The Berlin Declaration, issued at the conference, highlights commitments made by the 55 OSCE States and declares that “international developments or political issues, including those in Israel or elsewhere in the Middle East, never justify anti-Semitism.”  The action-oriented declaration also highlighted the commitment to monitor anti-Semitic crimes and hate crimes, including through collection and maintenance of statistics about such incidents.

Helsinki Commission Members have spearheaded efforts to draw attention to anti-Semitism and related violence.  These efforts helped create the momentum that moved the OSCE to convene this historic and high-level conference on anti-Semitism, attended by Secretary of State Colin Powell.

  • The OSCE and Roma

    Roma are the largest ethnic minority in Europe and are present in most of the participating States of the Organization for Security and Cooperation in Europe.  Concentrated in post-communist Central and Southern Europe, the Romani population is estimated at over 12 million in EU countries, with significant numbers in former Soviet republics, the Balkans, and Turkey. Roma have been part of every wave of European immigration to North American since the colonial period.  There may be as many as one million Americans with Romani ancestry. Roma have historically faced persecution in Europe and were the victims of genocide during World War II.  In post-communist countries, Roma suffered disproportionately in the transition from command- to market-economies, in part due to endemic racism and discrimination. Over the past three decades, Helsinki Commissioners have led the effort in Washington to condemn racially motivated violence against Roma, including pogroms, murders, other violent attacks, and police abuse. The Helsinki Commission has also advocated for recognition of the enslavement and genocide of Roma and redress for sterilization without informed consent.  The Commission has addressed race-based expulsion of Roma, the denial of citizenship to Roma after the break-up of federative states, and the consequences of ethnic conflict and war in the Balkans. The Helsinki Commission strongly supported the first international agreement to specially recognize the human rights problems faced by Roma, adopted by OSCE participating States in 1990.   • Inaugural PADWEEK Addresses Racial Discrimination across Europe

    On May 19, 2018, African-American Meghan Markle wed Prince Harry at St. George’s Chapel in Windsor, England. Black culture was celebrated throughout the event: Queen Elizabeth II’s first female black chaplain offered prayers, a black British choir sang African-American Ben E. King’s “Stand By Me,” and Chicago-based African-American Episcopalian bishop Michael Curry quoted civil rights icon Martin Luther King Jr. during his wedding address, preaching on “the power of love.” However, the public discussion leading up to the wedding was riddled with racial stereotyping and prejudice spurred by Markle’s biracial identity—her father is white and her mother is black. British news outlets were heavily criticized for racial insensitivity after commenting on Markle’s “unconventional family,” and using phrases like “unlikely pairing” to further differentiate between the prince and Markle. Unfortunately, racial bias is not confined to Markle—now Duchess of Sussex—but instead extends to many black people in Europe. According to four comprehensive reports from the Organization for Security and Cooperation in Europe, the European Commission, the EU Agency for Fundamental Rights, and Open Society Foundations, a significant percentage of the estimated 15–20 million people of African descent living in Europe have experienced high rates of prejudice and discrimination. Just days before the wedding, racial equality advocates from across Europe gathered in Brussels to address this problem. At the inaugural People of African Descent Week (PADWEEK), organized by the European Parliament Anti-Racism and Diversity Intergroup, Transatlantic Minority Political Leadership Conference, Each One Teach One, and the European Network Against Racism, more than 100 black European activists discussed current racial injustices in Europe and recommended ways for European leaders to respond to increasing hate and discrimination across the region. Attendees included black policymakers, business leaders, and human rights activists from across Europe. Helsinki Commissioners Rep. Alcee Hastings (FL-20) and Rep. Gwen Moore (WI-04) were two of nine honorary hosts. “Whether in America or Europe, we must all do more to uphold the democratic values of our nations,” Commissioner Hastings said in a statement. “Skin color should not determine one’s access to rights, protections, and opportunities in a democracy.” Though the agenda was full with discussions ranging from BREXIT to migration to Africa-EU relations, PADWEEK addressed issues of racial discrimination head-on and introduced new ways to find solutions. It called for change to a well-ingrained European system that has left black people by the wayside for centuries. Race and legal issues were raised repeatedly in discussions. German legal expert and human rights activist Thomas Ndindah called for justice for Oury Jalloh, an asylum seeker who burned to death in a German police cell while handcuffed to a mattress in 2005. Participants also questioned a so-called “Marshall Plan” for Africa, the name of which alludes to the American-European economic plan that helped rebuild Western Europe following World War II. Participants voiced concerns that African countries were not being viewed as equal partners in the negotiations or consulted on the name. Instead, many attendees viewed the plan as Europeans paying African governments to keep unwanted African migrants from reaching Europe, while at the same time purposefully attracting Africa’s highly skilled professionals to Europe. This raised one question: how would Africa benefit from this “Marshall Plan” for Africa if Africa’s brightest and best were contributing to countries elsewhere? The week ended with a list of recommendations from participants and a passionate speech by Mirielle Fanon-Mendes-France, daughter of twentieth century philosopher Frantz Fanon. She called on European institutions to deliver on longstanding promises to address the ongoing impact of colonialism and slavery on the present-day well-being of black Europeans. Recommendations from PADWEEK included: Recognizing the history of past injustices by adopting a European Black History Month and a Remembrance Day for victims of colonialism and enslavement Supporting empowerment and anti-discrimination initiatives by funding black-led civil and human rights organizations Adopting legislation in the European Parliament on an EU Framework for National Strategies for Equality and the Inclusion of People of African Descent in Europe

  • 2018 World Cup: The Beautiful Game and an Ugly Regime

    The 2018 World Cup hosted by Russia has created an unprecedented opportunity for the country’s kleptocrats to enrich themselves. Just as he did with the 2014 Winter Olympics in Sochi, President Vladimir Putin has hijacked a world sporting event in an attempt to burnish his own image and enrich the Kremlin elite, rather than to celebrate sport and sportsmanship in Russia. However, unlike the 2014 Winter Olympics, the World Cup has required multiple infrastructure projects in not just one, but eleven, host cities. Oligarchs, as well as regional and national officials, have worked together to embezzle assets from the tournament stadium construction and refurbishment to side projects of accommodation and transport. Mistreated and forced laborers have completed this work. Contractors have used and manipulated Rus-sian and migrant workers to erect the stadiums and other structures that are essential to hosting a World Cup. For example, Russia has continued its unscrupulous use of North Korean forced labor to build St. Petersburg Zenit Arena, opened by President Putin himself in March 2017. Russia presented the World Cup to the FIFA voters in 2010 as a wholesome tournament, bringing the world together for a festival of sport. Instead, President Putin will give the world a corrupt tournament, built on the backs of forced and mistreated labor, and expose fans to a real risk of soccer violence and hatred. Although troubling trends in each of these areas can be seen in countries throughout the OSCE region, the offenses of the Kremlin are particularly egregious. Download the full report to learn more.   • How to Get Human Rights Abusers and Kleptocrats Sanctioned under the Global Magnitsky Act

    The workshop provided human rights organizations, transparency advocates, and congressional staff with the tools they need to effectively petition the U.S. government to review and potentially designate individuals and organizations for sanctions under the Global Magnitsky Act. Sanctions experts described, from an operational perspective, how the U.S. government identifies, vets, and ultimately sanctions individuals. They also discussed the evidentiary standards for sanctioning human rights violators vs. those engaged in serious acts of corruption. Finally, panelists shared investigative techniques, communications strategies, and responses to aggressive tactics used to intimidate human rights and transparency advocates.

  • Screening and Discussion: "And We Were Germans"

    To celebrate Black History Month, the Helsinki Commission screened “And We Were Germans: The Life of Hans-Jürgen Massaquoi and Ralph Giordano.” The 30-minute film chronicles the journey of Hans-Jürgen Massaquoi, an Afro-German survivor of the Holocaust who emigrated to the United States and became the editor of Ebony magazine, one of the first monthly publications for African-Americans.  The film connects the experience of Afro-German and Jewish-German survivors of the Holocaust by recounting Massaquoi’s experience in Germany, including his relationship with Ralph Giordano, a lifelong Jewish friend. To introduce the film, Dr. Mischa Thompson of the Helsinki Commission spoke about the Commission’s focus on diverse and vulnerable populations from Roma and Jewish populations to national minorities and migrants in Europe and the United States since its inception. She also discussed Commissioner’s work on the situation of People of African Descent in Europe or Black Europeans, including hearings and legislation in the U.S. Congress and resolutions and events in the OSCE Parliamentary Assembly and OSCE.  The film was followed by a conversation with director John A. Kantara about the film and current situation of people of African descent in Germany and across Europe. Kantara discussed his motivation for making the film and what he considered to be the most moving parts of the process. He found inspiration after traveling with young Afro-Germans to Chicago and attending a cultural exchange with African-Americans where he met Hans Massaquoi. He was concerned that Black German history was not widely taught in schools, nor was there a strong awareness of the Afro-German population’s history from Germany's colonization of Namibia, Burundi, and Tanzania to the children of African-American soldiers stationed in Germany. Kantara made the film with the hope that he could change the lack of education regarding black history in Germany. Kantara also elaborated on what moved him during the filmmaking process, noting the importance of African-American struggles during the U.S. civil rights movement to Afro-Germans. He indicated that trying to organize people who have been affected by discrimination and racism is an important task, and was his primary aim throughout the filmmaking process. Kantara also offered his thoughts on the new release Black Panther, noting the large turnout in Berlin and special initiatives to screen the film for Afro-German youth. Kantara revealed that it was remarkable to see young black Germans relate to the movie, and identifying with the people and plot of the film.

  • A Call for Action against Anti-Semitism in Europe

    By Erika Schlager, Counsel for International Law, and Mischa Thompson, Senior Policy Advisor In commemoration of International Holocaust Remembrance Day, the OSCE Italian Chairmanship hosted an “International Conference on the Responsibility of States, Institutions, and Individuals in the Fight against Anti-Semitism in the OSCE Area” on January 29, 2018. More than 300 government officials and civil society leaders participated in the event, including ten cabinet-level Ministers from OSCE participating States. Ambassador Michael Kozak of the Department of State Bureau of Democracy, Human Rights, and Labor, represented the United States.  Reflecting the Chairmanship’s strong commitment to addressing anti-Semitism, the conference was held during the 80th anniversary of Italy’s adoption of the Italian Racial Laws, which restricted the rights of Italian Jews and the native inhabitants of the colonies. Conference participants raised concerns about the increasing power of anti-Semitic and xenophobic parties in France, Austria, Hungary, and Germany; anti-Semitic marches in Poland, Sweden, and the United States; and the safety and future of Jewish communities in Europe.  Several speakers voiced alarm regarding the a law passed in the Polish parliament on the eve of the conference, which is ostensibly intended to ensure accuracy when ascribing responsibility for the genocide perpetrated by Nazi Germany, particularly at death camps in German-occupied Poland. Critics argue that the bill will criminalize scholarship, journalism, and even first-hand observations regarding wartime crimes committed by Poles.  “Holocaust denial,” observed one participant, “should not be a state policy.” Ministers from a number of countries cited the importance of speaking out against anti-Semitism. They also stressed the value of using the expertise of the OSCE Chair-in-Office Personal Representatives and OSCE Office for Democratic Institutions and Human Rights’ tools on hate crimes, Jewish community security, tolerance and Holocaust education, and civil society capacity and coalition building. Several government representatives commented on their respective countries’ use of the International Holocaust Remembrance Alliance’s working definition of anti-Semitism as a useful guide for participating States and civil society to expand efforts to address rising intolerance. Non-governmental participants emphasized the important role of policymakers and government officials in speaking out against hate crimes and drafting and implementing laws to ensure that Jewish communities can live and worship in safety. Ensuring that individuals can practice the central tenets of their faith, from circumcision to kosher food preparation, without government impediments is central to freedom of worship.   Civil society groups, as well as representatives from Facebook and Google, discussed initiatives to address hate online, including the role of internet service providers in removing content that may violate terms of service or violate the law. Of particular concern were disinformation campaigns on social media that promulgate negative stereotypes about Jews and may foster prejudice. One speaker described the “Protocols of the Elders of Zion” as an early exemplar of “fake news,” and others stressed the importance of counter-narratives to address particularly problematic stereotypes and falsehoods. While artificial intelligence may have a future role in addressing content that may be legal but is still harmful, current technology does not provide solutions. A discussion of efforts targeting youth through education and sports featured Israeli Olympian Shaul Landansky and focused on the creation of environments in which anti-prejudice and anti-discrimination tools could be utilized, and at the same time bring diverse communities together. Such initiatives have the potential to broaden coalitions to address anti-Semitism and other forms of hatred.  OSCE Chair and Foreign Minister Angelino Alfano called for the OSCE to convene an annual anti-Semitism conference to commemorate International Holocaust Remembrance Day, and ensure a sustained focus on addressing anti-Semitism in the OSCE region. Slovakia, as the OSCE Chair-in-Office for 2019, has agreed to hold an anti-Semitism conference next January. Prior to the opening of the Chairmanship conference, Pope Francis granted an audience to delegates and speakers, citing the importance of “educat[ing] young generations to become actively involved in the struggle against hatred and discrimination.” His point was reiterated later in the day at the conference by young leader Alina Bricman of the European Union of Jewish students, who cited “treasuring inclusive societies” and “empowering youth to shape their communities” as key to a shared future. Members of the Helsinki Commission have long advanced solutions to address anti-Semitism. Ranking Commissioner Senator Ben Cardin serves as the OSCE Parliamentary Assembly’s first Special Representative on Anti-Semitism, Racism, and Intolerance.  "The growth in anti-Semitic and xenophobic political parties across Europe and North America that foster an environment of hate increase the urgency of this conference,” said Senator Cardin. “Acknowledging our common history of the Holocaust is essential but more must be done. It’s incumbent upon all civilized people to ensure that tools are in place to counter a resurgence of the fear and hate mongering — whether directed at old targets or new—that led to those tragic events in the first place." “I am deeply disappointed that on the eve of this conference the Polish parliament passed a law that may impede research, scholarship, journalism—even personal reflections—on the Holocaust subject to criminal penalties. While the stated purpose of this law is to improve more accurate statements about the Holocaust,  this is the wrong way to achieve that goal,” he said.

  • Parliamentarians and Commissioners Discuss Europe’s Changing Landscape and BREXIT

    By Mischa Thompson, Policy Advisor As part of a week of activities, top European legislators participated in a Capitol Hill event hosted by Helsinki Commissioners Representatives Gwen Moore (WI-04), Sheila Jackson Lee (TX-18), and Alcee L. Hastings (FL-20) on the potentially far-reaching impact of BREXIT and several European elections for the 57 North American and European countries that make up the region of the Organization for Security and Cooperation in Europe (OSCE).   Member of the European Parliament and former Italian Integeration Minister Cecile Kyenge launched the event with the assertion that the United Kingdom’s June 23, 2016 decision to leave the European Union (EU)—often described as BREXIT—“shook the European Project to its core with the unprecedented case of [a] Member State parting from the EU.”  Beyond BREXIT testing the EU, she also said it was a test for EU values.  Reminding the audience that “the motto of the EU is ‘United in Diversity’ [and] its significance in Europeans coming together for peace and prosperity [across cultures],” she also noted how BREXIT had divided communities throughout the EU. Building on these remarks, Commissioner Representative Sheila Jackson Lee highlighted the global leadership role the UK has played in human rights and asked the European delegation how BREXIT might impact this role going forward. UK Parliamentarian David Lammy noted that the BREXIT vote was an extraordinary break from the past.  “The British put politics before the economy [to] end the free movement of people across Europe,” he stated.  “BREXIT will lead to economic decline in the short to medium term [and] will not lead to an end to immigration […] because when Britain goes to negotiate free trade agreements with [for example]  India, the first thing they will say is they want visas for their people to come to the UK […]  We will be trading immigration from Eastern Europe from other parts of the […] Commonwealth.”  He also acknowledged that while a “UK-US FTA (free trade agreement) is being discussed,” an agreement could have negative implications for the British on issues from the “National Health Service [to] genetically modified foods and crops.” Observing that BREXIT was part of a long-standing conversation on immigration, refugees, and the economy of the European Union, Swedish Parliamentarian Momodou Jallow said, “Europe has an aging population and that means we need as many people as possible with the competencies we need to sustain the living conditions we created.”  Critical to sustaining European economies and standards of living, he highlighted the importance of “creat[ing] conditions for people to come work [under] the same labor conditions as Swedes and the need for social investments so all can work, pay taxes, [and] for a better society.”   “Policymakers have to do better to explain there is no conflict to have everyone work and maintain the living conditions we have created,” he stated.  He also raised the EU’s history of defending human rights and challenges to that image during the current refugee crisis. Noting that Britain has a need for trained adult workers “to scale up its workforce” in addition to a huge regional problem with wealth and power being centralized in London and resources not being adequately distributed throughout the country, Lammy said, “We should blame successive domestic governments for this failure in those communities.  The EU was giving us little bits of substantive money to actually make things easier for people [in other regions].  Unfortunately, we could see the breakup of the UK,” he lamented. Despite the uncertainty presented by BREXIT, Commissioners Representatives Sheila Jackson Lee and Gwen Moore vowed to continue transatlantic cooperation.  Closing remarks by Representative Moore reminded participants of the role in global security and leadership the UK has played including in human rights and the continuing importance of U.S. civil rights leaders working with civil society across the Atlantic.  “We are concerned and wondering about the global implications BREXIT has for human rights,” she said.   In the spirit of accountability and transparency “It is important for us to remain citizens and partners,” she said. In addition to meetings with representatives of the U.S. government, private sector, and civil society, the European delegation also spoke at the Congressional Black Caucus Foundation’s Annual Legislative Conference.     From September 11 to September 22, 2017, the OSCE participating States meet in Warsaw, Poland, for the Human Dimension Implementation Meeting (HDIM).  The HDIM is Europe’s largest annual human rights event. Over the course of two weeks, the 57 participating States will discuss compliance with consensus-based commitments on full range of fundamental freedoms, democracy, tolerance and nondiscrimination, and humanitarian concerns.  In particular, OSCE agreements address issues relating to the human rights of Roma, Holocaust remembrance, and preserving sensitive sites of remembrance. During the Nazi occupation of the Czech lands, an internment camp in the Czech village of Lety became a concentration camp for Roma. Around 1,300 people were imprisoned there, including many children.  Some died in Lety as a result of the horrible conditions in the camp.  Many more were deported and perished at Auschwitz. An estimated three hundred survived.  In some ways, Lety is as emblematic of the experiences of Roma both during the and after the Holocaust. During the communist period, a pig farm was established on the site of the former concentration camp.  After the fall of communism, the existence of the pork processing facility became an enduring controversy, generating progressively more frequent protests. In recent years, Czech officials moved closer to a decision to remove the pig farm.  In August, the Czech government announced agreement had been reached with the owners of the site on a purchase price, paving the way for the farm’s removal. The United States subsequently welcomed the progress made by the Czech Republic.  Helsinki Commission Chairman Senator Roger Wicker observed, “[t]his achievement is the culmination of decades of work on the part of survivors, human rights groups, members of the Helsinki Commission, and others. It paves the way for a dignified and appropriate memorial for the thousands of men, women, and children who suffered and died there.” At the opening of this year’s OSCE’s Human Dimension Implementation Meeting, the Czech Republic – the only European Union country to speak at the opening in its national capacity, in addition to supporting a joint EU statement – drew attention to this breakthrough: “Against the backdrop of the deteriorating situation of human rights and fundamental freedoms in the OSCE, heightened attacks leveled at civil society, media and persons belonging to minorities, it remains crucial to continue promoting and protection fundamental OSCE commitments and principles.  In this context, we would like to highlight the recent positive developments in the implementation of the Czech Republic’s Roma Integration Strategy 2015-2020.  I have in mind the issue of the former Gypsy Concentration Camp in Lety u Pisku.” In light of these developments, the Helsinki Commission had a conversation with Dr. Petra Gelbart.  Dr. Gelbart is a Romani ethnomusicologist who uses music and academic research to advocate for the remembrance of Romani victims of the Holocaust.[iv] She frequently speaks to a wide range of audiences about Romani music, culture, and their persecution during the Holocaust.  She has also served as a Public Member on a U.S. delegation to an OSCE Human Dimension Implementation Meeting. Born in Czechoslovakia and the granddaughter of Holocaust survivors, Dr. Gelbart was introduced to Romani language, music, and culture at a young age. Her personal background drove her passion to study Romani culture further and to become an educator in Romani music, history, and other socio-political issues. “My family’s experience during the Holocaust was the primary motivator in my decision to become involved in commemoration efforts,” Dr. Gelbart says. “Increasingly, I am also coming to terms with how much this background has shaped my personal identity and psychological makeup, so continuing the work is important for my mental wellbeing.” She first studied musicology at UC Berkeley. Shortly after finishing her degree, she went on to pursue her postgraduate studies and earned a Ph.D. in ethnomusicology from Harvard University. Dr. Gelbart co-founded the Initiative for Romani music at New York University and is currently the music curator for RomArchive. She has also taught ethnomusicology, music psychology, as well as Romani music and language at the university level.  Her research has focused on interethnic communication, the Holocaust, music psychology, and institutional ethnography. “I try to take what people think they know about so-called ‘Gypsies,’ and replace it with something that's much more based in reality,” she explains. Dr. Gelbart passionately advocates for the use of music to not only educate about Romani culture, but also to reflect upon the difficult aspects of this community’s history. “Oral traditions and personal memoirs have kept the memory of the Holocaust alive among Roma and Sinti even in the absence of sympathetic institutions,” she observes. “The song Chajori Romani, for example, is considered an anthem of both Czech and Slovak Roma. It has a generic, happy text about a Romani girl, but also an alternate text that recounts the conditions of a concentration camp. Thus, even though the Holocaust-related text is sung less frequently, it looms in the background of this popular memory, which has come to be known as ‘the Romani lament’ regardless of which lyrics are being sung.” “When people pay close attention to Romani music, they can learn not only things they may not have expected to find out about Roma and Sinti, but also about themselves,” Dr. Gelbart notes. “For example, many people associate Manouche (French Romani) people with Gypsy Jazz, and Gypsy Jazz with emotive passion. On objective analysis, however, it turns out that strong sentiments tend to be projected onto Gypsy Jazz and its performers, based on stereotypes of ‘Gypsies,’ rather than being inherent in the music itself. Also, some of the composers and performers who may be perceived as wild musicians have in fact produced decidedly tame, deeply reflective musical pieces, including a few with Holocaust-related themes.” She continues, “Students and lecture audiences are surprised by the existence of Romani Holocaust songs, and as a consequence some of them ask why they were previously never exposed to the voices of Roma and Sinti in Holocaust education. At that point, it is useful to point out that just as Roma and Sinti expressed their grief and ongoing fears for their safety in songs during and after World War II, some of them also wrote memoirs or formed organized commemoration narratives. The image of Romanies as unschooled or illiterate is persistent, and yet Holocaust-related education shows Romani traditions in a rather different light.” Dr. Gelbart works to educate her students and colleagues about the discrimination Romani face in Europe and to correct the offensive misconceptions many hold about them. One challenge she faces in educating people about the Romani experience during the Holocaust is undoing the erasure of Romani victimhood from historical narratives. Throughout much of Europe, the Romani were formerly not a legally recognized ethnic group and thus were excluded from regional Holocaust memory and discouraged from speaking out about their experiences. “It is absolutely true that the continued, state-sponsored shaming of Romani cultures made surviving Romani families very unlikely to speak out about their wartime experiences,” Dr. Gelbart explains. “There is an enduring misconception that Romani Holocaust remembrance is typically private,” she continues. “In reality, Romani attempts to give public testimony about genocide have largely paralleled post-war developments in Jewish families, albeit at a slower pace.” In August, the Czech government agreed to remove the pig farm from the Lety concentration camp site. Dr. Gelbart believes that this decision is symbolic of the gradual inclusion of Romani Holocaust experiences in mainstream discourse. “The pig farm at Lety, along with the recreational complex on the site of the Hodonin camp (where my great-great-grandmother was murdered by a Czech guard), are symbolic of not only the imperative to include Roma and Sinti fully in mainstream discourse on the Holocaust, but also the need to examine why the Romani Holocaust tends to be relegated to footnotes,” she says. Though she sees improvement in the perspectives and treatment of Romani communities and history, Dr. Gelbart argues that the Romani experience during the Holocaust is understudied and that this trend reflects itself in lasting discrimination towards the community. “In my opinion, the most important part of remembrance is making connections to present-day perils,” she explains. “We can honor the work of the Roma and allies who have fought for the dignity of the Lety victims, but we must not stop publicly pointing out the larger context of this struggle.” Dr. Gelbart is committed to expanding the study and inclusion of Romani history and culture in the public sphere. She urges governments to take greater care in promoting Romani rights and society to learn more about the Romani, while elevating their memory above mere victimhood. “Every book, every college course, every school curriculum and every ceremony commemorating the Holocaust should strive to make its audience aware of the difference between how Romanies are assumed to be and how they actually live their lives. It can be as simple as saying that ‘Roma and Sinti are a highly diverse ethnic group, with many communities striving for social integration. The same ideologies that labeled Romanies as subhuman in times of genocide are hindering their education, employment, and even physical safety in the twenty-first century.’ If nothing else, we need to show Romani students in both Europe and the Americas that their existence and their heritage are worth as much as any other group’s,” she says. Dr. Gelbart’s activism within the Romani community extends beyond the classroom. She works with Czech families who foster or adopt Romani children. She is also interested in the role music plays in therapy, specifically in rehabilitative and developmental therapy. She is based in New York.

  • Helsinki Commission Chief of Staff Meets with New ODIHR Director Gísladóttir

    On September 13, Helsinki Commission Chief of Staff Ambassador David T. Killion met with the new Director of the OSCE Office for Democratic Institutions and Human Rights (ODIHR), Ingibjörg Gísladóttir, during the 2017 OSCE Human Dimension Implementation Meeting (HDIM) in Warsaw, Poland. Ambassador Killion stressed the Commission’s commitment to the autonomy and work of ODIHR, and highlighted several Commission priorities including fighting anti-Semitism and racism; combating trafficking in persons; promoting religious freedom; and strengthening democratic institutions. He also noted the Commission’s support for the work of the ODIHR Contact Point on Roma and Sinti Issues. Ambassador Killion urged Director Gísladóttir to continue ODIHR’s positive collaboration with the OSCE Parliamentary Assembly, noting strong Commission support for OSCE election observation. Turning to the HDIM, he emphasized the importance of the continued open participation of civil society in the event, which is a singular feature of the annual meeting. He said the Commission will continue to fulfill its mandate to monitor the participating States’ compliance with their OSCE commitments, with particular regard to those relating to human rights.  

  • The 2017 Human Dimension Implementation Meeting: An Overview

    Each year,1 the OSCE Office for Democratic Institutions and Human Rights (ODIHR) organizes the Human Dimension Implementation Meeting (HDIM) in Warsaw, Poland. As Europe’s largest annual human rights conference, the HDIM brings together hundreds of government and nongovernmental representatives, international experts, and human rights activists for two weeks to review OSCE human rights commitments and progress.  The 2017 HDIM will be held from September 11 to September 22. Human Dimension Implementation Meeting 2017 The HDIM allows participating States to assess one another’s implementation of OSCE human dimension commitments, identify challenges, and make recommendations for improvement. The HDIM agenda covers all human dimension commitments, including freedoms of expression and the media, peaceful assembly and association, and religion or belief; democratic elections; the rule of law; tolerance and non-discrimination; combating trafficking in persons; women’s rights; and national minorities, including Roma.  Each year, three special topics are selected for a full-day review.  2017 special topics will be 1) ensuring “equal enjoyment of rates and participation in political and public life,” 2) “tolerance and nondiscrimination,” and 3) “economic, social and cultural rights as an answer to rising inequalities.”  This year’s meeting will take place at the Warsaw National Stadium (PGE Narodowy), the site of the NATO summit earlier this year. The meeting will be webcast live. Background on the Human Dimension Implementation Meeting When the Helsinki Final Act was signed in Finland in 1975, it enshrined among its ten Principles Guiding Relations between Participating States (the Decalogue) a commitment to "respect human rights and fundamental freedoms, including the freedom of thought, conscience, religion or belief, for all without distinction as to race, sex, language or religion" (Principle VII). In addition, the Final Act included a section on cooperation regarding humanitarian concerns, including transnational human contacts, information, culture and education. The phrase “human dimension” was coined to describe the OSCE norms and activities related to fundamental freedoms, democracy (such as free elections, the rule of law, and independence of the judiciary), humanitarian concerns (such as trafficking in human beings and refugees), and concerns relating to tolerance and nondiscrimination (e.g., countering anti-Semitism and racism). One of the innovations of the Helsinki Final Act was agreement to review the implementation of agreed commitments while considering the negotiation of new ones. Between 1975 and 1992, implementation review took place in the context of periodic “Follow-up Meetings” as well as smaller specialized meetings focused on specific subjects. The OSCE participating States established permanent institutions in the early 1990s. In 1992, they agreed to hold periodic Human Dimension Implementation Meetings” to foster compliance with agreed-upon principles on democracy and human rights. Additional changes to the modalities for the HDIM were agreed in 1998, 2001, and 2002, which included shortening the meeting from three weeks to two weeks, and adding three “Supplementary Human Dimension Meetings” annually on subjects selected by the Chairmanship-in-Office on particularly timely or time-sensitive issues. One of the most notable features of the HDIM is the strong participation of non-governmental organizations. The United States has been a strong advocate for the involvement of NGOs in the HDIM, recognizing the vital role that civil society plays in human rights and democracy-building initiatives. OSCE modalities allow NGO representatives to raise issues of concern directly with government representatives, both by speaking during the formal working sessions of the HDIM and by organizing side events that examine specific issues in greater detail. 1 In exceptional years when the OSCE participating States hold a summit of heads of state or government, the annual review of human dimension commitments is included as part of the Review Conference which precedes the summit, and also includes a review of the political-military and economic/environmental dimensions.

  • Muslims & Minorities in the Military

    A demographic shift spanning both sides of the Atlantic has brought the issues of diversity and inclusion to the forefront of the agendas in the public and private sector, including the security sector across the OSCE region.  The OSCE has had a focus on diverse populations, from Roma and Jewish populations to national minorities and migrants in Europe and the United States, since its inception.  This focus has increased in recent years with the demographic shifts being experienced in the US and throughout Europe.  The U.S. Census Bureau predicts that racial and ethnic groups will comprise close to 60 percent of the U.S. population by 2060, and that by the next decade the majority of the U.S. workforce will be people of color – e.g., Asian, Latino, and migrant populations – which will also account for much of the U.S. population growth in years to come.  In Europe, demographers predict that aging and waning birthrates will lead to a decline in workers. Historically, racial, ethnic, religious, and gender minority groups have been under represented in the security sector, yet they hold untapped potential to address the new and complex challenges of the 21st century. Panelists suggested making the military more attractive to all individuals, including from these groups, and addressing barriers of prejudice and bias.  Additionally, panelists recommended leadership in governments and the security sector embrace change efforts through words, actions and policies.  The expertise and experiences of the panelists were broad and included representation from various countries in Western Europe.‎  Rozemina Abbasi from the U.K. Ministry of Defense detailed research and outreach programs being carried out to achieve diversity targets set by military leadership as well as the Prime Minister in the United Kingdom. Dr. Elyamine Settoul, an academic at the French Ministry of Defense, spoke about the historical and present day contributions of muslims in the military, including assisting in the liberation of France during World War II.  Dominik Wullers a procurement spokesman for the Federal Ministry of Defense, explained the struggle to change perceptions and stereotypes of German soldiers, and how he launched the Deutscher.Soldat (German Soldier) initiative to address these issues. Samira Rafaela, the Organizational Strategy Advisor for the Dutch National Police, detailed community policing and other initiatives in the Netherlands to advance diversity in the forces. Helsinki Commissioner Representative Gwen Moore joined the panel and discussed the history of desegregation in the United States and patriotism in response to questions about the President's tweet stating transgender individuals would no longer be able to serve in the military. European panelists also responded to the question detailing diversity policies in their countries. The briefing took place against the backdrop of Helsinki Commissioners Senator Ben Cardin, Ranking Member and OSCE Parliamentary Assembly Special Representative on Anti-Semitism, Racism, and Intolerance, and Representative Alcee Hastings speaking at the German Marshall Fund's conference, "Mission Critical: Inclusive Security: Inclusive Leadership for the Security Sector". Addressing European and American security sector leaders and practitioners on the importance of diversity, Commissioner Cardin told of his work with Republican Senate Foreign Relations Chairman Bob Corker to include diversity provisions for the national security workforce in the State Department Authorization Bill before the Committee that day. Commissioner Hastings spoke of his efforts on the Rules committee to include diversity provisions in the Intelligence Bill being voted on the next day.   • Helsinki Commission Staff Meet with Special Envoys on Holocaust Issues

    By Erika Schlager, Counsel for International Law Thomas Yazdgerdi, Special Envoy for Holocaust Issues at the State Department, and The Rt Hon Sir Eric Pickles, the UK's Special Envoy for post-Holocaust Issues and Anti-Corruption Champion, met with staff of the U.S. Helsinki Commission on July 14, 2017, to discuss Holocaust-related issues. Sir Eric Pickles was appointed Special Envoy for Post-Holocaust issues in September 2015. He works closely with Holocaust survivors, scholars, educational and other civil society organizations in the UK.  The State Department’s Office of the Special Envoy for Holocaust Issues develops and implements U.S. policy with respect to the return of Holocaust-era assets to their rightful owners, compensation for wrongs committed during the Holocaust, and Holocaust remembrance. The meeting touched on issues related to the needs of elderly Holocaust survivors.  The Special Envoys praised the adoption of a bill in Serbia last year that provides compensation to Serbian Holocaust survivors both in Serbia and abroad. The compensation is derived from property rendered heirless as a result of the Holocaust. Although, generally speaking, states claim property that is without heirs, the specific circumstance of genocide makes that general rule unsupportable. The 2009 Terezin Declaration on Holocaust Era Assets and Related Issues, adopted at the conclusion of a 46-nation meeting, noted that “in some states heirless property could serve as a basis for addressing the material necessities of needy Holocaust (Shoah) survivors and to ensure ongoing education about the Holocaust (Shoah), its causes and consequences.” They also addressed issues regarding Croatia, the Czech Republic, Hungary, Latvia, Poland, and elsewhere. Poland remains the only country in central Europe that has not adopted a general private property compensation or restitution law. Special Envoys Yazdgerdi and Pickles discussed their work within the 31-nation International Holocaust Remembrance Alliance, including the breakthrough adoption in April of last year of a working definition of anti-Semitism, and the OSCE’s engagement in this area.  Germany, in its 2016 capacity as OSCE Chair-in-Office, committed funds for a multiyear project called “Turning Words Into Action” which seeks to improve implementation of the OSCE’s significant body of existing commitments regarding combating anti-Semitism and discrimination. Finally, participants in the meeting exchanged views on prospects for removing the pig farm from the Lety concentration camp site in the Czech Republic. The pig farm has been the target of criticism and is seen by some as a desecration of a sensitive site of remembrance. At the 2016 OSCE Human Dimension implementation Meeting, Czech government officials discussed efforts to remove the pig farm. The Helsinki Commission played an instrumental role in securing the agreement of the Czech government to share a complete microfilm copy of the Lety concentration camp archives with the U.S. Holocaust Memorial Museum. Although there were other World War II concentration camps established specifically for Roma, the only known complete surviving archives are from Lety.   • Addressing Anti-Semitism through Intersectional Advocacy

    By Dr. Mischa Thompson, Policy Advisor “[There were so many victims of the Holocaust] but we engage in competitive victimhood, where we take the oppressor’s view of a victim’s worth.” – Words into Action participant Misko Stanisic, Terraforming From June 21 to June 23, 2017, the Organization for Security and Cooperation in Europe Office for Democratic Institutions and Human Rights (OSCE/ODIHR) hosted the second in a series of workshops focused on addressing anti-Semitism.  The workshop, titled “Gender and Intersectional Activism: Coalition-Building for a More Tolerant Society,” provided a forum for 50 civil society leaders to discuss their efforts to address prejudice and discrimination across the 57 European and North American countries of the OSCE.  The forum was part of the OSCE/ODIHR’s “Turning Words into Action to Address Anti-Semitism” (WiA) project, which increases the capacity of countries and civil society to prevent and respond to anti-Semitism through security, education, and coalition-building measures.  According to Cristina Finch, Head of the ODIHR Tolerance and Discrimination Department, the forum will also assist with “creation of a coalition-building manual that ODIHR will publish to assist civil society in these efforts.”  Noting the problem of “underreporting,” the forum educated participants about OSCE/ODIHR efforts to collect hate crimes statistics, and highlighted methods by which civil society could work with local law enforcement and the OSCE/ODIHR to report hate crimes.  At the forum, OSCE/ODIHR shared recent findings that indicate that while Jewish men are more likely to be victims of anti-Semitic speech or physical violence, Jewish women fear anti-Semitic attacks more.  This suggests gender may play an important role in addressing anti-Semitism, prompting the need for more gender-rich and intersectional prevention efforts. For instance, Misko Stanisic of Terraforming, an organization focused on Holocaust and human rights education, noted that thousands of women participated in crimes of the Holocaust, but that gender stereotypes resulted in women often not being viewed as perpetrators, resulting in “female perpetrators [being] seldom investigated for their crimes and rarely prosecuted during the post-war trials.” He also described how socially constructed perceptions of gender, race, and other identities not only impacted who is – and who is not – included in text books and other educational tools on the Holocaust, but also how this has impacted efforts to address anti-Semitism.  “[There were so many victims of the Holocaust] but we engage in competitive victimhood, where we take the oppressor’s view of a victim’s worth,” he said. Other participants highlighted the forum’s relevance to American scholar Kimberle Crenshaw’s intersectionality theory, which details how hierarchal systems of gender and race resulted in African-American women often being excluded from the mainstream feminist movement in the United States.  In particular, participants discussed how efforts to address anti-Semitism and other forms of prejudice and discrimination have been stymied by approaches that have reinforced gender and other hierarchical power structures preventing men and women within communities from effectively working together.  Invoking American luminary James Baldwin, Finnish journalist Maryan Abdulkarim stated, “No one is free until we are all free.” She stressed the need for more inclusive efforts that move away from a focus on differences that separate the “majority” and “minorities,” and to restore humanity by challenging harmful societal constructs and working across communities, including with the “majority” to address problems. While the forum explored the importance of inclusive approaches to addressing anti-Semitism and other forms of intolerance, some participants warned that intersectionality could become an ineffective trend if care is not taken in its implementation.  Specifically, the differences between academic discussions and practice were raised.  In particular, participants cited the need for clear laws, processes, and procedures that protect all, as well as equal access to justice.   For example, laws and policies should be understandable to police, judges, and ordinary citizens, and straightforward to implement.  Researchers, funders, and advocates should be particularly mindful as to whether their efforts advance equality, or simply check a box. The art and commentary of speaker Dan Perjovschi underscored and offered insight into the societal challenges forum participants faced in efforts to address anti-Semitism, gender and other inequities in countering prejudice and discrimination at large, and the need for their continued efforts.     By Dr. Mischa Thompson, Policy Advisor “If we cannot be entrusted as leaders to do the small things, why should the public trust us to do the big ones, including governing international relations?” –Svante Myrick Mayor of Ithaca, New York TILN 2016 From March 20-26, 2017, the U.S. Helsinki Commission, in partnership with the German Marshall Fund of the United States (GMF), the U.S. State Department, and other stakeholders, hosted the sixth annual Transatlantic Inclusion Leaders Network (TILN) workshop in Brussels, Belgium.     Twenty-five young leaders representing more than fourteen European countries and the United States came together to learn from one another, expand their leadership skills, and offer a more inclusive vision for the world. As participants in the Brussels Forum Young Professionals Summit, TILN participants engaged with senior U.S. and European public and private sector leaders on the most pressing issues impacting the transatlantic relationship today, ranging from U.S. elections and the international workforce to Russia and counterterrorism. Several TILN participants also visited a high school in Brussels, exploring opportunities for international exchange and collaboration between administrators, educators, and students related to the educational needs of increasingly diverse student bodies and the future workforce on both sides of the Atlantic.   • Commissioner and Special Representative Ben Cardin Counters Anti-Semitism and Promotes Diversity

    When the U.S. funding bill commonly known as the Omnibus passed in May 2017, it included a number of provisions outlining U.S. foreign policy and national security measures.  It also included provisions supporting diversity and human rights in foreign affairs in the face of increased violence and discrimination across the 57 North American and European countries that make up the Organization for Security and Cooperation in Europe. “Continuing anti-migrant and refugee sentiments, anti-Muslim backlash following terrorist attacks, and a surge in anti-Semitic and racist incidents in this country and abroad are just some of the reasons I was compelled to act,” said Helsinki Commission Ranking Senator Ben Cardin (MD), who is also the OSCE Parliamentary Assembly’s first Special Representative on Anti-Semitism, Racism, and Intolerance. “These legislative provisions are just a few recent efforts I have advanced to ensure diverse populations in our country and throughout the OSCE region are afforded the same rights, protections, and opportunities as others that are enshrined in the Helsinki Final Act and numerous OSCE tolerance and non-discrimination commitments,” said Senator Cardin, whose U.S. spending bill provisions include: Increased funding to counter global anti-Semitism. U.S. support for the Organization for Security and Cooperation in Europe (OSCE) to advance new initiatives to counter anti-Semitism, racism, and intolerance. Expansion of the Department of State workforce diversity programs. Prior to the passage of the Omnibus, on April 25 Senator Cardin introduced the National Security Diversity and Inclusion Workforce Act (NSDIWA) of 2017, building on legislation he passed in December 2016 to diversify the State Department and USAID labor force.  “I have championed these equality and anti-discrimination provisions because America’s diversity is one of our greatest assets as a nation, and our government should reflect that reality,” said Senator Cardin. “When America leads with our values on display, whether we are promoting human rights abroad or helping resolve conflicts to help societies heal and move forward, including our own, it should be done with personnel who reflect the entire tapestry of the United States,” Senator Cardin continued. “Inequities and discrimination are not just a U.S. problem.  The hope is that this legislation can also serve as a model for other countries grappling with similar issues from hate crimes to inequality.” Senator Cardin was appointed the OSCE PA's Special Representative on Anti-Semitism, Racism and Intolerance in March 2015.   • International Roma Day 2017

    International Roma Day is observed annually on April 8, commemorating the anniversary of the1971 London meeting of Romani activists from across Europe. The 1971 London meeting, convened as the "World Romani Congress," was one of the first transnational gatherings of Roma.  Since 1990, International Roma Day has been an opportunity to celebrate Romani culture and counter anti-Roma prejudice that fosters political and economic marginalization.  Roma—Europe’s Largest Ethnic Minority Roma live throughout all European countries as well as the Americas and Australasia. In Europe, the Roma population is very conservatively estimated at 15 million, with large concentrations in Central, Eastern, and Southern Europe.  Roma have migrated to the United States since the colonial period. There are an estimated one million Americans with some Romani roots (recent or distant Romani ancestry).  Roma live throughout the United States, with larger communities in New York City, Baltimore, Chicago, and Los Angeles. They are sometimes the victims of racial profiling by law enforcement.  The last explicitly anti-Roma law in the United States was repealed in New Jersey in 1998. Romani Americans have served as public members on the U.S. delegation to several OSCE human dimension meetings.  In 2016, the President appointed Dr. Ethel Brooks to serve on the U.S. Holocaust Memorial Museum Council, bringing a Romani voice to that body. Helsinki Commission Advocacy on Romani Human Rights The Commission has long record of addressing human rights issues relating to Roma.  As early as 1990, a Helsinki Commission delegation in Bucharest raised alarm orchestrated attacks on Roma conducted as part of a larger crackdown on dissent.  Helsinki Commissioners have continued to engage regarding the situation of Roma through hearings, briefings, and congressional meetings with Roma in Europe and the United States.  In recent years, the Commission has supported Romani inclusion in annual initiatives for political leaders such as the Transatlantic Minority Political Leadership Conference (TMPLC) and Transatlantic Inclusion Leaders Network (TILN).  On March 27-28, the Commission worked in cooperation with the OSCE Office for Democratic Institutions and Human Rights to hold a workshop during “Roma Week” at the European Parliament in Brussels titled, “Strengthening diverse leadership, participation and representation of Roma, including women and youth, in public and political life.”  Roma Day Events in the United States Harvard will host its fifth Annual Roma conference on April 10, where Helsinki Commission staff will participate. Scholars of Romani culture and Roma who work as academics, activists, and performers will convene a conference at New York University April 28-29. Later in the spring, on May 6, the 20th Annual Herdeljezi Music Festival will be held in the San Francisco area at the Croatian American Cultural Center. In the Washington area, the Embassy of the Czech Republic supported a March 30 screening of the documentary about the prejudice faced by the FC Roma football club. On May 17, the Czech Embassy will support a concert at the national Gallery of Art by Romani-Czech pianist Tomas Kaco.   • Romani Political Participation Key to Change

    On March 27 and 28, 2017, thirty-five Romani elected officials and civil society representatives participated in a two-day event held by the OSCE Office for Democratic Institutions and Human Rights (ODIHR) in cooperation with the U.S. Helsinki Commission, as part of the European Union’s “Roma Week.”  The event focused on opportunities to enhance Romani political participation as a means of strengthening the long-term strength and stability of the OSCE region.  As citizens of many OSCE participating States, Roma have long contributed to the prosperity of their countries in numerous ways, ranging from serving in the military to educating the next generation.  However, Roma are often described and perceived in negative terms, leading political leaders and others, to consider Roma a problem rather than a solution. Referring to the political rhetoric that instigated the tragic murders of Roma in 2008 and 2009, Romani-Hungarian researcher and Transatlantic Inclusion Leaders Network alumni Roland Ferkovics stressed, “Political narratives should not only motivate and influence people but should also unite…Political leaders must take Roma as equal partner(s) using narratives [that] focus on similarities instead of differences.” Diverse speakers from across the OSCE region also shared experiences and practices that have been successful in inspiring democratic change. “Standing for elected office and using one’s right to vote is a powerful tool for Roma communities in Europe to counter anti-Roma rhetoric, hate crimes and racism,” said Mee Moua, former President of Asian Americans Advancing Justice (AAJC), who also served as a Minnesota State Senator in the United States. Noting the importance of united communities, Killion Munyama, a member of the Polish Parliament and the Parliamentary Assembly of the Council of Europe, noted the importance of Roma having a seat at the decision-making table:  “Societies benefit from broad and diverse participation representing the voices of all communities in the public and political spheres.” Participants also stressed the urgency in ensuring the success of current Romani legislative initiatives and the importance of ensuring that legislative initiatives aimed at Roma, such as the EU Framework Strategy for Integration, are designed and implemented with the participation of Roma at all levels of government.  Other speakers at the event included MEP Terry Reintke, former MEP Livia Jaroka, and Jamen Gabriela Hrabanova of the European Roma Grassroots Organizations Network. Dr. Mischa Thompson of the Helsinki Commission participated as a facilitator.
