the individual to profess and practice religion or belief. Unfortunately, as I have highlighted, these countries are failing in their commitment to promote and support human rights, and overall trends in the region are very disturbing.   The goals of fighting terrorism and steadfastly supporting human rights are not dichotomous. It is my hope that the U.S. Government will make issues of human rights and religious freedom paramount in bilateral discussions and public statements concerning the ongoing efforts against terrorism. In this context, the considerable body of OSCE commitments on democracy, human rights and the rule of law should serve as our common standard for our relations with these countries.

  • Helsinki Commission Hearing Examines Situation in Moldova

    By John Finerty CSCE Staff Advisor The United States Helsinki Commission held a hearing on September 25, 2001 to examine the situation in Moldova, with a specific focus on developments in the Transdniestria region and the withdrawal of Russian military forces as well as armaments and ammunition from Moldova. After years of delay and uncertainty, the Russian Government has made considerable progress in removing its armed forces and military equipment from Moldova in accordance with the 1999 Istanbul Declaration of the Organization for Security and Cooperation in Europe (OSCE) and the 1990 Conventional Forces in Europe Treaty (CFE). By mid-November 2001, the Treaty Limited Equipment (heavy weaponry) under the CFE were removed or destroyed. Russian armed forces are to be withdrawn by the end of 2002. Implementation of the agreements has been assisted by a voluntary fund established under the auspices of the OSCE. Russia’s continued military presence in the sovereign nation of Moldova has been an unresolved and contentious issue since the breakup of the Soviet Union, when units of the Soviet 14th Army (now known as the Operative Group of Russian Forces) remained stationed in the Transdniestria region of Moldova. Some elements of the 14th Army assisted the pro-Moscow leadership of Transdniestria to secede from Moldova in 1991-2 and establish an unrecognized political entity known as the Dniestr Moldovan Republic (DMR). The current leadership of the DMR has strenuously protested the recent destruction of tanks and armored combat vehicles, seeking to secure some of the hardware for itself. Testifying at the hearing were Ambassador Steven Pifer, Deputy Assistant Secretary of State of the Bureau of European and Eurasian Affairs; Ambassador Ceslav Ciobanu, Ambassador of the Republic of Moldova to the United States; Dr. Kimmo Kiljunen, Member of the Parliament of Finland and Chairman of the OSCE Parliamentary Assembly's Working Group on Moldova; Ambassador William Hill, Head of the OSCE Mission to Moldova; and Dr. Charles King, Assistant Professor, School of Foreign Service and Department of Government at Georgetown University. Commission Co-Chairman Rep. Christopher H. Smith (R-NJ) chaired the hearing with Commissioners Rep. Joseph R. Pitts (R-PA), Rep. Zach Wamp (R-TN), Rep. Robert B. Aderholt (R-AL) and Rep. Alcee L. Hastings (D-FL) participating. In response to a question by Co-Chairman Smith regarding the logistical and political problems facing troop withdrawal and weapons destruction, Ambassador Pifer replied that the main challenge is political, not logistical. Ambassador Hill added that the Russian Government appears prepared to leave; however, there is much resistance on the part of the Transdniestrian regime, since Tiraspol has relied on Russian troops as a “de facto shield” against attack, whether it would come from Moldova or elsewhere. Ambassador Pifer said the Russian Government is “on a schedule that will bring them down to zero tanks, armored combat vehicles and artillery by the end of the year,” which proved to be the case. He added that the difficult logistical challenges arise in the disposition of ammunition and small arms. According to Ambassador Pifer, the United States and Russia “want to make sure that these are eliminated and do not fall into the wrong hands.” Ambassador Pifer reported that the United States has already contributed $300,000 to the voluntary fund for destruction of equipment, as well as $69 million in financial assistance to Moldova from the Agency for International Development and other agencies. Responding to a question from Commissioner Hastings regarding U.S. assistance, “in the furtherance of Moldova’s involvement in the Stability Pact and in their overall re-development,” Ambassador Pifer pointed to U.S. assistance in helping Moldova integrate into European institutions. He continued that it is important that a “total commitment come from the United States and the European Union together.” Commissioner Pitts raised the possibility that perhaps Moscow is using the withdrawal tactic to gain concessions from the Moldovan Government in terms of the status of Transdniestra. Ambassador Hill described Russia as “deeply divided on this issue.” Most Russians realize that it is important to leave, but others see Transdniestra as part of Russia and thus desire the continued separation from Moldova. Commissioner Aderholt raised the question of the Moldovan Government’s efforts in resolving the Transdniestrian issue. Ambassador Ciobanu testified that the new Moldovan leadership, under President Vladimir Voronin has “resumed the dialogue with the separatist leaders” and “proposed a whole package of measures with a view of granting Transdniestria the status of a broad, regional self-government but preserving the sovereignty and territorial integrity of the Republic of Moldova.” Ambassador Ciobanu expressed dismay that Transdniestrian officials have not responded positively, but rather Transdniestria’s separatist position “became even tougher.” As a result, Ciobanu added, “We have reached the critical limits of possible concessions from our part.” Future concessions must come from Transdniestra and the international community should, according to the Moldovan Ambassador, commit to exerting pressure on the Transdniestrian regime. Dr. Kiljunen described the efforts made by the Working Group on Moldova to facilitate a dialogue between Chisinau and Tiraspol. The current Communist-led government enjoys a stable majority in the parliament and, according to Dr. Kiljunen, has “contributed [to] the solution of this Transdniestrian issue.” Dr. Kiljunen added that Russia should continue to be involved in Transdniestra as part of its “international commitments” to create stability in the region. With a more pessimistic view of the Transdniestrian conundrum, Dr. King suggested the current approach of the OSCE and the international community may have run its course. For the past ten years, he noted, “the people of Transdniestria have gone about, with the support of the Russian Federation, building something like a functioning state.” In fact, the last ten years have “strengthened Transdniestrian statehood,” instead of working towards reunification with Moldova. Today it is increasingly difficult to reintegrate these two societies because “they are fundamentally separate now.” The so-called Dniestr Moldovan Republic has solidified its position, and it may be too late for the type of resolution typically envisioned by the international community. Commissioner Wamp asked if the Moldovan Government provided for basic freedoms, including movement, religion, and elections. Dr. King responded that Moldova has made remarkable progress in “implementing freedoms across the board.” Freedom of movement, in particular, is relatively easy for average Moldovans; however, the Transdniestrian authorities have frequently obstructed freedom of movement across the border for Moldovan officials. Ambassador Hill suggested one problem in Moldova is not freedom of religion, but rather politicalization of the Orthodox Church. The European Court in Strasbourg is currently examining a suit against the Moldovan Government for not registering the Bessarabian Orthodox Church which sees itself as the legal successor to the pre-war Romanian Orthodox Church in Moldova. With respect to elections in Moldova, Dr. Kiljunen stated they have been free and fair. However, not all adults in the Transdniestra region were able to vote. “It was only a token, a small token...who really voted.” In addition, there have been parliamentary elections in Transdniestra itself. Because these elections were not observed, it is not known how fair and democratic they have been. Co-Chairman Smith noted Moldova’s status as a major source of trafficked women to Europe and inquired about the Moldovan Government’s response. Ambassador Pifer noted that the Moldovan Government has become more aware of the problem, and has begun to change some of its domestic legislation to include harsher penalties for trafficking. To help the women, Moldova has established a women’s crisis hotline center. Pifer said Moldova is attempting to recognize trafficked women as victims, not as prostitutes. Ambassador Ciobanu elaborated that Moldova has established a special governmental commission to deal with this issue.   • Fighting the Scourge of Trafficking in Women and Children

    Mr. Speaker, tonight I want to highlight our nation's efforts to fight, and hopefully end, the scourge of trafficking in women and children. Earlier today, International Relations Committee held an important hearing on the implementation of anti-trafficking legislation I authored, and which was signed into law last Congress.   As the Prime Sponsor of the Trafficking Victims Protection Act, H.R. 3244, I was pleased that our legislation attracted unanimous bipartisan support in both Houses of Congress, and was signed into law just over one year ago. We succeeded not only because this legislation is pro-woman, pro-child, pro-human rights, pro-family values, and anti-crime, but also because it addresses a horrendous problem that cries out for a comprehensive solution.   Each year as many as two million innocent victims, of whom the overwhelming majority are women and children, are brought by force and/or fraud into the international commercial sex industry and other forms of modern-day slavery. The Act was necessary because previous efforts by the United States government, international organizations, and others to stop this brutal practice had proved unsuccessful. Indeed, all the evidence suggests that the most severe forms of trafficking in persons are far more widespread than they were just a few years ago.   My legislation was designed to give our government the tools we believed it needed to eliminate slavery, and particularly sex slavery. The central principle behind the Trafficking Victims Protection Act is that criminals who knowingly operate enterprises that profit from sex acts involving persons who have been brought across international boundaries for such purposes by force or fraud, or who force human beings into slavery, should receive punishment commensurate with the penalties for kidnapping and forcible rape. This would be not only a just punishment, but also a powerful deterrent. And the logical corollary of this principle is that we need to treat victims of these terrible crimes as victims, who desperately need our help, compassion, and protection.   As the implementation of this important legislation moves forward, success will depend, in large part, on the development of a large coalition of citizen organizations that are out there on the streets helping these victims day in and day out. The problem is simply too big for any one, or even several, governments to tackle alone.   That is why I am so pleased to learn that outside advocacy and relief organizations are continuing to join the fight against human trafficking. Father Stan DeBoe, with the Conference of Major Superiors of Men, CMSM, is one such civic leader who deserves special recognition of his efforts, and the efforts of the CMSM. The CMSM, for those who are unfamiliar with their work, serves as the leadership of the Catholic orders and congregation of the 20,000 vowed religious priests and brothers of the United States. The CMSM is the voice of these Catholic priests and brothers in the U.S., and also collaborates with the U.S. bishops and other Catholic organizations which serve the Church, and our society. I have included, as part of the Record, a recent resolution jointly adopted by the CMSM and the Leadership Conference of Women Religious, LCWR, on August 26 during a conference in Baltimore, Maryland.   Like all laws, however, this law is only as good as its implementation. And, frankly, I have been deeply concerned at the slow pace of implamentation of the Trafficking Victims Protection Act. A year after enactment of this legislation, the State Department office, which is designed to be the nerve center of our diplomatic efforts to engage foreign governments in the war against trafficking, has only recently begun to get up and running. No regulations have yet been issued which will allow victims to apply for the visas provided by the Act. And many other important tasks remain undone.   I do not say this to complain or criticize. I know that many things move too slowly in the first year of a new Administration, and that since September 11 our attention and resources have been diverted elsewhere, but to emphasize that from now on, we do not have a minute to spare.   I should also say that I am profoundly encouraged by the fact that the Administration has been able to recruit Dr. Laura Lederer to bring her expertise and commitment to the State Department's anti-trafficking effort. Dr. Lederer is generally regarded as the world's leading expert on the pathology of human trafficking, and the Protection Project which she headed has provided the factual and analytical basis for most of the work that has been done so far to combat human trafficking. Throughout the long process of consideration and enactment of the Trafficking Victims Protection Act, Laura was our mentor and our comrade-in-arms. I commend Under Secretary Dobriansky, for this important choice.   Finally, I want to emphasize the principles behind the Trafficking Victims Protection Act. I take second place to none in my commitment to workers' rights, but this is not a labor law and it is not an immigration law, it is a comprehensive attack on human slavery, and especially sex slavery. It emphatically rejects the principle that commercial sex should be regarded as legitimate form of “work.”   I know that a number of officials in the previous Administration disagreed with the approach we took in this bill, and that many of these officials are career employees who still work in the government, but the Trafficking Victims Protection Act is the law of the land, and we now have a President who has made clear that he agrees with us on this fundamental question. So I hope and trust that in implementing the law, in making grants, in staffing offices and working groups, in seeking partners and advisors in this important effort, this Administration will rely on people who fully support the law they are implementing, rather than on those who never liked it and who may seek to evade or ignore some of its most important provisions.   What we need to make this law work are “true believers” who will spare no effort to mobilize the resources and the prestige of the United States government to implement this important Act and shut down this terrible industry, which routinely and grossly violates the most fundamental human rights of the world's most vulnerable people.   Resolution Opposing Trafficking in Women and Children: STATEMENT OF RESOLUTION LCWR and CMSM stand in support of human rights by opposing trafficking of women and children for purposes of sexual exploitation and forced labor, and will educate others regarding the magnitude, causes, and consequences of this abuse.   RATIONALE 1. At their May 2001 plenary session in Rome, the International Union of Superiors General, leaders of more than 780 congregations of women religious having a total membership of one million, endorsed a resolution opposing the abuse of women and children, with particular sensitivity to the trafficking and sexual exploitation of women. UISG resolved that this issue be addressed from a contemplative stance as an expression of a fully incarnated feminine spirituality in solidarity with women all over the world.   2. An LCWR goal is to work for a just world order by using our corporate voice and influence in solidarity with people who experience poverty, racism, powerlessness or any other form of violence or oppression. A CMSM goal is to provide a corporate influence in church and society.   3. The Platform for Action of the UN Fourth World Conference on Women held in Beijing, 1995, included the strategic objective to eliminate trafficking in women and assist victims of violence due to prostitution and trafficking.   4. Each year between 700,000 and 2 million women and children are trafficked across international borders, with more than 50,000 women trafficked into the U.S. (UISG papers) CALL FOR SPECIFIC ACTION   1. Deepen our understanding of the realities of trafficking and its integral relationship with poverty, male dominance, and the globalization of trade.   2. Join with UISG as they call for specific days of international prayer, contemplation, and fasting to unite religious in prayer throughout the world.   3. Encourage education about trafficking, prostitution, and workplace slavery in sponsored schools, colleges, and universities and in adult educational ministries.   4. If feasible, collaborate in applying for federal funds from the Department of Health and Human Services in implementation of HR 3244 to provide services to victims of trafficking.   The Conference of Major Superiors of Men (CMSM) serves the leadership of the Catholic orders and congregations of the 20,000 vowed religious priests and brothers of the United States, ten percent of whom are foreign missionaries. CMSM provides a voice for these communities in the U.S. church and society. CMSM also collaborates with the U.S. bishops and other key groups and organizations that serve church and society.   The Leadership Conference of Women Religious (LCWR) has approximately 1,000 members who are the elected leaders of their religious orders, representing 81,000 Catholic sisters in the United States.   • Helsinki Commission Examines U.S. Policy toward the OSCE

    By Erika B. Schlager, CSCE Counsel for International Law On October 3, the Helsinki Commission held a hearing on "U.S. Policy toward the OSCE." Originally scheduled for September 12, the hearing was postponed after the September 11 terrorist attacks. This hearing was convened to examine U.S. priorities and human rights concerns in the OSCE region; how the OSCE can serve to advance those goals and address human rights violations; the pros and cons of the institutionalization and bureaucratization of the OSCE and field activities; and the openness and transparency of the Helsinki process. Helsinki Commission Chairman Senator Ben Nighthorse Campbell (R-CO), Commissioners Rep. Benjamin L. Cardin (D-MD), and Rep. Robert B. Aderholt (R-AL) heard from four witnesses: A. Elizabeth Jones, Assistant Secretary of State for European Affairs; Lorne W. Craner, Assistant Secretary of State for Democracy, Human Rights, and Labor (who has since been formally appointed by the President as one of the three executive-branch Commissioners); Ambassador Robert Barry, former Head of OSCE Mission to Bosnia-Herzegovina; and P. Terrence Hopmann, professor of political science at Brown University and research director of the Program on Global Security at the Thomas J. Watson Jr. Institute for International Studies. Catherine Fitzpatrick, Executive Director of the International League for Human Rights, had agreed to participate in the hearing as originally scheduled for September 12, but was unable to attend on October 3. In her prepared statement, Assistant Secretary Jones described the OSCE as an important tool for advancing U.S. national interests “by promoting democracy, respect for human rights and fundamental freedoms, arms control and confidence building measures, economic progress, and responsible or sustainable environmental policies.” While portraying the OSCE as “the primary instrument for early warning, conflict prevention, crisis management, and post-conflict rehabilitation in [the] region,” she also argued that “it is not the forum for discussion or decision regarding all security issues” – a role implicitly reserved for NATO. Jones alluded to a possible role for the OSCE in combating terrorism, an issue that will be taken up at the OSCE Ministerial, scheduled for December 3 and 4 in Bucharest. In this connection, Chairman Campbell urged the State Department to pursue an OSCE meeting of Ministers of Justice and Interior as a step toward promoting practical cooperation in fighting corruption and organized crimes, major sources of financing for terrorist groups. Assistant Secretary Craner tackled an issue of key concern to human rights groups: would the war against terrorism erode efforts to promote democracy and human rights, particularly with respect to Central Asian countries that are now key U.S. allies in that war? Craner observed that “[s]ome people have expressed concern that, as a result of the September 11 attack on America, the Administration will abandon human rights. I welcome this hearing today to say boldly and firmly that this is not the case. Human rights and democracy are central to this Administration’s efforts, and are even more essential today than they were before September 11th. They remain in our national interest in promoting a stable and democratic world. We cannot win a war against terrorism by stopping our work on the universal observance of human rights. To do so would be merely to set the stage for a resurgence of terrorism in another generation.” The testimony of the two expert witnesses, Professor Hopmann and Ambassador Barry, examined the operational side of the OSCE, with particular focus on the field work of the institution. Hopmann, one of a small number of analysts in the United States who has written in depth about the work of the OSCE and who served as a public member on the U.S. Delegation to the OSCE Review Conference in Istanbul in 1999, offered several specific recommendations: 1) enhance the professional qualifications and training of its mission and support staff; 2) strengthen its capacity to mediate serious conflicts that appear to be on the brink of violence or that have become frozen in the aftermath of violence, including making better use of ‘eminent persons’ to assist these efforts; and 3) attract more active support from its major participating States, especially from the United States, to strengthen the OSCE's capacity to intervene early in potentially violent conflicts when diplomacy still has a chance to win out over force. Ambassador Barry drew on his experience as head of one of the OSCE’s largest missions to address the complex issue of the OSCE’s relations with other international organizations. Barry asserted that OSCE has, at times, “bitten off more than it can chew” and the United States needs to exercise discretion in assigning tasks to the OSCE. When asked specifically to describe the relationship between the OSCE and the Council of Europe, he characterized it as “permanent struggle.” He suggested that the two organizations should not compete with other, but play to their relative strengths: the OSCE, for example, should be dominant in field missions, while the Council of Europe should be given the lead in providing expert advice on legislative drafting. One area where the OSCE is underutilized is in the area of policing – the focus of a Commission hearing held on September 5, 2001. Barry remarked, “Last month several witnesses testified before the Commission concerning the OSCE role in police training and executive policing. With its requirement of universality, the [United Nations] must call upon police who are unable or unwilling to deal with terrorism or human rights violations at home. We cannot expect them to be much help, for example, in dealing with mujahedin fighters in Bosnia or Macedonia. Therefore I believe the OSCE ought to be the instrument of choice for both police training and executive policing. In order to fill the latter role the OSCE should change its policy on arming executive police. Unarmed international police have no leverage in societies where every taxi driver packs a gun.” Barry also argued that the United States needs to involve the Russian Federation more closely with OSCE. “Too often in the past,” he said, “we have marginalized Russia by making decisions in NATO and then asking OSCE to implement the decisions. Macedonia is only the most recent example.” Many of the questions raised by Commissioners focused on institutional issues such as the transparency of the weekly Permanent Council meetings in Vienna, the respective roles of the Chair-in-Office and Secretary General and pressure to enlarge the OSCE’s bureaucracy by establishing new high-level positions to address whatever is, at the moment, topical. State Department witnesses were asked several questions relating to specific countries where human rights issues are of particular concern, including Turkmenistan, a country whose human rights performance is so poor that some have suggested it should be suspended from the OSCE, and Azerbaijan, a country engaged in a significant crackdown against the media. Assistant Secretary Jones argued that, when faced with an absence of political will to implement OSCE human dimension commitments, it is necessary to “persevere” and to hold OSCE participating States accountable for their actions. Noting that the death penalty is the human rights issue most frequently raised with the United States, Commissioner Cardin asked Assistant Secretary Craner how the United States responds to this criticism and whether the use of capital punishment in the United States impacts our effectiveness. Craner noted that the death penalty in the United States is supported by the majority of Americans, in a democratic system, and that the quality of the U.S. judicial system ensures its fairness. He also argued that it does not affect the credibility of the United States on human rights issues. Professor Hopmann, however, disagreed with this assertion. Based on extensive contacts with European delegates to the OSCE in Vienna, Hopmann observed that Europeans find it difficult to reconcile the U.S. advocacy on human rights issues with a practice Europeans view as a human rights violation. Chairman Campbell recommended that similar hearings be convened on a periodic basis to update Congress and the American people on the ongoing work of the OSCE and how it advances U.S. interests across the spectrum of the security, economic, and human dimensions.
