Mr. Speaker, twenty-five years ago this month, on June 3, 1976, a law was enacted creating the Commission on Security and Cooperation in Europe. We know it as “the Helsinki Commission.” One of the smallest and most unique bodies in the U.S. Government, it perhaps ranks among the most effective for its size. I have been proud to be a member of the Commission for the past 16 years. When President Gerald Ford signed, in Helsinki in 1975, the Final Act of the Conference on Security and Cooperation in Europe, he said that “history will judge this Conference not by what we say here today, but by what we do tomorrow--not only by the promises we make, but by the promises we keep.” That piece of rhetoric has not only been repeated in various forms by every United States President since; it has continually served as a basis for U.S. policy toward Europe. Credit for this fact, and for the Commission's establishment, first goes to our late colleague here in the House, Millicent Fenwick, and the late-Senator Clifford Case, both of New Jersey. Observing the foundation of human rights groups in the Soviet Union and Eastern Europe to monitor and, it was hoped, to encourage their governments to keep the promises made in Helsinki, she and other Members of Congress felt it would be good to give them some signs of support.

 

Keep in mind, Mr. Speaker, that this was in the midst of detente with Moscow, a polite dance of otherwise antagonistic great powers. It was a time when the nuclear warhead was thought to be more powerful than the human spirit, and the pursuit of human rights in the communist world was not considered sufficiently realistic, except perhaps as a propaganda tool with which to woo a divided European continent and polarized world. The philosophy of the Commission was otherwise. Respect for human rights and fundamental freedoms is, as the Helsinki Final Act indicates, a prerequisite for true peace and true security. As such, it is also a principle guiding relations between states, a legitimate matter for discussion among them. This philosophy, broadened today to include democratic norms such as free and fair elections and respect for the rule of law, remains the basis for the Commission's work.

 

Of course, the Commission was not meant to be a place for mere debate on approaches to foreign policy; it had actually to insert itself into the policy-making process. The Commission Chairman for the first decade, the late Dante Fascell of Florida, fought hard to do just that. It was, I would say, a bipartisan fight, with several different Congresses taking on several different Administrations. Moreover, it was not just a fight for influence in policy-making; it was a much tougher fight for better policies. The Commission staff, led during those early years by R. Spencer Oliver, was superb in this respect. It knew the Soviet Union and Eastern Europe. It worked with non-governmental organizations to increase public diplomacy and, subsequently, public support for In 15 years at the East-West divide, the Commission also championed policies, like the Jackson-Vanik amendment, linking human rights to trade and other aspects of U.S. bilateral relationships. The concept of linkage has often been chastised by the foreign policy establishment, but it comes from the passion of our own country's democratic heritage and nature. With persistence and care, it ultimately proved successful for the United States and the countries concerned.

 

The Helsinki Commission also became the champion of engagement. Commission members did not simply speak out on human rights abuses; they also traveled to the Soviet Union and the communist countries of East-Central Europe, meeting dissidents and ``refuseniks'' and seeking to gain access to those in the prisons and prison camps. At first, the Commission was viewed as such a threat to the communist system that its existence would not be officially acknowledged, but Commissioners went anyway, in other congressional capacities until such time that barriers to the Commission were broken down. The Commission focus was on helping those who had first inspired the Commission's creation, namely the Helsinki and human rights monitors, who had soon been severely persecuted for assuming in the mid-1970s that they could act upon their rights. Ethnic rights, religious rights, movement, association and expression rights, all were under attack, and the Commission refused to give up its dedication to their defense. Eventually, the hard work paid off, and the beginning of my tenure with the Commission coincided with the first signs under Gorbachev that East-West divisions were finally coming to an end. Sharing the chairmanship with my Senate counterparts--first Alfonse D'Amato of New York and then Dennis DeConcini of Arizona--the Commission argued against easing the pressure at the time it was beginning to produce results.

 

We argued for the human rights counterpart of President Reagan's “zero option'' for arms control, in which not only the thousands of dissenters and prospective emigrants saw benefits. They were joined by millions of everyday people--workers, farmers, students--suddenly feeling more openness, real freedom, and an opportunity with democracy. Dissidents on whose behalf the Commission fought--while so many others were labeling them insignificant fringe elements in society--were now being released and becoming government leaders, people like Polish Foreign Minister Bronislaw Geremek and Czech President Vaclav Havel. The independence of the Baltic States, whose forced incorporation into the USSR was never officially recognized by the United States, was actually reestablished, followed by others wishing to act upon the Helsinki right to self-determination.

 

Of course, Mr. Speaker, those of us on the Commission knew that the fall of communism would give rise to new problems, namely the extreme nationalism which communism swept under the rug of repression rather than neutralized with democratic antiseptic. Still, none of us fully anticipated what was to come in the 1990s. It was a decade of democratic achievement, but it nevertheless witnessed the worst violations of Helsinki principles and provisions, including genocide in Bosnia-Herzegovina and brutal conflicts elsewhere in the Balkans as well as in Chechnya, the Caucuses and Central Asia, with hundreds of thousands innocent civilians killed and millions displaced. Again, it was the Commission which helped keep these tragedies on the U.S. foreign policy agenda, holding hearings, visiting war zones and advocating an appropriately active and decisive U.S. response. In the face of such serious matters, too many sought to blame history and even democracy, equated victim with aggressor and fecklessly abandoned the principles upon which Helsinki was based. Again the Commission, on a bipartisan basis in dialogue with different Administrations, took strong issue with such an approach. Moreover, with our distinguished colleague, Christopher Smith of New Jersey, taking his turn as Chairman during these tragic times, the Commission took on a new emphasis in seeking justice for victims, providing much needed humanitarian relief and supporting democratic movements in places like Serbia for the sake of long-term stability and the future of the people living there.

 

In this new decade, Mr. Speaker, the Commission has remained actively engaged on the issues of the time. Corruption and organized crime, trafficking of women and children into sexual slavery, new attacks on religious liberty and discrimination in society, particularly against Romani populations in Europe, present new challenges. Senator Ben Nighthorse Campbell of Colorado, the latest Commission Chairman, has kept the Commission current and relevant. In addition, there continue to be serious problem areas or widespread or systemic violations of OSCE standards in countries of the Balkans, Central Asia and the Caucuses, or reversals of the democratization process as in Belarus. The Commission was born in the Cold War, but its true mission--the struggle for human rights, democratic government and the rule of law--remains as important now as it was then. It remains an essential element for true security and stability in the world, as well as, to paraphrase Helsinki, for the free and full development of the individual person, from whose inherent dignity human rights ultimately derive.

 

To conclude, Mr. Speaker, I wish to erase any illusion I have given in my praise for the Helsinki Commission on its first quarter of a century that it had single-handedly vanquished the Soviet empire or stopped the genocidal policies of Slobodan Milosevic. No, this did not occur, and our own efforts pale in comparison to the courage and risk-taking of human rights activists in the countries concerned. But I would assert, Mr. Speaker, that the wheels of progress turn through the interaction of numerous cogs, and the Commission has been one of those cogs, maybe with some extra grease. The Commission certainly was the vehicle through which the United States Government was able to bring the will of the American people for morality and human rights into European diplomacy. To those who were in the Soviet gulag, or in Ceausescu's Romania as a recent acquaintance there relayed to me with much emotion, the fact that some Americans and others were out there, speaking on their behalf, gave them the will to survive those dark days, and to continue the struggle for freedom. Many of those voices were emanating in the non-governmental community, groups like Amnesty International, Freedom House and Human Rights Watch. Through the Helsinki Commission, the voice of the United States Congress was heard as well, and I know that all of my colleagues who have been on the Commission or worked with it are enormously proud of that fact.

  • Implementation of the Helsinki Accords Vol I - Human Rights and Contacts

    This hearing focused on the implementation of the Helsinki Accords and explored proposals for advancing compliance.  The Commissioners and witnesses discussed how the accords could better East-West relations. They discussed how the framework of the Helsinki accords helps provide protection against armed intervention in internal affairs, or the threat of such intervention.  The Commissioners heard testimonies from those working on human rights in Warsaw Pact countries and from many American citizens seeking reunification with relatives in Warsaw Pact countries.

  • Implementation of the Helsinki Accords Vol.I - Human Rights & Contacts

    Hon. Dante Fascell, Chairman of the Commission on Security and Cooperation in Europe, presided over this hearing on the implementation of the Helsinki Accords. This hearing focused on the Commisison's consideration of the provisions of the 1975 Helsinki Accords dealing with respect for human rights and fundamental freedoms and with freer movement of people and information. The purpose was to define what the Commission knew of implementation of the accords and of their violations, to explore proposals for advancing compliance, and to seek advice on the role the accords played bettering East-West relations. Hon. Fascell was joined by Leonard Garment, former U.S. Representative to the United Nations Commission on Human Rights, and Vladimir Bukovsky, former Soviet political prisoner.

  • East-West Economic Cooperation-Basket II-Helsinki Final Act

    Our immediate business is to look at Basket IT, whose scope is greater than mere questions of trade and commerce, because in many ways politics is economics. Basket IT was designed to enhance economic cooperation among CSCE states in a way to loosen restraints inhibiting dealings between the Soviet bloc and the West. The hearing will offer suggestions on resolving problems of trade with eastern CSCE states; and how the U.S. Government deals with Basket II problems and how it can improve the overall trade picture by exploiting Basket II provisions in order to bolster East-West trade initiatives.

  • Report of the Study Mission to Europe

    Study Mission of the Commission on Security and Cooperation in Europe visited 18 signatories of the Helsinki Final Act between November 5 and November 23, 1976. The purpose of the Mission was to gather information about the current status of implementation of the provisions of the Helsinki accords and to establish contacts with key European political and governmental officials as well as private individuals and organizations concerned with various aspects of the implementation process. The CSCE Study Mission was composed of Rep. Dante B. Fascell, D-Fla. (Commission chairman); Sen. Claiborne Pell, D-R.I. (co-chairman); Rep. Jonathan Bingham, D-N.Y.; Rep. Millicent Fenwick, R-N.J.; and Rep. Paul Simon, D-Ill. Travelling individually, Commissioners and staff aides met with government officials and parliamentarians in Austria, Belgium, Denmark, Finland, France, the Federal Republic of Germany, Greece, Italy, Liechtenstein, Luxembourg, the Netherlands,' Norway, the Holy See, Sweden, Switzerland, Turkey, the United Kingdom and Yugoslavia, as well as with experts at NATO, the European Community, the Council of Europe, UNESCO, the Intergovernmental Committee on European Migration, the OECD, the United Nations High Commission for Refugees, and the United Nations Economic Commission for Europe. The Mission regrets that it could not confer with all signatory countries at this time and intends to do so in the future. The limited time available precluded visits to some countries. The Warsaw Pact countries, however, refused to permit the Commissioners to visit their countries, an action which runs counter to the very spirit of Helsinki. Additionally, the Study Mission met with half a dozen private refugee organizations, a number of recent Soviet exiles, more than 30 businessmen and organizations active in East-West trade, a cross section of journalists specializing in Eastern European affairs, and more than 20 individuals and private institutions conducting research on Helsinki implementation questions. Commission members Mansfield Sprague and James G. Poor from the Departments of Commerce and Defense, respectively, attended the initial and final joint Study Mission sessions in Brussels and London, and Commissioner Monroe Leigh of the Department of State attended the Brussels meetings.

    In July 1973 the Foreign Ministers of 33 European countries and the United States opened the Conference on Security and Cooperation in Europe (CSCE), in Helsinki. Since then the participants have made slow but steady progress on a broad range of security, political, economic and other issues of mutual concern. As the conference reaches what appears to be a conclusive stage interest in its eventual outcome has mounted both in Congress and throughout the Nation: Special concern has been expressed over the implications the Conference may have for such issues as human rights in Eastern Europe, the division of Germany, U.S. force levels in Europe, and the future of the Baltic nations of Estonia, Latvia, and Lithuania.

    The work of the Helsinki Commission aligns closely with that of the Organization for Security and Cooperation in Europe (OSCE), the world’s largest regional security organization. The United States supports the work of the OSCE through not only the Helsinki Commission, but also through funding—generally contribution between 11 and 14 percent of the OSCE’s operating costs—and through the deployment of individuals who carry out the activities of the OSCE across its vast geographic expanse, who do the day-to-day work of trying to make the principles on which the OSCE is based into a reality on the ground.     President Alexander Lukashenko has been in power in Belarus since 1994. In the run-up to elections in the summer of 2020, the Lukashenko regime sought to eliminate political competition to  through disqualification, intimidation, and imprisonment.   Election Day proper featured widespread allegations of fraud.  Many countries, including the United States, rejected the election’s outcome as illegitimate and refused to recognize Lukashenko as the legitimate leader of Belarus.  The months since the election have seen an unrelenting crackdown by Belarusian authorities on peaceful protests, civil society, and the media. As a participating State in the OSCE, Belarus is party to a number of commitments on human rights and fundamental freedoms, such as the right to free and fair elections and the right to peaceful assembly.  In response to the apparent violation of these rights, 17 other OSCE states invoked one of the key human rights tools at their disposal: the Moscow Mechanism, a procedure that allows for the establishment of a short-term fact-finding mission tasked with producing a report on a specific human rights concern and recommendations on how to resolve it. In this episode, Professor Wolfgang Benedek, the rapporteur appointed to investigate the crisis in Belarus, discusses his findings that human rights abuses are "massive and systematic, and proven beyond doubt" and his recommendations to address the violations.   • Racial Justice and the Helsinki Commission

    The Helsinki Commission has long supported racial justice in the United States and worldwide through its commitment to champion the tenets of the Helsinki Final Act, which states “. . . for all, without distinction as to race, sex, language or religion.” The commission promotes understanding of critical issues including minority rights, anti-Semitism, discrimination against Roma, and racism through hearings, briefings, events, legislation, and other initiatives. In 2020, the commission launched a series entitled "Human Rights at Home" that gathered the testimony of subject matter experts through public hearings on the current human rights situation in the United States and the U.S. commitment to adhere to its promises as an OSCE participating State. Helsinki Commission Chairman Rep. Alcee L. Hastings (FL-20) and other commissioners including the OSCE Parliamentary Assembly’s Special Representative on Anti-Semitism, Racism, and Intolerance Senator Ben Cardin regularly introduce and support legislation addressing diversity, inclusion, and racial justice issues in the United States and abroad. For example, the National Security Diversity and Inclusion Workforce Act of 2019 requires national security agencies to publicly report diversity and inclusion efforts; the African Descent Affairs Act of 2019 establishes a “U.S. strategy to protect and promote the human rights of people of African descent worldwide;” and the LITE Act strengthens partnerships with U.S. allies, protects democratic institutions, and supports transatlantic leadership.   Through statements, articles, reports, and podcasts, the commission explores and comments on discrimination, intolerance, and racial justice. The commission also enlists and engages with diverse leaders across the OSCE region through initiatives like the Transatlantic Minority Political Leadership Conference (TMPLC) and Transatlantic Inclusion Leaders Network (TILN).     The creation of the Moscow Helsinki Group was announced on May 12, 1976, a day that Helsinki Commission Chair Sen. Ben Cardin has called, “One of the major events in the struggle for human rights around the globe.” The 11 founding members, including legends of the human rights movement like Yuri Orlov and Lyudmila Alexeyeva, came together as what was formally named the Public Group to Assist in the Implementation of the Helsinki Final Act in the USSR. Their mission was to monitor the Soviet government’s implementation of the human rights provisions of the historic 1975 Helsinki Accords. In this episode, Dmitri Makarov, co-chair of the Moscow Helsinki Group, and historian Sarah B. Snyder discuss the history and impact of the Helsinki monitors, as well as the important work the Moscow Helsinki Group continues to do today.   • The Helsinki Process and the OSCE

    The Organization for Security and Cooperation in Europe (OSCE) has its origins in the early 1950s, when the Soviet Union first proposed the creation of an all-European security conference. In the mid-1960s the Warsaw Pact renewed calls for such a conference. In May 1969, the Government of Finland sent a memorandum to all European countries, the United States and Canada, offering Helsinki as a conference venue. Beginning in November 1972, representatives from the original 35 nations met for nearly three years to work out the arrangements and the framework for the conference, concluding their work in July 1975. On August 1, 1975, the leaders of the original 35 participating States gathered in Helsinki and signed the Final Act of the Conference on Security and Cooperation in Europe. Also known as the Helsinki Accords, the Final Act is not a treaty, but rather a politically binding agreement consisting of three main sections informally known as "baskets," adopted on the basis of consensus. This comprehensive Act contains a broad range of measures designed to enhance security and cooperation in the region extending from Vancouver to Vladivostok. Basket I - the Security Dimension - contains a Declaration of Principles Guiding Relations between participating States, including the all-important Principle VII on human rights and fundamental freedoms. It also includes a section on confidence-building measures and other aspects of security and disarmament aimed at increasing military transparency. Basket II - the Economic Dimension - covers economic, scientific, technological and environmental cooperation, as well as migrant labor, vocational training and the promotion of tourism. Basket III is devoted to cooperation in humanitarian and other fields: freer movement of people; human contacts, including family reunification and visits; freedom of information, including working conditions for journalists; and cultural and educational exchanges. Principle VII and Basket III together have come to be known as the "Human Dimension." Since 1975, the number of countries signing the Helsinki Accords has expanded to 57, reflecting changes such as the breakup of the Soviet Union, Czechoslovakia and Yugoslavia. Institutionalization of the Conference in the early 1990s led to its transformation to the Organization for Security and Cooperation in Europe, effective January 1995. Today, the Organization for Security and Cooperation in Europe is engaged in standard setting in fields including military security, economic and environmental cooperation, and human rights and humanitarian concerns. In addition, the OSCE undertakes a variety of preventive diplomacy initiatives designed to prevent, manage and resolve conflict within and among the participating States. The OSCE has its main office in Vienna, Austria, where weekly meetings of the Permanent Council are held. In addition, specialized seminars and meetings are convened in various locations and periodic consultations are held among Senior Officials, Ministers and Heads of State or Government.

    Election observation is a core element of the OSCE’s efforts to promote human rights, democracy, and the rule of law. Each OSCE participating State—including the United States—pledges to invite foreign observers to observe its elections. The United States plays an active role in OSCE election observation missions, both by providing observers for foreign elections as well as by inviting the OSCE to observe every general and midterm election since 2002. Ahead of the 2020 presidential election, veteran election observer Orest Deychakiwsky, former director of the OSCE’s Office of Democratic Institutions and Human Rights and current OSCE PA member Michael Link, and Deputy Secretary of the State of Connecticut Scott Bates share insights on the origins and value of OSCE election observation, along with the process of election observation from the OSCE and state perspective.
