Chairman Hastings Applauds Release of JUST Act Report on Assets Wrongfully Seized During Holocaust Era

WASHINGTON—Following today’s release of the JUST Act report by the U.S. Department of State, pursuant to legislation passed by Congress in 2017 and signed into law in 2018, Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) issued the following statement:

“I applaud the State Department officials in embassies around the globe who have contributed to the reporting on this complicated and deeply compelling issue and the ongoing work of the Office of Holocaust Issues.

“The matters covered in this report—restitution of communal and religious properties, compensation for stolen private property, rightful ownership of looted artwork, and access to archives—are among the most challenging we have faced.

“This report not only seeks ways to address ‘one of the largest organized thefts in history,’ but also reminds us that these thefts were essential elements of the crime of genocide, depriving the victims of the very means of survival. Most importantly, the report demonstrates that, with requisite political will, progress can be made even after the passage of a great deal of time.”

In 2017, Congress passed the Justice for Uncompensated Survivors Today (JUST) Act, which required the State Department to provide a one-time report to Congress to assess the national laws and policies of countries relating to the identification of, return of, or restitution for assets wrongfully seized during the Holocaust era.

In July 2019, the Helsinki Commission hosted a briefing on truth, reconciliation and healing, where expert panelists reviewed lessons learned and discussed ways to heal and reunify societies divided by war, genocide, hierarchal systems of human value, and other tragedies stemming from extreme nationalism, racism, anti-Semitism, and other forms of ethnic and religious discrimination.

  • Chairman Smith Introduces Bipartisan, Bicameral Bill to Aid Holocaust Survivors

    WASHINGTON—U.S. Senators Tammy Baldwin (D-WI) and Marco Rubio (R-FL) and U.S. Representatives Chris Smith (R-NJ) and Joe Crowley (D-NY) today introduced the Justice for Uncompensated Survivors Today (JUST) Act. This bipartisan and bicameral bill will improve efforts to assist Holocaust survivors and the families of Holocaust victims by requiring the State Department to report on the progress of certain European countries on the return of, or restitution for, wrongfully confiscated or transferred Holocaust-era assets. “Holocaust survivors—witnesses to the brutal murders, torture and heartless thievery of the Nazis and their accomplices—continue to be cheated and defrauded, inexplicably, as they fight for the rightful return of their stolen property,” said Rep. I join Senator Baldwin in pressing for swift passage of this measure.” “Several decades removed from the horrors of the Holocaust, a substantial amount of Jewish-owned property still hasn’t been returned to their rightful owners, nor have they been compensated. This is unacceptable,” said Rep. Crowley, Vice Chair of the Democratic Caucus. “It’s important that we do what we can to ensure European governments are keeping their word, and I’m proud to join my colleagues in this legislation that will put us one step closer to bringing justice to Holocaust victims, survivors, and their families.” Seventy years after the Holocaust, in which the unprecedented looting of Jewish assets was a central aspect, the restitution of Jewish communal, private, and heirless property in Central and Eastern Europe remains unresolved. Indeed, decades after the Holocaust and the fall of Communism, most formerly Jewish-owned, real properties confiscated by the Nazis and their collaborators have not been returned, nor has compensation been provided to the rightful owners or their heirs. The JUST Act will build on the international Terezin Declaration on Holocaust Era Assets and Related Issues of 2009, which affirms that the protection of property rights is an essential component of a democratic society based on the rule of law and recognizes the importance of restituting or compensating Holocaust-related confiscations made during the Holocaust-era between 1933-45. Unfortunately, many nations that endorsed this declaration, including many of our NATO allies, have not fully addressed the restitution of Jewish communal, private and heirless property. The JUST Act permanently amends current law to require the State Department to report on certain countries’ compliance with and progress toward the goals of the 2009 Terezin Declaration on Holocaust Era Assets, as well as on what actions those countries are taking to resolve the claims of U.S. citizens. This will enhance on-going U.S. efforts to urge Central and Eastern European countries to achieve progress on this issue and will help build on America’s commitment to ensuring justice for Holocaust victims and their families. “Holocaust-era property restitution provides a measure of justice to victims and their families, and to surviving Jewish communities, for the violation of their basic human rights. The JUST Act would encourage countries around the globe to live up to the existing international consensus they endorsed in 2009,” said Abraham Biderman, co-chairman of the World Jewish Restitution Organization's Executive Committee. “We commend Sens.   • Chairman Smith Champions Improved Security for European Jewish Communities at Annual Meeting of OSCE Parliamentarians

    WASHINGTON—At the 2016 OSCE Parliamentary Assembly (OSCE PA) Annual Session, meeting in Tbilisi, Georgia this week, Helsinki Commission Chair Rep. Chris Smith (NJ-04) today called on participating States to more effectively prevent and combat violence against European Jewish communities in the face of increasing anti-Semitic violence in the region. “Violent anti-Semitic attacks are on the rise in several European countries – and there is a lot more we can do to stop it,” said Chairman Smith, who led the U.S. delegation to the event. “European police and security forces should be partnering with Jewish community security groups, and the United States government should be working with the European governments to encourage this. The terrorist threat to European Jewish communities is more deadly than ever. We must act to prevent a repeat of the horrific massacres of Paris and Copenhagen.”  Chairman Smith offered two amendments to the draft resolution of the OSCE PA General Committee on Democracy, Human Rights and Humanitarian Questions (also known as the Third Committee). His first amendment called for the explicit recognition of the increase in frequency, scope, and severity of anti-Semitic attacks in the OSCE region, while the second called on participating States to formally recognize and partner with Jewish community groups to strengthen crisis prevention, preparedness, mitigation, and responses related to anti-Semitic attacks. Both amendments reflect consultations with and requests from European Jewish communities. Chairman Smith has a long record as a leader in the fight against anti-Semitism.  He co-chairs the Bipartisan Task Force for Combating Anti-Semitism in the U.S. House of Representatives and authored the provisions of the U.S. Global Anti-Semitism Review Act of 2004 that created the Office to Monitor and Combat Anti-Semitism within the U.S. State Department. In 2015, he authored House Resolution 354, a blueprint for strengthening the safety and security of European Jewish communities. Following his landmark 2002 hearing on combating the escalation of anti-Semitic violence in Europe, “Escalating Anti-Semitic Violence in Europe,” he led a congressional drive to place the issue of combating anti-Semitism at the top of the OSCE agenda. As part of this effort he authored supplemental resolutions on combating anti-Semitism, which were adopted at the 2002, 2003, and 2004 Annual Sessions of the OSCE PA. In 2004 the OSCE adopted new norms for its participating States on fighting anti-Semitism. Chairman Smith is a founding member of the the Inter-Parliamentary Coalition for Combating Anti-Semitism (ICCA), where he also serves on the steering committee. In the 1990s, he chaired Congress’s first hearings on anti-Semitism and in the early 1980s, his first trips abroad as a member of Congress were to the former Soviet Union, where he fought for the release of Jewish “refuseniks.”

  • Chairman Smith Holds Hearing on Terrorist Threats to European Jewish Communities

    WASHINGTON— The growing risks to European Jewish communities and the actions that countries should take to address the threats faced by their Jewish citizens was the focus of a hearing of the Commission on Security and Cooperation in Europe (aka, Helsinki Commission) chaired today by Rep. Chris Smith (NJ-04). “The recent terrorist attacks in Brussels were reminders that Europeans of all religions and ethnicities are at risk from ISIS,” said Smith. “But there can be no European security without Jewish security. As we have seen so many times in so many places, violence against Jewish communities often foreshadows violence against other religious, ethnic, and national communities. ISIS especially hates the Jewish people and has instructed its followers to prioritize killing them. The group’s cronies targeted the Jewish Museum of Belgium in May 2014, the Paris kosher supermarket in January 2015, and the Great Synagogue in Copenhagen in February 2015, and murdered people in all of them.” Click here to read Chairman Smith’s opening statement. A number of other members of Congress spoke at the hearing, including Sen. Roger Wicker (MS), CSCE co-chairman, Rep. David Schweikert (AZ-06), Rep. Steve Cohen (TN-09), Rep. Rabbi Andrew Baker, Director of International Jewish Affairs at the American Jewish Congress, and the OSCE’s Personal Representative of the OSCE Chairperson, thanked Smith for the “pioneering work” he has done in identifying and addressing the problem of anti-Semitism in Europe, and pressing the United States government and European States and in mobilizing the OSCE to confront the “age-old scourge” of anti-Semitism. “One of the problems we have faced and we continue to face is that governments are slow to recognize the very problem itself, let alone to marshal the necessary resolve and expertise to confront it,”  Baker testified. For the past two years, witnesses John J. Farmer, Jr., Rutgers University Professor of Law, has led an initiative at Rutgers designed to identify the best ways to protect vulnerable communities in light of the evolving threat.  "We have worked with U.S. communities to develop what FBI officials have called an 'off-ramp' to radicalization," said Farmer. "This is a time of particular peril for the Jewish future in Europe, and it is incumbent upon us to do what we can to assure that future." Jonathan Biermann, Brussels attorney and elected city councilman, and a former political adviser to the President of the Belgian Senate, the Development Minister, and the Minister of Foreign Affairs, described the current atmosphere among Belgian Jews. “Community members are nowadays used to see Police, guards, military in front of Jewish buildings and schools,” Biermann said, recommending establishing Memorandums of Understanding as an important step. “Creating the tools to communicate amongst communities with the government will be considerably facilitated by the ‘See something Say something strategy,’”Beirmann said. “The collaboration with Law enforcement agencies has to be based on trust and confidence, in respect of international laws and rules protecting individual freedom, civil liberties and privacy.” Paul Goldenberg, a senior advisor to the U.S. Department of Homeland Security, serve on the Countering Violent Extremism Sub-Committee, Co-Chair the Foreign Fighter Task Force and Vice-Chair of the Faith-Based Advisory & Communications Sub-Committee. He also works with the Faith-Based Communities Security Program at Rutgers University. He is Executive Director of the Crisis Cell for the Belgian Jewish community “I have made countless trips in recent months overseas, traveling to multiple European cities,” Goldenberg said. “What we have seen, heard and learned has confirmed our initial hypothesis: while the levels of cooperation and partnerships between Jewish and other minority religious communities with their respective policing services–in many parts of Europe–is as diverse as the communities themselves, more work needs to be accomplished to move closer to a medium and standard of safety and security. While this presents distinct challenges, there is also hope. For much of what we have learned, innovated, tested and improved upon here in the United States, as well as in other progressive nations, can be imparted to, and replicated by, many of our partners.” Smith also chairs the Africa, Global Health, Global Human Rights and International Organizations subcommittee. In 2015, Smith held a hearing in, “After Paris and Copenhagen: Responding to the Rising Tide of Anti-Semitism,” on the crucial role of the U.S. and other participating States of the Organization for Security and Cooperation in Europe in battling anti-Semitism and called for strong American leadership.

  • Anticipating and Preventing Deadly Attacks on European Jewish Communities

    This hearing was organized in response to the growing number of violent anti-Semitic attacks (namely Belgium, Copenhagen and Paris credited to ISIS), and assessed what needed to be done - particularly by law enforcement agencies - to anticipate and prevent future attacks against the European Jewish communities. The threat to Jewish communities comes not only from Islamic militants, but also from Neo-Nazi groups across the continent, and from acts of anti-Zionists. The panelists expressed concern over the low levels of cooperation and consistency  in government responses to this violence. Witnesses Rabbi Andrew Baker, Jonathan Biermann (from Brussels), John Farmer, Paul Goldenberg also discussed counter terrorism strategies and methods to improve security and cooperation.  They suggested plans to further engage Muslim communities on integration and to gain their inside knowledge on “potential radicals.” This led to a debate on the “see something, say something” policy, with the Jewish community as pilots. The panelists debated  whether the military could play a role in the implementation of this, or if it would be best to keep engagement solely with the local police. All agreed that collaboration with law enforcement agencies would have to be based on trust and confidence and be in respect of international laws and rules protecting individual freedom, civil liberties and privacy.

ISIS has instructed its followers to prioritize targeting European Jewish sites and killing European Jewish people. The terrorists who attacked the Jewish Museum of Belgium, Great Synagogue in Copenhagen, and kosher supermarket in Paris, all claimed ISIS allegiance. In the wake of the recent terrorist bombings in Brussels, the hearing will focus on violent threats to European Jewish communities from the full range of groups and individuals, and what needs to be done – particularly by law enforcement agencies – to anticipate and prevent future attacks.   • Senator Wicker Responds to ICTY's Verdict on Bosnian Serb Leader

    WASHINGTON—Senator Roger F. Wicker, Co-Chairman of the Commission on Security and Cooperation in Europe (U.S. Helsinki Commission), made the following statement in regard to yesterday’s sentencing of former Bosnian Serb political leader Radovan Karadzic at the International Criminal Tribunal for the former Yugoslavia (ICTY), located in The Hague, to 40 years imprisonment for war crimes, crimes against humanity and genocide: “Yesterday’s conviction of Radovan Karadzic confirmed what we knew all along, namely that he was responsible for some of the worst atrocities to occur in Europe since World War II. Forty years in prison pale in comparison to the tens of thousands of innocent deaths that he caused. But it is good to see some measure of justice. I am hopeful that he never sees the light of day.” The Hague-based International Criminal Tribunal for the former Yugoslavia (ICTY) found Radovan Karadzic guilty of 10 out of 11 counts of war crimes, crimes against humanity, and genocide during the 1992-1995 conflict in Bosnia and Herzegovina.  He was acquitted of one count of genocide, finding that the prosecution did not prove beyond a reasonable doubt his genocidal intent in relation to crimes committed in seven municipalities across Bosnia and Herzegovina.  Karadzic was the leading political figure among Bosnian Serbs during the conflict.  The court, while taking into account mitigating circumstances, nevertheless sentenced the 70 year-old Karadzic to 40 years in prison for his crimes.

  • Chairman Smith Responds to ICTY's Verdict on Bosnian Serb Leader

    WASHINGTON—The long-awaited verdict handed down today to former Bosnian Serb political leader Radovan Karadzic at the International Criminal Tribunal for the former Yugoslavia (ICTY), prompted U.S. Rep. Chris Smith (NJ-04), Chairman of the Commission on Security and Cooperation in Europe and chairman of the House Global Human Rights Subcommittee, to issue the following statement: “Once again, ICTY has proved its worth. It has provided justice regarding horrific atrocities which occurred in Bosnia and Herzegovina from 1992 to 1995. Radovan Karadzic was a driving force in the encouragement, planning and execution of horrific crimes—from the artillery shelling and sniper attacks on Sarajevo, to the ethnic cleansing campaign that included the mass displacement, detention, abuse and execution of innocent civilians, to the taking of UN personnel as hostages, and ultimately to the Srebrenica genocide. “The guilty verdict and sentencing cannot replace action that could have been taken to prevent these crimes in the first place. But Karadzic’s 40-year sentence demonstrates a welcomed determination by the court to provide justice and some measure of closure for surviving victims and to hold to account one of the most egregious perpetrators of crimes against humanity and genocide. ICTY’s lessons and progress are not limited to Karadzic’s conviction, but instead stand as a model and prototype for a much needed tribunal for the prosecution of war crimes in Syria.” Earlier this month, the House of Representatives passed Smith’s legislation (H. Con. Res. 121) urging the U.N. Security Council to immediately establish a Syrian war crimes tribunal (March 14th; by a vote of 392-3). Smith’s bill notes that “ad hoc or regional tribunals, including the International Criminal Tribunal for the former Yugoslavia, the International Criminal Tribunal for Rwanda, and the Special Court for Sierra Leone, have successfully investigated and prosecuted war crimes, crimes against humanity, and genocide, and there are many positive lessons to be learned from such tribunals.” During debate in the House Smith said, “An ad hoc or regional court has significant advantages over the International Criminal Court (ICC) as a venue for justice. The ICC has operated since 2002 but boasts only two convictions. By way of contrast, the Yugoslavia court convicted 80 people; Rwanda, 61; and Sierra Leone, 9.  Moreover, a singularly focused Syrian tribunal that provides Syrians with a degree of ownership could significantly enhance its effectiveness.” Since 1995, Rep. Smith has chaired numerous hearings on the genocides and war crimes committed in Bosnia, Rwanda, and Sierra Leone. He has particularly worked to see that the perpetrators of the horrific crimes committed in Bosnia from 1992-1995 are punished and that closure is provided to survivors and victims’ families. In 2005, he authored H. Res. 199, which clearly and unambiguously condemned the Srebrenica massacre as a genocide and was passed with overwhelming support in the U.S. House of Representatives. In July 2007, Rep. Smith visited Srebrenica to witness the tragic aftermath of the genocide for himself. In 2015, ahead of the 20th anniversary of the Srebrenica genocide, he authored H. Res. 310, which condemned statements denying that the massacre was a genocide. Karadzic was found guilty of war crimes and crimes against humanity, as well as one count of genocide, relating to Srebrenica, where more than 7,000 Bosnian Muslim men and boys were massacred by Bosnian Serb forces. Karadzic was acquitted of a second charge of genocide, relating to other Bosnian municipalities.

  • Helsinki Commission Chair: Serbia Legislation an Historic Step

    Newly-passed legislation in the Serbian parliament that offers compensation for heirless Jewish property seized during and after the Holocaust was called “historic” by Congressman Chris Smith (NJ-04), chairman of the Commission on Security and Cooperation in Europe (CSCE), also known as the Helsinki Commission. “As a long-time advocate of restitution for Jewish property stolen around the Holocaust, I applaud Serbia’s leadership in passing this historic legislation,” said Smith. “When there are no heirs, restitution should go to the Jewish community, especially to Holocaust survivors and their heirs. It is the least that can be done after the atrocities of the Holocaust.” Rep. Smith joined his fellow Co-Chairs of the Bipartisan Task Force for Combatting Anti-Semitism, and other Members of Congress, on a February 2 letter to Serbian Prime Minister Aleksandar Vučić, encouraging him to ensure that the law would be passed. Rep. Smith has a long record as a congressional leader in the fight against anti-Semitism.   • Religious Freedom, Anti-Semitism, and Rule of Law in Europe and Eurasia

    In this hearing ODIHR Director Michael Link discussed the importance of the OSCE's work on human rights through ODIHR.  He focused on the fight against anti-Semitism and the human rights situation in Ukraine.  He spoke about ODIHR's newest project to combat anti-Semitism, called "Turning Words into Action," which will give leaders the knowledge and tools to address anti-Semitism in their communities.   Director Link also noted that in Ukraine he was particularly concerned about the human rights violations in Crimea and expressed his support for a cease-fire as a pre-condition of the implementation of the Minsk package.

  • Germany to Lead OSCE in 2016

    Germany will serve as OSCE Chair-in-Office in 2016. Germany has indicated it will continue the work on youth exchanges initiated by the previous Serbian and Swiss chairmanships. In the human dimension, Germany will focus on: Freedom of the press and freedom of information, independence of the media, and the safety of journalists. Protection of minorities.   • OSCE Human Dimension Implementation Meeting 2015

    “The Human Dimension” is OSCE-speak for human rights, democracy, and humanitarian concerns.  When the Helsinki Final Act (HFA) was signed in Helsinki, Finland in 1975, it enshrined among its ten Principles Guiding Relations between participating States (the Decalogue) a commitment to "respect human rights and fundamental freedoms, including the freedom of thought, conscience religion or belief, for all without distinction as to race, sex, language or religion" (Principle VII). In addition, the HFA included a section on cooperation regarding humanitarian issues that provided an umbrella for addressing (among other things) family reunification and working conditions for journalists. "The Human Dimension" was a term coined during the drafting of the 1989 Vienna Concluding Document to serve as shorthand to describe the human rights and humanitarian provisions of the agreements concluded within the framework of the Helsinki process. Today, it has come to include the OSCE’s watershed commitments on democracy, the rule of law, and free and fair elections. In any given year, the OSCE participating States address human dimension issues in multiple fora.  The Human Dimension Implementation Meeting – HDIM – attracts the largest number of participants, covers the greatest range of issues, and is open to participation by civil society. That work includes formal sessions on the full range of human rights  issues as well as rule of law, free elections, and democracy-building issues. National minorities, Roma, and tolerance and nondiscrimination are also on the agenda.  U.S. Delegation Led by David Kramer The 2015 HDIM was held September 21 to October 2 and drew 1,386 participants.  The U.S. delegation was led by David J. Kramer, Senior Director for Human Rights and Human Freedoms at the McCain Institute and former Assistant Secretary of State for Democracy, Human Rights, and Labor.  It also included U.S. Ambassador to the OSCE Daniel Baer; Deputy Assistant Secretary of State for Democracy, Human Rights and Labor Robert Berschinksi; Department of State Special Advisor for International Rights Judith Heumann; and Helsinki Commission Senior Senate Staff Representative Ambassador David T. Killion.  Helsinki Commission staff participated in all aspects of the delegation’s work. In addition to active engagement in the formal sessions, the United States participated in side events focused on specific countries or issues organized by civil society, OSCE participating States, or international organizations, and held numerous bilateral meetings with other delegations to raise and discuss human rights.  Special Advisor Heumann led a panel highlighting the importance of disability rights for OSCE countries as part of a U.S. side event cosponsored with Finland. Russia: External Aggression and Internal Repression During the HDIM, Russia’s aggression in and against Ukraine was raised in connection with almost every agenda item for the meeting.  The OSCE Office for Democratic Institutions and Human Rights (ODIHR) also issued a joint report prepared with the OSCE High Commissioner on National Minorities detailing widespread human rights violations in Russian-occupied Crimea.  Increasing levels of repression within Russia also were raised throughout the HDIM and served to highlight the relationship between external aggression and internal repression. In early 2015, Boris Nemtsov, an advocate for the rule of law and accountability in Russia and an outspoken Russian critic of the Russian government’s war against Ukraine, was gunned down just outside the Kremlin.  Russia’s increasingly repressive government has eroded the democratic institutions that ensure a government’s accountability to its people. A free and independent media is virtually nonexistent and the remaining state-controlled media is used to propagandize disinformation, fear, bigotry, and aggression. Azerbaijan’s Record Draws Sharp Criticism In 2015 Azerbaijan unilaterally shuttered the OSCE Mission in Baku, effectively blocked the OSCE’s independent election observation in October, and sentenced journalist-heroine Khadija Ismayilova to 7 ½ years in prison for reporting on government corruption.  The government of Azerbaijan has also escalated pressure against the family members of its critics, in a further effort to stifle dissent.  As a consequence, throughout the HDIM, Azerbaijan was the subject of singular attention and criticism. In one particularly sharp exchange with the moderator during the discussion of fundamental freedoms in the digital age, Azerbaijan challenged its critics to name at least 25 of an estimated 100 political prisoners.  A partial list – 25 names – is below. Abilov, Abdul Aliyev, Intigam Aliyev, Nijat Akhundov, Rashadat Guliyev, Araz Hasanov, Nasimi Hashimli, Parviz Hazi, Seymur Ismayilova, Khadija Jabrayilova, Valida Jafarov, Rasul Karimov, Fara Mammadli, Anar Mammadov, Hilal Mammadov, Igar Mammadov, Omar Mirkadirov, Rauf Ramazanov, Rashad Rustamov, Aliabbas Rustamzada, Ilkin Seyidov, Elnur Yagublu, Tofig Yunusov, Arif** Yunus, Leyla** Zakharchenko, Irina **Leyla and Arif Yunus have been released from prison since the HDIM but remain under house arrest.

  • Serbia Concludes Year-Long OSCE Chairmanship

    Four decades after the signature of the Helsinki Final Act, Serbian Foreign Minister Ivica Dacic presided over a Serbian chairmanship of the Organization for Security and Cooperation in Europe (OSCE) that kicked off with high expectations.  As a successor to the only participating State ever suspended from OSCE decision-making for egregious violation of Helsinki standards (1992 to 2000), the ability of Serbia to chair the organization was a credit not only to the country, but also to the OSCE which provided significant guidance and engagement through the transition.  Throughout Serbia’s chairmanship, the situation in Ukraine dominated the work of the OSCE participating States, including at the annual OSCE Parliamentary Assembly meeting.  This overshadowed efforts to commemorate the Helsinki Final Act’s 40th anniversary, as the OSCE’s future was considered to hinge on the Minsk agreements and its response to the crisis in and around Ukraine. Ukraine Russia’s egregious violations of the Minsk agreement led to its collapse in January 2015.  Minsk II, adopted in February 2015, represents a further attempt to de-escalate the war in the Donbas. After six months of non-implementation, a September 1 cease-fire has largely held, with considerably fewer casualties than earlier, although there has been an uptick in recent weeks.  Heavy weapons are slowly being withdrawn from the line of contact.  Nevertheless, the agreement remains extremely tentative as Russia and its separatist proxies continue to disregard the majority of its provisions:  Special Monitoring Mission (SMM) access remains blocked in large portions of the Russian-led separatist-controlled territory; Russian forces and equipment remain on Ukrainian territory; Ukrainian control over its borders with Russia has not been restored.  Furthermore, restrictions continue on humanitarian aid and Ukrainian hostages remain in Russian custody.  Terrorism 2015 was also scarred by numerous terrorist attacks in the OSCE region, including incidents targeting Jewish institutions and free speech in Paris and Copenhagen in January and February; the bombing of a Russian civilian airliner over the Sinai Peninsula in October; an attack in Turkey just three weeks before November 1 snap elections; and multiple, simultaneous attacks again in Paris in November.  On November 17, the Permanent Council adopted a declaration on the need to combat by all means, in accordance with the Charter of the United Nations and international law–including applicable international human rights, refugee and humanitarian law–threats to international peace and security caused by terrorist acts. Refugee Crisis Issues relating to the refugee crisis became more acute over the course of the year.  In early June, the Serbian Chairmanship held a special human dimension event on refugees and internally displaced persons.  On October 6, following significant increases of migrant flows into Europe, the Serbian Chairmanship convened an unprecedented joint meeting of the Permanent Council’s three committees (on military-security, economic and environmental cooperation, and the human dimension) to focus on the refugee-migrant crisis. Finally, many hoped that Serbia’s positive experience hosting a field mission would serve as an example to other participating States cooperating with OSCE field activity.  Unfortunately, turned out not to be the case, as illustrated by the abrupt closure of the mission in Baku. In addition, Serbia – missed an opportunity in 2015 to more strongly exemplify OSCE norms by providing justice for the 1999 execution-style murders of the three Kosovar-American Bytyqi brothers, a key issue in U.S.-Serbian relations.

  • Helsinki Commission Chair Honored by Voices of the Bosnian Genocide

    WASHINGTON—Voices of the Bosnian Genocide honored Helsinki Commission Chair Rep. Chris Smith (NJ-04) on Thursday with an award recognizing his efforts to ensure that the genocide at Srebrenica is acknowledged. “It is moving to receive this award from young people, many of whom are survivors of the genocide or lost relatives at Srebrenica and are now working to promote human rights,” said Rep. Smith. “Today the international community is nearly unanimous when it proclaims that the Srebrenica massacre was a genocide, although shockingly, there are those who continue to deny that the policies of aggression and ethnic cleansing implemented by Serb forces meet that criteria.” For more than 20 years, Rep. Smith has worked tirelessly to see that the perpetrators of the horrific acts at Srebrenica and elsewhere in Bosnia-Herzegovina are punished and that closure is provided to survivors and victims’ families. In July 2015, Rep. Smith authored H. Res. 310 defining the Srebrenica massacre as a genocide, which was passed unanimously by the U.S. House of Representatives.   Voices of the Bosnian Genocide is a Seattle-based nonprofit organization devoted to raising awareness and educating the public about the genocide that took place in Bosnia-Herzegovina in the 1990s and the ongoing effects that the genocide is having on Bosnia and the world. The group is made up of individuals who are passionate about genocide education and prevention and human rights.

  • US Lawmakers Back Protection for Europe’s Jewish Communities

    A resolution calling on the United States to urge European governments to act to keep their Jewish communities safe won unanimous support from the US House of Representatives Tuesday. The resolution, which had 89 co-sponsors, calls on the US administration to encourage European governments, law enforcement agencies and intergovernmental organizations to formally recognize and partner with Jewish community groups to strengthen crisis prevention, preparedness, mitigation and responses related to anti-Semitic attacks. It was introduced by Rep. Chris Smith, R-N.J., who chairs the Helsinki Commission, the congressional body that monitors compliance with human rights overseas.

  • Smith Resolution to Help Protect Jewish Communities in Europe Passes House Unanimously

    WASHINGTON—Following the recent upswing in violent anti-Semitic attacks in several European nations, the U.S. House of Representatives today unanimously passed legislation urging the United States and European governments to take key steps to help keep Jewish communities safe. The legislation was introduced by Helsinki Commission Chairman Rep. Chris Smith (NJ-04). “The number of violent anti-Semitic attacks has increased from 100 to 400 percent in some European countries since 2013,” said Rep. Smith, who co-chairs the Bipartisan Taskforce for Combating Anti-Semitism. “The murders in Paris, Copenhagen, and elsewhere reminded us that there are those who are motivated by anti-Semitism and have the will to kill.” H. Res. 354 calls on the U.S. Administration to encourage European governments, law enforcement agencies, and intergovernmental organizations to formally recognize and partner with Jewish community groups to strengthen crisis prevention, preparedness, mitigation, and responses related to anti-Semitic attacks. “This resolution calls for the United States Government to work with our European allies on specific actions that are essential to keep European Jewish communities safe and secure,” Rep. Smith continued. “It is based on consultations with the leading experts who are working directly with these communities.” The legislation passed today was endorsed by leading Jewish community groups including the Conference of Presidents of Major American Jewish Organizations, the Jewish Federations of North America, the American Jewish Committee, the Anti-Defamation League, the Orthodox Union, the Secure Community Network, and the Simon Wiesenthal Center. The 89 bipartisan co-sponsors included all seven of the other co-Chairs of the House of Representatives Bipartisan Taskforce for Combating Anti-Semitism: Reps. Ted Deutch (FL-21), Nita Lowey (NY-17), Eliot Engel (NY-16), Ileana Ros-Lehtinen (FL-27), Kay Granger (TX-12), Steve Israel (NY-03), and Peter Roskam (IL-06). “Jewish Federations are grateful to the House of Representatives for passing a responsive resolution today, which provides a needed framework for how the U.S. government and Jewish community security groups like the Secure Community Network can work with their European counterparts to combat increasing anti-Semitic attacks in Europe,” said William C. Smith has a long record as a congressional leader in the fight against anti-Semitism.  He is the author of the provisions of the Global Anti-Semitism Review Act of 2004 that created the Office to Monitor and Combat Anti-Semitism within the U.S. State Department. Following his 2002 landmark hearing on combating the escalation of anti-Semitic violence in Europe, “Escalating Anti-Semitic Violence in Europe,” he led a congressional drive to place the issue of combating anti-Semitism at the top of the Organization for Security and Cooperation in Europe (OSCE) agenda, as a result of which in 2004 the OSCE adopted new norms for its participating States on fighting anti-Semitism.  In 2009, he delivered the keynote address at the Interparliamentary Coalition Combating Anti-Semitism London conference. In the 1990s, he chaired Congress’s first hearings on anti-Semitism and in the early 1980s, his first trips abroad as a member of Congress were to the former Soviet Union, where he fought for the release of Jewish “refuseniks.”

  • Help Protect Jewish Communities in Europe

    Mr. SMITH of New Jersey. Mr. Speaker, I thank Chairman ROYCE for his leadership on this very important human rights issue, as he has done so ably and effectively on all of these issues, particularly his leadership on Iran; and that, of course, would be echoed with ELIOT ENGEL’s excellent work there as well. This is a group of leaders that have made a huge difference. So thank you, Chairman ROYCE, for that. H. Res. 354, Mr. Speaker, prescribes specific, effective actions that government should take in response to the deadly threats to the Jewish communities in Europe. As we all know, the number of violent anti-Semitic attacks have increased from 100 to 400 percent in some European countries since 2013 alone. Murders in Paris and Copen-hagen and elsewhere remind us that there are those who are motivated by anti-Semitic hate and have the will and the means to kill. I would just note parenthetically that my work in combating anti-Semitism began back in 1981, in my first term, from this very podium, speaking out in favor of Jewish refuseniks. I joined Mark Levin and the NCSJ 1 year later in 1982 on a trip to the Soviet Union where we met with men and women who were targeted by the KGB and the Soviet evil empire simply be-cause they were Jewish. Sadly, anti- Semitism has not abated, and in recent years, it has actually worsened. This resolution calls for the United States Government to work with our European allies on specific actions that are essential to keep European Jewish communities safe and secure. It is based on consultations with the leading experts who are working directly with these communities. The resolution focuses on the formal partnerships between European law enforcement agencies and Jewish community security groups. Here in the United States, Mr. Speaker, the collaboration between the Department of Homeland Security and Security Community Network—an initiative of the Jewish Federation of North America and the Conference of Presidents of Major American Jewish Organizations—has been essential to protecting Jewish communities here. The formal partnerships between the Community Security Trust in the United Kingdom and the Jewish Community Security Service in France and their respective governments are also excellent models that need to be emulated. The resolution emphasizes the importance of consistent, two-way communication and information sharing between law enforcement agencies and Jewish community groups. It encourages the development of a pan-European information sharing, communication, and alerting system, and envisions governments, intergovernmental agencies, and Jewish communities working together on it. Such a system should function day-round and year- round and include training for personnel who are implementing it. The resolution also calls for European governments to support assessments in several key areas and accordingly adjust their actions and strategies. Details matter. The assessments should gather and analyze data on crimes committed, response from law enforcement, types of attacks or incidents that are most prevalent, and the types of targets that are most at risk. It is essential to understand how law enforcement agencies usually receive reports of anti-Semitic crimes and what initial actions they take when a report is filed. I remember years ago, when I offered a resolution at the OSCE Parliamentary Assembly, we heard that it was just hooliganism and other kinds of acts done by young people when you spray-paint a swastika on a tombstone in a Jewish cemetery, when you deface a synagogue, and you attack a man simply because he is wearing a yarmulke. Clearly, these are acts of anti-Semitic hate; yet, they were being dismissed as something that was other. Assessments are also needed on Jewish community security groups, particularly of their capabilities, re-sources, relationships with local law enforcement agencies, preparedness, including emergency response plans, and the extent to which their decision-making is based on the best available information, analysis, and practices. The resolution calls for governments to use these assessments to help these community groups develop common baseline safety standards. These standards should include, as I said before, training, controlling access to physical facilities, physical security measures, including cameras, and crisis communications. Emergency exercises and simulations, mapping access to facilities, and sharing information with law enforcement agencies should also be part of the standards. These assessments, Mr. Speaker, will help achieve the resolution’s call for law enforcement personnel to be well trained to monitor, prevent, and respond to anti-Semitic violence and to partner with Jewish communities. For all of these assessments, governments should draw information from sources that include Jewish groups, law enforcement agencies, independent human rights NGOs, research initiatives, and other civil society groups and leaders. H. Res. 354 calls for safety awareness and suspicious activity reporting campaigns, like ‘‘If you see something, say something’’ here in the United States. Other aspects of the resolution include appropriately integrating initiatives to counter violent extremism and those to combat anti-Semitism and the urgency of implementing the declarations, decisions, and other commitments of the Organization for Security and Cooperation in Europe that focus on anti-Semitism. To accomplish these goals, the resolution calls for European governments to ensure that they appoint or designate senior officials with the necessary authority and resources to combat anti-Semitism and collaborate with governmental and intergovernmental agencies, law enforcement, and Jewish community groups. Finally, the resolution reaffirms support for the mandate of the United States Special Envoy to Monitor and Combat Anti-Semitism as part of the broader policy of fostering international religious freedom and urges the Secretary of State to continue robust U.S. reporting on anti-Semitism by the Department of State and the Special Envoy to Combat and Monitor Anti-Semitism. I would note parenthetically that I authored the amendment to the Global Anti-Semitism Review Act of 2004, introduced and sponsored by Senator Voinovich. My amendment created the Office to Monitor and Combat Anti- Semitism within the State Department. That has proven to be a key tool in this fight. Mr. Speaker, the resolution has the support of leading organizations, and it has 89 cosponsors, including all eight of the co-chairs of the Bipartisan Taskforce for Combating Anti-Semitism. I would like to acknowledge, Mr. Speaker, John Farmer, Jr., and Paul Goldenberg for their tireless efforts and dedication and leadership in fighting anti-Semitism and terrorism over the years. John is a former attorney general of New Jersey and is now on the steering committee of the Institute for Emergency Preparedness and Homeland Security and is the codirector of the Faith-Based Communities Security Program at Rutgers University. Paul is the executive director of the Secure Community Network and a senior adviser to the Institute and the program. Several major Jewish communities in Europe have relied on their counsel, and both have spent time on the ground within these communities. Finally, I would like to acknowledge and single out for very, very special thanks and recognition Rabbi Andy Baker, personal representative of the OSCE chair in the Office on Combating Anti-Semitism and director of the International Jewish Affairs for the American Jewish Committee. He has been critical—critical—to American leadership in Europe and in the United States in the fight against anti-Semitism.

  • Bipartisan Congressional Delegation Represents US at OSCE Parliamentary Assembly; Also Visits Ukraine, Czech Republic

    Forty years after the signing of the Helsinki Final Act established the precursor to today’s Organization for Security and Cooperation in Europe (OSCE), five members of the Helsinki Commission and four other members of Congress traveled to the OSCE Parliamentary Assembly Annual Session in Helsinki to demonstrate the U.S. commitment to confronting Russian aggression in Ukraine and elsewhere. Led by Commission Co-Chairman Senator Roger F. Wicker (MS), the bicameral, bipartisan delegation organized by the Helsinki Commission included Commission Chairman Representative Chris Smith (NJ- 04); House Commissioners Robert B. Aderholt (AL-04), Steve Cohen (TN-09) and Alan Grayson (FL-09); and Representatives Gwen Moore (WI-04), Michael Fitzpatrick (PA-08), Richard Hudson (NC-08) and Ruben Gallego (AZ-07). Before attending the Annual Session from July 5 to 7, several members of the delegation also visited Ukraine and the Czech Republic. A central concern to the delegation throughout the trip was Russia’s restrictions on democracy at home and aggression in Ukraine, along with Russia’s threat to European security.

    WASHINGTON—Following the stone-throwing attack on Serbian Prime Minister Aleksandar Vucic at Saturday’s ceremony commemorating the 20th anniversary of the Srebrenica genocide, Helsinki Commission Chair Rep. Chris Smith (NJ-04) issued the following statement: “Such violence is unworthy of the memory of the thousands of innocent civilians who were massacred in the genocide 20 years ago. Prime Minister Vucic’s attendance at the ceremony demonstrated a willingness to seek reconciliation and learn from the past.  I add my voice to those who have condemned the mob attack in the strongest possible terms and I urge the Bosnian authorities to take the necessary steps to apprehend and prosecute those responsible.” Rep. Smith is the author of the recently passed H. Res. 310, which affirms that the policies of aggression and ethnic cleansing implemented by Serb forces at Srebrenica constituted genocide, and condemns statements denying that the massacres meet the definition of genocide. Since 1995, Rep. Smith has worked to see that the perpetrators of the horrific acts at Srebrenica are punished and that closure is provided to survivors and victims’ families.

  • Urging Passage of H. Res. 310

    Madam Speaker, this week, the world pauses to remember and reflect on the Srebrenica genocide, horrific acts of brutality, wanton cruelty, and mass murder committed in Srebrenica beginning July 11, 20 years ago. This week, we pause to honor those brave Bosniaks who suffered and died, victims of genocide. This week, the people in the United States and men and women of goodwill throughout the world again extend our deepest condolences and respect to the mothers and surviving family members who have endured unspeakable sorrow and loss that time will never abate. And this week, the international community must recommit itself to justice, once and for all, for those who perpetrated these heinous crimes. Today, Ratko Mladic and Radovan Karadzic are incarcerated, awaiting final disposition of their cases before the International Tribunal for the former Yugoslavia for multiple counts of genocide, crimes against humanity, and violations of laws and customs of war. Twenty years ago, Madam Speaker, an estimated 8,000 people were systematically slaughtered by Bosnian Serb soldiers in the United Nations-designated “safe haven” area of Srebrenica. They killed Muslim women and children, but especially sought out and murdered adult males in that area. These brutal killings were not committed in battle. They were committed against people who were unarmed and helpless and who had been repeatedly assured by Dutch peacekeepers that they would not be harmed if they surrendered. The evidence is overwhelming that the executions were committed with the specific intention of destroying the Bosnian Muslim population of that area. This intention is the central element in the crime of genocide. The U.N. peacekeeping forces in Srebrenica were charged with enforcing Security Council Resolution 836, which had pledged to defend the safe areas with “all necessary means, including the use of force.” But when the moment of truth came, the U.N. forces offered only token resistance to the Serb offensive. Their military and political commanders had redefined their primary mission not as the protection of the people of Srebrenica, but as the safety of the U.N. forces themselves. When Bosnian Serb Commander Ratko Mladic threatened violence against the blue- helmeted soldiers here is the way one of those soldiers described the reaction. And I quote him: ‘‘everybody got a fright. You could easily get killed in such an operation. As far as I knew, we had not been sent to Srebrenica to defend the enclave, but, rather, as some kind of spruced-up observers.’’ So that is what the peacekeepers became: observers to genocide. Soon they became something more than observers: enablers. On July 13, the Dutch blue-helmet battalion handed Bosnian Muslims who had sought safety within the U.N. compound over to the Serbs. They watched as the men were separated from the women and children, a process which was already well known in Bosnia—it was at the time—as a sign that the men were in imminent danger of being executed. These men were never heard from again. At one congressional hearing I chaired in March of 1998—and I had six of them— Hasan Nuhanovic, the indigenous translator working for the U.N. peacekeepers in Srebrenica, testified. He was there in the room. Hasan lost his family in the genocide. He was there when Mladic and the commanders of the Dutch peacekeepers talked about the terms. Here is what he told my panel, in part: “On July 12, the day before the fall of Srebrenica, the Bosnian Serb Army commander, General Ratko Mladic, requested a meeting with the Dutchbat commander, Lieutenant Colonel Karemans, and local representatives of Srebrenica in the nearby town of Bratunac outside the enclave . . . During the meeting, Mladic assured the Dutch and local delegation that no harm would come to the refugees in Potocari . . . “Upon returning to the camp, three local representatives are ordered by Dutchbat deputy commander, Major Franken, to prepare a list of all males, all men and boys between the ages of 16 and 65 among the refugees inside and outside the camp. The list of the males among the 6,000 inside the camp was completed the same day . . . “On July 13, the Dutch ordered 6,000 refugees out of the Potocari camp. The Serbs were waiting at the gate, separating all males from the women and children. Major Franken stated that all the males whose names were on the list would be safe . . . I watched my parents and my brother being handed over to the Serbs at the gate. None of them have been seen since. “I want to explain here that the people hoped that the Dutch were going to protect them, the U.N. peacekeeping troops and all other members of all other organization who were present in Srebrenica who were inside the camp, the people hoped that they would be protected, but the Dutch soldiers and officer gave no other option to the refugees but to leave. So the refugees inside were told to leave without any other choice. My family was told on the evening of 13 July that they should leave. About 6 p.m., there were no more refugees inside the camp. “I don’t know if this is the topic of the meeting or hearing, but the same night the Dutch soldiers had a party inside the camp because they received two or three trucks full of beer and cigarettes. They played music while I was sitting, not knowing what happened to my family.” As he went on to say later, they had all been slaughtered. In July of 2007, Madam Speaker, I visited Srebrenica, where, together with my good friends President Haris Silajdzic and the Grand Mufti of Bosnia, Reis Ceric, I spoke at a solemn memorial service and witnessed the internment of hundreds of wooden coffins of newly discovered victims of the genocide. It was a deeply moving experience to see 12 years then after the genocide— now it is 20 years—families still grieving loved ones whose bodies were being identified, often miles from the killing sites, as Serb forces, trying to hide the evidence of their crimes, moved the bodies of their victims. For the record, 10 years ago—in 2005— the House of Representatives overwhelmingly passed H. Res. 199, which I authored, which clearly and unambiguously condemned the Srebrenica massacre for what it was: genocide. That resolution was a landmark in the recognition of the Srebrenica massacre as a genocide. Two years later the verdict of the International Court of Justice found the same, in confirming the ruling of the International Criminal Tribunal for the former Yugoslavia. Today the international community is nearly unanimous when it proclaims that the Srebrenica massacre was a genocide. The resolution today, of course, supports that as well. Astonishingly, Madam Speaker, there are some genocide deniers. That is why this resolution condemns statements that deny that the massacre at Srebrenica constituted genocide. Just last weekend Milorad Dodik, the president of Republika Srpska, asserted that the Srebrenica genocide is a lie. Madam Speaker, just as it is doing in Ukraine, Russia is utilizing misinformation and historical revisionism in an attempt to destabilize Bosnia and the Balkan region. Today Russia vetoed a British U.N. Security Council resolution that reaffirms that Srebrenica was a genocide. Russia has encouraged Serbia itself to protest the resolution and emboldened genocide denialism in the Republika Srpska, one of Bosnia’s two constituent entities. Madam Speaker, this resolution also encourages the administration to fulfill other neglected responsibilities. In particular, it urges the Atrocities Prevention Board to study the lessons of Srebrenica and issue informed guidance on how to prevent similar incidents from recurring in the future. As you may know, the Atrocities Prevention Board is a U.S. interagency committee established by the administration in 2012 to flag potential atrocities. However, since its creation, the board has been marked by inaction and a complete lack of transparency. This is unacceptable, especially as conflicts with disturbing parallels to Bosnia before the genocide continue to fester in Syria, the Central African Republic, Burma, and in Burundi. Africa, in particular, would stand to benefit from a more active board. The conflict in Burundi is currently at a tipping point, and it absolutely needs attention.  Madam Speaker, despite the need for much greater atrocities prevention in U.S. policy, there have been many promising developments in the Balkan region, and this needs to be underscored. In particular, I would note that Serbia today is not the Serbia of the Slobodan Milosevic era. That era was marked by nationalist aggression against neighboring countries and peoples, as well as considerable repression at home. One of those who testified at one of my hearings on Serbia, Curuvija, a great young leader, was murdered on the second day after our bombing began by Serbian people. And the persons who did that have now been held to account. So what has happened there—thankfully, there have now been significant changes in Serbia. I want to thank my colleagues.
