Has the UN failed Ukraine and the World?
Wednesday, September 27, 2023Many leaders and experts argue that the United Nations has struggled to uphold Article I of the UN Charter which mandates the UN to “take effective collective measures for the preventions and removal of threats to the peace,”. Russia, a permanent member of the United Nations Security Council, has been blocking actions to defend Ukraine’s internationally recognized borders and has thus undermined effective humanitarian action and peacekeeping in Ukraine. This Helsinki Commission hearing examined how dynamics in the UN and its UNSC have prevented adequate humanitarian and diplomatic responses to international crises that Russia has either caused or exacerbated, Ukrainian perceptions of the organization, and specific actions towards reforming the United Nations Security Council. Dr. Thomas Grant, Senior Research Fellow at the University of Cambridge, addressed in his testimony reasoning to curtail Russia’s presence in the UNSC and how to achieve this. He explained how Russia exploits its position on the UNSC by being a bully and fabricating fictious claims. Dr. Thomas Grant proposed the use of the ‘credentials procedure’ which has been used by the United Nations in the past. He stated how “under the procedure, any member of the Council may raise objection against the presence of any other member” and a vote may proceed that is not subject to permanent-member veto. Dr. Thomas Grant concluded his testimony by saying how Russia is preventing the UNSC from “action in response to Russia’s aggression against Ukraine.” H.E. Sergiy Kyslytsa, the Ambassador and Permanent Representative of Ukraine to the United Nations, began his testimony by listing Russia’s occupations and describing what historically led to the importance of Russia’s seat on the UN Security Council. He stated that following the Yalta conference, Stalin had the idea that the United Nations would be designed in a way that would allow the Soviet Union to maintain all power which increased the importance of the permanent seat on the Security Council. Sergiy singled out the issue of Russia’s presence on the UN Security Council by saying “how soon in New York and in the capitals will be able to call a spade a spade” and discuss the future world order. Sergiy then completed his testimony by expressing his gratitude to the U.S. Mission to New York for their extensive cooperation together. Ms. Natasha Hall, Senior Fellow for the Middle East Program at the Center for Strategic & International Studies (CSIS), described in her testimony how authoritarian regimes undermine democratic values and thus take advantage of UN humanitarian aid. She urged that the answer to the dilemma with Russia is to not turn away from the United Nations but instead argued that “this is time for the United States to lean in”. Ms. Natasha Hall then provided three recommendations to this Helsinki Commission. The first of these was for the United States to remove humanitarian assistance from the UN Security Council. Second, in any country where peace negotiations are stalled, the United States should work with allies for alternatives. Thirdly, Ms. Natasha Hall stated that funding for humanitarian aid should not be cut and that it requires a “coherent strategy to end conflicts”. The Commissioners proceeded to ask the witnesses questions regarding the removal of Russia from the UN Security Council and what the United Nations has done to stop Russia’s actions in Ukraine. A notable quote from the question and answer timeframe, was spoken by Sergiy Kyslytsa: “we have to reach a point where we are able to call a spade a spade. We have to be brave – to be brave enough to say: Mr. Ambassador of the Russian Federation, the actions of your country are totally incompatible with your status. And we have not reached this point, unfortunately”.

In its wake, experts and leaders like President Zelenskyy raise serious questions whether a United Nations (UN) created for a post-World War II world over a half century ago lacks the capability and political will to meet today’s 21st Century challenges. The lack of UN collective action on Russia’s war on Ukraine--from its 2014 seizure of the Crimea to the UN General Assembly this week--is stark evidence of the urgent need to address these questions. Article 1 of the UN Charter mandates the UN to “take effective collective measures for the prevention and removal of threats to the peace,” a purpose the UN has struggled with, not just in Ukraine, but in war-torn areas around the world. Leaders and experts argue the UN has instead enabled Russia, including through its role as a permanent member of the United Nations Security Council (UNSC), to block actions to defend Ukraine’s internationally recognized borders and undermine effective humanitarian action and peacekeeping in Ukraine and elsewhere. The hearing will examine how dynamics in the UN and its UNSC have prevented adequate humanitarian and diplomatic responses to international crises that Russia has either caused or exacerbated. It will further explore Ukrainian and global perceptions of the organization, and specific actions and reforms needed to meet one of the greatest challenges to international security and peace since the UN’s founding. Finally, it will start a critical conversation between Commission leaders, leading officials, and top experts on how fundamental issues in the UN and other institutions founded in the last century can be addressed to meet today’s emerging international challenges. Rescuing Ukrainian Children and Women from Russia's Aggression
Wednesday, July 26, 2023Russia’s war has exposed the critical need for U.S. and international action to both save Ukraine’s children and to put in place measures for the future that will protect children, as well as vulnerable refugees around the world, from wartime atrocities and from other threats such as human trafficking. Ukraine’s children are suffering serious injury and trauma due to Russia’s genocidal war of aggression on Ukraine. Almost two-thirds of Ukraine’s children have been displaced, thousands have been injured and hundreds killed. The Ukrainian government has documented close to 20,000 cases of children forcibly taken to Russia or Russian-controlled areas of Ukraine for forced russification, a war crime under the Geneva Convention that could amount to genocide. In addition to the immediate dangers, the effects of war on children will have lasting negative consequences if not addressed. Many Ukrainian children have witnessed unimaginable violence, including the murders of their own parents or family members. At the same time, some Ukrainian women and children are facing increased vulnerability to human trafficking. Of the 8 million refugees that have fled Ukraine, 90% are women and children. There continue to be credible reports of traffickers trolling border areas, train stations, and refugee centers trying to lure refugees with promises of accommodation, onward transportation, or employment, sometimes even masquerading as volunteers providing assistance. Nevertheless, international responses, particularly along border areas, have not been sufficient. This hearing will provide testimony from top officials and experts on the ground to discuss the devastating impact of Russia’s war on Ukrainian children and women and what the United States and the international community can do to better protect these vulnerable women and children from the trauma of war and to prevent human trafficking. It will also detail a new bill taking action to address these challenges, Oleksandr’s Act, which is dedicated to the Ukrainian children who have suffered during this war.

United States Demonstrates Global Leadership on Ukraine at OSCE PA Annual Session
Friday, July 14, 2023The Helsinki Commission’s four senior leaders helmed the United States’ bicameral, bipartisan delegation to the 30th Annual Session of the OSCE Parliamentary Assembly last week in Vancouver, Canada. Co-Chairman Senator Ben Cardin (MD), serving as Head of Delegation, was joined by Chairman Joe Wilson (SC-02) as Deputy Head of Delegation as well as Ranking Members Rep. Steve Cohen (TN-09) and Sen. Roger Wicker (MS), alongside six other Members of Congress. The high-level delegation demonstrated the United States’ global leadership role in rallying support for Ukraine’s fight against Russian aggression. At the outset of the Parliamentary Assembly session, the U.S. delegation held a closed-door bilateral meeting with the Ukrainian delegation to synchronize support. The U.S. delegation also voted to establish an Ad Hoc Committee on Ukraine to consolidate and coordinate the Parliamentary Assembly’s manifold activities on Ukraine. “We are comprised of Democrats, Republicans, House members, and Senate members and we are unified in our support for Ukraine,” Sen. Cardin said, introducing the U.S. delegation at the opening plenary on June 30. Speaking on behalf of the delegation, he told the gathering of more than 225 parliamentarians from 50 countries that “we recognize Ukraine is our front line in the defense of democracy and sovereignty. Members of the Russian delegation are subject to Canadian travel sanctions and the delegation has forfeited its voting rights in the Assembly after refusing to pay its national contribution to the PA’s annual budget for 2022-2023. Demonstrating Resolute Support for Ukraine Over the course of four days of debate, votes, and bilateral meetings, the United States’ representatives at the Annual Session drew attention to the enormity of Russia’s atrocities in Ukraine and the threat Russian President Vladimir Putin poses to global peace. The Annual Session culminated in the overwhelming adoption of a concluding document, known as the Vancouver Declaration. Contributing to the text of the declaration, the U.S. delegation sponsored three resolutions, known as supplementary items, on combatting antisemitism, on countering the notorious Wagner Group of Russian mercenaries, and on protecting and supporting Ukraine’s women and children. The United States also successfully proposed 23 amendments to other resolutions, including those from the PA’s three general committees as well as supplementary items from other delegations on Belarus, Moldova, and Ukraine. Across these initiatives, the United States called attention to Russian acts of genocide in Ukraine, Belarus’ complicity in Russia’s war on Ukraine, Russia’s practice of energy blackmail, Chinese harassment of dissidents in OSCE participating States, democratic backsliding in the OSCE region, Russia’s occupation of Georgian territory, and the need to reform the global security architecture to prevent further acts of Russian aggression. (Photo Credit: CSCE) Helsinki Commission Chairman Wilson took the floor in the opening plenary to condemn the “genocidal intent” behind Moscow’s assault on civilian infrastructure and women and children in Ukraine. Calling for outright victory for Ukraine, Rep. Wilson observed that “Putin does not negotiate in good faith. He perceives negotiations as an invitation for appeasement.” Rep. Victoria Spartz spoke in personal terms about the war in Ukraine: “As someone who was born in Ukraine and spent half of my life there…I understand what a high price the Ukrainian people are paying for their freedoms. But they’re paying this price not just for them but also for each of us.” Rep. Spartz called on OSCE participating States to consider reform of international security mechanisms to create “a framework to deter these brutal atrocities that are happening in Ukraine.” Countering Russia’s Threats and Bolstering Ukraine’s Resilience Rep. Richard Hudson chaired the OSCE PA’s General Committee on Political Affairs and Security for the third straight year and used his opening remarks to highlight Russia’s “dangerous rhetoric about using nuclear weapons, on top of its complete disregard for international security mechanisms and military transparency.” In particular, he noted “Russia’s announced withdrawal from the Conventional Forces in Europe treaty…[that] underscores its reckless and bad faith approach to arms control and confidence building measures.” Later in the session, Rep. (Photo Credit: OSCE) The First Committee unanimously adopted a resolution on “The Wagner Group’s Terroristic Nature and Actions” co-sponsored by Rep. Marc Veasey, a member of the OSCE PA Ad Hoc Committee on Countering Terrorism (CCT), and led by Austrian Member of Parliament and CCT Chairman Reinhold Lopatka. Echoing the Holding Accountable Russian Mercenaries Act (HARM Act) in the U.S. Congress, the resolution calls on OSCE participating States to designate the Wagner Group as a foreign terrorist organization to facilitate criminal prosecutions of those involved in the group and enablers provisioning it with financial and material resources. While introducing the text, Rep. Veasey explained how the Wagner Group fits the definition of a terrorist group given its record of “atrocities in furtherance of political ends” committed against noncombatants. He further noted that “the fact that Wagner turned against the regime that birthed it, does not change the fact that this is a terrorist group.” Former First Committee Chairman and OSCE PA Vice President Sen. Roger Wicker (MS) weighed in during the committee’s opening debate to decry Russia’s practice of “energy blackmail,” including targeting “Ukraine’s basic infrastructure and the energy security of the rest of the continent.” Noting his position as Ranking Member of the Senate Armed Services Committee, Sen. Wicker highlighted the United States’ $130 billion of security, economic and humanitarian assistance to Ukraine since the start of the full-scale invasion and thanked other OSCE countries for contributing to the effort. “Ukraine,” he said, “is not asking us as members of the OSCE to do their fighting for them….they’re simply asking us to give them the financial means and the resources to get the job done.” U.S. delegates also contributed to the work of the General Committee on Economic Affairs, Science, Technology, and Environment, or Second Committee, by proposing amendments on Ukraine to the committee’s draft resolution. These amendments decried the environmental impact of Russia’s war and its systematic use of energy blackmail as an instrument of malign influence. Pointing toward emerging technologies that could mitigate energy dependence on Russia, Sen. Cardin also presented an amendment authored by Rep. Hudson “encouraging cooperation for the development and adoption of small modular reactors to achieve energy independence and diversification.” Advocating for Political Prisoners and Protecting Ukrainian Women and Children In the General Committee on Democracy, Human Rights, and Humanitarian Questions, known as the Third Committee, Rep. Cohen invoked his role as OSCE PA Special Representative on Political Prisoners while paying tribute to political prisoners in Belarus and Russia who face brutal punishment for speaking the truth. “These,” he said, “are the people who evoke the principles of the OSCE: they speak for transparency, they speak for freedom, they speak against autocrats.” In particular, he highlighted the ongoing detention of oppositionists Alexei Navalny and Vladimir Kara-Murza in Russia as well as Siarhei Tsikhanouski in Belarus and called on parliamentarians to use their platforms as elected officials to draw attention to these prisoners and work for their release. (Photo Credit: OSCE) Members of the Third Committee unanimously adopted a U.S. resolution on “Adopting Effective Mechanisms to Safeguard Ukrainian Women and Children from Abuse, Exploitation, and Human Trafficking,” led by OSCE PA Special Representative on Human Trafficking Issues Rep. Chris Smith and co-sponsored by Rep. Wilson. Rep. Wilson introduced the resolution, which calls on OSCE participating States to take specific steps to press for the return of Ukrainian children forcibly taken to Russia and Russian-controlled areas of Ukraine, prevent human trafficking of Ukrainian refugees, most of whom are women and children, and provide resources for trauma treatment for children. “Russia’s brutal and unjustified invasion of Ukraine has exposed the critical need for international action to both save Ukraine’s children and to put in place measures for the future that will protect children, as well as vulnerable refugees, from wartime atrocities and other threats such as human trafficking,” Rep. Wilson told the committee. Countering the Rise of Antisemitsm In a plenary session on July 3, Sen. Cardin presented his annual report as OSCE PA Special Representative on Antisemitism, Racism, and Intolerance and introduced a corresponding U.S. resolution on “Rising Antisemitism in the OSCE Region.” Sen. Cardin sounded the alarm that “antisemitism, racism, and intolerance is clearly on the rise across the OSCE region.” To counter this disturbing trend, he called on parliamentarians and OSCE participating States to “lead the fight against hate” by speaking out, preventing the normalization of hateful behaviors, adopting a national strategy such as has recently been done in the United States, strengthening Holocaust education, and deploying OSCE resources designed to address antisemitism and hate-based incidents. Earlier in the day, Sen. Cardin hosted a well-attended side event titled “Countering the Rise in Antisemitism and Other Hate-Based Incidents: Government Action and Leadership.” The panel discussion featured participation from Susan Heller Pinto, Vice President of International Policy at the Anti-Defamation League (ADL); Matteo Mecacci, Director of the OSCE Office for Democratic Institutions and Human Rights; and Rabbi Andrew Baker, Personal Representative of the OSCE Chairman-in-Office on Combating Antisemitism. Helsinki Commission Chair and Co-Chair Lead Delegation to 2023 OSCE PA Annual Meeting
Monday, July 10, 2023WASHINGTON—Helsinki Commission Co-Chair Senator Ben Cardin (MD) and Helsinki Commission Chair Representative Joe Wilson (SC-02) led a bipartisan Congressional delegation to the 30th Annual Session of the OSCE Parliamentary Assembly (OSCE PA) in Vancouver, Canada from June 30-July 4. As Head of Delegation and Deputy Head of Delegation respectively, Senator Cardin and Representative Wilson welcomed the passage of the Vancouver Declaration on the final day of the OSCE PA Annual Session. The Declaration strongly condemned Russia’s war of aggression in Ukraine, calling for Russia’s complete withdrawal from all of Ukraine. It urged OSCE states to hold Russia accountable for its war crimes and genocide against the Ukrainian people and support the establishment of a special international tribunal. En route, members of the Delegation received in-region briefings to advance awareness on Arctic security challenges impacting U.S. military installations and Alaska Native organizations. “Last week, we have had the privilege to spend time with parliamentarians from a wide array of OSCE countries who remain committed to supporting Ukraine as it continues to fight Russian aggression,” Senator Cardin and Representative Wilson said. “We were pleased to join the OSCE countries at the PA in declaring our commitment to a path to peace on Ukraine’s terms by endorsing President Zelenskyy’s 10-point Peace Plan. As we return home, we look forward to building on the Declaration by ensuring that Ukraine receives the support it needs to defend itself against this ruthless invasion and secure Russian withdrawal from all areas of Ukraine.” The legislators also applauded the OSCE PA’s adoption of all three resolutions sponsored by U.S. delegation members: a resolution addressing the Wagner group’s terroristic nature and actions, sponsored by Representative Marc Veasey (TX-33); a resolution on adopting effective mechanisms to safeguard Ukrainian women and children from abuse, exploitation, and human trafficking, sponsored by Representative Chris Smith (NJ-04) and Representative Wilson; and a resolution on rising antisemitism in the OSCE region, sponsored by Senator Cardin. “As members of a body whose charter centers around securing human rights for all individuals in member countries, we are proud that the American delegation shined a light on and built consensus around some of the most pressing challenges facing the OSCE region,” the chair and co-chair added. “We are encouraged by our counterparts’ willingness to work to prevent future violence, address the physical and psychological trauma suffered by those experiencing conflict zones and discrimination, and hold perpetrators of such abuses accountable.” Throughout the OSCE PA Annual Session, members of the U.S. delegation participated in committees and bilateral meetings on a variety of topics affecting the region. Hearing: Supporting a Democratic and Secure Moldova

In 2022, the European Union granted Moldova “Candidate” status in its EU bid alongside Ukraine. Moldova’s many accomplishments are made all the more remarkable given the ongoing destabilizing effects of Russia’s illegal war on Ukraine and the Putin regime’s efforts to undermine Moldova’s security, economy, and political processes. Nonetheless, Moldova’s government and people have doggedly pursued a liberal democratic path, and have opened their country to hundreds of thousands of Ukrainian citizens who have transited or found refuge in the country in the wake of Russia’s brutal war. The hearing will feature a discussion with senior U.S. and Moldovan parliamentary leadership to explore how the United States can continue to support Moldova in its democratic reform agenda, continue its anti-corruption efforts, and achieve durable security for itself and the region. Helsinki Commissioners Lead Call for "Clear and Achievable" NATO Path for Ukraine at Vilnius Summit
Wednesday, June 21, 2023WASHINGTON—Last week, members of the Commission on Security and Cooperation in Europe, Chairman Representative Joe Wilson (SC-02), Ranking Member Representative Steve Cohen (TN-09), Commissioners Sen. Richard Blumenthal (CT), Sen. Sheldon Whitehouse (RI), Rep. Mike Lawler (NY-17), and Rep. Richard Hudson (NC-09) sent a letter to President Biden, requesting he work with our North Atlantic Treaty Organization (NATO) allies to ensure that Ukraine receives a concrete and achievable pathway to NATO membership at next month’s NATO Summit in Vilnius, Lithuania. Members of Congress Sen. Lindsey Graham (SC), Rep. Lloyd Doggett (TX-37), Rep. Mike Quigley (IL-05), Rep. Marcy Kaptur (OH-09), Rep. Brian Fitzpatrick (PA-01), Rep. Thomas Kean II (NJ-07), and Rep. Sheila Jackson Lee (TX-18) were co-signatories. In the letter, the Commissioners emphasize the importance of NATO providing Ukraine a near-term path to membership as part of a forward leaning effort to lay the groundwork for restoring, expanding, and enforcing peace in the region. The Commissioners also highlighted the value Ukraine would bring to NATO as both a model for democratic resilience and a premier military power that has faced Russia in the field. The letter reads: Dear President Biden, In the face of Russia’s wanton aggression, we ask that you work with our NATO allies to ensure Ukraine receives a concrete and achievable pathway to NATO membership at the upcoming NATO Summit. Next month, leaders from the 31 member states of the North Atlantic Treaty Organization will gather in Vilnius, Lithuania for what should be the most momentous summit for NATO since the end of the Cold War. The 2022 NATO Summit in Madrid was a critical moment to forge Alliance unity in the face of Russia’s full-scale war of aggression against Ukraine and the very idea of a Europe whole, free, and at peace. However, this year’s summit challenges the Atlantic Alliance to lay the crucial groundwork for restoring that peace, expanding it, and establishing fresh mechanisms to enforce it. It is in that spirit that we urge that the United States should take a forward leaning position in Vilnius and beyond to ensure Ukraine has a concrete, near-term path to NATO membership as soon as conditions allow. Ukraine’s recovery and Europe’s long-term security depend on our efforts during this moment. Russia could continue to be a threat to Ukraine, a disaster for European peace, and a challenge to U.S. interests around the world. Counting Ukraine as an Ally is also squarely in the Alliance’s self-interest: Ukraine in NATO will be a premier military power and the only European state to have faced Russian forces on the field since the end of the Cold War—and won. Ukrainian membership will also be a powerful expression of our shared values and solidarity with a democratic, open society that has demonstrated remarkable resilience in the face of the unendurable. It is clear that forward progress on Ukraine’s integration into NATO will not happen without U.S. leadership. Even if establishing a date for Ukraine’s accession may be beyond the reach of this Summit, a clear and achievable pathway to membership, alongside robust security commitments until accession occurs, is the minimum outcome we should expect from the meeting in Vilnius. We urge you to ensure the Alliance’s upcoming Summit truly meets the demands of this fraught moment and lays the foundation for a more peaceful, prosperous and secure Europe. His imprisonment, on spurious charges, is a violation of his human rights and an affront to Georgia’s democracy. Releasing political prisoners such as Mr. Gvaramia is an essential step towards EU candidacy for Georgia, and an important humanitarian gesture. CHURCH, STATE, AND RUSSIA’S WAR ON UKRAINE
Thursday, April 27, 2023The Putin regime has long used the Russian Orthodox Church (ROC) to consolidate its power at home and abroad. Under the leadership of Patriarch Kirill, the ROC has explicitly endorsed Russia’s war on Ukraine, even blessing weapons for the invasion. Churches under the mantle of the Ukrainian Orthodox Church (Moscow Patriarchate) had long been viewed as actual or potential surveillance and influence outposts for the Putin regime, directly contributing to the official establishment of the independent Orthodox Church of Ukraine in 2019. Additionally, the Putin regime has exported its widespread internal persecution of non-ROC-affiliated Christians to the territories it occupies in Ukraine. This hearing will assess Putin’s political control over ROC institutions and the implications for Ukraine’s religious and political culture. Relatedly, panelists will speak to harassment and denial of religious freedoms in territories occupied by Russia. Much of the OSCE’s focus over the past year has revolved around responses to the war, including using the organization to condemn Russian aggression and hold the government of the Russian Federation to account, to launch international investigations on Russian war crimes, and to reestablish an OSCE mission on the ground in Ukraine. The OSCE has remained at the forefront despite Russian efforts to block consensus and undermine the Organization and its work. Other challenges in the region include spillover effects of Putin’s war in Ukraine, the extension of the Nagorno-Karabakh conflict, and backsliding in some countries on human rights, democracy, and the rule of law. Anti-Semitic attacks and rhetoric continue to be on the rise, and vulnerable communities are targets of discrimination and violence. Combating human trafficking has taken on a renewed urgency as millions of vulnerable women and children have fled Ukraine. Attacks on independent media continues in some OSCE participating States, including Russia, Belarus and most recently, Kyrgyzstan. No Safe Haven: Launching the US-Europe Coalition on Russia Sanctions
Tuesday, December 13, 2022Since February 24, 2022, Western countries have imposed sanctions against Russian officials, businessmen, and public figures who support Russian aggression against Ukraine by financial or political means. Personal sanctions have been effective in creating tension between Putin’s proponents and continuing to help Ukraine fight for its independence. The biggest issue of personal sanctions policy is desynchronization among the countries imposing them. For example, when the United States enacts sanctions against politicians, public officials, and businessmen who support Russia’s war, the European Union and the United Kingdom do not. A similar dysfunction occurs when the European Union and Great Britain enforce sanctions on individuals without equal participation from the United States. The unity of the West in imposing sanctions on those driving Russia’s brutal invasion of Ukraine is essential for Ukrainian victory. This public briefing united seven legislators from the United States, Ukraine, United Kingdom, Lithuania, Estonia, and Poland. The panelists will announce the creation of the US-Europe Coalition on Russia Sanctions, which will synchronize the sanctions policy between the European Union, Ukraine, and the USA.

Whereas Robert (Bob) Hand has given 40 years of faithful service to the Commission on Security and Cooperation in Europe, making him the longest serving staff of the United States Helsinki Commission to date; Whereas he is a highly respected expert on the Western Balkans with his work being invaluable during the wars in the former Yugoslavia in the 1990s, he was focused on holding accountable those responsible for atrocities such as the Srebrenica genocide in 1995 and the murder of the Albanian-American Bytyqi brothers in Serbia in 2001, and he kept Commissioners up to date on developments in the region, including in Albania, where he is also known for his expert analysis; Whereas having served on numerous United States delegations to Organization for Security and Cooperation in Europe (OSCE) meetings, observed dozens of elections, and served as a mission member on one of the OSCE’s first field missions, the OSCE Missions of Long Duration in Kosovo, Sandjak, and Vojvodina while stationed in Novi Pazar in 1993, Bob’s institutional expertise and memory on the OSCE has been vital to both the Helsinki Commission and the Department of State; Whereas in his role as the Secretary of the United States delegation to the OSCE Parliamentary Assembly (PA), Bob deftly and tirelessly guaranteed that the delegation was always well-prepared to engage with our counterparts from other countries and that our proposals and resolutions had the best possible chance for adoption; Whereas his deep expertise on procedural matters and election monitoring, among other processes, made him an extraordinarily effective advocate and negotiator for United States interests and for human rights and democracy throughout his time as Secretary of the United States delegation; Whereas no major meeting of the Parliamentary Assembly could be considered “typical”, with an enormous variety of subjects discussed, new procedures created, and different Members of Congress participating on the United States delegation from meeting to meeting, Bob rose to a huge diversity of challenges as Secretary of the United States delegation, and he ensured that Members could meaningfully participate and contribute, and that the United States presence was impactful in every meeting he coordinated; Whereas during annual sessions in particular, Bob’s calm demeanor and deep knowledge of OSCE Parliamentary Assembly processes helped all members of the delegation, whether Commissioners or not, whether it was their 1st or 15th time at an OSCE PA meeting, to know where they were supposed to be, when they were voting, what issues were at stake, and when they were scheduled to speak; Whereas ahead of OSCE’s yearly gatherings, Bob skillfully collected signatures from other delegations for United States initiatives in the Parliamentary Assembly as well as secured support from Members for important supplementary items and amendments fielded by other delegations; Whereas at the 2022 OSCE PA Annual Session in Birmingham, Bob worked diligently with several other delegations to ensure that a critical resolution condemning Russia’s unprovoked invasion of Ukraine was adopted with the strongest possible language; Whereas the United States delegation had a 100-percent success rate at the 2022 OSCE PA Annual Session with the joint Ukraine resolution submitted by the United States, Ukrainian, and Lithuanian delegations, and all United States amendments to committee resolutions and supplementary items adopted; Whereas over the years, Bob guided the United States delegation through elections for OSCE PA leadership and helped secure positions for United States Members as OSCE PA President, Vice Presidents, and committee Chairs to make up the OSCE PA Bureau as well as positions on ad hoc committees and appointments as Special Representatives on Anti-Semitism, Racism and Intolerance, Human Trafficking Issues, and on Political Prisoners; Whereas Bob was instrumental in ensuring that the COVID pandemic in no way diminished the United States delegation’s consistent and meaningful impact, and that United States objectives were advanced at each and every opportunity despite the unprecedented shift to online formats spanning multiple time zones; Whereas Bob was always guided by a clear sense that what the United States says matters in a body such as the OSCE Parliamentary Assembly, he prioritized principles over dialogue for its own sake, and he served the Commission’s mandate faithfully and tirelessly; and Whereas his longstanding relationships with the OSCE Parliamentary Assembly leadership, staff, and other parliamentarians mean his departure will be felt not only by the Commission but by many of our friends in the OSCE region who have worked with him over the years: Now, therefore, be it Resolved, That the House of Representatives— (1) recognizes Robert A. My "Hell" in Russian Captivity
Thursday, September 15, 2022Russia’s war crimes in Ukraine include the brutal and unlawful detention of thousands of Ukrainians. At this hearing, Yuliia “Taira” Paievska, a well-known Ukrainian volunteer medic who was detained in Mariupol in March and held by the Russians for three months, testified about her capture, the deplorable conditions of her captivity, the plight of those who continue to be detained unlawfully, and her lifesaving work since 2014 providing medical assistance to those wounded by Russia’s war. Taira outlined the daily experience of torture, psychological manipulation, and inhumane living conditions she and others were subjected to by their Russian captors. She explained that she was detained during a document check, and when a guard recognized her name, she was singled out for especially cruel treatment. Held in the occupied territories but under the direct control of Russian forces, Taira spent three months in captivity. Her captors attempted to force a public confession from her for crimes she had not committed. Taira knew they would use this footage to drive the Russian propaganda narrative of Ukrainian cruelty and defend their own atrocities. She had seen footage of friends and colleagues admitting to crimes she knows they did not commit in order to escape the torture that she herself faced. Taira noted that the Russians spared no one, capturing and torturing civilians as well as soldiers. After thanking the United States for all the support it has given to Ukraine, she asked for help fighting Russian propaganda. She believes that the world must challenge Russian narratives. Taira requested additional shipments of modern weapons from the United States, stating that Ukrainians have proved themselves as responsible stewards of American weaponry and will use them to continue fighting with honor. She also asked for American help in facilitating international access to prisons in occupied Ukraine, in order to ensure fair treatment of prisoners according to the Geneva Conventions. Finally, Taira requested that the United States designate Russia as a state sponsor of terrorism, continue supporting Ukraine financially, and recognize the violence and oppression committed by Russia in Ukraine as a genocide.

Helsinki Commission Alarmed By Reported Transport of S-300 Missile Systems by Russia into the Black Sea
Friday, September 02, 2022WASHINGTON—Following reports that the Sparta II, a Russian cargo ship, transported S-300 missile systems through the Turkish Straits, Helsinki Commission Chairman Sen. Joe Wilson (SC-02) issued the following joint statement: “We are alarmed by Russia’s reported transport of S-300 missile systems through the Turkish Straits into the Black Sea. As Russia is waging a bloody, unprovoked war against Ukraine, it is critical that any supplies of arms to Moscow be cut off as quickly and efficiently as possible. Any additional weapon in the hands of the Kremlin would mean another Ukrainian who would lose his or her life to the aggressor. “As the gatekeeper to the Black Sea, Turkey must do everything in its power to stop the flow of arms to Russia. We are perplexed that while third parties were able to spot the ship as it was entering the straits, it appears the Turkish government failed to prevent it from delivering the missile systems to Russia. Such systems will inevitably be deployed to commit crimes against humanity. “We are sure that Turkey does not want to be complicit in this by failing to carry out its responsibilities. NATO Refocused, Europe Reinforced
Wednesday, August 10, 2022By Jessika Nebrat, Max Kampelman Fellow Following the escalation of Russia’s war against Ukraine, the North Atlantic Treaty Organization (NATO) is playing a role it has not filled in years. Forced to reconcentrate its attention to Europe’s defense, NATO allies are demonstrating persistent resolve in countering Moscow’s expansionist tendencies. In doing so, NATO returns to a core facet of its founding mission: the defense against Moscow’s militarism. While NATO represents just one facet of the Euro-Atlantic security infrastructure, it is perhaps the most robust organization bound by formal agreements, dedicated to peacekeeping, and capable of enforcement. Its mission to “guarantee the freedom and security of its members through political and military means” echoes the first dimension principles outlined by the Helsinki Final Act, and aligns NATO with the Organization for Security and Cooperation in Europe and the U.S. Helsinki Commission. In supporting each other’s work, these institutions mutually reinforce their shared values and bolster European security. History of NATO In the aftermath of the second World War, the United States, Canada, and several Western European nations sought to boost European economic reconstruction and protect themselves from Soviet domination. The 1947 Treaty of Dunkirk predated NATO in promoting Atlantic alliance and mutual assistance between France and the United Kingdom. The agreement was expanded in March 1948 as the Treaty of Brussels to engage Belgium, Luxembourg, and the Netherlands in military, economic, social, and cultural cooperation. In the same month, the United States hosted talks intended to unite both North American and Western European allies; as a result, NATO was officially signed into existence on April 4, 1949. The 12 founding member nations derived their legitimacy from United Nations (UN) Charter Article 51, which affirmed the right to collective defense. The foundational NATO Treaty mentioned collective defense only after declaring the parties’ commitments to finding peaceful resolutions of disputes, upholding UN principles, strengthening free institutions, and promoting economic collaboration. The Alliance formally defined its principal objectives to deter Soviet expansionism, oppose nationalist militarism on the continent, and bolster European political integration. Though it sought to deter military aggression, NATO’s original treaty did not provide any means of enforcing the agreed-upon principles. It was not until after the USSR’s 1949 detonation of an atomic bomb and the 1950 start of the Korean War that NATO approved a military command structure. In response, the Soviet Union established the Warsaw Pact in 1955. Though neither of the two ideologically opposed organizations used force during the Cold War, they engaged in an arms race that persisted until the Soviet Union dissolved in 1991. NATO after the Cold War Once NATO no longer had to defend against Soviet expansionism, the Alliance broadened the scope of its peacekeeping and security enforcement missions. In the 1990s, NATO forces were deployed: to Turkey during the Gulf Crisis; upon request to Russia and other Commonwealth of Independent States nations as part of a humanitarian mission after the fall of the USSR; to enforce a UN arms embargo and no-fly zone over former Yugoslavia; and in the Central Mediterranean during a period of tension with Libya. In the 21st century, NATO forces were also deployed during: the Second Gulf War; to the US and Afghanistan in the aftermath of the September 11, 2001 terrorist attacks, the only Article 5 invocation in NATO history; to mitigate rising ethnic tensions in North Macedonia; to counter terrorist activity in the Mediterranean; as counter-piracy escorts to UN World Food Programme ships transiting the Gulf of Aden; to train Iraqi security forces; to enforce a no-fly zone after the popular uprising in Libya; for peacekeeping in Sudan; and to provide disaster relief throughout Europe, the Middle East, and in the United States. NATO currently maintains active operations in Kosovo, the Mediterranean, Iraq, and throughout the African Union; it recently ramped up air policing as part of a peace-keeping response to the Russian Federation’s illegal annexation of Crimea in 2014, and the escalation against Ukraine this past February. Kremlin Narrative against NATO Over the years, Moscow has repeatedly resisted NATO enlargement – especially for countries it claims within its sphere of influence. Putin asserts that during a 1990 summit between President George H. W. Bush and President Gorbachev, the United States promised no further expansion of NATO; civil servants present at that meeting have refuted this claim, as has Mr. Gorbachev himself. In his conversation with Bush, Gorbachev repeatedly affirmed that nations have the right to make their own alliances. Though internal U.S. analyses of the 1990s suggested that expansion eastward may not be politically expedient, such positions never became official policy. The United States has remained resolute in its recognition of sovereign choice, and expansion has been driven by requests from former Soviet and Warsaw Pact states wary of Russian revanchism. The Kremlin has deployed an opposing narrative to justify Russian military engagements in Georgia in the early 2000s, and more recently in Ukraine. Putin sees the inclusion of either nation in NATO, and the political and economic liberalization that go with it, as threats to his regime’s stability. NATO membership would limit Russian interference in the internal affairs of either state. Additionally, if Russia’s neighbors and fellow post-Soviet states can become true democracies, provide higher quality of living, and ensure the rule of law, then why can’t Putin’s Russia? Any argument that NATO expansion threatens Russia misrepresents the organization, which is a diverse coalition dedicated to mutual defense and development. Moreover, such an assertion overlooks the efforts NATO has made to include and collaborate with Russia in the pursuit of cooperative security. NATO Back to its Roots By illegally and brutally invading Ukraine in February 2022 – a dramatic escalation of the grinding conflict started in 2014 – Putin has galvanized European and Western unity. Hearkening to its origins and returning attention to Eastern Europe, NATO is recommitting itself to “counter Russia’s attempts to destroy the foundations of international security and stability.” The international community is largely on board. In its collective attention beyond security, NATO – alongside other organizations – highlights not only the potential for, but the responsibility of the international community to condemn human rights violations, uphold the rule of law, and pursue economic health, all efforts that further challenge the Kremlin’s narrative that it can lead (or that there even needs to exist) an opposing bloc. Alarmed by Moscow’s renewed expansionism, Sweden and Finland have abandoned decades of neutrality in favor of NATO membership. They are on track towards the fastest accession process in history, and anticipate a smooth integration. Both already engage in the wider European community through membership in such organizations as the European Union and the Organization for Security and Cooperation in Europe. Their force structures are robust, and well-versed in NATO procedures following decades of partnership; their accession will secure northeast Europe, expand NATO’s border with Russia, and reinforce NATO presence in the Arctic and Baltic Sea. Although the Kremlin initially vowed “military and political repercussions” were Finland and Sweden to join NATO, such threats have dulled to warnings about the installation of NATO military infrastructure nearer Russia’s borders; as Finland and Sweden’s NATO membership neared finalization, Putin even expressed “no problem” with these states joining the Alliance. It remains to be seen how this change will play out. After decades of orientation towards international stabilization, humanitarian, and counterinsurgency mission sets, NATO has been refocused on European deterrence and defense following the Kremlin’s violent assault on Ukraine. In addition to condemning Russia’s invasion and supporting Ukraine via such measures as the Comprehensive Assistance Package, NATO plays a critical role in championing European collective defense and discouraging any expansion of conflict.

Cyprus’ unique location at the cultural crossroads of the eastern Mediterranean and important trade routes between Europe and the Middle East and beyond has shaped the island nation’s rich history. I recently returned to Cyprus to assess developments as the 35th commemoration of the Turkish invasion approaches and a significant portion of the country remains under occupation. Virtually every conversation during my visit, whether with officials or private citizens, touched on some aspect of the ongoing occupation of the country, the legacy of the 1974 invasion, or the prospects for a resolution of “the Cyprus issue.”
In a country with slightly less than a million people covering an area slightly more than half the size of Connecticut, one is hard-pressed to find a Greek Cypriot or Turkish Cypriot family that has not been affected in one way or another by the conflict and its lingering impact.
While the Cyprus conflict predated the 1975 signing of the Helsinki Final Act, many of the principles found in that historic document have particular applicability to the situation in Cyprus, including: territorial integrity of states; peaceful settlement of disputes; respect for human rights and fundamental freedoms, including the freedom of thought, conscience, religion or belief; and fulfillment in good faith of obligations under international law. Cyprus and Turkey were both original signatories to the Final Act.
Traveling to the remote Karpas peninsula, in northeastern Cyprus, I was able to speak with an elderly pensioner in Rizokarpaso, a town where thousands of Greek Cypriots once thrived.Today they number scarcely more than 200, the largest concentration of Greek Cypriots in the Turkish occupied north. A short distance from the main square, featuring a large statue of modern Turkey’s founder Kemal Atatürk on horseback, the gentleman described his existence amid a burgeoning population of newcomers from mainland Turkey. He explained that as elderly Greek Cypriots pass away in the area, their homes are occupied, often by “settlers.” The aged man, deeply rooted in the town, showed a fierce determination to remain despite the hardships, making clear that he would not be complicit with the effective cleansing of Greek Cypriots from the region. Within minutes after we sat down at a nearby cafe, a couple of young men sat conspicuously nearby, within easy listening distance from us, an action that seemed designed to intimidate.
The man pointed to a building across the street that serves as the school for the small number of Greek Cypriot children a short distance from the Orthodox Church, mainly used for funerals conducted by the lone cleric permitted to conduct such services in the region. According to the May 15 “Report of the Secretary-General on the United Nations operation in Cyprus,” humanitarian assistance was provided to 367 Greek Cypriots and 133 Maronites living in the northern part of the island.
While numerous mixed towns and villages existed throughout the country prior to 1974, today, the town of Pyla, partly located in the UN-monitored buffer zone, is the sole surviving bi-communal village, with around 500 Turkish Cypriots and 1,500 Greek-Cypriots. While local leaders from the communities described a generally harmonious and cooperative atmosphere, the reality is that interaction between the two remains limited, with separate schools, sports teams, municipal budgets, and police forces, among others.
Many of the people I met touched in one way or another on the ongoing talks between Cypriot President Demetris Christofias and the Turkish Cypriot leader, Mehmet Talat. In his February 28, 2008 inauguration, Christofias reiterated the requirements for a negotiated resolution of the Cyprus conflict and reunification of the country as a federal bi-zonal, bi-communal, with a single sovereignty, international personality and citizenship. Christofias and Talat have repeatedly reaffirmed their commitment to such a formula based on UN Security Council resolutions dating back to the 1970s.
The current talks, initiated by Christofias shortly after his 2008 election, focus on six main chapters, or themes, with corresponding working groups: governance and power sharing, European Union matters, security and guarantees, territory, property, and economic matters. Technical committees have also been established to consider crime, economic and commercial matters, cultural heritage, crisis management, humanitarian matters, health, and environmental matters. While formally conducted under the auspices of the UN, the talks are mainly being conducted directly between Christofias and Talat, with teams of experts focused on specific aspects of each topic.
A meeting with George Iacovou, President Christofias’ top aide on the current direct talks, helped put the negotiations in context against the backdrop of prior efforts to reunite the country, including the Annan plan, which the Greek Cypriots overwhelmingly rejected in a 2004 referendum. Officials, including government spokesman Stefanos Stefanou repeatedly emphasized that negotiations on a resolution of the conflict be by the Cypriots, for the Cypriots. That said, such an outcome depends in large measure on Turkey playing a constructive role as the leaders of the two communities seek to hammer out a comprehensive agreement.
Briefings by Foreign Minister Markos Kyprianou and other senior officials focused largely on the international dimension of the Cyprus issue. Central to the discussions was Turkey’s longstanding aspiration to join the European Union. Accession talks with Turkey began in October 2005.
In July of that year, the EU welcomed the country’s decision to sign a protocol adapting the Ankara Agreement to expand the existing customs union between Turkey and the EU to include all member states, including Cyprus. Simultaneously to the signing, Ankara issued a unilateral declaration, noting that its signature did not amount to recognition of the Republic of Cyprus. In response, the EU issued its own declaration on September 21, 2005 making clear that “this declaration by Turkey is unilateral, does not form part of the Protocol and has no legal effect on Turkey’s obligations under the Protocol.” Despite signing the adapted agreement, Turkish ports remain closed to Cypriot ships and airplanes. Cypriot government officials suggested that the status quo has cost the island nation millions in lost business.
EU foreign ministers meeting in Brussels on December 11, 2006 partially froze membership talks with Turkey over the impasse, suspending eight of the 35 chapters on the agenda of the accession negotiations, a step endorsed by the European Council on December 15. The Turkey 2008 Progress Report issued by the EU Commission reiterated the call for Turkey “to remove all remaining restrictions on the free movement of goods, including restrictions on means of transport regarding Cyprus.” Turkey's accession to the EU would also require Ankara to work toward recognizing the Republic of Cyprus, including establishment of diplomatic relations.
The next periodic report on Turkey’s implementation of the Ankara Protocol is expected later this year. While Cyprus supports Turkey’s aspirations to join the EU, the passage of time has brought potential opposition to the surface, notably from France and Germany.
Property
Property, another chapter heading under active discussion, has enormous implications. According to government officials, the vast majority of properties in the occupied north were owned by Greek Cypriots. Upholding the property rights of the owners as they were prior to the invasion remains a major priority for the government, with restitution the preferred end result. Considerable real estate development in the north and the continued occupancy of their homes by strangers, has led many Greek Cypriot property owners to file cases with the European Court of Human Rights (ECHR) claiming their property rights were violated. In the case of Loizidou v. Turkey, the court held that “denial of access to property in northern Cyprus was imputable to Turkey” and awarded damages, finding that the applicant had “effectively lost all control over, as well as all possibilities to use and enjoy, her property.”
More recently, a judgment issued by the European Court of Justice (ECJ) in the case of Meletis Apostolides v. David Charles Orams and Linda Elizabeth Orams could have a chilling effect on foreigners purchasing property in the occupied territory. The ECJ affirmed that courts in other EU countries must recognize and enforce Cypriot court judgments. Cyprus joined the EU in 2004.
Since the partial lifting, in 2003, of restrictions imposed by authorities in the north on freedom of movement, Greek Cypriots for the first time in large numbers have been able to cross into the northern part of the country – visiting their homes and villages many had not seen since 1974. Increased movement in both directions followed, with over 15 million incident-free crossings.
A Greek Cypriot shared his experience of visiting his home for the first time since being forced to flee during the invasion. He discovered that a Turkish Cypriot family was living in the house. To his surprise, the father had meticulously collected and stored all of the owner’s family photos and presented him with the box at that first visit. Similarly, the occupant had placed crosses and other religious articles in the attic for safekeeping. A Turkish Cypriot expressed relief at the fact that some Greek Cypriot friends from his home village were living in his house and maintaining his lands in the southwestern part of the country. Unfortunately, these stories appear to be the exception rather than the rule.
Missing Persons
Of the many painful consequences of the 1974 invasion, perhaps none is as heartrending as that of missing persons. According to The Committee on Missing Persons, a total of 1493 Greek Cypriots, including five Americans, were officially reported missing in the aftermath of the conflict. Five hundred and two Turkish Cypriots had already been missing, mainly victims of inter-communal violence that erupted in the early 1960s. The remains of one of the Americans, Andrew Kassapis, were eventually recovered and returned. The cases of the other four remain open.
The Committee on Missing Persons in Cyprus, established in 1981, facilitates the exhuming, indentifying and returning of remains of missing persons. The CMP mandate is limited in that it does not extend to Turkey. The Greek Cypriot and Turkish Cypriot communities each have one member on the committee. A third member is selected by the International Committee of the Red Cross and appointed by the UN Secretary-General. While in Nicosia, I had an opportunity to be briefed separately by Elias Georgiades, the Greek Cypriot representative and Christophe Girod, the UN representative.
Operating on the basis of consensus, the committee does not attempt to establish the cause of death or attribute responsibility for the death of missing persons. Since becoming operational in 2006, an anthropological laboratory has analyzed the remains of several hundred individuals. According to the committee, remains of 530 individuals have been exhumed from more than 273 burial sites throughout the country. Of remains examined at the forensic facility, the youngest individual was 10 months old and the oldest 86 years old. Walking though the lab I noted that most of the remains under examination had visible signs of gun wounds to the head. The remains of over 160 individuals have been returned to family members as a result of the bi-communal field teams and forensic work undertaken at the lab. The U.S. contributed funds for a family viewing facility which opened in 2008.
Land Mines
A briefing at the Mine Action Center in Cyprus provided insight into another legacy of the 1974 conflict, the presence of thousands of anti-personnel and anti-tank mines. Established in 2004, the center has assisted in planning, coordinating and monitoring of demining operations, including land surveys as well as the actual clearance and disposal of mines. While thousands of landmines have been cleared to date, thousands more remain. The center’s goal is a mine-free buffer zone by the end of 2010. In addition to efforts undertaken within the framework of the UN, Cyprus’ National Guard has worked to clear anti-personnel mines. Of the 101 known or suspected minefields in the country about half are in the UN monitored buffer zone, with most of the remainder nearby. Briefers underscored the continued threat posed by minefields adjacent to the buffer zone, recounting incidents of migrants trying to cross from the northern part of the country to the government-controlled south finding themselves surrounded by mines.
Farmers on either side of the buffer zone are also at risk as they seek to cultivate the arable farming lands bordering the area. The experts described the clearing operations involved in the opening of the Ledras Street pedestrian crossing point in the middle of the Cypriot capital, Nicosia, in April 2008. The Mine Action Center is assisting in clearing operations paving the way for the opening of additional crossing points. In late June, President Christofias and Mr. Talat reached agreement on the opening of the Limnitis crossing point with access to and from Kokkina in the remote northwest, offering an opportunity for development and integration by Greek Cypriots and Turkish Cypriots.
The United Nations has maintained an operational force on Cyprus since the establishment of the United Nations Peacekeeping Force in Cyprus (UNFICYP) in March 1964, following the outbreak of intercommunal violence. The force, one of the longest existing UN peacekeeping missions, consists of 858 troops, 68 police, and 160 civilians. UNFICYP is responsible for maintaining the status quo along the de facto ceasefire lines of the Cyprus National Guard, to the south, and Turkish and Turkish Cypriot forces to the north and a buffer zone between the two. The buffer zone stretches 111 miles from east to west, with 214 square miles of land between the lines, constituting about three percent of the country’s territory. The distance of separation varies from barely more than an arm’s span in some places to about four miles. Numerous villages, including Pyla, mentioned above, are located in partially or entirely in the buffer zone.
The once bustling seaside city of Famagusta along the east coast remains deserted, a veritable ghost town, as it has since the mainly Greek Cypriot population was forced to flee during the second phase of the Turkish invasion in August 1974. A center for commerce and tourism, the city and surrounding region was the second largest in the country prior to the evacuation. It is home to nearly half of the people uprooted by the conflict. Standing on the beachhead just north of the city in the Turkish-controlled area the unpopulated city stretched as far down the coast as I could see. Abandoned hotels and high-rise apartment buildings rise from the sandy shore standing as a collection of steel skeletal frames liberated of their contents by plunder and the passage of time since their occupants were forced to flee.
Religious Cultural Heritage
The ancient Roman city of Salamis, located a short distance from Famagusta on the east coast, was the arrival point for St. Paul on his first missionary journey, accompanied by St. Barnabas, a native son of that city. Paul eventually made his way to Paphos, on the opposite side of the island, where his preaching led to the conversion of the Roman Proconsul, making Cyprus the first country governed by a Christian. A short distance from Salamis is the village of Enkomi, where according to tradition, Barnabas’ remains were buried following his martyrdom.
Among minorities throughout the country recognized by the 1960 constitution are: Maronite Christians number approximately 5,000; Armenians 2,500; and Latins (Catholics) 1,000. The overwhelming majority of Cypriots are Orthodox, with Muslims comprising the next largest faith community.
His Beatitude Chrysostomos II has served as Archbishop of New Justiniana and All Cyprus since November 2006. During our meeting he underscored the long history of harmony among faith communities in Cyprus. The archbishop voiced particular concern for those displaced by the 1974 invasion and stressed the importance of upholding human rights, including the rights of individuals to return to their homes. He contrasted the efforts taken by the authorities with the support of the Church to preserve mosques in the government-controlled area with the destruction of religious cultural heritage, including churches, monasteries and chapels in the north. Archbishop Chrysostomos II, who was joined by the Bishop of Karpasia, described the challenges faced by clergy seeking to travel to the occupied north, including those seeking to participate in religious services. The rare Orthodox services that are allowed to be conducted in the north are mainly for feast days of several saints, notably St. Mamas and St. Barnabas. Even such exceptional occasions have occasionally been marred by security forces preventing worshipers from crossing into the area. The Archbishop said that the Church would soon file a formal case with the European Court of Human Rights regarding its religious sites and other property in the occupied north.
In the aftermath of Turkey’s 1974 military invasion and ongoing occupation of the northern part of Cyprus, a precious piece of the country’s cultural heritage is at risk of collapse – Orthodox churches, chapels and monasteries as well as those of other Christian communities. According to Archbishop Chrysostomos II, over 500 religious sites in the area have been seriously damaged or destroyed. During my travels throughout the region, I visited a score of churches – each in various stages of deterioration, all plundered. In Lapithos, in the Keryneia region, the Agia Anastasia complex is now a tourist resort. I found the Monastery of Ayios Panteleemon, in Myrtou, reduced to little more than a pigeon coup, with bird droppings everywhere – a scene I encountered repeatedly. In each church visited the interiors were stripped of religious objects, including altars, iconostasis, icons, and fonts. In some, it was clear how frescos had been chiseled out of walls and ceilings. It was a surprise to see a single bell still hanging in one of the many bell towers I saw. The main church in Rizokarpaso and a few elsewhere in the Karpas region were noteworthy for the fact that they even had doors; most others I visited did not. One of the countryside churches I visited was being used for storage, with heavy farm equipment in the yard and plastic crates and large tractor ties filling the interior space. In Keryneia, I found that a small chapel in the port was being used by the authorities as a tourist information center and snack bar. According to Church sources, others have been converted into stables, shops, and night clubs.
In the village of Kythrea, a small Catholic chapel was reduced to a shell with no roof. Most of the main church had been converted into a mosque, along with a couple of others in the town, but for some reason a quarter of the structure remained in ruins. Another church, Agios Andronikos, located nearby was heavily damaged, with the rubble of the collapsed roof strewn about the interior space, with traces of frescoes still visible on the exposed walls. In the village of Stylloi, in the Famagusta region, the Profitis Ilias Church yard also serves as a cemetery. There I found desecrated ruins of graves with all of the crosses broken off of their bases and smashed. A shed in the corner of the yard was stacked with broken crosses and headstones. Another cemetery a short distance away was similarly in shambles. An adjacent Muslim cemetery was in meticulous condition.
The U.S. Agency for International Development has supported a number of restoration projects in the occupied north, including work at the Agios Mamas Church in Morfou, operated mainly as an icon museum. In Keryneia, the prominent belfry of the Archangelos Mikhael Church disguises the fact that the once venerated site has likewise been converted into an icon museum. Such collections reportedly contain a small fraction of the thousands of icons, sacred vessels, vestments, manuscripts, frescos, and mosaics looted from churches, chapels and monasteries in the north. Many stolen icons and other antiquities are placed on the auction block for sale on the international market, some making their way into U.S. collections. The Byzantine Museum, in Nicosia, featured an exhibit: “Hostages in Germany: The Plundered Ecclesiastical Treasures of the Turkish-occupied Cyprus.” In a recent case, two icons from the early 1600s taken from a church in the northern village of Trikomo, were seized in Zurich by Swiss police.
In stark contrast to the situation in the occupied area, in Nicosia I visited the Ömerge Mosque housed in the 13th century Church of St. Mary built by the Augustinian religious order. The recently refurbished mosque is a functioning place of worship. A short distance away in the old walled city is Bayraktar Mosque. When I visited the site there were large pallets of stone to be used to renovate the plaza in the mosque complex. Another example is the Mosque of Umm Haram, or Hala Sultan Tekke, a mosque and prominent Muslim shrine, located in Larnaca, southeast of the capital. According to Cyprus government sources, scores of other mosques and other Islamic places of worship are maintained in the south.
A visitor to Cyprus need not look far to discover the scars left by the artificial division of the country following the 1974 invasion and ongoing occupation. Since my earlier trip to that island nation eleven years ago, there has been progress on some fronts, most noticeably in terms of freedom of movement since the partial lifting, in 2003, of restrictions imposed by authorities in the north. According to officials, the majority of Turkish Cypriots hold Cyprus-issued EU passports, affording them free movement throughout the EU area, employment opportunities in member countries and other benefits. In addition, thousands of Turkish Cypriots cross into the south daily for work. Other steps have come about as a direct result of the talks between the leaders of the two communities initiated last year. It remains to be seen, however, if the current negotiations will produce a comprehensive and durable resolution to the challenges in Cyprus. Beyond practical steps to ease the day-to-day lives of Greek Cypriots and Turkish Cypriots, key principles such as sovereignty, independence, and territorial integrity as well as respect for human rights and fundamental freedoms are also at stake, with implications for conflicts elsewhere.
Numerous earlier diplomatic initiatives were launched, but in the end failed. A particular challenge remains the thorny issues of the tens of thousands of Turkish troops and settlers from mainland Turkey still in Cyprus today, outnumbering Turkish Cypriots. Other factors, especially Turkey’s stated desire to join the EU, should not be discounted and could prove decisive to the ultimate success or failure of the current process. Meanwhile, Christofias and Talat and their teams grapple with an array of tough issues as they seek to overcome the legacy of the past 35 years and build a brighter future for all Cypriots.
