2009 OSCE Mediterranean Conference in Cairo is a Sucess
Highlights Importance of Revisiting Annual Conference Administration

In December 2009, Commission staff attended the 2009 OSCE Mediterranean Conference on “The Mediterranean Partners and the OSCE: Cooperation Toward Enhanced Security and Stability” in Cairo, Egypt. This conference brought together 33 of the 56 OSCE participating States, four of the Asian Partners for Cooperation (Australia, South Korea, Japan, and Thailand), and representation from all of the Mediterranean Partners for Cooperation. The Palestinian National Authority attended at the invitation of the host government. The conference featured three sessions focusing on the politico-military aspects of security in the OSCE area, implications of the current financial crisis on migration, and prospects for OSCE Mediterranean Cooperation. These sessions featured presentations from Mediterranean Partner OSCE delegations, academics, international organizations, and relevant ministry representatives.

Participation in this conference was at a high level with the majority of the participating States and all of the Mediterranean Partners for Cooperation represented by their Ambassadors to the OSCE. Members of the Parliamentary Assembly of the OSCE in attendance included a Vice-President and officers of two of the Assembly’s General Committees. Discussion in all of the sessions was lively with active participation by the Ambassadors, particularly those representing the Mediterranean Partners, as well as other public and private sector participants. A number of themes emerged across the sessions including agreement that the partnership between the OSCE participating States and their Mediterranean Partners has strengthened. The establishment of the Partnership Fund and the Athens’ Ministerial invitation to the Partners to contribute to the Corfu Process are largely attributed with bolstering the strength of the Partnership. Findings included a future activity emphasis on specific areas of cooperation by setting both short and long-term goals and providing a mechanism to assess effectiveness. In addition, the OSCE Mediterranean Partnership should undertake its work in coordination with other regional organizations and institutions, through which the possibility of expanding the Partnership could be considered.

Session 1: Politico-military aspects of security in the OSCE area and the Mediterranean

The session’s moderators were Ambassador Ian Cliff, Head of the delegation of the United Kingdom to the OSCE and Ambassador Taous Feroukhi, Permanent Representative of Algeria to the OSCE. Panelists included Mr. Pascal Heyman, Deputy Director of the OSCE Conflict Prevention Center, Ambassador Gyorgy Molnar, Head of the Permanent Mission of the Republic of Hungary to the OSCE, and Dr. Mostafa Elwy Saif, Professor and Chairman of the Department of Political Science, Cairo University and Member of the Shura Council.

Ambassador Cliff opened the discussion by pointing out that the OSCE had developed expertise on crisis prevention and conflict resolution, particularly regarding protracted conflicts. He believes there has recently been some incremental progress.

Pascal Heyman emphasized that the OSCE has developed a unique conflict prevention and resolution expertise through constant political dialogue, dedicated crisis management mechanisms such as fact-finding missions, the Conflict Prevention Center, confidence and security building measures and the establishment of field operations. While these are effective tools, Heyman maintained that workable and lasting conflict resolution depends ultimately on the political will of the participating States and the parties in a conflict.

Ambassador Molnar spoke to the destabilizing consequences of transnational or multi-dimensional threats to security in the OSCE space. He noted that participating States are attempting to address these threats through the Maastricht Strategy and decisions adopted at both the Madrid and Athens Ministerials regarding transnational threats, combating terrorism, and promoting effective law enforcement and police training programs.

Dr. Saif presented a detailed review of Egypt’s political and military security concerns and concluded that the primary challenges to his country’s security stem from the Israeli-Palestinian conflict, Iran’s regional and nuclear ambitions, water shortages, the political situations in Iraq and Afghanistan, and the proliferation of weapons of mass destruction in the Middle East.

Ambassador Feroukhi said that the absence of a dedicated institutional forum in the Mediterranean region hampered the development of effective security mechanisms but felt that the development of confidence-building measures – particularly involving civil society and academic communities – should be encouraged as a first step. She also agreed that a just resolution of the Israeli-Palestinian conflict and better protection of the environment were vital for the stability and security of the Mediterranean region.

All delegations who participated in the discussion welcomed the Athens Ministerial decision to invite input from the Partners for Cooperation on furthering the Corfu Process. A number of delegations raised the possibility of enlarging the Mediterranean Partnership to include the Palestinian National Authority, while others pointed out the difficulties of doing so, due to the fact that the OSCE is a state-based organization. The Partnership Fund was hailed as an effective tool to enhance the Mediterranean Partnership and it should continue to be used to sustain a culture of cooperation, including the possible creation of a clearing house on water issues within the OSCE. It was also stressed that the OSCE should coordinate its activities with relevant international and regional organizations.

The moderators stated the following conclusions emanating from the discussion: The confidence and security building measures as well as early warning mechanisms developed in the framework of the OSCE could serve as a model and help to foster cooperation and confidence in the Mediterranean region; the participation of the Partners in the Corfu process should enhance the Mediterranean Partnership; and, the Partnership should move forward based on concrete, achievable objectives with possible long-term goals of establishing a Mediterranean conflict prevention center and developing regional codes of conduct to enhance dialogue and cooperation.

Session 2: Implications of the current economic and financial crisis on migration

The second session was moderated by Mr. Daman Bergant, Head of the OSCE Department of the Ministry of Foreign Affairs of Slovenia, and panelists included Ambassador Omar Zniber, Head of the Delegation of the Kingdom of Morocco to the OSCE, and Ms. Rebecca Bardach, Director of the Center for International Migration and Integration of the American Jewish Joint Distribution Committee.

Mr. Bergant began the session by explaining that the global economic and financial crisis has an impact on migration and development. He outlined several topics to guide the discussion including the development of cooperative migration policies between the OSCE and the Mediterranean Partners; dialogue on how to prevent and combat illegal migration; international and regional cooperation on preventing trafficking in human beings, including trafficking for forced labor; protecting the human rights of migrants, including through combating hate crimes; and, the role of migrants in promoting tolerance and non-discrimination.

Ambassador Zniber spoke to the impact of the current economic crisis on both migrants and development. He pointed out that the impact of the crisis makes migrants even more vulnerable and they face increased discrimination and further marginalization in society. Decreasing remittances, said the Ambassador – 10 to 15% in 2009 according to the World Bank – are a destabilizing factor, impacting countries of origin like Morocco which are particularly dependent on revenues from abroad.

The Ambassador welcomed the Athens Ministerial Council Decision on migration management and urged that the OSCE continue its work in this area, in particular, by facilitating dialogue, exchanging best practices and fighting discrimination against migrants. Specifically, he recommended that the OSCE and its Mediterranean Partners establish a working group on migration management and related security aspects; develop a multi-dimensional and long-term approach on migration management; promote regional cooperation and partnerships between all responsible parties including countries of origin, transit and destination, civil society and the private sector; create reintegration and training programs; and, protect the human rights of migrants and their families.

Ms. Bardach gave a comprehensive review of migration issues impacting Israel. She explained that only in the last two decades has Israel seen a significant increase in migration flows across its borders. This is presenting challenges to the government in managing migration and dealing with large numbers of refugees, asylum seekers, and labor migrants, in addition to human smuggling and trafficking. While Israeli efforts to combat trafficking for sexual exploitation have resulted in marked progress, she said, efforts to combat labor trafficking are still in their infancy. Based on this experience, Ms. Bardach suggested that the OSCE should develop policies to address irregular recruitment practices and raise awareness about such practices; develop cooperation on both the regional and bilateral level to increase information sharing, strengthen border controls and address the humanitarian needs of migrants; develop culturally sensitive tools for law enforcement officials; and, improve the reception and registration of refugees, including assisted voluntary return.

During the discussion following the panel presentations, a number of delegations echoed the view that the OSCE and its Mediterranean Partners should serve as a broad regional platform for a coordinated dialogue on migration, and should develop a comprehensive strategy to prevent cross-border trafficking that includes the private sector.

The contributors in this session demonstrated the need for better data collection and sharing regarding migration in the Euro-Mediterranean context. This goal was identified as a potential priority for the Partnership Fund. Proposals distributed by the Moroccan and Egyptian delegations have both cited the importance of developing research institutions, which could serve to further the goal of better data collection and expertise sharing.

Session 3: Prospects for OSCE Mediterranean Cooperation

The third session Chaired by Ambassador Kairat Abdrakhmanov, Head of the Permanent Mission of Kazakhstan to the OSCE and Chair of the OSCE Permanent Council, focused on a review of achievements to date in improving dialogue and cooperation between the participating States and the Mediterranean Partners, and developing effective follow-up on recommendations of previous seminars and ministerial declarations referencing the Partners. Featured speakers were Ambassador Makram Queisi, Permanent Representative of Jordan to the OSCE, and Mr. Agustin Nunez, Deputy Head of Mission of the Permanent Mission of Spain to the OSCE.

Ambassador Queisi presented four areas in which he felt cooperation could improve the relationship between the OSCE and the Mediterranean region – environmental aspects of security such as soil erosion, desertification and water management including the possible creation of an environmental data collection center in the region; enhanced border security to combat terrorism and trafficking including cooperation with the Regional Counter Terrorism Training Center in Jordan; combating discrimination against Muslims; and developing nuclear non-proliferation strategies for the region. The Ambassador also stated his view that Partner status should be granted to the Palestinian National Authority as a confidence building measure.

Mr. Nunez reviewed the development of the participating State’s cooperation with their Mediterranean Partners including increased participation by Mediterranean Partners in OSCE activities and recent examples of concrete cooperation on issues such as countering terrorism, promoting tolerance and freedom of the media, and enhancing border management. He emphasized the importance of having a strategic vision for the Partnership and commended the proposal by the Kazakh Chair of the Mediterranean Contact Group that three priority areas should be identified for developing projects to be financed by the Partnership Fund. Mr. Nunez concurred with Ambassador Queisi’s view that the Partnership should be enlarged to include the Palestinian National Authority and noted that Spain had circulated two food-for-thought papers on this topic in 2008.

Following the presentations, active debate among the delegations ensued and focused primarily on the current status of the Partnership and its achievements to date, proposals for additional areas of cooperation, procedural improvements and the issue of possible enlargement of the Partnership.

Enhanced cooperation in the areas of promoting tolerance and non-discrimination, freedom of the media, gender, combating trafficking in human beings, energy security, security aspects of climate change, water management and fighting corruption, drug trafficking and terrorism was discussed. It was suggested that working groups should be established to examine these issues and make recommendations for action. Participants also called for the establishment of a system for effective follow-up on recommendations and agreed proposals, as well as enhanced coordination with other regional institutions and organizations.

The participants actively discussed the question of enlarging the Mediterranean Partnership with some participants supporting the granting of Partner status to the Palestinian National Authority as a confidence building measure conducive to dialogue and peace in the region. Debate over this particular consideration illuminated the need for an expeditious response to the request of the Palestinian National Authority (PNA) to become an OSCE Mediterranean Partner for Cooperation. It is apparent that a number of participating States and partners recognize the value of their participation in Mediterranean Dimension activities. Yet, disagreement arises when considering the implications of recognizing a territory as a full-fledged partner. Some participating States see the case of the PNA as unique in that there is already international agreement on the existence of a future Palestinian State. Other participating States believe that affording a territory official status sets a precedent for other territories seeking recognition in the OSCE region. A number of these leaders believe that a future Palestinian State should be granted partner status after formal international recognition. Thus, it will be unlikely that consensus on partnership with the PNA will be reached at this time and the OSCE Chair-in-Office should issue a formal response acknowledging this. The question of PNA participation will continue to mire productive dialogue on other opportunities for cooperation until a decisive response is issued by the OSCE Chair-in-Office. Alternatives for their participation should however be explored. Some possibilities include establishment of an alternative status of “observer” or other title within the framework of the Partners for Cooperation to allow for a transitional process of full recognition as a Partner. In addition, some sort of agreement should be established on recommended countries outside of the Mediterranean Partnership for invitations to OSCE Mediterranean Dimension activities.

Conclusion: Future Considerations for Annual Conference Administration

A tremendous success of the 2009 Mediterranean Conference was the engagement of the Ambassadors from the Mediterranean Partners in the agenda. Each panel featured a Mediterranean Partner Ambassador, which helped balance the contributions during the discussion. Previous conferences did not adequately balance the opportunities for contributions between the Mediterranean Partners and the OSCE participating States. In the most grievous of incidences, panelists and participating States at the 2008 Mediterranean Conference in Amman, Jordan took so much time during the discussion that contributions from representatives of the Partners were significantly curtailed. It only makes sense that the contributions of the Partners be prioritized when the purpose of the conference is enhancing cooperation with their respective countries. Meaningful participation by the Partners remains the only way to sustain the future of the OSCE Mediterranean Dimension.

A recurring challenge of the annual Mediterranean conference is a lack of willingness to host the event among the Mediterranean Partners. The venue question remains an issue that paralyzes cooperation among the Mediterranean Partners and has the potential to diminish the productivity of the conference each year. The venue question stems from a number of factors. Not only is the conference capital-intensive for the hosting State, political considerations regarding the participants in the OSCE Mediterranean Dimension keep Partners like Algeria and Tunisia from taking a leadership role in hosting the event. Thus, active Partners like Egypt, Jordan, Morocco, and Israel bear the burden of hosting the conference most frequently. Ownership of the OSCE Mediterranean Dimension through hosting the conference and originating initiatives remains an ideal that the partnership should aspire to. However, it is not unprecedented that participating States would host the conference. Previous Mediterranean seminars were hosted by Greece (2002), Croatia (2001), Slovenia (2000), and Malta (1998), prior to the elevation of the event to a “conference” by the Greek chairmanship of the OSCE in 2008. Participating States have offered to host the upcoming 2010 conference. Proceeding with an established venue earlier in the year may provide for more time for substantive topic development. Such a deviation from Mediterranean Partner ownership of the event should be seen as an exception until a more appropriate mechanism for rotating the responsibility of hosting the conference is devised.

The 2009 Mediterranean Conference was well executed by the Egyptian government, especially considering the short time between their final commitment to do so and the date of the event. However, NGO participation was notably missing. The 2008 OSCE Mediterranean Conference in Amman featured a session for NGOs from throughout the Mediterranean region on the day prior to the conference and subsequently included a robust NGO presence during the conference proceedings. OSCE Participating States led by the United States made extra-budgetary contributions to the OSCE Partnership Fund to help facilitate a robust NGO presence. International organization representatives that were invited to present on the session panels in the 2009 Cairo conference were among the few non-governmental participants present. It is true that participating States lack the wherewithal to contribute annually to facilitate an NGO presence especially given global fiscal challenges. However, exploring partnerships with appropriate foundations, endowments, and institutions involved in Euro-Mediterranean engagement may result in a consistent and strong NGO presence at events within the OSCE Mediterranean Dimension.

  • Revolt Against the Silence - The State of Human Rights in Romania: An Update

    Patterns of repression in Romania remain sadly the same year after year. The Romanian regime has kept up pressure on members of religious and national minorities, as well as on all who have sought to express themselves freely. It has harassed and punished would-be emigrants by removing them from jobs and housing. It has exiled writers, philosophers and former leaders. It has jailed those who have sought the means to worship freely, and used psychiatric incarceration to punish free expression. The regime has steadily curtailed the opportunities for members of ethnic minorities to maintain and cultivate their cultural heritage, cutting minority-language instruction and publishing to a minimum. Minority cultural and family ties have also been strictly limited. The regime has used violence and threats of violence to discourage citizens from seeking to exercise their rights. Many Romanian dissidents inside and outside the country have received black-bordered death threats, widely believed to be a favorite calling-card of Romania's notorious Securitate (secret police). Increasingly, the regime's persecution has touched all Romanian citizens, who suffer from severe, state-imposed food shortages and the threat of displacement through the sjstematizare, or systematization, program. Despite the Romanian Government's March announcement, with great fanfare, that it had repaid the country's foreign debt, there is no sign that the regime will reorder its fiscal priorities in favor of consumption. Rationing continues unabated, while construction of new industrial projects seems to be moving forward with redoubled speed.

  • THE NEW AND IMPROVED SUPREME SOVIET AND THE INSTITUTIONALIZATION OF HUMAN RIGHTS REFORM

    The hearing looked into the role of the Supreme Soviet in promulgating and institutionalizing human rights in the Soviet Union. Our Soviet guest today was Mr. Fyodor Burlatskiy who gave testimony alongside Louise Shelley, consultant to the Helsinki Watch on issues of Soviet law. This briefing was a follow-up to talks in Moscow in November of 1988.

  • The Baltic Question

    This Helsinki Commission hearing was brought to order due to the independence movements in the Baltic States. The independence movements in these states expressed the desire for self-rule on the part of peoples who, after forcible incorporation into the Soviet Union, had been brutally colonized for 50 years, reduced to the status of minorities and second-class citizens in their historic homelands, robbed of their language, their culture and their history, and victimized by police brutality and environmental assault. They sought independence from Moscow not because they hate Russians, but because they saw it as a prerequisite for physical and cultural survival.

  • Sofia CSCE Meeting on the Protection of the Environment

    The purpose of this hearing, which Sen. Dennis DeConcini and Rep. Steny H. Hoyer chaired, was to examine the first meeting in CSCE history devoted exclusively to the environment. The hearing predated the Sofia Meeting itself, whose purpose was to address environmental problems that recognize no borders and threaten every individual’s right to a peaceful and secure life. Unfortunately, the Sofia Meeting had been marred by the Bulgarian government’s lack of tolerance in its treatment of its Turkish and Muslim minorities, specifically the Bulgarian government’s campaign to assimilate Turkish minorities, which constituted a serious violation of human rights. Needless to say, then, intersectionality existed and continues to exist among environmental issues and the Helsinki process’s other top priorities.

  • CODEL DeConcini - Trip Report on Turkey and Poland

    The Commission on Security and Cooperation in Europe, more commonly known as the Helsinki Commission, was established by law in 1976 to monitor and report on compliance with the 1975 Helsinki Final Act. The Helsinki Final Act, as well as successor agreements, includes provisions regarding military security; trade, economic issues, and the environment; and human rights and humanitarian concerns. Thirty-two European countries participate in the Helsinki process, plus the United States, Canada, and the Soviet Union. The Helsinki Commission is currently chaired by Senator Dennis DeConcini (D-AZ) and co­ chaired by Representative Steny H. Hoyer (D-MD), and has 18 members from the Senate and House, as well as one each from the Departments of Commerce, State, and Defense. In accordance with its legislative mandate, the Commission undertakes a variety of activities aimed at monitoring and reporting on all three sections (known as baskets) of the Helsinki Accords. These activities include the solicitation of expert testimony before Congress, providing to Congress and the public reports on implementation of the Helsinki Accords, and the publication of human rights documents issued by independent monitoring groups. In addition, the Chairman and Co-Chairman of the Commission lead delegations to participating States and to meetings of the Conference on Security and Cooperation in Europe. In undertaking a trip to Poland at this time, the Helsinki Commission had two main objectives. First, the Commission hoped to evaluate the status of human rights reform in the wake of the quantitative and qualitative changes which had taken place in Poland since the Commission's trip to Poland in April 1988 and in light of the new opportunities for reform created by the Round-Table Agreement of April 1989. Second, the delegation was interested in establishing direct contact with those segments of the National Assembly which were democratically elected.3 During the course of the trip, the delegation visited Gdansk, Warsaw. and Krakow. Meetings were held with senior leaders from key political groups, memhers of the Polish parliament, independent human rights advocates, opposition journalists, and environmental activists.

  • Paris Human Dimension Meeting: Human Rights in the Helsinki Process

    This hearing, chaired by Commissioner Steny Hoyer, took place after the first meeting of three 4-week meetings of the Conference of the Human Dimension. These meetings were a function of the Conference on the Security and Cooperation in Europe the first of which took place on June 23, with the 35 member states of the OSCE in attendance. On the U.S.’s part, the goal was to seek greater implementation of the human rights and human contacts provisions of the Helsinki Accords. The atendees discussed the Vienna Concluding Document of January 1989, continued Soviet and East European violations of the rights of national minorities and religious believers and restrictions on the rights of free assembly, association, expression, and noncompliance with human contacts provisions, and fostering greater respect for human rights and fundamental freedoms.

  • The London Information Forum of the CSCE - Compilation of Speeches

    The London Information Forum was the first non-military follow-up activity to be held within the Conference on Security and Cooperation in Europe following the conclusion of the Vienna CSCE Review Meeting. The forum's aims, as mandated by the Vienna document, included examination of the circulation of, access to and exchange of information; cooperation in the field of information; and the improvement of working conditions for journalists. The London Information Forum addressed fundamental human rights questions: the right to free expression and free choice of information sources. At issue were not only new initiatives in the exchange of information, but also improved compliance with existing CSCE commitments.

  • Conclusion of the Vienna Meeting and implications for U.S. Policy

    The general tenor of East-West relations has changed considerably in recent years. Some changes give cause for hope, others reinforce longstanding doubts. The Helsinki process in general, and the Vienna Meeting in particular, have contributed to this dynamic period, and rightly so, for change is what the Helsinki process is all about, the changing relationships between governments, their citizens, as well as between states. The Vienna Concluding Document itself contains more precise provisions than any previous CSCE document. Particularly noteworthy are those texts concerning religious freedoms, the rights of national minorities, freedoms of movement, the environment, and information. The document, like those which preceded it, will be used as a standard against which to measure the behavior of the participating States. For it is a demonstration of commitment which will give the document its true meaning.

    The representatives of the participating States of the Conference on Security and Co-operation in Europe (CSCE), Austria, Belgium, Bulgaria, Canada, Cyprus, Czechoslovakia, Denmark, Finland, France, the German Democratic Republic, the Federal Republic of Germany, Greece, the Holy See, Hungary, Iceland, Ireland, Italy, Liechtenstein, Luxembourg, Malta, Monaco, the Netherlands, Norway, Poland, Portugal, Romania, San Marino, Spain, Sweden, Switzerland, Turkey, the Union of Soviet Socialist Republics, the United Kingdom, the United States of America and Yugoslavia met in Vienna from 4 November 1986 to 19 January 1989 in accordance with the provisions of the Final Act relating to the Follow-Up to the conference, as well as on the basis of the other relevant CSCE documents. The representatives of the participating States reaffirmed their commitment to the CSCE process and underlined its essential role in increasing confidence, in opening up new ways for cooperation, in promoting respect for human rights and fundamental freedoms and thus strengthening international security.

  • Concluding Document of the 1986 Vienna Review Meeting of the CSCE

    The representatives of the participating States of the Conference on Security and Co-operation in Europe (CSCE), Austria, Belgium, Bulgaria, Canada, Cyprus, Czechoslovakia, Denmark, Fin­ land, France, the German Democratic Republic, the Federal Republic of Germany, Greece, the Holy See, Hungary, Iceland, Ireland, Italy, Liechtenstein, Luxembourg, Malta, Monaco, the Netherlands, Norway, Poland, Portugal, Romania, San Marino, Spain, Sweden, Switzerland, Thrkey, the Union of Soviet Socialist Republics, the United Kingdom, the United States of America and Yugoslavia, met in Vienna from 4 November 1986 to 19 January 1989 in accordance with the provisions of the Final Act relating to the Follow-up to the Conference, as well as on the basis of the other relevant CSCE documents. The participants were addressed on 4 November 1986 by the Austrian Federal Chancellor. Opening statements were made by all Heads of Delegations among whom were Ministers and Deputy Ministers of many participating States. Some Ministers of Foreign Affairs addressed the Meeting also at later stages. The participants were addressed by a representative of the Secretary-General of the United Nations. Contributions were made by representatives of the United Nations Economic Commis­ sion for Europe (ECE) and UNESCO. Contributions were also made by the following non-participating Mediterranean States: Algeria, Egypt, Israel, Lebanon, Libya, Morocco, Syria and Thnisia. The representatives of the participating States reaffirmed their commitment to the CSCE process and underlined its essential role in increasing confidence, in opening up new ways for co-operation, in promoting respect for human rights and fundamental freedoms and thus strengthening international security. The participating States welcomed the favourable developments in the international situation since the conclusion of the Madrid Meeting in 1983 and expressed their satisfaction that the CSCE process has contributed to these developments. Noting the intensification of political dialogue among them and the important progress in negotiations on military security and disarmament, they agreed that renewed efforts should be undertaken to consolidate these positive trends and to achieve a substantial further improvement of their mutual relations. Accordingly, they reaffirmed their resolve fully to implement, unilaterally, bilaterally and multilaterally, all the provisions of the Final Act and of the other CSCE documents. As provided for in the Agenda of the Vienna Meeting, the representatives of the participating States held a thorough exchange of views both on the implementation of the provisions of the Final Act and the Madrid Concluding Document and of the tasks defined by the Conference, as well as, in the context of the questions dealt with by the latter, on the deepening of their mutual relations, the improvement of security and the development of co-operation in Europe, and the development of the process of detente in the future.

  • CSCE Vienna Follow-Up Meeting - A Framework for Europe's Future

    The representatives of the participating States of the Conference on Security and Co-operation in Europe (CSCE), Austria, Belgium, Bulgaria, Canada, Cyprus, Czechoslovakia, Denmark, Finland, France, the German Democratic Republic, the Federal Republic of Germany, Greece, the Holy See, Hungary, Iceland, Ireland, Italy, Liechtenstein, Luxembourg, Malta, Monaco, the Netherlands, Norway, Poland, Portugal, Romania, San Marino, Spain, Sweden, Switzerland, Turkey, the Union of Soviet Socialist Republics, the United Kingdom, the United States of America and Yugoslavia met in Vienna from 4 November 1986 to 17 January 1989 in accordance with the provisions of the Final Act relating to the Follow-Up to the conference, as well as on the basis of the other relevant CSCE documents. The representatives of the participating States reaffirmed their commitment to the CSCE process and underlined its essential role in increasing confidence, in opening up new ways for cooperation, in promoting respect for human rights and fundamental freedoms and thus strengthening international security. The participating States welcomed the favourable developments in the international situation since the conclusion of the Madrid Meeting in 1983 and expressed their satisfaction that the CSCE process has contributed to these developments. Noting the intensification of political dialogue between their countries and the important progress in negotiations onmilitary security and disarmament they agreed that renewed efforts should be undertaken to consolidate these positive trends and to achieve a substantial further improvement of their mutual relations. Accordingly, they reaffirmed their resolve to implement fully, unilaterally, bilaterally and multilaterally, all the provisions of the Final Act and of the other CSCE documents.

  • The State of Human Rights in Romania: An Update

    One year after worker-led disturbances erupted in Brasov and other Romanian cities, Romanian society remains tense, divided and increasingly impatient with a regime that exhibits little regard for the well-being of its citizenry. While the Romanian Party and Government have succeeded in quashing most open expressions of dissent, they have failed abysmally in garnering popular support for their programs -- if such support was ever solicited or even de­sired. Systematically depriving its citizens of the possibility to exer­cise the most fundamental human rights, and robbing them of the social and economic rights it supports so heartily in words, the Ro­manian regime has lost any legitimacy it might once have enjoyed among its citizens. Romanian citizens and recent emigrants from that country testi­fy that repression has grown in the year after Brasov. While most prisoners of conscience were released under a January 1988 amnes­ ty, dissidents continue to be surveilled, followed, called in repeatedly for questioning by the Securitate, and placed under house arrest. Telephone lines are cut and mail intercepted to increase the dissidents' sense of isolation not only from the world outside Romania, but also from contacts within the country. Censorship has become more severe, and the security apparatus maintains an even more visible presence than before. The notorious but still unpublished Decree 408, which requires Romanian citizens to report to police all meetings with foreign citizens within 24 hours, is stringently enforced. Romania's economy continues to deteriorate. Fuel and electricity have been rationed for years. Staple foods, including milk, bread and flour, are rationed, and in many localities even these are unavailable. Meat is a rarity; soup bones only occasionally appear in stores. Decades of financial misplanning and inefficient industrial devel­opment have led to the dire condition of the Romanian economy, making it the poorest in Europe after Albania. The Government continues to repay its foreign debts at a swift rate and modernizeat the expense of the Romanian people's well-being.  

  • Status of Conventional Stability Talks in Europe

    This hearing, which Commissioner Steny H. Hoyer presided over, was part and parcel of an anticipated series of Conventional Stability Talks within the framework of the Commission on Security and Cooperation in Europe. The hearing also was a joint hearing of the Foreign Affairs Committee and the Helsinki Commission. At the hearing, Commissioner Hoyer expressed the sentiment of a heightened political awareness of the conventional force issue, particularly in the wake of the recently ratified INF Treaty, tempered with the desire to not have these sorts of issues (i.e. the CSCE’s expansion to encompass conventional force negotiations and the developing overlap of the conventional stability and CSBM talks) overshadow human rights. Balancing of the different East-West relations is an explicit objective, the Commissioner said. Not only did attendees at this hearing discuss Conventional Stability, but they also discussed the status of the agenda in Vienna and the developing relationship among all these talks within the CSCE process.  

  • Soviet Trade and Economic Reforms: Implications for U.S. Policy

    The motive for holding this hearing, which Rep. Steny H. Hoyer and Sen. Dennis DeConcini chaired, was due to the increased attention that the commercial aspect of East-West relations had gotten. Of course, balance among the different aspects of East-West relations has been a stated political objective of all signatories of the Helsinki Final Act. More specifically, attendees at the hearing discussed tying human rights on the part of the U.S.S.R. to East-West trade relations. From its inception, the Helsinki Final Act has explicitly set forward progress in the area of human rights and fundamental freedoms, as well as increased cooperation in areas of trade, exchanges, and military security. The sense of the hearing was that the U.S.’s security needs, human rights concerns, and economic can be balanced.

  • Reform and Human Rights - The Gorbachev Record

    Based on the Commission's continuing, professional contacts with a wide range of experts on Soviet affairs in this country and abroad, this report is a sober, factual survey of Mikhail Gorbachev's efforts during his first three years as General Secretary of the Soviet Communist Party to promote significant reforms in the politics, economy and society of his country. The report is designed to contribute to that consistent pressure, for in describing how much has changed or seems to be in the process of changing, it also documents how many fundamental rights of Soviet citizens to freedom of expression, of belief, of movement and of national character remain restricted and unprotected. There has been much to applaud in the three years of Gorbachev's rule, especially compared to the repressive actions of his predecessors. The release of many political prisoners from camps and psychiatric prison-hospitals, the rise in the numbers of Soviet citizens permitted to emigrate and to travel, the increasing candor of the official Soviet press and the increasing tolerance shown to unofficial groups and unorthodox points of view are all welcome first steps in the right direction. They are, however, no more than first steps. And as our reportdocuments, they were taken slowly and could be retracted almost overnight. Until the rule of law establishes a decent balance between the power of the Soviet state and the human dignity of individual Soviet citizens, the latter will always be at risk.

  • Vienna Review Meeting of the CSCE - Phase III and IV

    The main activity of the Vienna Meeting throughout Phases III and IV was the presentation and negotiation of proposals for inclu sion in the concluding document of the meeting. The number (more than 160), complexity and controversial nature of many of these propos­als led to the extension of the Vienna Meeting well beyond its target closing date of July 31. These factors, along with other ele­ments such as continuing major shortcomings in the implementa­ tion of existing commitments, are largely responsible for the con­tinuation of the Vienna Meeting into 1988. The slow pace of progress already evident in Phase II continued through the next phase. Each side defended its own proposals but showed little disposition to begin the process of compromise which could lead to the conclusion of the meeting. The main procedural development during this phase was the appointment of coordina­tors from the neutral and non-aligned states to guide the work of the drafting groups. This development provided greater order and structure for the proceedings but did little to advance the drafting work or to induce compromises. Other major developments during this phase were the introduc­tion of the long-awaited Western proposal on military security and the tabling of a comprehensive compromise proposed in Basket III by two neutral delegations, Austria and Switzerland. Both propos­als were put forth at the very end of the phase and thus did not have much impact until the next phase. The Western (NATO) proposal on military security questions was designed as a response to the Eastern proposal which envisioned two main objectives: another round of negotiations on confidence­ and security-building measures (CSBMs) to build upon the success­ful Stockholm meeting and the initiation of negotiations on conven­tional disarmament, both within the same CSCE forum. The West­ern response to this proposal was delayed primarily because of United States and French differences over the connection between the conventional arms negotiations and the CSCE process, the French arguing that the negotiations should be an integral part of the process and the U.S. insisting that they be independent. The issue was resolved by agreement that the negotiations would be "within the framework of the CSCE," but should remain autono­mous.

  • The Miroslav Medvid Incident - Findings, Conclusions and Recommendations (Part 2)

    This report results from an investigation directed by the Commission on Security and Cooperation in Europe into the attempted defection of Miroslav Medvid and other similar incidents of involuntary repatriation of Soviet and Soviet-bloc nationals, with recommendations for any appropriate changes in US law. This investigation began in July 1986, with research into available public source background material. By September 1986, fieldwork commenced, consisting primarily of witness interviews, records reviews, and search for other evidentiary materials. More than 200 interviews and 100 informal contacts were conducted by CSCE investigators. A few investigative initiatives were hampered by foreign government and Executive Branch decisions to deny access to certain witnesses and records. However, the effect of the omissions was minimized by the preponderance of other available evidence on the issues. This report presents a narrative story of The Medvid Incident, followed by the factual and legal issues raised by the events (Part I). The second section examines other incidents of repatriation cases, including case studies and analyses, and a statistical examination of deserting crewmen and apprehensions.

  • The Vienna Review Meeting of the CSCE - Compilation of Speeches (Jan-Apr 1987)

    On November 4, 1986, the 35 signatory nations to the Helsinki  Final  Act convened in Vienna for the third follow-up meeting of the Conference on Security and Cooperation in Europe. During the six weeks that followed the opening of the Conference, there was a thorough exchange of views on the implementation of the provisions of the Helsinki Final Act and the Madrid Concluding Document, along with discussion about the next phases of review of the Helsinki process. The United States delegation to the Vienna Review Meeting made significant contributions in detailing the human rights abuses of the Soviet Union and the Eastern Bloc countries in their many speeches in both the plenary sessions and in various subsidiary working groups.

  • Allocation of Resources in the Soviet Union and China

    Hon. William Proxmire, Chairman of the Subcommittee on National Security Economics, presided the hearing on the allocation of resources in the Soviet Union and China. The first section of the hearing was devoted to the Soviet Union, because of the many changes and substantive developments in this region. Since coming to power in March 1985, Mikhail Gorbachev had put forward the most ambitious program for economic, political, and social change since Nikita Khrushchev, often linking the URSS's ability to mantain its status as a military "superpower" to the success of his efforts. This hearing provided an initial evaluation of Gorbachev's program. It began by describing Gorbachev's policies and assessing their impact on the economy's performance in 1986. The witnesses, then, analyzed the future direction of his economic modernization program in light of the 1987 Plan and the demands for continued military force development. Finally, they evaluated the Soviet external relations, including the trade initiatives and the effect of changes in Soviet-China relations. Senator Proxmire was joined by Douglas MacEachin, Director of Soviet Analysis for Central Intelligence Agency and Rear Admiral Robert Schmitt, Deputy Director of Defense Intelligence Agency.
