Russian dictator Vladimir Putin’s war on the Ukrainian people is an urgent threat to European security and global peace. Should his destructive gambit succeed in Ukraine, Russia will have dramatically expanded its de-facto border with NATO—including through a soft annexation of Belarus—as well as its ability to destabilize the democracies of Central and Western Europe. Russian military success would threaten to draw a new iron curtain across Europe, dividing those protected by NATO’s security guarantees from those left exposed to Russian predation. This division could lead to significant remilitarization, a reappearance of Cold War tensions, and a reversion to historic cycles of European conflict. Beyond Europe, revisionist powers would be emboldened, and the United States and its Allies would be less able to deter them. On March 23, 2022, the Helsinki Commission heard testimony from a panel of witnesses who recommended ways to deter Russian dictator Vladimir Putin’s from further escalating his unprovoked attack on Ukraine. Helsinki Commission Chairman Sen. Ben Cardin (MD) opened the hearing by denouncing Mr. Putin as a war criminal, calling for accountability for the heinous war crimes currently being committed in Ukraine. He lauded the heroism of the Ukrainian people and recognized Ukraine’s President Volodymyr Zelensky as a champion of democracy. “They’re an inspiration to all of us,” he stated. “President Zelensky [is] there fighting for the sovereignty of Ukraine, but he’s also fighting for the sovereignty of the free world.” Ranking Member Sen. Roger Wicker (MS) welcomed the assistance the United States already has provided, while simultaneously calling for greater action. “I call on the President today, the Secretary of State, and the White House to unleash the full package of sanctions that are available to them,” he said, “and to enhance the weaponry that we have already made available to our friends in Ukraine.” Co-Chairman Rep. Steve Cohen (TN-09) and Sen. Richard Blumenthal (CT) pledged to support Ukraine and called for the facilitation of additional weaponry to the Ukrainian army and implementation of stronger economic sanctions of Russian oligarchs and their enablers. Before the witnesses testified, Ukrainian Ambassador to the United States Oksana Markarova addressed the commission, denouncing the Russian invasion of Ukraine as a violation of international law and a greater threat to the democratic world. “So what is happening in Ukraine is not only about Ukraine,” she asserted. “The very foundation of the world rule-based order, as we all knew and respected it after World War II, has been under attack today.” General Phillip Breedlove, former commander of U.S. European Command and NATO’s former Supreme Allied Commander Europe, testified that the Western response to Russia’s invasion has been almost entirely limited to economic measures, with no formidable action taken thus far in the diplomatic, informational, or military sphere. He supported the implementation of humanitarian corridors and humanitarian airlifts, both protected by NATO-enforced humanitarian no-fly zones. “We have allowed Mr. Putin to accomplish both the goals of deterring us and gaining initiative,” he stated. “I’m advocating that we and our Western partners reevaluate our strategic approach: Mr. Putin should be deterred, vice we in the West[HS1] . This requires moving away from a passive deterrent posture to affecting a more active deterrence.” Dr. Michael Kimmage, fellow at the German Marshall Fund and Department Chair at Catholic University of America, warned of historical precedents regarding containment of the Soviet Union, and how it applies contemporarily to Russia’s war in Ukraine. “Policy success should be measured not against maximalist dreams in which Putin, and with him Russian military power, exit the scene. Russian power is here to stay. Policy success should be measured against the much more achievable goal of containing this very power,” he said. Dr. Miriam Lanskoy, senior director for Russia and Eurasia at the National Endowment of Democracy, warned of the dangers of potentially isolating the Russian public from the global internet and media. She advocated for engaging with Russian citizens, while simultaneously opposing the Russian government. “Distinguish between Putin’s regime and its various enablers and the Russian people, preserve support and amplify the voices of Russian democrats now fleeing the country and those who remain inside,” she recommended. The United States has been a key supporter of Ukraine, providing weaponry, humanitarian relief, and other forms of urgent assistance, in addition to leveling crippling sanctions on Russia. However, Russian forces continue to bombard Ukrainian cities, targeting civilians and critical infrastructure. Russia’s brutal war is causing an unprecedented humanitarian catastrophe in Ukraine, and observers worry that Putin may next use chemical or other weapons of mass destruction. On March 16, President Zelenskyy appealed to the U.S. Congress to render additional aid to Ukraine, including the possibility of enforcing a no-fly zone. The briefing, held on March 18, 2022, explored the various military strategies available to the West in its defense of Ukraine. Panelists examined Ukraine’s militaristic capabilities, as well as the various risks associated with implementing military recommendations, such as humanitarian air corridors or NATO-enforced no-fly zones. Steve Cohen (TN-09) opened the briefing by reaffirming his support for the facilitation of transferring Polish fighter jets to Ukraine, as well as his confidence in the strength and capability of the Ukrainian military. “The Ukrainian army has proven to be [pretty good] at knowing what they can do with their equipment,” he said. “It’s a conflict between rule of law and rule of gun.” Mr. Cecire explained that despite Russia’s obvious military advantages, the Ukrainian military has thus far successfully stymied Russian aggression. Unfortunately, as Russian forces grow frustrated with their lack of military progress, they have become increasingly indiscriminate in their attacks, targeting innocent Ukrainian civilians, and bombarding critical infrastructure, such as shelters and hospitals. General Clark advocated for a humanitarian airlift, implemented with U.N. approval, and a no-fly zone, as requested by Ukraine. He asserted that Russian dictator Vladimir Putin will eventually strike NATO territory with missiles, and that Putin’s threats of nuclear escalation should not deter Western states from defending a rules-based international order. “There’s a fallacy here, that somehow NATO inaction will translate into Putin’s refusal to escalate. This is a logical fallacy,” he said. “Putin will escalate as necessary to obtain his objectives. So I’m trying to find a third course of action between Ukrainian defense and Russian escalation, which is to provide the firebreak of a humanitarian rescue mission assigned into various locations that puts a firebreak into the fighting that could lead to a ceasefire, that could lead eventually to, coupled with the sanctions, a Russian pullback and withdrawal.” Dr. Pettyjohn discussed the risks of implementing humanitarian no-fly zones or humanitarian corridors, deeming them potentially escalatory and ineffective. A better alternative, she argued, would be for the international community to arm the Ukrainian people with mobile short-, medium-, and long-range air defenses, and to continue to provide precision standoff weapons. “The international community should help Ukraine, but not by following the post-Cold War playbook of implementing a no-fly zone,” she stated. “Against Russia, a no-fly zone would be even more difficult to implement and may not succeed… and it raises the potential for limited, or even more extensive than that, nuclear use, which is not something that I ever want to see in my lifetime.” Dr. Kroenig addressed the risk of nuclear escalation, arguing that although Russia’s threat of utilizing nuclear weapons in Ukraine should not be dismissed, the United States and NATO can enhance military support to Ukraine without escalating the risk on nuclear war. He advocated for the creation of humanitarian corridors, while cautioning against the establishment of a no-fly zone. “When it comes to no-fly zones or humanitarian corridors, I think I might split the difference between Dr. Pettyjohn and General Clark. Russian dictator Vladimir Putin’s invasion of Ukraine has destroyed the international framework that has kept the peace in Europe since 1945, at a time when Baltic states Lithuania, Estonia, and Latvia already faced complex and evolving security challenges. Beyond Putin’s existential threats, the Baltic states now must deal with a Belarus that has become little more than a staging area for Moscow to wage war on its peaceful neighbors. China’s economic and diplomatic pressures also continue to weigh heavily. Yet these three relatively small countries nevertheless are demonstrating courageous, principled, and effective leadership on the international stage. On March 17, 2022, the Helsinki Commission heard from the chairs of the foreign affairs committees of the national parliaments of Lithuania, Estonia, and Latvia. The three witnesses offered views on opportunities to address the deteriorating security situation in Europe, including and especially through partnership with the United States. Ranking Member Sen. Roger Wicker (MS) opened the hearing by acknowledging the vulnerable position the Baltic States are in as they face security challenges from Russia, Belarus, and China. He also praised the economic, military, and moral support the Baltic States have provided to Ukraine. “Once again, in this crisis the three Baltic countries are punching above their weight,” he said. “And I have every expectation they will continue to do so.” Co-Chairman Rep. Steve Cohen (TN-09) emphasized the longstanding bonds between the Baltic countries and the United States, particularly throughout the era of Soviet occupation. “I suspect if the three Baltic countries were not members of NATO, you might have already met Vladimir Putin’s armies… we want to assure you that we are with you.” Chairman Sen. Ben Cardin (MD) underscored the deep and bipartisan commitment of the United States to Article 5 of NATO. “We stand with you on your sovereignty and will be there to protect the sovereignty of your countries against any attempt by Russia to interfere with that,” he said. Joe Wilson (SC-02) expressed appreciation for the commitment Latvia, Lithuania, and Estonia have shown to promoting independence and freedom in Europe, and to their NATO membership. “The Baltic allies have been on the forefront of trying to stop the advance by Putin,” he said. He also praised the support the Baltic states are providing to Belarussian dissidents, activists, and opposition politicians. Commissioner Rep. Ruben Gallego (AZ-07) stressed the importance of the current moment for Baltic security and highlighted the Baltic Security Initiative, which bolsters the defense capabilities of Estonia, Latvia and Lithuania in areas including air defense, maritime situational awareness, ammunition, C4ISR, and anti-tank capabilities. He said, “If we draw any lessons from the ongoing war in Ukraine, it’s that we need to ensure our allies and our partners are too prickly for any adversary or competitor to swallow.” Laima Andrikiene, Chair of the Foreign Relations Committee of the Seimas of Lithuania, testified that the global democratic order has been ravaged and called on the United States to position permanent combat forces in Lithuania in order to build credible defense against Russian military threats. She also urged international allies not to forget the threat China poses. “The case of Lithuania is a test for the entire democratic world of our ability to withstand economic coercion and to deter China from using coercion as a regular foreign policy tool to advance its goals,” she said. Marko Mihkelson, Chair of the Foreign Affairs Committee of the Riigikogu of Estonia, warned of the brutality and ruthlessness of the Russian war machine, referencing his prior career as a journalist, when he reported on the Chechen War. “Russia’s blatant aggression and military invasion in Ukraine has caused a fundamental shift in the European security architecture and threatens the peace and stability of democratic nations, not only in Europe but worldwide,” he said. “The future of our common security will be decided in Ukraine.” Rihards Kols, Chair of the Foreign Affairs Committee of the Saeima of Latvia, described the hybrid warfare tactics Russia is employing and the importance of supporting a well-educated and informed society in order to counter hybrid threats. Kols advocated for decisive action against Putin and warned against hesitance. Helsinki Commission Urges Biden to Designate Ukraine, Georgia as Major Non-NATO AlliesSaturday, March 12, 2022
The Helsinki Commission, an independent U.S. government agency tasked with promoting human rights and security in Europe, has called on the Biden administration to upgrade the United States’ defense relationship with Ukraine. The commission seeks to help facilitate military and economic assistance to Kyiv as Russian forces move to encircle the Ukrainian capital. In a letter to U.S. President Joe Biden obtained by Foreign Policy, the commission urged the administration to designate Ukraine and Georgia, which was invaded by Russia in 2008, as major non-NATO allies (MNNA) and to reinvigorate U.S. support for the NATO accession of both countries. “Although the United States has consistently supported Ukraine’s and Georgia’s NATO membership, Russia’s occupations and ongoing invasion expose the tragedy of long-stalled Euro-Atlantic enlargement,” wrote the commission, which is led by Democratic Sen. Ben Cardin and Democratic Rep. Steve Cohen. “Absent strong and proactive U.S. backing for Ukrainian and Georgian NATO membership, [Russian President Vladimir] Putin will continue to take ample advantage in his aspirations to upend security and cooperation in Europe and his neocolonial agenda,” the letter said. Both Ukraine and Georgia were promised membership to the defense alliance during the NATO summit in Bucharest, Romania, in 2008. But despite extensive reform efforts, neither country has been offered a timetable for accession. The United States has provided billions of dollars of military assistance to Ukraine since it was first invaded by Russia in 2014, with more than $1.2 billion approved over the past year. “This designation is a fair reflection of our current bilateral defense relationships and does not commit the United States to military action,” the commission letter said, which also recommended that the administration consider extending the status to other non-NATO members along Europe’s eastern flank: Finland, Moldova, and Sweden. Much of U.S. military aid for Ukraine has been approved through a range of ad hoc government funding mechanisms. Granting the country MNNA status would open a variety of established channels to facilitate arms transfers, financial assistance, and information sharing, smoothing the way for further cooperation. It would also send a powerful signal of support for both Kyiv and Tbilisi. Unlike NATO membership, MNNA status does not entail any mutual security and defense obligations. On Thursday, the White House announced it would designate Colombia and Qatar as major non-NATO allies, bringing the total number of countries to receive the title up to 19. The title has usually been reserved for countries with no ambitions or prospects of joining NATO, which prompted the Ukrainian ambassador to the United States, Oksana Markarova, to express wariness about the designation last year. “MNNA is a status for countries that do not plan/can not force political or geographical reasons to join NATO. This is definitely not about us,” she wrote in a Facebook post. NATO accession is decided between the 30 members of the alliance, and an MNNA designation by the United States would not necessarily impede Ukraine’s membership prospects. The Helsinki Commission, formally known as the Commission on Security and Cooperation in Europe, was founded in 1976 as an independent government agency to monitor compliance with the Helsinki Accords, a major Cold War-era diplomatic agreement that sought to reduce tensions between the Soviet Union and the West as well as establish human rights and security norms. The commission is made up of 18 members of U.S. Congress drawn from both parties and representatives from the U.S. departments of State, Defense, and Commerce.

Helsinki Commission calls on Biden administration to push for Russia's expulsion from InterpolFriday, March 11, 2022
An independent US government agency is calling on the Biden administration to push for Russia to be permanently expelled from Interpol — a step further than the suspension the administration has already sought — citing the invasion of Ukraine and previous abuses by Russia, according to a letter obtained by CNN. Earlier this week, Attorney General Merrick Garland joined justice ministers from several allied countries to demand that Interpol immediately suspend Russia from accessing its systems, according to Justice Department spokesperson Anthony Coley. Interpol, the International Criminal Police Organization, is a global agency which facilitates police across its 195 member countries to collaborate on criminal investigations. Interpol issues what are known as Red Notices to request the location and arrest of an individual pending their extradition. Friday’s letter from the Commission on Security and Cooperation in Europe commended the steps the US has taken so far, but added that the administration should call for the permanent suspension of Russia. “We urge you to use the U.S. position in Interpol (and in particular Interpol's Executive Committee and its Advisory Group on Financial Matters) to make it clear that any failure to act against Russia's abuse of lnterpol will have grave consequences for the U.S. contribution to Interpol's budget and Interpol's legal immunities in the United States,” the letter, directed to Garland and Secretary of State Antony Blinken, reads. The commission — also known as the US Helsinki Commission — was created by Congress in 1976 with a focus on human rights, military security, and economic cooperation. It is led by Sen. Ben Cardin and Rep. Steve Cohen. If Russia is suspended from Interpol, it would bar the country from continuing to participate and therefore put in requests for Red Notices, but it would not remove Red Notices that are already in the system, said Ted Bromund, a senior research fellow at the Heritage Foundation and an expert in Interpol.

Since Russia launched a full-scale invasion of Ukraine on February 24, Moldova was among the first to open its borders to Ukrainian refugees and hosts more refugees per capita compared to any other European state. Russia illegally maintains a garrison of approximately 1,500 troops on Moldovan territory in Transnistria and supports a separatist government. On March 2, the Government of Georgia co-sponsored a UN General Assembly resolution that condemned Russia’s war against Ukraine. Steve Cohen (TN-09) led a bipartisan Congressional delegation to the Winter Meeting of the OSCE Parliamentary Assembly (OSCE PA) in Vienna, where he served as the Head of the U.S. Delegation. Other participating Helsinki Commissioners included Ranking House Commissioner Rep. Joe Wilson (SC-02), and Commissioners Rep. Robert Aderholt (AL-04), Rep. Richard Hudson (NC-08), and Rep. Marc Veasey (TX-33). They were joined on the delegation by Rep. Sheila Jackson Lee (TX-18). Ranking Senate Commissioner Sen. Roger Wicker (MS) and Rep. Chris Smith (NJ-04) participated remotely as members of the U.S. Delegation. The OSCE PA, consisting of 323 legislators from the 57 countries of the OSCE, has been particularly useful in defending democracy and promoting security in the face of numerous threats and challenges across the OSCE region. The Winter Meeting, held in a hybrid format due to ongoing but easing COVID restrictions, allows parliamentarians an opportunity to engage OSCE officials and diplomatic representatives, as well as to initiate work for the coming year. Prior to the Winter Meeting, the delegation visited Lithuania to demonstrate the strong U.S. support for this close NATO ally, which not only faces security threats on its borders but also provides refuge to independent voices from Russia and Belarus. OSCE PA Winter Meeting The 2022 Winter Meeting coincided with Russian dictator Vladimir Putin’s large-scale invasion of neighboring Ukraine, a horrific escalation of a conflict that began with Russia’s illegal occupation of the Crimean Peninsula in 2014 and ongoing aggression in the eastern portion of Ukraine. Ahead of the Winter Meeting, the OSCE PA Secretary General Roberto Montella and members of OSCE PA leadership (including Sen. Wicker as a Vice President and Rep. Hudson as Chair of the Committee on Political Affairs and Security) met in an emergency session and issued a statement condemning the Kremlin invasion as a “clear and gross violation of the most basic norms of international law as well as OSCE principles and commitments.” The group also issued a subsequent statement standing “in solidarity with the people of Ukraine and its elected government” and noting the “extraordinary courage” exhibited by “civilians, the armed forces and national leaders, including President Volodymyr Zelensky.” Statements condemning Vladimir Putin for the deliberate assault of Russian forces on Ukraine dominated the formal sessions of the meeting, despite an agenda originally designed to consider ongoing OSCE PA work on a wide range of issues. Co-Chairman Cohen spoke for the United States, decrying Putin’s claim that the Ukrainian government is led and run by Nazis. In a poignant end to the Standing Committee’s second session, the Ukrainian Head of Delegation, Mykyta Poturaiev, reported on violence in his neighborhood of Kyiv and bid farewell as he sought to return to his family in Ukraine. The 2022 Polish Chair-in-Office of the OSCE for 2022 outlined Poland’s priorities in an utterly transformed era in European security. During the general debate, nominally on the topic of “security guarantees and the indivisibility of security in Europe,” delegations resumed their near-universal condemnation of Putin’s invasion of Ukraine. Rep. Hudson opened the meeting of the Committee on Political Affairs and Security by denouncing the invasion of one participating State by another, in total opposition of Helsinki principles. He also underlined the committee’s particular relevance in the context of the security crisis precipitated by Russia, a view reinforced by a panel of senior OSCE officials present as guest speakers. Finally, Rep. Hudson moderated a debate on “heightened tensions in the OSCE area and the need for inter-parliamentary dialogue.” The debate focused heavily on the attack on Ukraine, with Sen.Wicker remotely joining those in Vienna condemning Russia’s outrageous behavior, and Rep. Jackson Lee forcefully urging members to recall the role of the Belarusian government in the events leading to the invasion. In the economic and environmental affairs committee, Rep. Smith spoke alongside OSCE official Valiant Richey about their efforts as special representatives on human trafficking issues of the Parliamentary Assembly and the OSCE, respectively. They specifically discussed supply chains as they relate to human trafficking matters. Representative Wilson spoke for the United States in the subsequent debate. In the committee dealing with democracy and human rights, Rep. Wilson condemned Russian human-rights violations in occupied Ukraine and in Russia itself, as well as ongoing repression in Belarus. Rep. Aderholt defended free media in his statement to the committee following presentations by recent Nobel laureate and Novaya Gazeta editor Dmitriy Muratov and OSCE Representative on Freedom of the Media Teresa Ribeiro. On the margins of the Winter Meeting, the U.S. delegation gathered key parliamentarians from a range of participating States over dinner, fostering an opportunity for frank and candid exchanges of views on important topics confronting the OSCE. The event emphasized the depth of the U.S. commitment to European security, going beyond diplomatic representatives to include elected Members of Congress. The delegation also was briefed by diplomats representing the United States in the OSCE, including Ambassador Michael Carpenter, and held bilateral meetings with the heads of the Azerbaijani and Mongolian OSCE PA Delegations. Visiting Lithuania The delegation’s presence in Europe also afforded an opportunity to visit Lithuania to underscore U.S. support for a crucial NATO ally at a time of deep concern caused by Russian aggression. In Vilnius, the delegation met with Lithuanian President Gitanas Nauseda, Prime Minister Ingrida Simonyte, Foreign Minister Gabrielius Landsbergis, and senior members of the Lithuanian Parliament (Seimas) to discuss the Russian assault on Ukraine, the deterioration of regional security, and Lithuania’s values-based foreign policy, including relations with China. Officials emphasized to the delegation the game-changing nature of recent developments, especially the total capitulation of the Lukashenko regime in Belarus to Moscow. These actions resulted in a dramatically more challenging situation on Lithuania’s border, leaving the country essentially no warning should Putin choose to act against the Baltic states. The delegation also visited the Pabrade Training Area, a Lithuanian initiative which provides facilities for U.S. and Allied military activities in the region. Members also met with Belarusians and Russians who had fled to Lithuania to avoid persecution, including Sviatlana Tsikhanouskaya and other opposition leaders, civil society organizations, and the media.

Joe Wilson (SC-02) issued the following joint statement: “We are saddened and angered by the tragic death of Maryna Fenina, a Ukrainian member of the OSCE Special Monitoring Mission (SMM) in Ukraine, during shelling in Kharkiv on March 1. We offer our deepest condolences to her family and friends. “Russian dictator Vladimir Putin’s ruthless attack against the people of Ukraine is targeting men, women, and children; destroying homes, businesses, and cultural treasures; and forcing millions to flee for their lives. Putin’s unprovoked war is shredding the European security architecture that brought peace after the Second World War. Individuals like Maryna Fenina remind us of the terrible human toll of war. “Russia must cease its brutal and criminal invasion and withdraw its forces from the sovereign territory of Ukraine.” Maryna Fenina was the second OSCE SMM member to die as a result of Russia’s aggression against Ukraine. Joseph Stone, a U.S. paramedic serving with the SMM, was killed In April 2017 when his vehicle struck a landmine in Russian-controlled territory in eastern Ukraine. The SMM was established in 2014 to monitor implementation of the Minsk agreements, which were designed to bring peace to eastern Ukraine. It is an unarmed, civilian mission that has served as the international community’s eyes and ears on the security and humanitarian situation in the conflict zone. On February 25, the SMM decided to withdraw its international mission members from Ukraine. Ukrainian national mission members remain in the country.

A sizable and active U.S. presence at the hybrid event helped generate nearly united condemnation of the Kremlin attack and provided assurance of the U.S. commitment to European security during a time of great uncertainty. “Our bipartisan delegation actively and adamantly defended Ukraine’s rights as a sovereign nation in the face of unchecked Russian aggression,” said Co-Chairman Cohen. “The European security architecture that has supported peace and prosperity on the continent and around the world for decades must not be allowed to crumble at the whim of a dictator with grandiose aspirations of returning to some imagined past glory. Turkey is at a crossroads. Even as the Turkish Government insists that it remains committed to its NATO partners and to future EU integration, its actions—both foreign and domestic—call those promises into question. Turkey has been a steadfast supporter of Ukraine and Turkish officials have announced plans to normalize relations with Armenia and moved to restore ties with several Middle Eastern countries, including Egypt and Israel. At the same time, the government has reiterated its commitment to the use of Russian military equipment, eroding relations with the United States and other members of NATO. Despite being a founding member of the Organization for Security and Cooperation in Europe (OSCE), Turkey is struggling to live up to the principles of respect for fundamental freedoms outlined in the Helsinki Final Act. A record number of Turkish journalists are behind bars. The failure of the Turkish government to comply with a ruling of the European Court for Human Rights on the case of Osman Kavala paved the way for the country’s potential expulsion from the Council of Europe, and thousands of others arrested following the attempted 2016 coup also languish in prison on dubious charges. The briefing, held on February 16, 2022, investigated the intersection of Turkey’s OSCE and NATO commitments related to human rights and security, and its domestic policies that fail to hold true to these principles. Panelists also explored practical policy recommendations to help Turkey overcome this disconnect. During the briefing, attendees heard from Dr. Soner Cagaptay, Director of the Turkish Research Program at the Washington Institute for the Near East, and Deniz Yuksel, Turkey Advocacy Specialist with Amnesty International. The briefing was moderated by Helsinki Commission Senior Policy Advisor Bakhti Nishanov. Co-Chairman Rep. Steve Cohen (TN-09) opened the briefing by remarking on the importance of Turkey and his personal history with Turkey. He also emphasized that human rights abuses in Turkey have long been a subject of concern, particularly those brought about by President Erdogan’s empire-building attempts. “We need to do what we can to see that the whole world is fair for citizens to express themselves, for press to express themselves, and for people to get information, without which we will not have independent democracies,” he said. Mr. Nishanov explained in opening remarks that Turkey’s position is complex and multi-faceted—while Turkey has been making efforts to normalize relationships with Armenia, Israel, and Egypt as well as bearing a large refugee burden, recent years have been challenging as Turkey experienced economic pain, inflation, and governance issues. Additionally, Turkey’s record of human rights abuses, anti-immigrant sentiments, and other obstacles cast a pall on recent progress, and bring into question the future of Turkey’s democratic development. Dr. Soner Cagaptay spoke about President Erdogan’s declining domestic popularity and the looming threat of economic hardship in Turkey. He also remarked on President Erdogan’s attempts to restore ties with Turkey’s Gulf neighbors, as well as with the United States and Europe. Dr. Cagaptay asserted that as tensions heightened between Russia and Ukraine, Turkey would adopt a neutral public-facing identity, but support Kyiv militarily. While Russia and Turkey are often compared, he pointed out that Turkey has measures of democracy that Russia does not. “The lesson of Turkey under Erdogan is that it takes a long time to kill [democracy]. Turkish democracy is resilient, it is not dead,” he said. Deniz Yuksel spoke to Turkey’s human rights crisis and the dangers opposition politicians, journalists, and citizens face. Reports of torture and detention are common, and those calling out such abuses face persecution themselves. She recommended that U.S. officials raise human rights concerns in every engagement with Turkey. She emphasized, “From the record-breaking imprisonment of journalists to the persecution of LGBTI people, an ongoing crisis of gender-based violence, and the unlawful deportation of refugees, the failures of Turkey’s judicial system cut across societal lines and undermine the human rights of all.” During the question-and-answer segment of the briefing, panelists addressed a range of questions including how specific ethnic minorities are treated in Turkey, how human rights abuses may affect Turkey’s relationship with the United States, and what challenges will arise alongside Turkey’s 2023 elections. By Ryn Hintz, Paulina Kanburiyan, and Worth Talley, Max Kampelman Fellows, and Shannon Simrell, Representative of the Helsinki Commission to the U.S. Mission to the OSCE On February 7 – 8, 2022, the OSCE’s Polish Chair-in-Office organized a high-level conference in Warsaw on Combating Anti-Semitism in the OSCE Region with the support of OSCE’s Office for Democratic Institutions and Human Rights (ODHIR). During the event, government officials, experts, civil society organizations, and the private sector underscored the ongoing threat that anti-Semitism poses not only to Jewish communities, but to democracy everywhere, and the shared responsibility to fight it. In a series of exchanges with experts over two days, more than 100 participants from over 25 countries unilaterally condemned anti-Semitism, Holocaust denial, discriminatory prohibition of religious practices, and other manifestations of prejudice against the Jewish community. They also discussed innovative history education, youth engagement, and legislative responses to foster Jewish life. Helsinki Commission Chairman Sen. Ben Cardin, who also serves as the OSCE Parliamentary Assembly’s Special Representative on Anti-Semitism, Racism, and Intolerance, opened the event by underscoring the need for sustained, coordinated action to end the pervasive anti-Semitism plaguing the OSCE region. “Although recalling the Holocaust is painful, it seems as if we have not fully learned our lesson,” he said. Law Enforcement: A Partner in Combating Hate Speech and Scapegoating OSCE Personal Representative on Combating Anti-Semitism Rabbi Andrew Baker led a session where panelists highlighted the rise in anti-Semitic hate speech, scapegoating, and conspiracy theories since the onset of the global pandemic. Participating States then shared effective national policies and strategies, including best practices of partnering with law enforcement. Addressing Anti-Semitism Online: A Shared Responsibility OSCE Advisor on Combating Anti-Semitism Mikolaj Wrzecionkowski moderated a discussion on steps the private sector, civil societies and governments can take to combat the spread of anti-Semitism online, including actively challenging anti-Semitic algorithms and hashtags, appointing points of contact to address concerns about anti-Semitic content, and promoting educational initiatives among young people, educators, and companies to increase media literacy. The United Kingdom’s Special Envoy for Post-Holocaust Issues, Rt. Honorable Lord Eric Pickles, again underscored the importance of joint action. “At a time of distortion and contempt for our fellow human beings, we need to be able to see our own faces in the faces of strangers,” he stated. Beyond Combatting Anti-Semitism: The Need to Actively Foster Jewish Life Dr. Felix Klein, Federal Government Commissioner for Jewish Life in Germany and the Fight against Anti-Semitism, led a discussion on the challenges and successes of states, cities, and societies in fostering vibrant Jewish communities to both resist the spread of anti-Semitism and uplift Jewish history, culture, and tradition. Panelists shared examples of initiatives to restore cemeteries and monuments, open museums, and compile educational and cultural resources online. Rabbi Pinchas Goldschmidt, President of the Conference of European Rabbis, illustrated the interconnectivity between fostering Jewish life and democracy by discussing recent legislative backlash against Jewish religious practices like circumcision and kosher preparation of meals, further stressing that regulations on these practices must not be prohibitive and should be formed in collaboration with Jewish communities. The Centrality of Education to Address Anti-Semitism and Anti-Roma Discrimination A session moderated by Kishan Manocha, ODIHR’s Head of the Tolerance and Non-Discrimination Department, highlighted the importance of new and innovative education initiatives to address root causes of anti-Semitism and anti-Roma discrimination. Panelists highlighted the need for cross-cultural exposure to combat anti-Semitic and anti-Roma attitudes and build greater connections between those inside and outside Jewish and Roma communities. Policymakers noted the ability to use interactive and digital tools to address histories of discrimination, related not only to the Holocaust but also to Jewish history and contributions to culture and the world. Despite advancements, participants acknowledged that challenges remain: online courses suffer from low completion rates and some curricula address the subject of anti-Roma discrimination only tangentially. Panelists agreed that addressing anti-Roma discrimination also requires a holistic, inter-curricular approach that builds upon knowledge both of the genocide of Roma and Sinti, and of their histories and cultures. To close the conference, Plenipotentiary of Poland’s Ministry Foreign Affairs, Ambassador Paweł Kotowski called on participants to continue their important work to defeat anti-Semitism and anti-Roma discrimination.

Cyprus’ unique location at the cultural crossroads of the eastern Mediterranean and important trade routes between Europe and the Middle East and beyond has shaped the island nation’s rich history. I recently returned to Cyprus to assess developments as the 35th commemoration of the Turkish invasion approaches and a significant portion of the country remains under occupation. Virtually every conversation during my visit, whether with officials or private citizens, touched on some aspect of the ongoing occupation of the country, the legacy of the 1974 invasion, or the prospects for a resolution of “the Cyprus issue.”
In a country with slightly less than a million people covering an area slightly more than half the size of Connecticut, one is hard-pressed to find a Greek Cypriot or Turkish Cypriot family that has not been affected in one way or another by the conflict and its lingering impact.
While the Cyprus conflict predated the 1975 signing of the Helsinki Final Act, many of the principles found in that historic document have particular applicability to the situation in Cyprus, including: territorial integrity of states; peaceful settlement of disputes; respect for human rights and fundamental freedoms, including the freedom of thought, conscience, religion or belief; and fulfillment in good faith of obligations under international law. Cyprus and Turkey were both original signatories to the Final Act.
Traveling to the remote Karpas peninsula, in northeastern Cyprus, I was able to speak with an elderly pensioner in Rizokarpaso, a town where thousands of Greek Cypriots once thrived.Today they number scarcely more than 200, the largest concentration of Greek Cypriots in the Turkish occupied north. A short distance from the main square, featuring a large statue of modern Turkey’s founder Kemal Atatürk on horseback, the gentleman described his existence amid a burgeoning population of newcomers from mainland Turkey. He explained that as elderly Greek Cypriots pass away in the area, their homes are occupied, often by “settlers.” The aged man, deeply rooted in the town, showed a fierce determination to remain despite the hardships, making clear that he would not be complicit with the effective cleansing of Greek Cypriots from the region. Within minutes after we sat down at a nearby cafe, a couple of young men sat conspicuously nearby, within easy listening distance from us, an action that seemed designed to intimidate.
The man pointed to a building across the street that serves as the school for the small number of Greek Cypriot children a short distance from the Orthodox Church, mainly used for funerals conducted by the lone cleric permitted to conduct such services in the region. According to the May 15 “Report of the Secretary-General on the United Nations operation in Cyprus,” humanitarian assistance was provided to 367 Greek Cypriots and 133 Maronites living in the northern part of the island.
While numerous mixed towns and villages existed throughout the country prior to 1974, today, the town of Pyla, partly located in the UN-monitored buffer zone, is the sole surviving bi-communal village, with around 500 Turkish Cypriots and 1,500 Greek-Cypriots. While local leaders from the communities described a generally harmonious and cooperative atmosphere, the reality is that interaction between the two remains limited, with separate schools, sports teams, municipal budgets, and police forces, among others.
Many of the people I met touched in one way or another on the ongoing talks between Cypriot President Demetris Christofias and the Turkish Cypriot leader, Mehmet Talat. In his February 28, 2008 inauguration, Christofias reiterated the requirements for a negotiated resolution of the Cyprus conflict and reunification of the country as a federal bi-zonal, bi-communal, with a single sovereignty, international personality and citizenship. Christofias and Talat have repeatedly reaffirmed their commitment to such a formula based on UN Security Council resolutions dating back to the 1970s.
The current talks, initiated by Christofias shortly after his 2008 election, focus on six main chapters, or themes, with corresponding working groups: governance and power sharing, European Union matters, security and guarantees, territory, property, and economic matters. Technical committees have also been established to consider crime, economic and commercial matters, cultural heritage, crisis management, humanitarian matters, health, and environmental matters. While formally conducted under the auspices of the UN, the talks are mainly being conducted directly between Christofias and Talat, with teams of experts focused on specific aspects of each topic.
A meeting with George Iacovou, President Christofias’ top aide on the current direct talks, helped put the negotiations in context against the backdrop of prior efforts to reunite the country, including the Annan plan, which the Greek Cypriots overwhelmingly rejected in a 2004 referendum. Officials, including government spokesman Stefanos Stefanou repeatedly emphasized that negotiations on a resolution of the conflict be by the Cypriots, for the Cypriots. That said, such an outcome depends in large measure on Turkey playing a constructive role as the leaders of the two communities seek to hammer out a comprehensive agreement.
Briefings by Foreign Minister Markos Kyprianou and other senior officials focused largely on the international dimension of the Cyprus issue. Central to the discussions was Turkey’s longstanding aspiration to join the European Union. Accession talks with Turkey began in October 2005.
In July of that year, the EU welcomed the country’s decision to sign a protocol adapting the Ankara Agreement to expand the existing customs union between Turkey and the EU to include all member states, including Cyprus. Simultaneously to the signing, Ankara issued a unilateral declaration, noting that its signature did not amount to recognition of the Republic of Cyprus. In response, the EU issued its own declaration on September 21, 2005 making clear that “this declaration by Turkey is unilateral, does not form part of the Protocol and has no legal effect on Turkey’s obligations under the Protocol.” Despite signing the adapted agreement, Turkish ports remain closed to Cypriot ships and airplanes. Cypriot government officials suggested that the status quo has cost the island nation millions in lost business.
EU foreign ministers meeting in Brussels on December 11, 2006 partially froze membership talks with Turkey over the impasse, suspending eight of the 35 chapters on the agenda of the accession negotiations, a step endorsed by the European Council on December 15. The Turkey 2008 Progress Report issued by the EU Commission reiterated the call for Turkey “to remove all remaining restrictions on the free movement of goods, including restrictions on means of transport regarding Cyprus.” Turkey's accession to the EU would also require Ankara to work toward recognizing the Republic of Cyprus, including establishment of diplomatic relations.
The next periodic report on Turkey’s implementation of the Ankara Protocol is expected later this year. While Cyprus supports Turkey’s aspirations to join the EU, the passage of time has brought potential opposition to the surface, notably from France and Germany.
Property, another chapter heading under active discussion, has enormous implications. According to government officials, the vast majority of properties in the occupied north were owned by Greek Cypriots. Upholding the property rights of the owners as they were prior to the invasion remains a major priority for the government, with restitution the preferred end result. Considerable real estate development in the north and the continued occupancy of their homes by strangers, has led many Greek Cypriot property owners to file cases with the European Court of Human Rights (ECHR) claiming their property rights were violated. In the case of Loizidou v. Turkey, the court held that “denial of access to property in northern Cyprus was imputable to Turkey” and awarded damages, finding that the applicant had “effectively lost all control over, as well as all possibilities to use and enjoy, her property.”
More recently, a judgment issued by the European Court of Justice (ECJ) in the case of Meletis Apostolides v. David Charles Orams and Linda Elizabeth Orams could have a chilling effect on foreigners purchasing property in the occupied territory. The ECJ affirmed that courts in other EU countries must recognize and enforce Cypriot court judgments. Cyprus joined the EU in 2004.
Since the partial lifting, in 2003, of restrictions imposed by authorities in the north on freedom of movement, Greek Cypriots for the first time in large numbers have been able to cross into the northern part of the country – visiting their homes and villages many had not seen since 1974. Increased movement in both directions followed, with over 15 million incident-free crossings.
A Greek Cypriot shared his experience of visiting his home for the first time since being forced to flee during the invasion. He discovered that a Turkish Cypriot family was living in the house. To his surprise, the father had meticulously collected and stored all of the owner’s family photos and presented him with the box at that first visit. Similarly, the occupant had placed crosses and other religious articles in the attic for safekeeping. A Turkish Cypriot expressed relief at the fact that some Greek Cypriot friends from his home village were living in his house and maintaining his lands in the southwestern part of the country. Unfortunately, these stories appear to be the exception rather than the rule.
Of the many painful consequences of the 1974 invasion, perhaps none is as heartrending as that of missing persons. According to The Committee on Missing Persons, a total of 1493 Greek Cypriots, including five Americans, were officially reported missing in the aftermath of the conflict. Five hundred and two Turkish Cypriots had already been missing, mainly victims of inter-communal violence that erupted in the early 1960s. The remains of one of the Americans, Andrew Kassapis, were eventually recovered and returned. The cases of the other four remain open.
The Committee on Missing Persons in Cyprus, established in 1981, facilitates the exhuming, indentifying and returning of remains of missing persons. The CMP mandate is limited in that it does not extend to Turkey. The Greek Cypriot and Turkish Cypriot communities each have one member on the committee. A third member is selected by the International Committee of the Red Cross and appointed by the UN Secretary-General. While in Nicosia, I had an opportunity to be briefed separately by Elias Georgiades, the Greek Cypriot representative and Christophe Girod, the UN representative.
Operating on the basis of consensus, the committee does not attempt to establish the cause of death or attribute responsibility for the death of missing persons. Since becoming operational in 2006, an anthropological laboratory has analyzed the remains of several hundred individuals. According to the committee, remains of 530 individuals have been exhumed from more than 273 burial sites throughout the country. Of remains examined at the forensic facility, the youngest individual was 10 months old and the oldest 86 years old. Walking though the lab I noted that most of the remains under examination had visible signs of gun wounds to the head. The remains of over 160 individuals have been returned to family members as a result of the bi-communal field teams and forensic work undertaken at the lab. The U.S. contributed funds for a family viewing facility which opened in 2008.
A briefing at the Mine Action Center in Cyprus provided insight into another legacy of the 1974 conflict, the presence of thousands of anti-personnel and anti-tank mines. Established in 2004, the center has assisted in planning, coordinating and monitoring of demining operations, including land surveys as well as the actual clearance and disposal of mines. While thousands of landmines have been cleared to date, thousands more remain. The center’s goal is a mine-free buffer zone by the end of 2010. In addition to efforts undertaken within the framework of the UN, Cyprus’ National Guard has worked to clear anti-personnel mines. Of the 101 known or suspected minefields in the country about half are in the UN monitored buffer zone, with most of the remainder nearby. Briefers underscored the continued threat posed by minefields adjacent to the buffer zone, recounting incidents of migrants trying to cross from the northern part of the country to the government-controlled south finding themselves surrounded by mines.
Farmers on either side of the buffer zone are also at risk as they seek to cultivate the arable farming lands bordering the area. The experts described the clearing operations involved in the opening of the Ledras Street pedestrian crossing point in the middle of the Cypriot capital, Nicosia, in April 2008. The Mine Action Center is assisting in clearing operations paving the way for the opening of additional crossing points. In late June, President Christofias and Mr. Talat reached agreement on the opening of the Limnitis crossing point with access to and from Kokkina in the remote northwest, offering an opportunity for development and integration by Greek Cypriots and Turkish Cypriots.
The United Nations has maintained an operational force on Cyprus since the establishment of the United Nations Peacekeeping Force in Cyprus (UNFICYP) in March 1964, following the outbreak of intercommunal violence. The force, one of the longest existing UN peacekeeping missions, consists of 858 troops, 68 police, and 160 civilians. UNFICYP is responsible for maintaining the status quo along the de facto ceasefire lines of the Cyprus National Guard, to the south, and Turkish and Turkish Cypriot forces to the north and a buffer zone between the two. The buffer zone stretches 111 miles from east to west, with 214 square miles of land between the lines, constituting about three percent of the country’s territory. The distance of separation varies from barely more than an arm’s span in some places to about four miles. Numerous villages, including Pyla, mentioned above, are located in partially or entirely in the buffer zone.
The once bustling seaside city of Famagusta along the east coast remains deserted, a veritable ghost town, as it has since the mainly Greek Cypriot population was forced to flee during the second phase of the Turkish invasion in August 1974. A center for commerce and tourism, the city and surrounding region was the second largest in the country prior to the evacuation. It is home to nearly half of the people uprooted by the conflict. Standing on the beachhead just north of the city in the Turkish-controlled area the unpopulated city stretched as far down the coast as I could see. Abandoned hotels and high-rise apartment buildings rise from the sandy shore standing as a collection of steel skeletal frames liberated of their contents by plunder and the passage of time since their occupants were forced to flee.
Religious Cultural Heritage
The ancient Roman city of Salamis, located a short distance from Famagusta on the east coast, was the arrival point for St. Paul on his first missionary journey, accompanied by St. Barnabas, a native son of that city. Paul eventually made his way to Paphos, on the opposite side of the island, where his preaching led to the conversion of the Roman Proconsul, making Cyprus the first country governed by a Christian. A short distance from Salamis is the village of Enkomi, where according to tradition, Barnabas’ remains were buried following his martyrdom.
Among minorities throughout the country recognized by the 1960 constitution are: Maronite Christians number approximately 5,000; Armenians 2,500; and Latins (Catholics) 1,000. The overwhelming majority of Cypriots are Orthodox, with Muslims comprising the next largest faith community.
His Beatitude Chrysostomos II has served as Archbishop of New Justiniana and All Cyprus since November 2006. During our meeting he underscored the long history of harmony among faith communities in Cyprus. The archbishop voiced particular concern for those displaced by the 1974 invasion and stressed the importance of upholding human rights, including the rights of individuals to return to their homes. He contrasted the efforts taken by the authorities with the support of the Church to preserve mosques in the government-controlled area with the destruction of religious cultural heritage, including churches, monasteries and chapels in the north. Archbishop Chrysostomos II, who was joined by the Bishop of Karpasia, described the challenges faced by clergy seeking to travel to the occupied north, including those seeking to participate in religious services. The rare Orthodox services that are allowed to be conducted in the north are mainly for feast days of several saints, notably St. Mamas and St. Barnabas. Even such exceptional occasions have occasionally been marred by security forces preventing worshipers from crossing into the area. The Archbishop said that the Church would soon file a formal case with the European Court of Human Rights regarding its religious sites and other property in the occupied north.
In the aftermath of Turkey’s 1974 military invasion and ongoing occupation of the northern part of Cyprus, a precious piece of the country’s cultural heritage is at risk of collapse – Orthodox churches, chapels and monasteries as well as those of other Christian communities. According to Archbishop Chrysostomos II, over 500 religious sites in the area have been seriously damaged or destroyed. During my travels throughout the region, I visited a score of churches – each in various stages of deterioration, all plundered. In Lapithos, in the Keryneia region, the Agia Anastasia complex is now a tourist resort. I found the Monastery of Ayios Panteleemon, in Myrtou, reduced to little more than a pigeon coup, with bird droppings everywhere – a scene I encountered repeatedly. In each church visited the interiors were stripped of religious objects, including altars, iconostasis, icons, and fonts. In some, it was clear how frescos had been chiseled out of walls and ceilings. It was a surprise to see a single bell still hanging in one of the many bell towers I saw. The main church in Rizokarpaso and a few elsewhere in the Karpas region were noteworthy for the fact that they even had doors; most others I visited did not. One of the countryside churches I visited was being used for storage, with heavy farm equipment in the yard and plastic crates and large tractor ties filling the interior space. In Keryneia, I found that a small chapel in the port was being used by the authorities as a tourist information center and snack bar. According to Church sources, others have been converted into stables, shops, and night clubs.
In the village of Kythrea, a small Catholic chapel was reduced to a shell with no roof. Most of the main church had been converted into a mosque, along with a couple of others in the town, but for some reason a quarter of the structure remained in ruins. Another church, Agios Andronikos, located nearby was heavily damaged, with the rubble of the collapsed roof strewn about the interior space, with traces of frescoes still visible on the exposed walls. In the village of Stylloi, in the Famagusta region, the Profitis Ilias Church yard also serves as a cemetery. There I found desecrated ruins of graves with all of the crosses broken off of their bases and smashed. A shed in the corner of the yard was stacked with broken crosses and headstones. Another cemetery a short distance away was similarly in shambles. An adjacent Muslim cemetery was in meticulous condition.
The U.S. Agency for International Development has supported a number of restoration projects in the occupied north, including work at the Agios Mamas Church in Morfou, operated mainly as an icon museum. In Keryneia, the prominent belfry of the Archangelos Mikhael Church disguises the fact that the once venerated site has likewise been converted into an icon museum. Such collections reportedly contain a small fraction of the thousands of icons, sacred vessels, vestments, manuscripts, frescos, and mosaics looted from churches, chapels and monasteries in the north. Many stolen icons and other antiquities are placed on the auction block for sale on the international market, some making their way into U.S. collections. The Byzantine Museum, in Nicosia, featured an exhibit: “Hostages in Germany: The Plundered Ecclesiastical Treasures of the Turkish-occupied Cyprus.” In a recent case, two icons from the early 1600s taken from a church in the northern village of Trikomo, were seized in Zurich by Swiss police.
In stark contrast to the situation in the occupied area, in Nicosia I visited the Ömerge Mosque housed in the 13th century Church of St. Mary built by the Augustinian religious order. The recently refurbished mosque is a functioning place of worship. A short distance away in the old walled city is Bayraktar Mosque. When I visited the site there were large pallets of stone to be used to renovate the plaza in the mosque complex. Another example is the Mosque of Umm Haram, or Hala Sultan Tekke, a mosque and prominent Muslim shrine, located in Larnaca, southeast of the capital. According to Cyprus government sources, scores of other mosques and other Islamic places of worship are maintained in the south.
A visitor to Cyprus need not look far to discover the scars left by the artificial division of the country following the 1974 invasion and ongoing occupation. Since my earlier trip to that island nation eleven years ago, there has been progress on some fronts, most noticeably in terms of freedom of movement since the partial lifting, in 2003, of restrictions imposed by authorities in the north. According to officials, the majority of Turkish Cypriots hold Cyprus-issued EU passports, affording them free movement throughout the EU area, employment opportunities in member countries and other benefits. In addition, thousands of Turkish Cypriots cross into the south daily for work. Other steps have come about as a direct result of the talks between the leaders of the two communities initiated last year. It remains to be seen, however, if the current negotiations will produce a comprehensive and durable resolution to the challenges in Cyprus. Beyond practical steps to ease the day-to-day lives of Greek Cypriots and Turkish Cypriots, key principles such as sovereignty, independence, and territorial integrity as well as respect for human rights and fundamental freedoms are also at stake, with implications for conflicts elsewhere.
Numerous earlier diplomatic initiatives were launched, but in the end failed. A particular challenge remains the thorny issues of the tens of thousands of Turkish troops and settlers from mainland Turkey still in Cyprus today, outnumbering Turkish Cypriots. Other factors, especially Turkey’s stated desire to join the EU, should not be discounted and could prove decisive to the ultimate success or failure of the current process. Meanwhile, Christofias and Talat and their teams grapple with an array of tough issues as they seek to overcome the legacy of the past 35 years and build a brighter future for all Cypriots.
