OSCE Election Commitments Reaffirmed
Enhancements May Follow

Representatives of the OSCE participating States and a variety of non-governmental organizations met in Vienna, Austria, July 15 and 16 for a Supplementary Human Dimension Meeting on Election Standards and Commitments.  The first of a multi-part process, the meeting was organized by the Office for Democratic Institutions and Human Rights in keeping with the December 2003 Maastricht Ministerial Council Decision on elections.

That decision tasked the ODIHR “to consider ways to improve the effectiveness of its assistance to participating States in following up recommendations made in ODIHR election-observation reports and inform the Permanent Council on progress made in fulfilling th[e] task.”

The decision also tasked “the Permanent Council, drawing on expertise from the ODIHR, to consider the need for additional commitments on elections, supplementing existing ones, and report to the next Ministerial Council.” The next Ministerial Council is scheduled for Sofia, Bulgaria, December 6 and 7, 2004.

However, several days prior to the Vienna meeting, the Permanent Representative of the Russian Federation to the OSCE Permanent Council, Ambassador Alexey N. Borodavkin, delivered an intervention to the Permanent Council presenting a Declaration by some member States of the Commonwealth of Independent States (CIS) “regarding the state of affairs within the OSCE.”  The intervention presented a wide range of sharp criticisms of the OSCE, not the least of which was a supposed inability to “adapt itself to the demands of a changing world and ensure an effective solution of the problems of security and co-operation in the Euro-Atlantic area.” The Declaration went on to accuse the organization of interfering in internal affairs and failing to respect the sovereignty of States.

The OSCE was also accused of applying double standards and failing to take into account the realities and specific features of individual countries. Then Borodavkin laid what many believed to be the groundwork for the approach of countries associated with the Declaration to the SHDM:

These attitudes manifest themselves particularly in the work of the OSCE’s Office for Democratic Institutions and Human Rights (ODIHR), which mainly deals with monitoring and assessment of election results in participating States. This work of the ODIHR is frequently politicized and does not take into account the specific features of individual countries. For that reason, we believe it necessary to draw up standard objective criteria for assessments by the ODIHR and OSCE missions of election processes throughout the OSCE area.

Thus, as the attendees approached Vienna, many were expecting a classic stand-off between a group of former Soviet states, led by the Russian Federation, and at least the United States, if not many members of the European Union, over the role of election observation and the various commitments, especially provisions of the Copenhagen Document.

Hints of Russian dissatisfaction with the OSCE’s democracy promotion activity can be traced back to a terse statement issued by the Ministry of Foreign Affairs of the Russian Federation on August 1, 2000, the 25th anniversary of the Helsinki Final Act.  “Attempts to turn it [OSCE] exclusively into an instrument of ‘democratizing’ individual states will only land the OSCE in an impasse. They are fraught with the danger of a retreat from the Helsinki principles and, in the end, the degradation of the Organization. 

Opening remarks at the Vienna meeting were delivered by Ambassador Ivo Petrov, Chairman of the Permanent Council, and Ambassador Christian Strohal, Director of ODIHR. Strohal mentioned that there might be a need for new commitments to address future challenges regarding referenda, new technology and election standards from outside the OSCE. He thought there might be a need for additional commitments to further universal suffrage, increase transparency, enhance accountability of election and political authorities, and to maintain public confidence in the electoral process.

Alexander Veshnyakov, Chairman of the Central Election Commission of the Russian Federation, gave the initial keynote speech. Those waiting to see if the Russian Federation would continue the line of attack started at the July 8 meeting of the PC were not disappointed. Mr. Veshnyakov quickly pointed out that electoral standards and commitments need to be added to converge “our ideas for the democratic process and help remove possibilities of double standards. The democratic process can be used for anti-democratic means.” He then proceeded to point out that the Copenhagen Document must be fleshed out and rights need to be promoted, agreements since Copenhagen have been diverse and detailed, and despite shortcomings, the OSCE must be given its due for applying these standards.

Veshnykov cited the new “vector” in elections toward European-wide documents on standards in draft form in some twenty Central Election Commissions and that the adoption of the Code of Good Practice in Electoral Matters of the European Commission for Democracy through Law, also known as the Venice Commission, could be the source for a “Copenhagen II.”

Interestingly he lamented the lack of a “binding character” to the existing commitments and felt that making them binding with sanctions for the failure could be useful to help develop common goals.

The main complaint expressed was that each state should know precisely what has been agreed in such commitments: the current commitments are too vague, just a set of guidelines as opposed to standards, and thus have led to the development of double standards in both practice and election observation criteria.

Jean-Pierre Kingsley, the Chief Electoral Officer of Canada, was the second keynote speaker. He addressed several issues of common concern, such as the role of the media, control of money, and public versus private concerns. He contrasted the fundamental tension as between egalitarians and libertarians.

Three sessions were structured to address the key areas of ODIHR’s concerns to fulfill their Maastricht tasking: The OSCE/ODIHR 2003 Progress Report “Existing Commitments for Democratic Elections in OSCE Participating States”; implementation of existing OSCE commitments for democratic elections and follow up on OSCE/ODIHR recommendations; and, identification of possible areas for supplementing the existing OSCE commitments and potential need for additional commitments.

Moderators of the sessions were Steven Wagenseil, First Deputy Director of the ODIHR and Patrick Merloe, Senior Associate and Director of Election Programs, National Democratic Institute for International Affairs. Introducers, who presented the core content of each session in their remarks, were: Mr. Merloe; Professor Christoph Grabenwarter, Substitute Member of the Council on Democratic Elections, Council of Europe; Pentii Väänänen, Deputy Secretary General, OSCE Parliamentary Assembly; Mr. Kingsley; Jessie Pilgrim, Legal Expert; and, Jeno Szep, Advisor, Association of Central and Eastern European Election Officials.

The general thrust of each session was remarkably similar. It quickly became clear that there was a near consensus that while clarification of the details of a few of the existing commitments might be desirable, if not outright necessary, reopening the Copenhagen election commitments to debate was not necessary or desirable. Many delegations restated in various ways that those commitments, and those from all the other OSCE documents that have addressed elections, have created a body of obligations and guidance so fundamental and expansive that there is little new that can or ought to be added. Most interesting was the statement of the European Union that expressed the general opinion:  “If we really need to consider if new commitments are necessary, if so, where?” The European Commission addressed the issue, “We don’t need a Copenhagen II, but maybe a Copenhagen Plus.”

However, a few speakers did mention specific areas of concern, and former Soviet states that are signatories to the aforementioned Declaration made comments of note.

Mr. Merloe saw the possibility to enrich, reinforce and amplify the existing commitments might be forthcoming, possibly at Sofia. He reminded the meeting that those areas critical to all elections are: establishing public confidence in the electorate; establishing universal equal suffrage; transparency at all stages; and, accountability of all authorities.

The opening statement from the U.S. Delegation reiterated these points, emphasizing that elections cannot be assessed solely by examining the technical aspects of voting, and transparency and accountability are absolutely essential components of democratic elections. Regarding the ODIHR election monitoring teams, the United States took the opportunity to underscore that:

[T]he U.S. does not see ODIHR’s election monitoring efforts as “politicized,” but rather as objective and based upon standards set out in the OSCE commitments stipulated in the 1990 Copenhagen Document and the 1991 Moscow Document and reaffirmed in the Charter for European Security adopted at the Istanbul Summit.  Furthermore, the U.S. emphasized that ODIHR monitoring teams should not be seen as “interference in [a country’s] internal affairs,” but rather as an international resource, like the Election Assistance Commission that works domestically in the United States, which is available to countries that seek to improve public confidence in elections and uphold their OSCE commitments.

NGOs from the Russian Federation, Belarus, Uzbekistan, Kyrgyzstan and Ukraine (note: all States that signed the CIS Declaration) uniformly complained that their governments fail to fulfill the existing OSCE commitments.  So why, they asked, would the OSCE need new commitments when governments fail to meet the existing ones?

By contrast, the government representatives of Belarus, Uzbekistan, Tajikistan, Kazakhstan and Armenia (all signatories of the CIS Declaration) complained that the Copenhagen commitments were more like guidelines than standards.  Some said that the commitments should be obligatory instead of voluntary.

Mr. Väänänen pointed out that often when returning to a country a few years after observing elections and providing recommendations for electoral improvements the same problems remain. The attitude of the state leadership and the nature of the problems found are the crux of the problem (numerous comments regarding the need for political will in follow up to observation missions’ recommendations were made throughout the meeting).

Mr. Pilgrim discussed six issues of concern that need to be addressed. Public confidence is critical to the legitimacy of all elections. Electronic voting, which is becoming the norm, must produce a verifiable paper trail. Referenda or recounts must not be used to end or change a term of office as this practice is in direct conflict with the Copenhagen commitments. Observation is necessary to guarantee other criteria. Transparency includes public knowledge about the role of money, i.e. public disclosure of all funding and expenditures is necessary for public confidence. The protection of electoral rights – registration, party regulation, media access, etc. – while assumed, must be actively pursued.

An extensive discussion regarding electronic voting was held. The distinction between voting on an electronic device, such as a touch-screen device, versus E-voting over the Internet was made by Dr. Szep. The need for the electronic device to produce an auditable paper trail seemed universally accepted as a basic standard for use of such systems. However, the German Delegation described the degree of public skepticism and lack of confidence in electronic devices, and “that is why we’re going to stay on paper.” The primary problem with E-voting seems to be the lack of public trust, but there is hope that in time, with the improvement of technology and security software, this will change.

During the closing session, DeForest B. Soaries, Jr., Chairman of the U.S. Election Assistance Commission, expressed the general consensus of the meeting in the U.S. Delegation’s closing statement.  Reiterating that the United States remains as committed as ever to the OSCE commitments laid out in the 1990 Copenhagen Document and in subsequent OSCE documents, he made clear the openness of the United States to ideas on how the OSCE election commitments, and especially their implementation, can be improved. However, he said, there is no need to re-open the Copenhagen commitments as they provide the guidelines and benchmarks necessary to achieve democratic, free, and fair elections.

Mr. Soaries pointed out that the OSCE does not yet have specific commitments related to the participation of internally displaced persons in electoral processes or concerning accountable, balanced, and impartial election administration, and a more systematic mechanism that might be considered for follow up to election observation missions’ recommendations.

Interestingly, the comments from the representatives of countries associated with the Declaration were quite benign and agreeable at the end of the session, emphasizing the forward-looking nature of the meeting.

Ambassador Strohal described the further steps in the process, noting that the ODIHR would be forthcoming with recommendations to the Permanent Council on any changes to the election standards and commitments in preparation for the Ministerial Meeting in Sofia in December. 

The United States Helsinki Commission, an independent federal agency, by law monitors and encourages progress in implementing provisions of the Helsinki Accords. The Commission, created in 1976, is composed of nine Senators, nine Representatives and one official each from the Departments of State, Defense and Commerce.

  • Smith Calls for Action on Worst Refugee Crisis in Europe since WWII

    WASHINGTON—At a hearing convened today by the Commission on Security and Cooperation in Europe, also known as the Helsinki Commission, Chairman Chris Smith (NJ-04) and other lawmakers scrutinized actions being taken to deal with Europe’s largest refugee crisis since World War II by the United States, European governments, regional bodies like the OSCE and the EU, and civil society. The Commission also reviewed recommendations on developing a long-term solution to the crisis. “The European crisis requires a response that is European, national, and international. There must be effective coordination and communication directly between countries as well as through and with entities like the OSCE and European Union,” said Rep. Smith, who called today’s hearing. “There is real human need and desperation. Refugees are entrusting themselves to smugglers and where there is human smuggling there is a higher risk of human trafficking,” he continued. “There is also the real threat that terrorist groups like ISIS will infiltrate these massive movements of people to kill civilians in Europe and beyond. I am deeply concerned that the screening at many European borders is inadequate and putting lives at risk. All of us must be responsive to the humanitarian needs without compromising one iota on security.” Smith said that “given the disproportionate number of men fleeing to Europe and potentially soon to the United States – currently only 14 percent of the refugees and migrants arriving via the Mediterranean Sea are women, 20 percent are children, and the remaining 65 percent are men – robust vetting is essential. We must ensure that lone wolf terrorists don’t turn into wolf packs.” Smith noted that during the conflict in Kosovo, he travelled to Stenkovec refugee camp in Macedonia and was at the McGuire Air Force Base in New Jersey to welcome some of the 4,400 people brought from there to the United States. A refugee – Agron Abdullahu – was apprehended and sent to jail in 2008 for supplying guns and ammunition to the “Fort Dix 5,” a group of terrorists who were also sent to prison for plotting to kill American soldiers at the Fort Dix military installation. Given Secretary Kerry’s announcement in September that the United States intended to resettle at least 85,000 refugees in fiscal year 2016, including at least 10,000 Syrians, and at least 100,000 refugees in fiscal year 2017, “The United State and Europe must be on high alert to weed out terrorists from real refugees,” Smith said. He added, “ISIS has committed genocide, mass atrocities, and war crimes, against Christians and other minorities. Religious and ethnic minorities often have additional risks and vulnerabilities even as refugees and should be prioritized for resettlement.”   Witnesses testifying at the hearing focused on the root causes of the refugee crisis as well as the current measures being put into place to help mitigate the humanitarian impact and ensure that security and economic challenges are addressed. In addition, witnesses emphasized the importance of a shared and coordinated response by all actors involved to ensure a long-term solution to the crisis. “It’s a very challenging situation,” said Anne Richard, Assistant Secretary of State for Population, Refugees, and Migration. “The scale of this migration is much bigger than before.” “The US government has a three-pronged approach: strong levels of humanitarian assistance; active diplomacy; and expanded refugee resettlement,” she continued. “Without our support, more people would be making the dangerous journey to the north.” “Europe is facing its biggest refugee influx in decades. UNHCR is calling upon the European Union to provide an immediate and life-saving response to the thousands of refugees as they are crossing the Mediterranean and making their way through Europe,” said Shelly Pitterman, Regional Representative to the United States and Caribbean, Office of the United Nations High Commissioner for Refugees. “Europe can no longer afford to continue with this fragmented approach that undermines efforts to rebuild responsibility, solidarity and trust among states, and is creating chaos and desperation among thousands of refugee women, men and children. After the many gestures by governments and citizens across Europe to welcome refugees, the focus now needs to be on a robust, joint European response.” “The ongoing refugee crisis is not a European crisis. It is a global crisis, fueled by conflicts, inequality and poverty, the consequences of which unfolded in Europe but the roots of which are far away from our continent,” noted EU Ambassador to the United States David O’Sullivan. “The EU and its Member States are firmly committed to the promotion and protection of the human rights of migrants. Despite the influx, we do not remove or return genuine refugees, we respect the fundamental rights of all persons arriving in the EU, and we invest major resources in saving lives at sea.” Djerdj Matkovic, Ambassador of the Republic of Serbia to the United States, said, “The OSCE region is witnessing the largest refugee influx in decades. Apart from being a significant economic challenge, this is a process with potentially very serious security implications and the cause of concern in regards to the respect for human rights… As the presiding country [of the OSCE] Serbia recognizes the importance of this issue and is trying to provide more active and concrete approach of the OSCE in addressing it. In light of this bleak security situation and looming instability, it is paramount that all the mechanisms that were designed and adopted by the participating States to oversee the implementation of commitments are strong and functioning.” Sean Callahan, chief operating officer of Catholic Relief Services, observed, “As global leaders in international humanitarian and refugee response, the US and Europe must find new and creative ways to help to alleviate this suffering and protect the vulnerable.  Pope Francis has led in this effort to do more by asking every Catholic parish in Europe to reach out and assist the refugees; he reminds us of our moral obligation to help the stranger... Despite efforts by [international NGOs] like CRS, local civil societies, governments, and non-traditional donors, the despair of so many refugees indicates that assistance must move beyond short-term band-aids to longer-term solutions.” Chairman Smith was joined at the hearing by a bipartisan group of lawmakers, including Senator John Boozman (AR), Senator Jeanne Shaheen (NH), Representative Michael Burgess (TX-26), Representative Randy Hultgren (IL-14), and Representative Joe Pitts (PA-16).

  • Europe's Refugee Crisis: How Should the US, EU and OSCE Respond?

    This hearing, held on October 20, 2015, discussed possible responses to the Syrian refugee crisis.  Witnesses, including representatives from the American and Serbian governments, the UNHCR, the European Union, and non-profit groups working with refugees, highlighted the scale and intensity of the crisis.  Many of the witnesses also emphasized the need for cooperation among governments and between governments and non-profit organizations in addressing this crisis.

  • Helsinki Commission Announces Hearing to Examine Europe's Refugee Crisis

    Europe is experiencing an enormous refugee crisis. An estimated half a million migrants and refugees have crossed the Mediterranean to Europe so far in 2015; as many as 50 percent are Syrian refugees.  Thousands more join them each day, and many of the European nations of the Organization for Security and Cooperation in Europe (OSCE) are struggling to cope.

    As the regional security organization in Europe, how can the OSCE use its tools, standards, and commitments to help manage the humanitarian crisis and ensure that security and economic challenges are addressed? What has the US government done, and what should it be doing? The hearing will examine the reasons for the current crisis; relevant OSCE and other European agreements, commitments, and structures; the response of the OSCE, the EU, and the US; potential security issues related to the ability of extremists to infiltrate the refugee stream; and the potential for refugees to become victims of human trafficking.

  • Bipartisan Congressional Delegation Represents US at OSCE Parliamentary Assembly; Also Visits Ukraine, Czech Republic

    Forty years after the signing of the Helsinki Final Act established the precursor to today’s Organization for Security and Cooperation in Europe (OSCE), five members of the Helsinki Commission and four other members of Congress traveled to the OSCE Parliamentary Assembly Annual Session in Helsinki to demonstrate the U.S. commitment to confronting Russian aggression in Ukraine and elsewhere. Led by Commission Co-Chairman Senator Roger F. Wicker (MS), the bicameral, bipartisan delegation organized by the Helsinki Commission included Commission Chairman Representative Chris Smith (NJ- 04); House Commissioners Robert B. Aderholt (AL-04), Steve Cohen (TN-09) and Alan Grayson (FL-09); and Representatives Gwen Moore (WI-04), Michael Fitzpatrick (PA-08), Richard Hudson (NC-08) and Ruben Gallego (AZ-07). Before attending the Annual Session from July 5 to 7, several members of the delegation also visited Ukraine and the Czech Republic. A central concern to the delegation throughout the trip was Russia’s restrictions on democracy at home and aggression in Ukraine, along with Russia’s threat to European security.

  • Chairman Smith and Serbian Foreign Minister Support OSCE Role in Promoting Peace in Ukraine

    WASHINGTON–On February 25, Rep. Chris Smith (NJ-04), Chairman of the Helsinki Commission, held a hearing at which Ivica Dacic, the Foreign Minister of Serbia and Chairman-in-Office of the Organization for Security and Cooperation in Europe (OSCE), testified as to his plans for Serbia’s 2015 leadership of the OSCE. The chief issue facing the organization is Russia’s invasion of Ukraine and the humanitarian needs of the people of eastern Ukraine, including the OSCE’s role in monitoring the Minsk cease-fire agreement. Both Russia and Ukraine are among the 57 member states of the OSCE, the world’s largest regional security organization. Opening the hearing, Chairman Smith said that Foreign Minister Dacic’s leadership of the OSCE “comes at a moment of tragedy, of tremendous human suffering.” Smith emphasized that “one OSCE member – the Russian government – is tearing the heart out of a neighboring member, Ukraine.” “Understanding that the OSCE is a consensus organization – meaning that the Russian government has an effective veto over many significant actions – we believe that the OSCE is still able and responsible to speak the truth about the conflict, to find ways to limit it, and to help the people of Ukraine,” he said. Foreign Minister Dacic emphasized that “the Serbian Chairmanship will make every effort to help restore peace in Ukraine.” In its role as Chairman of the OSCE, Dacic said, “Serbia brings to the table good relations with all the key stakeholders, and we are making every effort to serve as an honest broker and use our leadership role to utilize the OSCE toolbox impartially and transparently.” Foreign Minister Dacic also discussed the fight against human trafficking and anti-Semitism with Chairman Smith.  Other members of the Helsinki Commission participating in the hearing included Senator Ben Cardin, and Congressmen Joe Pitts, Alcee Hastings, and Steve Cohen.

  • Chairman Smith Urges OSCE Leaders: Respond to Humanitarian Needs in Eastern Ukraine

    WASHINGTON—A renewed effort is underway in the Organization for Cooperation for Security and Cooperation in Europe (OSCE) to urge it to respond to humanitarian needs in eastern Ukraine, and to follow through on OSCE commitments to fight human trafficking and anti-Semitism. Rep. Chris Smith (NJ-04) led the U.S. Delegation to the annual Winter Meeting of the OSCE Parliamentary Assembly (OSCE PA) last week in Vienna, where he spearheaded this push. Smith expressed particular concern about the potential for human trafficking of vulnerable groups stemming from the current conflict in Ukraine. In a question to Ivica Dačić, the OSCE’s Chairman-in-Office for 2015 and the Foreign Minister of Serbia, Smith drew attention to the needs of internally displaced persons and the potential for human trafficking in eastern Ukraine. He noted that, among the nearly one million internally displaced persons, woman and children are particularly vulnerable to trafficking, and raised concerns that criminal gangs are taking advantage of the conflict:   “Is the OSCE equipping the special monitoring mission and other OSCE entities working in the Ukraine conflict zone, or with IDPs, to recognize and protect human trafficking victims, and is the OSCE taking trafficking prevention measures for this particular vulnerable population?” At a private meeting during the event, Chairman Smith met with Chairman-in-Office Dačić  to discuss the humanitarian, human rights, and security concerns arising from the Russian-backed conflict in eastern Ukraine. Smith encouraged Serbia to vigorously uphold the commitments made at the at the 10th  anniversary of the OSCE's Berlin Conference on anti-Semitism, and to review and reform the OSCE’s contracting regulations to ensure that OSCE activities do not contribute to trafficking in persons. He also urged Chairman-in-Office Dačić to promote an appropriate commemoration by the OSCE of the 20th anniversary of the Srebrenica genocide. Chairman Smith also met the Director of the OSCE’s Office of Democratic Institutions and Human Rights, Michael Georg Link. In addition to human trafficking and anti-Semitism, the two discussed OSCE election observation missions, as well as the organization’s current efforts to protect freedom of religion. In a meeting with Ambassador Madina Jarbussynova, the OSCE Special Representative and Coordinator for Combating Trafficking in Human Beings, Chairman Smith spoke about the most effective ways to fight human trafficking and assist with the rehabilitation of trafficking victims – including by working with faith-based organizations, as well as by encouraging participating States to adopt legislation preventing child sex tourism, such as Chairman Smith’s legislation currently pending in the U.S. Senate. Chairman Smith has pioneered OSCE engagement in fighting human trafficking and anti-Semitism. Since 2004, he has served as the OSCE PA’s Special Representative on Human Trafficking Issues – click here to read his most recent report. Starting in 2002, Smith led the movement to put anti-Semitism on the agenda of the OSCE, and he continues to work closely with Rabbi Andy Baker, the OSCE’s Representative on Combating Anti-Semitism, to ensure a more vigorous implementation of OSCE commitments in the area. In 2005 Smith authored H. Res. 199, a landmark congressional resolution recognizing the atrocity at Srebrenica in which an estimated 8,000 civilian men and boys were murdered by Serb forces as a genocide.

  • Serbia's Leadership of the OSCE

    In 2015 Europe was faced with a number of security and human rights concerns, especially with regard to Russian aggression in Ukraine. In this hearing, OSCE Chairman-in-Office Ivica Dačić testified to several Commissioners about Serbia's plans for leadership of the OSCE in 2015. He noted that in addition to persistent efforts supporting Ukraine's security and territorial integrity, they would place a special emphasis on strengthening rule of law, freedom of expression, and freedom of the media. Mr. Dačić also emphasized that the active engagement of the United States within the OSCE is critical to the organization's effectiveness.

    WASHINGTON—The Commission on Security and Cooperation in Europe, also known as the Helsinki Commission, today announced the following hearing: “Serbia’s Leadership of the OSCE” Wednesday, February 25, 2015 2:30PM Rayburn House Office Building Room 2200 Serbia’s 2015 Chairmanship-in-Office of the 57-nation Organization for Security and Cooperation in Europe (OSCE) comes at a pivotal point in European security. The OSCE, a regional security organization based known for its work in promoting democracy, human rights, and the rule of law, operates on the front lines of Russia-Ukraine conflict and seeks to counter backsliding on human rights in other countries of the OSCE region.   Serbia’s First Deputy Prime Minister and Minister of Foreign Affairs, H.E. Ivica Dačić, will testify before the Helsinki Commission in his capacity as Chairman-in-Office of the OSCE. He takes the helm to conclude the implementation of a joint leadership plan developed with Switzerland, which chaired the OSCE in 2014. Minister Dačić is expected to discuss the Serbian Chairmanship-in-Office’s priorities, including resolution of the conflict in and around Ukraine; reconciliation and cooperation in the Western Balkans; reforming security sector governance; combating transnational threats, including foreign terrorist fighters, terrorism, and cyber-security; safeguarding journalists; fostering freedom of expression, assembly, and association; combating organized crime and its linkages to human trafficking; combating corruption; and improving water governance. He will also provide insights regarding the ongoing work of the OSCE.

  • Rep. Chris Smith, Sen. Roger Wicker to Lead Helsinki Commission

    WASHINGTON—Rep. Chris Smith (NJ-04) has been appointed by Speaker of the House John Boehner as chairman of the Commission on Security and Cooperation in Europe, also known as the Helsinki Commission, during the 114th Congress. Senator Roger Wicker (MS) has been appointed by Senate Majority Leader Mitch McConnell to co-chair the Commission. “Today, the principles enshrined in the Helsinki Final Act are under attack. The Russian government is blatantly violating the territorial integrity of Ukraine,” said Chairman Smith. “More than 20 million people are trafficked each year for sexual or other forms of exploitation. Journalists in the OSCE region are being imprisoned, tortured, and even murdered for exposing corruption or publishing controversial pieces. In Europe, violent anti-Semitism is again rearing its ugly head, and in some OSCE countries religious people face restrictions and even persecution merely for practicing their faith.” “The United States must advocate much more vigorously for those who are victims and are voiceless. As the chair of the bipartisan, bicameral Helsinki Commission, I look forward to working with my fellow Commissioners to promote human rights and fundamental freedoms and to safeguard the principles shared by the 57 participating States of the OSCE,” said Chairman Smith, who has been an active member of the Helsinki Commission since 1983. “I am pleased to join Chairman Smith and the other members of the Helsinki Commission in defending democratic values and the rule of law,” said Co-Chairman Wicker. “Peace and security are under threat in the wake of escalating Russian aggression – impacting our economic and strategic interests in the region. This situation calls for a unified response from the United States and our OSCE partner countries. We should work together to ensure a safe, free, and prosperous Europe for this generation and those that follow.” Chairman Smith has previously chaired the Commission and serves as a member of the OSCE Parliamentary Assembly (PA), which facilitates inter-parliamentary dialogue among the 57 participating States; he is also the OSCE PA’s Special Representative on Human Trafficking Issues. Senator Wicker also serves as a member of the OSCE PA, where he chairs the Committee on Political Affairs and Security.

  • OSCE Must Act on Anti-Semitism

    Germany, in cooperation with the Swiss Chairmanship of the Organization for Security and Cooperation in Europe (OSCE) and the OSCE Office for Democratic Institutions and Human Rights (ODIHR), held the Berlin Tenth Anniversary Conference on Anti-Semitism on November 12-13, 2014, against the backdrop of the ongoing Ukraine-Russia conflict.   The Conference was set to be a commemorative meeting acknowledging government efforts to combat anti-Semitism over the past decade.  However, the recent rise in anti-Semitic incidents such as those that resulted in deaths in Kansas, Brussels, and Toulouse earlier this year, dictated that the meeting focus on a way forward to address current problems. Although the Conference attracted a notably lower level of attendance than it did a decade earlier, participants identified key opportunities for coalition development and OSCE action in the years to come. The Conference was attended by some 550 participants (including approximately 200 civil society representatives), and featured high-level panelists and speakers including Ambassador Samantha Power, United States Ambassador to the United Nations; Miroslav Lajcák, Slovak Republic Deputy Prime Minister and Minister of Foreign and European Affairs; Lynne Yelich, Minister of State of Canada; Paavo Lipponen, Former Prime Minister of Finland; and Tzachi Hanegbi, Deputy Minister of Foreign Affairs of the State of Israel.

  • Helsinki Commission Chairman Urges Russia to Cease Blatant Violations of OSCE Principles

    WASHINGTON—On the conclusion of the December 4-5 OSCE Ministerial Council in Basel, Switzerland, U.S. Helsinki Commission Chairman Senator Ben Cardin (MD) issued the following statement: “The OSCE Ministerial this year has been exceptional. I welcome the fact that an overwhelming majority of OSCE countries condemned the unlawful occupation of Crimea, defended the sovereignty and territorial integrity of Ukraine, and called for Russia to end its support for violence in eastern Ukraine. Russia’s illegal activities in Ukraine have violated the most fundamental principles of the Helsinki Final Act, on which the OSCE is based. “Moving forward, the OSCE must focus on the implementation of its core commitments. The OSCE PA has spoken to this issue by passing a resolution I introduced in July, calling on Russia to cease its clear, gross, and uncorrected violations of Helsinki principles, not only in Ukraine but regarding other neighbors and at home as well. “Other serious human rights concerns in the OSCE region were spotlighted by the absence of some leading figures from this year’s Ministerial meeting. “While Turkmenistan’s current ambassador to the OSCE addressed his counterparts in Basel, the fate of his predecessor, Batyr Berdiev – as well as some 100 other prisoners – remains unknown. I welcome the Swiss Chairmanship’s efforts to address the issues of torture and enforced disappearances during their chairmanship and call on Turkmenistan to tell the families of Ambassador Berdiev and the other disappeared persons what has happened to their loved ones. “In addition, Rasul Jafarov was prevented from leading a civil society discussion on freedom of expression in Basel. Jafarov remains imprisoned in Azerbaijan in retaliation for his activism. Eldeniz Hajiyev, another human rights activist, was unable to travel to Basel because she is under house arrest in Baku. I commend the 43 OSCE countries which worked to advance an OSCE decision on freedom of expression and urge Azerbaijan to cease its flagrant persecution of independent civil society activists.”

  • Bipartisan U.S. Delegation Defends Ukraine, Raises Concerns about Russia at OSCE Parliamentary Session

    From June 27 to July 3, 2014, a bicameral, bipartisan delegation of eight Members of Congress represented the United States at the annual session of the OSCE’s 57-nation Parliamentary Assembly in Baku, Azerbaijan. The delegation, which was organized by the U.S. Helsinki Commission, also made side visits to Georgia and Moldova. The congressional delegation was led by the Commission Chairman, Senator Ben Cardin (MD), while the Co-Chairman, Representative Chris Smith (NJ-04) was head of delegation at the Assembly session. The Commission’s Ranking Senator, Roger Wicker (MS) and House Commissioners Robert Aderholt (AL-04) and Phil Gingrey (GA-11) also participated, along with Senator Tom Harkin (IA) and Representatives David Schweikert (AZ-06) and Adam Schiff (CA-28). A central concern at the Assembly meeting, as well as during bilateral interaction with the authorities and people of Azerbaijan, Georgia, and Moldova, was Russian Federation’s annexation of Crimea and its incursions into eastern Ukraine. The congressional delegation was highly critical of Moscow’s attempt to reassert its domination over the affairs of its neighbors more than two decades after the Soviet Union’s collapse, and it reassured friends and allies of the deep and continuing commitment of the United States to security and cooperation in Europe and throughout the OSCE region.

  • Statement on Tragic Synagogue Slayings

    Mr. President, I know I express the sentiments and outrage of every Member of this body about the tragic events in Israel this past Tuesday where those in a synagogue were brutally slain. It was a shock to all of us--in a synagogue, in a place of worship, people there praying and studying, and their lives were brutally ended. Let me just mention the victims. Rabbi Moshe Twersky, Rabbi Aryeh Kupinsky, Rabbi Kalman Levine, Avraham Goldberg, and Zidan Saif, a police officer. I particularly want to mention Rabbi Kupinsky because there is a connection here to Maryland. Three of the victims had U.S. citizenship. Rabbi Kupinsky is a cousin of a distinguished constituent, Judge Karen Friedman of Baltimore. So this affects all of us. I know first and foremost our prayers are with the families and we express our deepest sympathy. I also express our resolve to eliminate such extremists and to work with the international community so there is no refuge anywhere in the world--anywhere in the civilized world--for such extremists. Then I would hope we would all recognize and speak out for Israel's right, indeed its obligation, to defend its people from such brutal attacks. The Baltimore Sun said this morning in its editorial there could be no excuse, no explanation, no reason or even plausible justification for the horrific attack on a Jerusalem synagogue Tuesday that left four Rabbis and an Israeli police officer dead. I know we all believe in that statement. There is no justification for such actions. Yet Hamas--and again I would quote from the Sun paper--"Hamas, the militant [extremist] group that controls Gaza, hailed the attack in the synagogue as a blow against Israel's occupation. ..... '' This just points out the difference between Hamas and Israel. I have been on the floor many times talking about Israel's legitimate right to defend itself and Hamas's desire to put innocent people in harm's way. It is our responsibility to speak out. If this event would have happened in the United States, I think we all know what the reaction would have been. So our resolve goes out to the people of Israel that we will stand by them and that we stand by their right to defend themselves. This is in the backdrop of a rise of anti-Semitism. We have seen these violent attacks in Brussels and Toulouse earlier this year, a brutal slaying in Antwerp, Jewish schools and community centers and synagogues being targets of attacks, extremist parties gaining political support espousing anti-Semitism. We saw that in Hungary and other countries. I want to mention once again the role this Congress plays in the Helsinki Commission. I have the honor of being the Chair of the Helsinki Commission during this Congress, and the Helsinki Commission implements the commitments we made almost 40 years ago--the Helsinki Final Act; the core principles of human rights and tolerance. Our bedrock principle is that in order to have a stable country you have to have a commitment to basic human rights, and it is not just your obligation but every country that is part of Helsinki, including the United States, that has the right to challenge any other country in its compliance with those basic human rights. We have made progress. Ten years ago I was privileged to be part of the U.S. delegation in the Berlin conference. The Berlin conference was established to deal with the rise of anti-Semitism, and an action agenda came out of that conference 10 years ago. It put responsibility on us--political leaders--to speak out against anti-Semitic activities in our own country or anywhere in the world. It set up an action plan to deal with educating, and particularly dealing with Holocaust education, to deal with the Holocaust deniers. It dealt with police training because we understand a lot of criminal activities are hate crimes and the police need to be able to identify when hate crimes are taking place in their own community. We decided to share best practices by providing technical help to countries to do better, and we established a special representative to deal with anti-Semitism. Rabbi Baker is currently that special representative. But we went further than that, we expanded it to all forms of intolerance--not just anti-Semitism but xenophobia, anti-Muslim activities--because we recognized that the same people who are extremists and who deny individuals because of their anti-Semitic acts would do the same against Muslims, would do the same against any people because of their race or ethnic background. I was very pleased to see commemorated the 10th anniversary of the Berlin conference. There was a reconvening in Berlin--Berlin plus 10. Ambassador Powers, our Ambassador to the United Nations, led the U.S. delegation. She did a great job. I want to acknowledge that Wade Henderson, representing the Leadership Conference on Civil and Human Rights, also participated because there is unity here. It is not just the anti-Semitic activities, it is the intolerance we have seen grow too much in our world community today. The concluding document said we need to increase our political and financial support for civil societies, and I agree with that. Transparency and supporting the NGOs, supporting civil societies, is critically important. The bottom line is we must work together to root out all forms of anti-Semitism and all forms of intolerance. Let us work together to make all our communities safer by embracing diversity and recognizing basic human rights. 

  • Ukraine's Pivotal Parliamentary Poll

    Hon. Michael Burgess, a member of Congress from the state of Texas, presided the briefing on Ukrainian parliamentary elections, an important moment for the future of the State. Ukraine faced significant internal challenges, such as overcoming the institutional corruption which had so debilited the country, reforming the system of governance, getting the economy back on track and tracking the dire humanitarian situation resulting from the war and other challenges.   • Helsinki Commission to Hold Hearing on Combating Corruption

    WASHINGTON—The Commission on Security and Cooperation in Europe, also known as the U.S. Helsinki Commission, today announced the following hearing: “Combating Corruption in the OSCE Region: The Link between Security and Good Governance” Wednesday, November 19, 2014 10:00AM U.S. Capitol Visitor Center Room SVC 203-202 Combating corruption is increasingly recognized as the critical factor in ensuring long-term security, because corruption creates fertile ground for social upheaval and instability. The change in government in Ukraine earlier this year is a prime example of how corruption can fuel legitimate popular discontent. Although the Organization for Security and Cooperation in Europe (OSCE) has created new tools to address corruption, tackling the problem requires more than raising awareness and sharing best practices. In many OSCE participating States, systemic issues including lack of media freedom, lack of political will, and lack of an independent judiciary contribute substantially to persistent high-level and low-level corruption. The hearing will draw attention to the work of the OSCE in combating corruption in all 57 participating States, with a particular emphasis on the need to build effective institutions and the important role played by civil society in combatting corruption.   • Helsinki Commission to Hold Public Briefing on Ukrainian Elections

    WASHINGTON—The Commission on Security and Cooperation in Europe, also known as the U.S. Helsinki Commission, today announced the following public briefing: “Ukraine’s Pivotal Parliamentary Poll” Friday, November 14, 2014 2:00PM – 3:30PM Dirksen Senate Office Building Room 608 On October 26, Ukraine held early parliamentary elections that international observers—including the Organization for Security and Cooperation in Europe—assessed as largely positive, with the exception of the disenfranchisement of voters in Russian-occupied Crimea and southeastern Ukraine.   • Annual OSCE Human Rights Meeting Dominated by Russia and Ukraine

    Representatives of governments and civil society from OSCE participating States met in Warsaw, Poland, from September 22 to October 3, 2014 for the annual Human Dimension Implementation Meeting (HDIM).  The meeting was organized by the OSCE office for Democratic Institutions and Human Rights (ODIHR) under the leadership of its newly-appointed Director Michael Link. This year’s annual OSCE human dimension implementation meeting drew 1,225 participants from 53 countries, including 700 NGOs.  There were an unprecedented 82 side events on specific countries or issues.  The session on tolerance and nondiscrimination was the most oversubscribed of the three-hour sessions with 85 people vying for the speaker’s list. Other specific topics for HDIM sessions included violence against women, rights of migrants and right of national minorities.   • U.S. Helsinki Commission Welcomes Candidacies of Germany, Austria for Future OSCE Chairs

    WASHINGTON—On November 4, Germany formally announced its candidacy for the 2016 chairmanship of the Organization for Security and Cooperation in Europe (OSCE), followed by Austria, which announced its candidacy for the 2017 chairmanship. In response, U.S. Senator Ben Cardin (MD), Chairman of the Commission on Security and Cooperation in Europe and Representative Chris Smith (NJ-04), Co-Chairman of the Commission, issued the following joint statement: “We welcome the initiative demonstrated by the German and Austrian governments during a pivotal moment in the history of the OSCE. The leadership of these nations, which have been committed to the Helsinki Process from the very beginning, will be vital. We thank them in advance for their willingness to lead and for their drive to advance the cause of human rights, democracy, and international cooperation among our participating States.” The OSCE Chairmanship rotates annually among the 57 participating States, and is decided by consensus. The post of the Chairperson-in-Office (CiO) is held by the Foreign Minister of the participating State selected to hold the Chairmanship. The CiO is assisted by the previous and succeeding Chairpersons; the three of them together are known as the Troika, which ensures continuity and consistency in the OSCE’s work. Switzerland currently holds the OSCE Chairmanship, and Serbia will assume the OSCE Chairmanship in January 2015.

  • U.S. Helsinki Commission Congratulates Ukraine on Successful Parliamentary Election

    WASHINGTON—Following the successful parliamentary election in Ukraine on October 26, Senator Ben Cardin (MD), Chairman of the Commission on Security and Cooperation in Europe, and Rep. Chris Smith (NJ-04), Co-Chairman of the Commission, issued the following statement: “We congratulate the people of Ukraine on yesterday’s parliamentary election. According to election observers, including those from the Organization for Security and Cooperation in Europe, the election was held in accordance with international norms and upheld Ukraine’s democratic commitments to its citizens.   Unfortunately, voters in many parts of Donetsk and Luhansk were prevented from exercising their democratic rights through the interference of illegal armed groups. In addition, no voting took place on the Crimean peninsula due to its illegal annexation by the Russian Federation earlier this year. Although this casts no doubt on the validity of the overall election, we are reminded that citizens in Ukraine still face serious challenges – both internal and external – as they work to build a stable, independent, and prosperous democracy.   The U.S. will continue to stand with the Ukrainian people and the new Ukrainian government as they forge ahead with their courageous and determined efforts to foster democracy, human rights, and the rule of law in Ukraine.”

  • U.S. Helsinki Commission Denounces Russia’s Charges against Memorial Human Rights Group

    WASHINGTON— Following new charges brought by the Russian Federation against Memorial, one of Russia’s most respected human rights organizations, U.S. Senator Ben Cardin (MD), Chairman of the Commission on Security and Cooperation in Europe, issued the following statement: “This latest effort by Moscow to ‘liquidate’ the human rights organization Memorial is an obvious attempt to silence the voice of its own conscience. Just over a week ago, representatives of Memorial participated in the OSCE’s annual human rights meeting in Warsaw, speaking out against escalating threats against civil society. It is very troubling that an organization founded by Andrei Sakharov to address the crimes of the Stalinist era now has become the target of a new wave of repression.” In the past, Russia has sought to starve many non-governmental organizations of the resources necessary to function, hobbling the work of other human rights NGOs like the Moscow Helsinki Group; the new charges against Memorial suggests an escalation of such anti-civil society tactics. In 2009, Natalia Estemirova, head of Memorial’s office in Chechnya, was kidnapped and murdered. Memorial recently condemned Russia’s aggression in Ukraine.
