The State of Diversity and Inclusion in Europe
Wednesday, September 11, 2019The U.S. Helsinki Commission convened the hearing, “The State of Diversity and Inclusion in Europe: Race, Rights, and Politics” one week ahead of the OSCE’s annual Human Dimension Implementation Meeting (HDIM), which included a focus on hate crimes and Roma populations, and the European Union’s first ever Anti-Racism and Diversity Week held in the European Parliament. Helsinki Commissioner Representative Gwen Moore (WI-04) chaired the hearing and was joined by Helsinki Commissioners: Chairman Alcee L. Hastings (FL-20), Rep. Steve Cohen (TN-09), Rep. Emanuel Cleaver, II (MO-05), and Rep. Marc Veasey (TX-33). Against the backdrop of recent European elections that included numerous xenophobic political parties, Chairman Hastings highlighted the importance of the hearing given the rise in prejudice and xenophobic violence in both Europe and in the United States including from far-right extremists. Rep. Moore reiterated the necessity of the hearing given “numerous reports from Europe of hate crimes and acts of extremism, racial profiling in cities and at borders, and discrimination at work and in the schools, with the OSCE reporting close to 6,000 hate crimes in the region over the last year, and a recent European parliamentary study concluding that people from ethnic or racial minorities in the EU experience higher risks of economic hardship, poorer-quality housing, residential segregation, unemployment, and assault.” She also raised concerns regarding Americans being impacted by disparate treatment and related violence in Europe, following reports that U.S. military personnel and diplomats serving in Europe, students studying abroad, and tourists have been the targets of discrimination, including hate crimes. Panel 1 The first panel consisted of Members of the European Parliament who lead the Anti-Racism and Diversity Intergroup: MEP Romeo Franz (Germany), MEP Dr. Pierrette Herzberger-Fofana (Germany), MEP Evin Incir (Sweden), MEP Samira Rafaela (Netherlands), and Coordinator Alfiaz Vaiya of the Intergroup. MEP Dr. Herzberger-Fofana described how Afro-German victims are often excluded from the discourse on Nazis and the Holocaust, and the need for recognition and restitution, stating, “We owe more to our ancestors than to allow their memories and sacrifices to be erased from the common conscious.” MEP Franz stated that despite the adoption of anti-discrimination legislation by all EU states, 80 percent of the Roma community lives below their respective country’s poverty line due to anti-gypsyism and institutionalized racism. “Europe was based on that fundamental belief that all people are born equal, regardless the color of the skin, religion, or ethnicity. And that is what must be defended and promoted by its leaders,” said MEP Franz. MEP Incir called for those who believe in equal, democratic societies to stand together to counter global nationalist movements being led by right-wing extremist organizations, while MEP Rafaela discussed the importance of representative politics in preserving democracies and the need to address current tensions in the transatlantic relationship. Mr. Vaiya concluded the first panel, stating, “In a majority of the 28 [EU] member states, we see far-right political parties in government [and] working with the current U.S. administration and other far-right political parties and leaders across the world.” Mr. Vaiya went on to say, “Jewish people, whether it’s Muslims, whether it’s LGBTI people, whether it’s people who are Roma or black […] The shared threat is the same. It’s the populism, it’s the racism, it’s the fascism. It may be specific to each individual community, but we have to understand that threat is together.” Panel 2 The second panel consisted of Councilor Irene Appiah (Hamburg, Germany), Vice-Chair Domenica Ghidei Biidu (Netherlands) of the European Commission Against Racism and Intolerance (ECRI), and MPs Olivier Serva and Daniele Obono (France). Vice-Chair Biidu recognized the U.S. as a partner and peer in combating racism and intolerance and urged the U.S. to engage in counter-populistic rhetoric and hate speech, foster constructive and peaceful relationships with Muslim countries and between Muslim countries and Israel, assist in the fight against anti-Semitism, safeguard irregular migrants, and seek observer status in the plenary meeting of ECRI. Remarking on the vibrant Afro-descent population in Germany, Councilor Appiah called for Germany and other countries to provide statistical data on minorities and the African diaspora to assist in the fight against racism. In discussing French diversity resulting from colonialism and African enslavement, MP Obono highlighted the need for statistics on race to address continuing racial disparities. In addressing continuing disparities between French territories in the Caribbean and France, MP Serva called for teaching of the history of slavery in the French overseas territories, increasing minorities in French media, equality data, and addressing brain drain in the territories. Other points discussed included complacency from both left and right parties in protecting western democracies, Russian exploitation of societal divisions, including utilizing racial prejudice, to disrupt democracy, and the need to strengthen efforts to address online hate while protecting free speech. Witnesses also participated in meetings and other events during the week, such as the Transatlantic Minority Political Leadership Conference.

Hastings and Wicker Condemn Police Crackdown on Russian Pro-Democracy Protesters and Opposition Leader Alexei Navalny
Tuesday, July 30, 2019WASHINGTON—Following violent police crackdowns on protesters during a weekend of pro-democratic demonstrations in Moscow, as well as the arrest of Russian opposition leader Alexei Navalny days before the protest and his subsequent hospitalization, Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) and Co-Chairman Sen. Roger Wicker (MS) issued the following statement: “We condemn the extraordinary use of force by riot police against peaceful protesters in Moscow seeking a free and fair electoral process. Ahead of the upcoming September 8 municipal elections, we hope that the citizens of Russia will be able to exercise their rights to participate freely in the democratic process, including voicing their opinion about the transparency of the system of voting and nomination of candidates. “We also are concerned about the health of opposition leader Alexei Navalny, who was arrested on Wednesday, July 24, and subsequently hospitalized following an unknown ‘allergic reaction.’ We will be monitoring the situation closely.” Last weekend, thousands of Russian people took to the streets of Moscow to protest the exclusion of several opposition candidates from the ballot for upcoming City Duma municipal elections on September 8. On July 24, Russian opposition leader Alexei Navalny was arrested, reportedly for his plans to lead the protests. On Sunday, July 28, Navalny’s spokeswoman Kira Yarmysh announced that Navalny suddenly had been hospitalized while in government custody.

FIRST PERSON: UKRAINIAN PARLIAMENTARY ELECTIONS
Monday, July 29, 2019By Alex Tiersky, Senior Policy Advisor, Global Security and Political-Military Affairs “Why aren’t you doing your job?!” An unexpectedly tense early morning on July 21, 2019—Election Day in Ukraine: the polling station was more than 30 minutes late in opening. The shouted reprimand came from a voter, an older man who was one of several Kyiv residents who had been present and seeking to vote at this school in the center of the Ukrainian capital since well before 8:00 a.m., when the polls for the national parliamentary elections were supposed to open. His indignation was directed at the beleaguered leadership of the local polling station, who struggled to organize their work and follow the extensive procedures required to meet Ukrainian law and international best practices. *** As an official election observer representing the OSCE Parliamentary Assembly, I was at the polling station to observe the extent to which those best practices were followed. With my capable interpreter Natalya beside me, and in partnership with my experienced observation team partner Latvian MP Aleksandrs Kiršteins, I had arrived days earlier on the invitation of the Ukrainian government for a series of preparatory briefings. On Election Day, we would follow a prescribed plan of observation as part of a larger team of more than 800 international observers spread across Ukraine (with the exception of illegally occupied Crimea, and the Donbas region under the occupation of Russian-controlled forces, where holding a free and fair election would be impossible). *** The disorganized polling station was the first stop of the day for our team. While this was my first time serving as an election observer, I didn’t need the extensive and detailed procedural checklist and questionnaire provided by the OSCE to know that something was seriously amiss. My Latvian colleague confirmed, based on his extensive observation experience, that the situation was extremely unusual. The key problem seemed to be that the leadership of the team responsible for proper running of the polling station (the chair and the secretary, among others), recently had been replaced and the newcomers had little experience with their assigned duties. It was clear that they had done precious little preparation to be able to effectively direct the work of their team on Election Day. We had been warned during the extensive pre-election briefings provided by the OSCE that many local election officials across Ukraine had been replaced. The experts were concerned that this loss of institutional memory had the potential to hamper the operations of local electoral bodies—a warning that, in our case, proved prescient. At 8:45 a.m., a full 45 minutes after its scheduled opening time and to the relief of several increasingly agitated voters and local observers, the polling station finally began to process votes. Judging that tensions at the school building had de-escalated and the situation had achieved some normalcy, we dutifully finalized our observation—promptly reporting our findings to the OSCE election experts compiling statistics from other teams deployed across the country—and moved on to observe voting procedures at several other polling stations. Before leaving, given the challenges at the polling station, we resolved to return in the evening to observe closing procedures and the counting of the vote. *** We spent much of the rest of the day visiting several polling stations in the west of Kyiv. Contrary to our first observation, all the other polling stations we visited were extremely well-organized, with experienced and well-functioning teams of officials ensuring an orderly and transparent voting process. The civic pride demonstrated by the election officials and voters in properly exercising their democratic choice was evident in each location we visited. We witnessed voters of all ages casting their ballots in serene conditions, which we learned from other observation teams was largely the norm across Ukraine that day. *** As the afternoon turned to evening, it was time to return to our initial polling station to assess closing procedures and the start of the counting of ballots. With the station closing as planned at 8 p.m. on the dot, we were quietly hopeful that the morning’s problems had been resolved. Our optimism quickly proved misguided. The election officials were even more poorly directed by their leadership than they had been in the early hours of the day. After two hours of inconclusive progress toward beginning a count of actual ballots, the procedures ground to a halt in a cloud of remonstrations among several hard-working poll workers and local observers on one hand, and the polling station’s leadership on the other. In what I understood to be an extremely unusual development, the majority of the poll workers essentially sidelined their grievously underperforming leadership on the spot in order to better organize themselves. At this point, we needed to return to our home base to report on our observation, leaving behind several other international and local observers to witness what surely would be a long and challenging night of tabulation of ballots. *** As we returned to the hotel, I reflected on the day’s remarkable events. It struck me how counterintuitive some might find it that we had been allowed to witness the poor performance by the leadership of this particular polling station. After all, who wants to air their dirty laundry in front of international observers taking careful note of every discrepancy? It was then, for the first time, that I truly understood the key purpose of our election observation mission. OSCE participating States like Ukraine make the choice to invite international observation missions to their elections precisely because only in providing full transparency can a fair judgment on the electoral process be made. In other words, our observation and reporting of the procedural imperfections we witnessed only underlined the relatively excellent performance witnessed by observation teams in the vast majority of other polling stations across Ukraine. Only through the full transparency provided by impartial external observers using a standardized methodology can the people of Ukraine be sure that their electoral process, to the maximum extent possible, allows for the full and fair expression of their democratic choice. I feel honored to have been able to play even a very small part in this extremely consequential democratic process, and to help an OSCE participating State hold itself accountable to its commitment to the rule of law. I am already looking forward to the next opportunity to serve as an election observer.

Truth, Reconciliation, and Healing
Thursday, July 18, 2019Today, many countries seek to address historic wrongs, heal wounds, bridge divisions, and build a shared future. Truth and reconciliation efforts to encourage restitution, reparations, and restorative justice have been called for in many places, including the United States, Western Europe, Canada, and the Balkans, while Holocaust survivors and other victims of Nazi persecution continue to seek justice worldwide. In June, Amsterdam city councilors voted to apologize for the city’s role in the transatlantic slave trade. In April, Belgium’s Prime Minister Charles Michel apologized for the kidnapping of thousands of children born to mixed-race couples during its colonial rule in several African countries. In 2015, Sweden published a historic white paper on abuses and rights violations against Roma in the 20th century. A decade ago, Canada established a reconciliation process in response to the Indian Residential School legacy, which forced First Nation children to attend government-funded boarding schools. On July 18th, 2019, the U.S. Helsinki Commission held a briefing entitled, “Truth, Reconciliation and Healing: Towards a Unified Future,” where expert panelists reviewed lessons learned and discussed ways to heal and reunify societies divided by war, genocide, hierarchal systems of human value, and other tragedies stemming from extreme nationalism, racism, anti-Semitism, and other forms of ethnic and religious discrimination. Speakers addressed official government apologies, truth and reconciliation processes, restitution, reparations, and other policy prescriptions that have been used or are currently being considered to address historic wrongs and unify citizens in countries across Europe and North America. According to Dr. Gail C. Christopher, “this country was built over two and a half centuries with the deeply embedded fallacy of a hierarchy of human value, that some human beings just simply don’t have value.” She continued, “racism, anti-Semitism, religious bias, extremism, xenophobia – they all have their root in this fundamental fallacy of a hierarchy of human value. […] Our country has a history of enslaving people, committing genocide among Indigenous people, and embracing centuries of institutionalized racism [additionally] inequities caused by racism [are] costing our nation almost $2 trillion annually in lost purchasing power, reduced job opportunities, and diminished productivity.” She went on to note that unlike other countries that have endured war, sectarian or racial strife, the United States has never undertaken a comprehensive Truth and Reconciliation Commission (TRC) or other process, undergirding the antiquated belief in a hierarchical separation of races. To address this problem, she discussed her efforts to adapt a truth and reconciliation process across America based upon “truth, racial healing, and transformation.” Ambassador Stuart Eizenstat discussed his work over three U.S. administrations to provide belated justice for victims of the Holocaust and other victims of Nazi tyranny during World War II, as a Special Representative of the President and Secretary of State on Holocaust-era issues. “I’ve negotiated $17 billion in recoveries for Holocaust survivors who suffered under the Nazis. Eight billion as a U.S. government representative under Clinton and Obama administrations and $9 billion as the chief negotiator for the Jewish claims conference in our annual negotiations with Germany,” he stated. The payments covered everything from forced enslaved labor, unpaid insurance policies, to looted works of art including for non-Jews in some cases. His other efforts included a presidential commission on the Holocaust led by Eli Wiesel that led to the creation of the U.S. Holocaust Memorial Museum and $5 billion for a German remembrance foundation. He also described how Jewish refugees were refused entry into some countries, or their assets confiscated and then used to finance Nazi war efforts. Citing the Justice for Uncompensated Holocaust Survivors (JUST) Act, he called for Congress to hold hearings on findings from a report to be released in November 2019 on whether countries have met their commitments under the Terezin Declaration. Former Flemish Christian and Democratic Party (CD&V) Councilwoman Tracy Tansia Bibo spoke in her video testimony about recent efforts to address the horrors of Belgian colonialism from the period of Leopold II through the 1960s where people's hands were cut off when they did not reach their rubber quota, communities and villages burned in response to uprisings and women were raped. As one of the authors of Belgian legislation that led to an apology from the Prime Minister, Councilwoman Bibo described efforts to provide reparations and other means of redress for the kidnapping and forced adoption of close to 20,000 children from former Belgian colonies in Burundi, Congo, and Rwanda. She noted that in addition to the apology, archives had been opened and travel assistance provided to support families in finding one another. With the work of the Belgian government on hold since the last elections, she highlighted continuing efforts towards reconciliation and healing for Belgium and its former colony, including open societal dialogue; recognition of colonization and its modern day-effects; education and knowledge about colonization and racism; and reparations to address social and economic inequities stemming from institutional racism and colonization. “It's hard to talk about reparations,” she said. “Reparations is about fighting racial inequalities created by political systems that in the past were maintained by a privileged group. Hearings to determine exactly what this recovery means are therefore necessary… What if we finance programmes that, for example, aim to provide better health care for the black population who, according to studies, are more affected by certain diseases? What if we eliminate inequality in education by means of targeted programmes? Reparations is about more than handing out cheques to the black population. It is about eliminating inequalities.” Dutch Councilman and ChristienUnie Party Leader Don Ceder shared a European perspective on truth and reconciliation efforts, following his role in passing June 2019 legislation calling for a formal apology for the city of Amsterdam’s role in enslaving close to 600,000 Africans in the colonies and the Netherlands being the largest slave trader between West African and South America in the 17th century. The apology is scheduled to take place July 1, 2020 on the Dutch day of remembering the abolition of slavery also known as Keti Koti - a Surinamese term that means “the chains are broken.” According to Ceder, the effort was a result of seven political parties coming together because, “we see that a formal apology for the shared past is a mature step to a consolidated shared future in Amsterdam [in part because] though slavery has been abolished since 1863 in the Netherlands, the traces remain visible everywhere around the city today.” Amsterdam will join cities such as Liverpool and Charleston and countries such as Benin and Ghana in issuing formal apologies for their participation in racial oppression, in addition to the European Parliament calling for all Member states to apologize for their roles. Ceder recognized that a new narrative may be needed to redefine Amsterdam with the understanding that withholding truth only creates an obstacle to a unified future. Dr. Diane Orentlicher cited numerous lessons learned from her work in Bosnia-Herzegovina. “Experience in many countries has shown that, unless they are adequately addressed, historic wrongs leave deep wounds, whose toxic legacy afflicts not only victims but whole societies. […] Social divisions rooted in wrongs and oppression will not be fixed without an honest reckoning, including a robust acknowledgement and condemnation of the original wrongs and a determination to address their toxic legacies.” Listing “denial” and “silence” as some of the main barriers to societies recovering from tragedy, she stated, “I do not believe Bosnia can become unified in any meaningful sense until public officials and other elites, as well as ordinary citizens, acknowledge the full extent of atrocities committed by members of their in-group and unequivocally condemn their crimes.“ Acknowledging that addressing historic wrongs can be painful, she noted the importance of honesty, bringing people together, courageous and innovative leadership, and persistence.

HELSINKI COMMISSIONERS VISIT HUNGARY

From July 1 to July 3, three members of the U.S. Helsinki Commission visited Hungary as part of a bipartisan delegation led by House Majority Leader Steny H. Hoyer. The delegation included Senator Benjamin L. Cardin, Ranking Senate Commissioner and OSCE Parliamentary Assembly Special Representative on Anti-Semitism, Racism and Intolerance, as well as Commissioners Steve Cohen and Gwen Moore. In addition, the delegation met with the rector of Central European University and the head of Hungary’s Jewish communities. The delegation requested meetings with the Prime Minister, Minister of Foreign Affairs and Speaker of the Hungarian parliament. During the visit, the Members of Congress had an exchange of views with Gergely Gulyás, the Prime Minister’s Chief of Staff, and Zsolt Nemeth, the chair of the Hungarian National Assembly foreign affairs committee. U.S. Ambassador to Hungary David Cornstein welcomed the delegation and accompanied the Members to their meetings, also hearing the diverse concerns raised. The purpose of the visit was to strengthen support for the shared principles of democracy and collective security to which the United States and Hungary have jointly committed and with a view to safeguarding fundamental freedoms, democracy, and the rule of law. In meetings with government officials, the members welcomed the Hungarian parliament’s approval of the Defense Cooperation Agreement on July 2. Following the conclusion of their visit to Hungary, the delegation traveled to Luxembourg to participate in the annual session of the OSCE Parliamentary Assembly. Majority Leader Hoyer served as chair and co-chair of the Helsinki Commission (positions that rotate between the House of Representatives and Senate) from 1985 to 1994. During that critical period of transition before and during the fall of communism, he made Central Europe a focus of the Commission’s efforts to support human rights and democracy. He led delegations to Bulgaria, Czechoslovakia, the German Democratic Republic, Hungary, Poland, and Romania, working closely with Secretaries of State George Schultz, James Baker, and Warren Christopher to advance democracy in the region. He also chaired roughly a dozen hearings focused specifically on human rights in Central Europe, including minority rights and religious liberties. As chairman of the Helsinki Commission, Majority Leader Hoyer participated in the 1989 Paris Meeting of the Conference on the Human Dimension and personally introduced a Helsinki Commission initiative that became a formal U.S. proposal: a call for free and fair elections throughout the OSCE region. Majority Leader Hoyer also represented the United States at the 1991 Moscow Conference on the Human Dimension, a meeting notable for taking place shortly after the August coup attempt in Russia. In his first appearance before Congress, OSCE Representative for Freedom of the Media Harlem Desir will assess the fragile state of media freedom within the OSCE region. Mr. Desir also will address the number of imprisoned media professionals as well as the violence, threats, and intimidation directed toward female journalists. The hearing will explore the threat posed by disinformation and online content designed to provoke violence and hate. Following the hearing, at 5:00 p.m. in Room HVC-200, the Helsinki Commission will host a viewing of the documentary, “A Dark Place,” which details the online harassment of female journalists working in the OSCE region.

Responding to Hate
Tuesday, July 16, 2019In the past year alone, places of worship in Christchurch, Colombo, Pittsburgh, and Poway were targets of hate-based violence, resulting in the tragic loss of more than 300 lives. Effectively countering hate crimes requires a comprehensive effort bringing together government institutions, criminal justice systems, civil society actors, and international organizations. Religious actors and interfaith institutions play an important role in promoting safe and inclusive societies and reducing violence, hostility, and discrimination. The U.S. Helsinki Commission convened a hearing on Tuesday, July 16, 2019 that examined the role of religious actors in responding to hate domestically in the United States and throughout the OSCE region. The hearing, titled “Responding to Hate: The Role of Religious Actors,” focused on how faith-based institutions can promote safe and inclusive societies and reduce violence, hostility, and discrimination. Helsinki Commissioner Rep. Gwen Moore (WI-04) chaired the hearing and was joined by other commissioners including OSCE PA Special Representative on Anti-Semitism, Racism, and Intolerance and Helsinki Commission Ranking Member Sen. Ben Cardin (MD), Rep. Richard Hudson (NC-08), Rep. Sheila Jackson Lee (TX-18), Rep. Brian Fitzpatrick (PA-01), and Rep. Steve Cohen (TN-09). Rep. Moore opened the hearing by stating, “All of us have something to gain from those who look different, pray differently, and may come from a different place. And we must not wait until tragedy strikes, again and again and again, to learn the value of mutual respect. We must seize every opportunity to denounce hate-motivated violence, and in doing so we protect the value of freedom of expression, the hallmark of democracy.” She also paid homage to six Sikh worshippers killed near her district in Oak Creek, Wisconsin seven years ago. In his opening remarks, Sen. Cardin recounted his side event at the 28th Annual Session of the OSCE PA earlier in July, titled, “Countering Hate: Lessons from the Past, Leadership for the Future,” where he called on parliamentarians to act now to prevent a repeat of the past where bigotry and violence resulted in the deaths of millions under Nazi rule. Witnesses at the hearing described how religious actors and interfaith institutions can work together to further human rights and protections for all, domestically and throughout the OSCE region. Witnesses also shared strategies to prevent and respond to hate, ignorance, and violence targeting our societies, including places of worship. Father James Martin shared a video testimony about his response to the Pulse nightclub shooting, which at the time was the largest mass shooting in U.S. history, taking 49 lives. He noted that the LGBT community received an outpouring of love and support the in the aftermath of the tragedy, with the notable exception of the Catholic church. Father Martin said, “Why am I bringing this up? Because when it comes to the role that religious actors and organizations can play in combatting hate crimes, the most effective thing they can do is to get their own houses of worship in order. Racism, sexism, and homophobia still exist in many Christian denominations – my own included.” He ended his testimony by underlining that “the most important thing that religious actors and organizations can do to combat hate crimes is not only to fight the hatred on the outside, but on the inside as well.” Imam Gamal Fouda also testified by video and remarked on New Zealand’s response to the tragic shooting that targeted and killed Muslims at the Al Noor Mosque and Linwood Islamic Centre in Christchurch, where he is the imam. “New Zealand set a good example to the whole world for how to look after your people, how to actually support all your people. And we all stand together against hate, hate speech, and hate crimes,” he said. He said the power of New Zealand was demonstrated in the wake of the Christchurch shooting and called for more education on the strength of diverse and inclusive societies. “We have to stand together looking at the diversity in our communities as something that is strengthening our community,” he said. “It is the secret of the power of our community to see different colors and different languages.” Rabbi Jeffrey Myers, victim, witness, and survivor of the 2018 attack on the Tree of Life Synagogue in Pittsburgh, PA—the worst attack on a synagogue in the history of the United States—stated, “The metaphor of America as a melting pot, is a beautiful image, but sadly, it is not true, [because …we] do not know our neighbors. We live in silos, with no bridges connecting them. Many choose to live in their own private silos, not wanting ‘others’ to enter their silo.” He believes that the key to addressing hate—what he referred to as the “H-word”— is to learn to build bridges. “Some people just don’t know how to build a bridge. This is where religious leaders like me make a difference…I’m a bridge builder. When the Muslim community extended an olive branch to me, I responded by offering an olive tree,” he said. Reverend Aaron Jenkins testified on the power of developing partnerships and relationships across different sectors of society to adequately tackle the issue of hate and hate crimes wherever they occur. He remarked, “Any plan to address hate must engage faith actors within and across their faith traditions in respectful and meaningful ways. We cannot wait until the next hate crime happens.” He stated that partnerships, resources, and relationships were needed to address the problem. Radia Bakkouch spoke about the situation in France and Coexister’s “belief in the concept of ‘faith for good’ and the practice of interfaith cooperation in empowering young people to address violence and exclusion.” She stressed the importance of defending pluralistic societies and highlighted the importance of building coalitions to address the rise in hate-based violence taking place in France and elsewhere in Europe. Usra Ghazi detailed federal hate crimes statistics, highlighting that hate crimes historically and consistently are underreported. This, she said, is partly due to a lack of a standardized reporting processes and “strained relationships between bigotry-impacted communities and law enforcement entities.” Ghazi shared that many members of the Muslim, Arab, and Sikh communities affected by anti-Muslim discrimination, hate, and violence in the United States have opted to keep low profiles rather than report these events. She stressed, “Due to the rise of hate crimes and hate speech against Muslim and Sikh Americans, these communities by necessity have had to organize outreach efforts to humanize themselves while raising cultural and religious literacy among their neighbors and governments.” Ghazi also shared positive examples of how discriminated communities are building their civic health, getting more involved in elections, and running for office at record rates. “We now have Muslim and Sikh mayors of American cities, as well as officials from these faiths in a range of governmental positions. These efforts help to ensure that our cities, counties and states are truly representative of the rich diversity of American communities.” Alina Bricman’s video testimony concluded the hearing. She presented an overview of the first-ever report of Young Jewish Europeans: perceptions and experiences of antisemitism, released July 4, 2019. Findings included that “44 percent of young Jewish Europeans have faced anti-Semitic harassment, that’s almost 1 in 2 Jews; […] and 25 percent identified as too scared to display Jewish-affiliated ornaments or accessories.” To address the problem, Bricman recommended investing in education (such as anti-racist and anti-bias training) that emphasizes the importance and strength of diversity and diverse communities, supporting civil society, and depoliticizing anti-Semitism and racism by having leaders engage responsibly in the public arena where it is not viewed as a left or right issue.

Delegation Led by Co-Chairman Wicker Demonstrates U.S. Commitment to Countering Kremlin Aggression and Preserving Stability in Europe

Roger Wicker (MS) led the largest bipartisan, bicameral U.S. delegation in history to the 2019 OSCE Parliamentary Assembly (OSCE PA) Annual Session in Luxembourg. The participation of 19 members of Congress showed the deep U.S. commitment to European security and to countering Kremlin aggression and anti-democratic trends across the 57-country OSCE region. “The size of our delegation for this Parliamentary Assembly is a clear demonstration of the importance that the Americans place on this institution and its mission,” said Sen. Wicker ahead of the official opening of the event, which brought together approximately 300 parliamentarians from North America, Europe, and Central Asia. Sen. Wicker, who also serves as a vice-president of the OSCE PA, was joined in Luxembourg by House Majority Leader and former Helsinki Commission Chairman Rep. Fourteen of the 16 amendments proposed by the U.S. delegation were adopted, including those holding the Kremlin accountable for the collapse of the Intermediate-Range Nuclear Forces Treaty; criticizing Moscow for abusing INTERPOL diffusions to harass Kremlin critics abroad; expressing concern about the overreliance of European countries on Russia for energy supplies; and seeking to protect those who report hate crimes from retaliation. During the annual session, Sen. Wicker and Rep. Smith co-hosted a presentation to raise awareness and encourage reporting of efforts to entice children into being trafficked. Sen. Cardin, who serves as the OSCE PA Special Representative on Anti-Semitism, Racism and Intolerance, hosted a discussion on best practices to combat hate in society. Prior to attending the annual session, Co-Chairman Wicker convened the first-ever Helsinki Commission hearing held outside of the United States. Countering Hate: Lessons from the Past, Leadership for the Future
Friday, July 05, 2019Today at the 28th Annual Session of the OSCE Parliamentary Assembly in Luxembourg, Helsinki Commission Ranking Member Sen. Ben Cardin hosted a U.S. side event in his capacity as OSCE PA Special Representative on Anti-Semitism, Racism and Intolerance. The event, “Countering Hate: Lessons from the Past, Leadership for the Future,” called for parliamentarians from across the 57 OSCE participating States to adopt an action plan to counter bias and discrimination and foster inclusion. Several members of the U.S. delegation—along with U.S. Ambassador to the OSCE James Gilmore and U.S. Ambassador to Luxembourg Randy Evans—attended the event, where speakers included Dr. Rebecca Erbelding of the U.S. Holocaust Memorial Museum and OSCE parliamentarians Michael Link (Germany), Nahima Lanjri (Belgium), and Lord Alf Dubs (United Kingdom). “We are here today to exchange information on what we are doing in our home countries to address the problem and how we might be able to develop a plan of action to work better together to address the rise in hate-based incidents we have been witnessing across the OSCE region and beyond from Pittsburgh and Poway to Christchurch,” said Sen. Cardin. “It is not only the most vulnerable in our societies whom are in danger when we fail to act, but the very foundations of our democracies.” Dr. Rebecca Erbelding of the U.S. Holocaust Memorial Museum shared a cautionary tale, reminding the audience, “The Holocaust did not appear out of nowhere [and] the Nazi Party was in power in Germany for eight years before mass killing began.” Warning signs in the past were ignored, she stated. “A rise of populist leaders, of simple solutions, of demonizing minorities, of propagandizing hate, of neglecting or ignoring refugee protections, of isolationism, of appeasement—these factors, when taken together, have led to genocide in the past, and not just in Europe. We must [..] work together to prevent genocide in the future.” OSCE parliamentarian and former director of the OSCE Office of Democratic Institutions and Human Rights (ODIHR) Michael Link stressed the need for action, saying that we are witnessing these first alarming signs of hate, but have a choice in whether we will repeat the past. He lauded the success of and need to continue the OSCE’s Words Into Action project funded by the German government to increase education on addressing anti-Semitism, security protections for the Jewish community, and build diverse coalitions across communities against hate. He cautioned that Romani populations should also not be forgotten in the efforts to address the problem. OSCE parliamentarian Nahima Lanjri described rampant discrimination in Belgium’s employment sector and its negative impact on the labor market. Citing the need for increased tools to fight all forms of discrimination that have the negative affect of repressing talents needed for societies to flourish, she called for more disparities data and initiatives that address economic and other forms of discrimination and bias. Lord Dubs, a British parliamentarian who was born in Prague in what was then Czechoslovakia, was one of 669 Jewish children saved by English stockbroker Nicholas Winton, and others, from the Nazis on the Kindertransport. He shared a recent hate post he had received online and stressed the need to address increasing hate in our societies through education, legislation against hate speech and discrimination, and by shifting public opinion that denigrates communities instead of building them up. U.S. House Majority Leader Rep. Steny Hoyer cited the anti-discrimination work of Brian Stevenson and stressed that difference does not make one “less than." Parliamentarian Hedy Fry of Canada noted rising hate crimes in her country amid numerous initiatives addressing disparities and inclusion. U.S. Rep. Gregory Meeks highlighted the importance of Jewish and African-American coalitions in the civil rights movement. Stating that no group should have to fight for their rights alone if we truly espouse democratic values, he said, we all should be joining the Roma in their human rights struggle. U.S. Rep. Val Demings called for the conversation to also include LGBT+ communities, recalling the tragic mass shooting at the Pulse nightclub in her Orlando, Florida district. The sessions concluded with Special Representative Cardin calling for an OSCE Action Plan to address bias and discrimination and foster inclusion and OSCE/ODIHR Advisor Dermana Seta providing an overview of tools currently offered by the OSCE to assist governments in addressing hate crimes and discrimination.

Leading through Change
Friday, July 05, 2019From June 23-29, 2019, 29 young leaders from across Europe and the United States participated in the eighth annual Transatlantic Inclusion Leaders Network (TILN) workshop held in Brussels, Belgium. Hosted by the German Marshall Fund of the United States (GMF) in partnership with the U.S. Helsinki Commission, U.S. State Department, and other stakeholders, TILN brought leaders together to learn from one another, expand their leadership skills, and offer a more inclusive vision for the world. As part of the workshop, TILN leaders joined the German Marshall Fund’s Brussels Forum Young Professionals Summit and engaged with senior U.S. and European officials on issues ranging from BREXIT and trade to migration. As elected officials and civil society leaders under the age of 35, TILN participants focused on tools to strengthen democratic practices in the lead up to elections in Europe and the United States. Ensuring respect and protections for rights across political, cultural, religious, and other differences was a central aspect of discussions. Participants also highlighted the need for increased strategies to address barriers to political participation, including increasing hate speech and physical threats directed towards elected officials and candidates. The importance of inclusive intergenerational workforces and leadership was also raised as a key aspect to ensure economic stability on both sides of the Atlantic and strengthen transatlantic ties. Following the workshop, TILN alumni convened workshops in the Netherlands, Germany, and Italy. The Transatlantic Inclusion Leaders Network (TILN) “inspires, informs, and connects diverse young leaders to excel in elected office and other leadership roles, advance inclusive policies, and engage with transatlantic policymakers.” Participants are from diverse U.S. and European communities, including the Balkans, with a proven commitment to advancing diversity and inclusion best practices in their policymaking and society. Conference on Security and Cooperation in Europe and OSCE Commitments Regarding Freedom of Religion or Belief
Monday, June 24, 2019The 57 participating States of the Organization for Security and Cooperation in Europe have repeatedly committed to recognizing and respecting freedom of religion or belief. The 35 participating States of the Conference on Security and Cooperation in Europe–the forerunner of the OSCE–signed the Helsinki Final Act of 1975, which included: “The participating States will recognize and respect the freedom of the individual to profess and practice, alone or in community with others, religion or belief acting in accordance with the dictates of his own conscience.” The OSCE’s Office of Democratic Institutions and Human Rights has staff dedicated to freedom of religion or belief, led by a senior advisor. ODIHR legal reviews to help participating States comply with their OSCE commitments have included existing law and draft legislation on freedom of religion or belief. ODIHR only conducts such reviews after receiving a formal invitation from a participating State. A panel of OSCE/ODIHR experts on freedom of religion or belief assists OSCE/ODIHR, and the ODIHR director appoints the panel’s 14 members every three years. This compilation, developed by Helsinki Commission staff, covers CSCE/OSCE commitments on freedom of religion or belief in 16 documents from the Final Act to the OSCE Ministerial Council in 2015. It includes the document title, excerpted text, and links to the original document. Participating States have also made commitments relating to discrimination or hate crimes base on religion or belief. Some examples are in “OSCE Human Dimension Commitments: Thematic Compilation.” This Helsinki Commission compilation only includes commitments on freedom of religion or belief. The Commission will update the compilation when new commitments on freedom of religion or belief are made.

Chairman Hastings on Political Crisis in Moldova
Wednesday, June 12, 2019WASHINGTON—In light of the current political crisis unfolding in Moldova, Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) issued the following statement: “I am watching developments in Moldova with concern. Moving the goalpost because one party doesn’t like the outcome of an agreement does not reflect the commitment to democracy we expect to see in an OSCE participating State. I applaud the formation of a democratically legitimate coalition and look forward to supporting the Euro-Atlantic aspirations of the Moldovan people.” National elections in Moldova in late February resulted in a parliament split almost equally between three major parties—the Socialist Party, the Democratic Party, and the ACUM bloc. According to the Moldovan constitution, a new parliament has a maximum of three months after its election is certified to form a government. The Moldovan elections were certified on March 9. For the past three months, the parties negotiated unsuccessfully to form a coalition government. On June 8, just before the deadline for dissolving parliament and calling new elections, last-minute negotiations produced an agreement between the Socialist and ACUM parties. However, the agreement was immediately challenged by the Democratic Party, and the new coalition was declared illegal by Moldova’s Constitutional Court on the grounds that negotiations had exceed the three-month deadline. Most Moldovans thought the three-month deadline would fall on June 9. The Constitutional Court argued that three months means 90 days, making the deadline June 7. The court’s ruling is now under review by the European Commission for Democracy through Law, also known as the Venice Commission of the Council of Europe.

STANDARD FOR JUSTICE: JUNE 10, 2010
Monday, June 10, 2019By Annie Lentz, Kampelman Fellow On June 10, 2010, seven senior Bosnian Serb officials were convicted of war crimes by the United Nations International Criminal Tribunal for the former Yugoslavia (ICTY). This was the largest trial to date held before the ICTY, which uncovered an organized and strategic attack against civilians and UN-protected safe areas in 1995 during the conflict in the Balkans. Bosnian Serb political and military leaders Radovan Karadžić and Ratko Mladic were later convicted of orchestrating the criminal plan. The trial began on August 21, 2006 and continued for 425 days until concluding on September 15, 2009. The inquiry featured testimony from 315 witnesses, with 5,383 exhibits of evidence totaling 87,392 pages. U.S. Helsinki Commission leaders expressed their support for the convictions handed down by the Tribunal, serving justice to those involved in the genocide of about 8,000 ethnic Bosniak men and boys residing in Srebrenica, an enclave in Bosnia and Herzegovina which fell despite U.N. protection. Then-Chairman Sen. Ben Cardin said, “The ethnic cleansing that occurred in Bosnia was orchestrated by individuals who are now finally facing justice for their crimes. Others awaiting trial or who believe they may have escaped prosecution should take this as a sign that they too will answer for their crimes against humanity.” “The wheels of justice may not always turn as fast as victims’ families would like, but the convictions of Vujadin Popovic and Ljubisa Beara show the strength of the International War Crimes Tribunal to hold people to account,” said then-Co-Chairman Rep. Alcee L. Hastings. Following calls from Helsinki Commission leadership and other human rights advocates, the ICTY was established in reaction to the atrocities committed during the decade of conflicts in the former Yugoslavia. It was the first international attempt to hold political leaders accountable for war crimes, crimes against humanity, and genocide since the Nuremburg and Tokyo trials following World War II, and it established that the massacre committed in Srebrenica in July 1995 constituted genocide. Other crimes committed in Croatia, Bosnia and Herzegovina, and Kosovo included mass ethnic cleansing campaigns in which millions were displaced, thousands of women and girls were raped, and many others were detained and tortured. The death toll in Bosnia and Herzegovina alone is believed to have exceeded 100,000 individuals. The ICTY concluded its work in 2017, having indicted 161 individuals in connection to crimes during the conflicts in the Balkans while setting global precedents regarding cases of genocide, crimes against humanity, violations of the laws or customs of war, and grave breaches of the Geneva Conventions. Ninety offenders were sentenced to serve prison time in 14 European states. The Tribunal also set the standard for how such atrocities should be handled to achieve international justice. In December 2017, the Helsinki Commission organized a public briefing to assess the accomplishments of the tribunal and ongoing efforts to pursue justice for atrocities in the Western Balkans.

A New European Parliament – How Will EU-U.S. Relations Change?
Thursday, June 06, 2019By Andrew Carroll, Kampelman Fellow On June 6, 2019, the European Parliament Liaison Office in Washington, D.C, in cooperation with the Delegation of the European Union (EU) to the United States, the U.S. Helsinki Commission, and the EU Congressional Caucus, convened a panel discussion on the May 2019 EU Parliamentary elections, and the future of the EU-U.S. relationship. New EU Ambassador to the U.S. Stavros Lambrinidis opened the event, which was held on the 75th anniversary of D-Day, by reflecting on the heroism and sacrifice of those who helped construct the rules-based system of freedom and order underpinning continued peace and security in Europe. Their contributions, he noted, are directly tied to last month’s European Parliamentary elections, which he hailed as a triumph for democracy following record voter turnout among EU Member States. Dr. Mischa Thompson, Helsinki Commission director of global partnerships, policy, and innovation, delivered remarks on behalf of Helsinki Commission Chairman Rep. Alcee Hastings (FL-20). Chairman Hastings’ statement discussed the symbolism of the 75th Anniversary of D-Day, stating it was a “stark reminder of the power of allied U.S. and European strength in the face of threats to democracy.” His comments also emphasized the close bond the U.S. shares with Europe, highlighting programs such as the Transatlantic Inclusion Leaders Network (TILN), which supports emerging leaders for the long-term prosperity of democracies on both sides of the Atlantic. Three European alumni of the TILN program were elected to the European Parliament in May. In the discussion that followed, moderated by Paul Adamson, Chairman of Forum Europe, panelists Heather Conley of the Center for Strategic and International Studies, Daniel Hamilton of Johns Hopkins University's School of Advanced International Studies, Kathleen McNamara of Georgetown University, and Antoine Ripoll of the European Parliament Liaison Office stressed the enduring importance of the U.S.-EU relationship amidst the changing political landscapes. The panelists stressed security and economic ties, as well as the need to strengthen the relationship between the U.S. Congress and European Parliament on policy matters ranging from trade to counterterrorism and data privacy. Speakers commented on the dramatic increase in voter turnout in the EU’s newest Member States in Central and Eastern Europe. They also noted the new composition of the European Parliament, which not only reflects losses by mainstream political parties, but also the entrance of new players; 60 percent of new MEPs have not previously held office in the body. Discussants later fielded questions on subjects including EU defense integration, trade and investment, and U.S.-EU common policy towards China.

On January 21, Serbia held elections for the 250-seat parliament, the National Assembly. Monitored by more than 300 international observers under OSCE auspices, including two members of the Helsinki Commission staff, the elections were overwhelmingly viewed as being conducted in a free and fair manner. The outcome and related institutional questions, on the other hand, indicate that Serbia’s political development remains burdened by the legacy of the Milosevic regime that ruled for over a decade before being ousted in 2000, even as the country moves in an increasingly democratic direction.
These elections were held in the aftermath of the dissolution of the state-union between Serbia and Montenegro following the latter’s declaration of independence in June 2006. Serbia subsequently adopted a new constitution in October 2006. Looming over these formal developments and new elections, however, is the larger question of Kosovo’s future status. The actual timing of the elections was used as a pretext for delaying a UN recommendation on Kosovo, which is expected shortly.
Based on the conduct of previous elections in Serbia, there was little concern that these elections would fall short of international standards. However, some concerns were raised regarding the conduct of the earlier constitutional referendum, which witnessed a strong, last-minute push of voting in some regions with the apparent purpose of ensuring a positive outcome. The constitution itself is controversial, particularly in its numerous references to Kosovo as an integral part of Serbia, which may have led some segments of Serbian society to boycott the referendum. Undoubtedly, more important international concerns include the uncertain direction of Serbia’s political development and a desire to strengthen Serbia’s democratic institutions.
OSCE Parliamentary Assembly President Goran Lennmarker, a Swedish parliamentarian, was designated by the OSCE Chair-in-Office to lead the short-term election observation mission as Special Coordinator. The OSCE’s Office for Democratic Institutions and Human Rights (ODIHR) conducted a long-term observation effort headed by retired German Ambassador Geert Ahrens.
Perhaps the chief criticism of the election process was the obvious gap between the voter’s choice and the actual selection of the person who ultimately takes a parliamentary seat. The Serbian voter chooses a political party or coalition on the election list, but, once it is determined how many seats a particular party/coalition gets, the party leadership then has ten days in which to select which of the 250 persons on its submitted party list actually take a seat. This method of selecting parliamentarians has been criticized for lacking transparency and effectively concentrating attention not on specific candidates and their views or abilities but on the political party leaders who retain control over their members. This leadership control may be further strengthened by requiring deputies to sign undated letters of resignation which can be used to remove them if they fail to observe party discipline.
On the other hand, efforts were undertaken – albeit not without some opposition -- to modify existing law and encourage minority representation, including lowering the number of signatures for parties representing ethnic minorities from the normal 10,000 to only 3,000 and dropping the threshold needed to enter the parliament from 5 percent of the votes case to 0.4 percent (1/250) of those cast. Two Hungarian and two Romani political parties joined a Bosniak coalition from the Sandzak region and an Albanian coalition from southern Serbia on the election ballot. Albanian participation was the first since 1997, although two Albanian-based political parties which originally joined the coalition subsequently withdrew and supported a boycott of the elections.
The election campaign was long by Serbian standards and quite intense. In contrast to the constitutional referendum campaign, the issue of Kosovo’s status did not dominate campaign rhetoric. Instead, there was considerable and perhaps refreshing discussion of economic issues, for example, reflecting the fact that despite significant economic growth, unemployment remains high. EU enlargement may also increasingly isolate Serbia and its people within the region. Some parties focused more heavily on corruption, property restitution and other economic issues. The democratic and nationalistic range of the dominant Serbian political parties differed on integration mostly in their degree of enthusiasm and differentiation between support for joining the European Union on the one hand and joining NATO on the other. They likewise differed on Kosovo mostly to the degree to which its loss to Serbia was an acknowledged inevitability. Comments by politicians and diplomats from other countries supporting reformist parties late in the campaign prompted cries of interference from more nationalist parties.
Observers monitoring media coverage of the campaign reported a very balanced approach, particularly among the broadcast media, as well as a positive tone indicating almost too much official instruction about how to remain neutral. The print media’s performance was more uneven in its campaign coverage, but low reliance on print media in Serbia made such differentiation of questionable significance.
Election day was largely dry and unseasonably mild, and this contributed to high voter turnout of above 60 percent. This reversed trends toward voter apathy in previous elections. Out-of-country voting also took place for Serbian citizens in 34 other countries. Upon visiting their designated polling station, over 8,500 in all, voters typically encountered a polling board enlarged by political party representation to often as many as 20 to 30 or more members. Nevertheless, with few exceptions the polling was conducted in a professional manner that respected the secrecy of the ballot and made election-day manipulation, if any was intended, difficult to accomplish. The ballot presented the same list of 20 political parties or coalitions to voters across the country, albeit in different languages depending on concentrations of ethnic minorities residing in the area.
Unlike the referendum in which the constitution would either pass or fail, polling board members represented political parties that had no real expectation of an outright victory and merely hoped to achieve or maybe exceed the high end of predictions based on public opinion polls. This likely reduced tension on election day, including during the critical counting of ballots once polls closed, despite significant political differences within polling boards. The Center for Free Elections and Democracy (CeSID), a civic non-governmental organization, helped reduce tension by peppering Serbia with close to 4,000 domestic observers to discourage irregularities.
The day after the election, before final results were announced, the International Election Observation Mission held a press conference to announce its preliminary conclusions. As Special Coordinator, OSCE Parliamentary Assembly President Goran Lennmarker released the joint statement which began with the clear statement that the “parliamentary elections in Serbia were free and fair. They provided a genuine opportunity for the citizens of Serbia to freely choose from a range of political platforms. The 20 lists of political parties and coalitions vigorously competed in an open campaign environment. The election campaign was calm, and checks and balances ensured that the election reflects the will of the people, in line with the OSCE’s Commitments as well as with the Council of Europe standards.” The OSCE’s ODIHR released an additional report of its preliminary findings based on the month-long observation of its 28-member team. Despite the overwhelmingly positive assessment, the Republican Election Commission did cancel results in 14 polling stations due to irregularities.
World reaction to the results focused heavily on the continued support among the Serbian electorate for the Serbian Radical Party (SRS) led by indicted war criminal Vojislav Seselj, which garnered 28.7 percent of the vote, up from 27.6 percent in the last elections in 2003. That, of course, rightly leads to concern about Serbia’s inability to reject the extreme nationalism fostered by the Milosevic regime throughout the 1990s. On the other hand, the Democratic Party (DS) of President Boris Tadic came in second with 22.9 percent of the vote, an increase from 12.6 percent in 2003 and an indication that entrenched nationalist sentiments have not negated strong support for democratic development and integration.
The coalition led by the Democratic Party of Serbia (DSS) of the current Prime Minister, Vojislav Kostunica, gained only 16.7 percent of the vote, compared to 17.7 percent in 2003. The DSS, which bridges the nationalist/democratic divide in Serbian politics, appears to be replaced by the DS as the leading reform-oriented party in Serbia. G17-Plus, which has focused heavily on economic reform, saw its percentage of support drop but retained enough for parliamentary representation, as did the Socialist Party of Serbia (SPS), once led by Slobodan Milosevic. The Liberal Democratic Party (LDP), a newer party led by Cedomir Jovanovic which more completely than any other rejects the Milosevic legacy, crossed the 5 percent threshold by leading a coalitions of like-minded parties. The Serbian Renewal Movement (SPO) of Vuk Draskovic, which traditionally featured prominently in Serbia’s multi-party political history, did not. One Hungarian and two Romani parties, along with the Bosniak and the Albanian coalition, won one or more seats in the National Assembly.
The odds that the SRS will be part of a coalition government appear to be slimmer than one year ago, when that was a major concern. Instead, the hope is for the DS and the DSS to overcome differences to form a new government with the support of other democratic forces, such as the G-17 Plus. Such a coalition could advance Serbia’s integration into the Euro-Atlantic community. Prime Minister Kostunica’s past government relied on SPS support to stay in power, and he has indicated an unwillingness to enter a coalition with the Radicals. Personality conflicts, as well as differences over important issues such as cooperation with the Hague-based International Criminal Tribunal for the Former Yugoslavia (ICTY) and the appropriate response to an expected UN proposal on the status of Kosovo could complicate coalition formation. Most leading Serbian parties have counted on international concern over Serbia’s political direction to delay an expected UN recommendation, but that appears increasingly unlikely.
A proposal on a new status for Kosovo will jolt the Serbian political scene. Many in Serbia feel victimized by the Milosevic regime. They fail to fully appreciate, however, the tremendous damage and suffering inflicted on the neighboring peoples of the former Yugoslavia during the Milosevic era through the commission of war crimes, crimes against humanity and genocide, and a deep distrust resulting from Serbia’s inability to acknowledge that reality. Serbia will not fulfill its democratic promise until it fully comes to terms with this recent history. For that reason full cooperation with The Hague Tribunal remains essential. Over the longer term, democratic forces inside the country should prevail and advance Serbia’s reconciliation with its neighbors and its full integration into Europe, but without a mental break with its past this task will take longer and be more difficult to accomplish.
