United States Demonstrates Global Leadership on Ukraine at OSCE PA Annual Session
Friday, July 14, 2023The Helsinki Commission’s four senior leaders helmed the United States’ bicameral, bipartisan delegation to the 30th Annual Session of the OSCE Parliamentary Assembly last week in Vancouver, Canada. Co-Chairman Senator Ben Cardin (MD), serving as Head of Delegation, was joined by Chairman Joe Wilson (SC-02) as Deputy Head of Delegation as well as Ranking Members Rep. Steve Cohen (TN-09) and Sen. Roger Wicker (MS), alongside six other Members of Congress. The high-level delegation demonstrated the United States’ global leadership role in rallying support for Ukraine’s fight against Russian aggression. At the outset of the Parliamentary Assembly session, the U.S. delegation held a closed-door bilateral meeting with the Ukrainian delegation to synchronize support. The U.S. delegation also voted to establish an Ad Hoc Committee on Ukraine to consolidate and coordinate the Parliamentary Assembly’s manifold activities on Ukraine. “We are comprised of Democrats, Republicans, House members, and Senate members and we are unified in our support for Ukraine,” Sen. Cardin said, introducing the U.S. delegation at the opening plenary on June 30. Speaking on behalf of the delegation, he told the gathering of more than 225 parliamentarians from 50 countries that “we recognize Ukraine is our front line in the defense of democracy and sovereignty. Members of the Russian delegation are subject to Canadian travel sanctions and the delegation has forfeited its voting rights in the Assembly after refusing to pay its national contribution to the PA’s annual budget for 2022-2023. Demonstrating Resolute Support for Ukraine Over the course of four days of debate, votes, and bilateral meetings, the United States’ representatives at the Annual Session drew attention to the enormity of Russia’s atrocities in Ukraine and the threat Russian President Vladimir Putin poses to global peace. The Annual Session culminated in the overwhelming adoption of a concluding document, known as the Vancouver Declaration. Contributing to the text of the declaration, the U.S. delegation sponsored three resolutions, known as supplementary items, on combatting antisemitism, on countering the notorious Wagner Group of Russian mercenaries, and on protecting and supporting Ukraine’s women and children. The United States also successfully proposed 23 amendments to other resolutions, including those from the PA’s three general committees as well as supplementary items from other delegations on Belarus, Moldova, and Ukraine. Across these initiatives, the United States called attention to Russian acts of genocide in Ukraine, Belarus’ complicity in Russia’s war on Ukraine, Russia’s practice of energy blackmail, Chinese harassment of dissidents in OSCE participating States, democratic backsliding in the OSCE region, Russia’s occupation of Georgian territory, and the need to reform the global security architecture to prevent further acts of Russian aggression. (Photo Credit: CSCE) Helsinki Commission Chairman Wilson took the floor in the opening plenary to condemn the “genocidal intent” behind Moscow’s assault on civilian infrastructure and women and children in Ukraine. Calling for outright victory for Ukraine, Rep. Wilson observed that “Putin does not negotiate in good faith. He perceives negotiations as an invitation for appeasement.” Rep. Victoria Spartz spoke in personal terms about the war in Ukraine: “As someone who was born in Ukraine and spent half of my life there…I understand what a high price the Ukrainian people are paying for their freedoms. But they’re paying this price not just for them but also for each of us.” Rep. Spartz called on OSCE participating States to consider reform of international security mechanisms to create “a framework to deter these brutal atrocities that are happening in Ukraine.” Countering Russia’s Threats and Bolstering Ukraine’s Resilience Rep. Richard Hudson chaired the OSCE PA’s General Committee on Political Affairs and Security for the third straight year and used his opening remarks to highlight Russia’s “dangerous rhetoric about using nuclear weapons, on top of its complete disregard for international security mechanisms and military transparency.” In particular, he noted “Russia’s announced withdrawal from the Conventional Forces in Europe treaty…[that] underscores its reckless and bad faith approach to arms control and confidence building measures.” Later in the session, Rep. (Photo Credit: OSCE) The First Committee unanimously adopted a resolution on “The Wagner Group’s Terroristic Nature and Actions” co-sponsored by Rep. Marc Veasey, a member of the OSCE PA Ad Hoc Committee on Countering Terrorism (CCT), and led by Austrian Member of Parliament and CCT Chairman Reinhold Lopatka. Echoing the Holding Accountable Russian Mercenaries Act (HARM Act) in the U.S. Congress, the resolution calls on OSCE participating States to designate the Wagner Group as a foreign terrorist organization to facilitate criminal prosecutions of those involved in the group and enablers provisioning it with financial and material resources. While introducing the text, Rep. Veasey explained how the Wagner Group fits the definition of a terrorist group given its record of “atrocities in furtherance of political ends” committed against noncombatants. He further noted that “the fact that Wagner turned against the regime that birthed it, does not change the fact that this is a terrorist group.” Former First Committee Chairman and OSCE PA Vice President Sen. Roger Wicker (MS) weighed in during the committee’s opening debate to decry Russia’s practice of “energy blackmail,” including targeting “Ukraine’s basic infrastructure and the energy security of the rest of the continent.” Noting his position as Ranking Member of the Senate Armed Services Committee, Sen. Wicker highlighted the United States’ $130 billion of security, economic and humanitarian assistance to Ukraine since the start of the full-scale invasion and thanked other OSCE countries for contributing to the effort. “Ukraine,” he said, “is not asking us as members of the OSCE to do their fighting for them….they’re simply asking us to give them the financial means and the resources to get the job done.” U.S. delegates also contributed to the work of the General Committee on Economic Affairs, Science, Technology, and Environment, or Second Committee, by proposing amendments on Ukraine to the committee’s draft resolution. These amendments decried the environmental impact of Russia’s war and its systematic use of energy blackmail as an instrument of malign influence. Pointing toward emerging technologies that could mitigate energy dependence on Russia, Sen. Cardin also presented an amendment authored by Rep. Hudson “encouraging cooperation for the development and adoption of small modular reactors to achieve energy independence and diversification.” Advocating for Political Prisoners and Protecting Ukrainian Women and Children In the General Committee on Democracy, Human Rights, and Humanitarian Questions, known as the Third Committee, Rep. Cohen invoked his role as OSCE PA Special Representative on Political Prisoners while paying tribute to political prisoners in Belarus and Russia who face brutal punishment for speaking the truth. “These,” he said, “are the people who evoke the principles of the OSCE: they speak for transparency, they speak for freedom, they speak against autocrats.” In particular, he highlighted the ongoing detention of oppositionists Alexei Navalny and Vladimir Kara-Murza in Russia as well as Siarhei Tsikhanouski in Belarus and called on parliamentarians to use their platforms as elected officials to draw attention to these prisoners and work for their release. (Photo Credit: OSCE) Members of the Third Committee unanimously adopted a U.S. resolution on “Adopting Effective Mechanisms to Safeguard Ukrainian Women and Children from Abuse, Exploitation, and Human Trafficking,” led by OSCE PA Special Representative on Human Trafficking Issues Rep. Chris Smith and co-sponsored by Rep. Wilson. Rep. Wilson introduced the resolution, which calls on OSCE participating States to take specific steps to press for the return of Ukrainian children forcibly taken to Russia and Russian-controlled areas of Ukraine, prevent human trafficking of Ukrainian refugees, most of whom are women and children, and provide resources for trauma treatment for children. “Russia’s brutal and unjustified invasion of Ukraine has exposed the critical need for international action to both save Ukraine’s children and to put in place measures for the future that will protect children, as well as vulnerable refugees, from wartime atrocities and other threats such as human trafficking,” Rep. Wilson told the committee. Countering the Rise of Antisemitsm In a plenary session on July 3, Sen. Cardin presented his annual report as OSCE PA Special Representative on Antisemitism, Racism, and Intolerance and introduced a corresponding U.S. resolution on “Rising Antisemitism in the OSCE Region.” Sen. Cardin sounded the alarm that “antisemitism, racism, and intolerance is clearly on the rise across the OSCE region.” To counter this disturbing trend, he called on parliamentarians and OSCE participating States to “lead the fight against hate” by speaking out, preventing the normalization of hateful behaviors, adopting a national strategy such as has recently been done in the United States, strengthening Holocaust education, and deploying OSCE resources designed to address antisemitism and hate-based incidents. Earlier in the day, Sen. Cardin hosted a well-attended side event titled “Countering the Rise in Antisemitism and Other Hate-Based Incidents: Government Action and Leadership.” The panel discussion featured participation from Susan Heller Pinto, Vice President of International Policy at the Anti-Defamation League (ADL); Matteo Mecacci, Director of the OSCE Office for Democratic Institutions and Human Rights; and Rabbi Andrew Baker, Personal Representative of the OSCE Chairman-in-Office on Combating Antisemitism. THE ALARMING RISE IN ANTISEMITISM AND ITS THREAT TO DEMOCRACY
Tuesday, December 13, 2022In response to a rise in antisemitism in the United States and abroad, the Helsinki Commission held a hearing on December 13, 2022, featuring experts on preventing and combatting it. Witnesses testified about current development and how best to respond, as well as reinforced the important role of multilateral cooperation. In an increasingly global world where antisemitism can spread rapidly online, witnesses stressed that every country has a responsibility to combat anti-Semitism, as it has serious implications for democracy. Opening the hearing, Helsinki Commission Chairman Sen. Ben Cardin (MD) expressed his alarm at the shocking rise of antisemitic speech and attacks in recent years in both the United States and Europe. Popular entertainers and public figures such as rapper and producer “Ye,” formerly Kanye West, have spread antisemitic tropes to their followers on social media or through public statements. Antisemitic disinformation and conspiracy theories proliferated in connection with the COVID-19 pandemic. He said that statements by public figures and online disinformation not only serve to normalize prejudice and discrimination, but they also can incite extremism and violent attacks. President Putin has even tried to justify Russia’s brutal invasion of Ukraine through perversely antisemitic statements claiming the invasion was an effort to “de-Nazify” the country, notwithstanding its Jewish president. He highlighted the destructive role of disinformation and the importance of educational programs, calling for a unified strategy to combat antisemitism across government and society: “We must speak out loudly and clearly against antisemitism when it occurs. As leaders, we must lead and fight against hate. We cannot allow antisemitism or any type of prejudice or intolerance to be normalized,” he said. Helsinki Commission Co-Chairman Rep. Steve Cohen (TN-09) raised questions about the cause of the recent increase in antisemitism. Ranking Member Rep. Joe Wilson (SC-02) condemned the rise of antisemitism around the world, highlighted the important work the U.S. Helsinki Commission and the OSCE have done to combat it, and called on countries to take more action: “... it is clear what I stated last week, that antisemitism cannot be tolerated in any situation or under any circumstances. I’m very concerned by the rise of antisemitic incidents over the past several years, both in the United States and Europe.” Rep. Ruben Gallego (AZ-03) expressed his disgust at the alarming rise of antisemitism in the United States and Europe, raising concerns about Holocaust denial and securing places of worship: “It seems that every day and every week there’s another bomb threat at a Jewish day school, another discovery of antisemitic graffiti spraypainted on a college campus, or, at its worst, a shooting at a synagogue.” Rep. Marc Veasey (TX -33) inquired about what Congress should do in response to the rapid acceleration of antisemitism and extremism online: “We know that century-old antisemitic tropes are being increasingly mainstreamed and normalized due, in part, to social media and the amplification of problematic individuals.” Senator Richard Blumenthal (CT), discussed how to improve hate-crime legislation as well as how to come to terms with the history of antisemitism in the United States: “One of the innovations that we included in hate-crimes legislation was to give judges the option in sentencing to require that the convicted defendant, the perpetrator, perform acts of community service that put him or her in direct – in direct contact with the community who was the victim of the hate crime." Senator Rosen (NV) described how she co-led a bipartisan and bicameral letter signed by 126 members of Congress calling on President Biden to develop a unified national strategy to monitor and combat antisemitism: “I’m proud to say, just last night [Dec. 12, 2022] the White House heeded our call, announcing the formation of an interagency task force to combat anti-Semitism and Islamophobia. And its first order of business is to develop a national strategy to combat anti-Semitism." She also outlined specific actions that the United States must pursue including addressing online antisemitism, allocating increased resources to provide physical security for Jewish institutions, educating students about the Holocaust and anti-Semitism, improving hate crimes data collection and reporting, and advancing a whole-of-government approach to combat this issue. Ambassador Deborah Lipstadt, U.S. Special Envoy to Monitor and Combat Antisemitism at the U.S. State Department reiterated the importance of international coalition building and multilateral institutions in coordinating responses to antisemitism. She highlighted that antisemitism is often inextricably linked to prejudice and violence against other groups and religions: “Antisemitism is not a niche issue. It’s not just about helping or protecting Jews. As you entitled this hearing, it’s also a danger to democracy. Jews are the canary in the coal mine. If something is – if anti-Semitism is manifesting itself, other hatreds cannot be far behind." She also mentioned positive international developments, specifically in the Middle East such as Abraham Accords, and described how countries are starting to rethink their attitudes about antisemitism. Rabbi Andrew Baker, Personal Representative of the OSCE Chairman-in-Office on Combating Antisemitism as well as Director of International Jewish Affairs at the American Jewish Committee (AJC), described the steps OSCE governments should take to better tackle this issue. He emphasized the importance of accurate data collection, securing Jewish community buildings, and expanding Holocaust education in Europe. He also described that preventing the spread of antisemitism online is perhaps the most difficult part of the problem to solve: “We are outnumbered and out-funded by the social media giants. Content monitors are no match for algorithms designed to push grievance as the basic business model.” Members brought several concerns and questions to witnesses about the source of the recent rise of antisemitism, the importance of Holocaust education, how best to allocate resources to secure religious and community spaces, the value of differentiatng among different types of hate crime, and how to halt the rapid spread of antisemitism online. OSCE’s 2022 Ministerial Council in Lodz: Russia Isolated as States Demand Accountability and Reaffirm Commitments
Friday, December 09, 2022By Janice Helwig, Senior Policy Advisor, Demitra Pappas, Senior Advisor Department of State, Shannon Simrell, Representative of the Helsinki Commission to the U.S. Mission to OSCE Foreign Ministers and senior officials from the 57 participating States and 11 Asian and Mediterranean partners of the Organization for Security and Cooperation in Europe (OSCE) convened the OSCE Ministerial Council in Lodz, Poland on December 1-2. While the OSCE Ministerial is held annually, this year’s meeting was atypical, due to its taking place amid the greatest crisis in European security since World War II, namely Russia’s full-scale invasion of Ukraine. States Accuse Russia and Belarus of Violating Principles, Stand with Ukraine Polish-Chairman-in-Office, Foreign Minister Zbigniew Rau in his opening remarks pointedly blamed Russia for destroying the security order and attempting to undermine the Organization. Russia’s full-scale invasion of Ukraine in February, abetted by Belarus, violated each of the politico-military, democratic, human rights, and economic and environmental commitments enshrined in the 1975 Helsinki Final Act, an agreement that underpinned European security for nearly 50 years. Most fundamentally, the Lodz Ministerial underscored participating States’ desire to return to the founding principles of the OSCE - the Helsinki Final Act – and to call out Russia’s violation of each. Participating State after participating State took the floor to reaffirm their OSCE commitments and to call Russia to account. Russia was entirely isolated, with only Belarus attempting, pathetically, to deflect blame on others for “corroding” the spirit of Helsinki. At each instance, participating States overwhelmingly reaffirmed their support for OSCE principles and denounced Russia’s war of aggression on Ukraine, declared solidarity with Ukraine, and demanded accountability for war crimes, the crime of aggression, and violations of international humanitarian law. Participating States also voiced strong support for the work of the OSCE’s autonomous institutions, including the Office for Democratic Institutions and Human Rights and the Representative of the Freedom of the Media in particular, whose mandates and funding are often in Russia’s crosshairs. Many participating States also noted the importance of the three “Moscow Mechanism” reports issued this past year to document Russia’s violations of international humanitarian law in Ukraine and its repression of human rights at home. A joint statement delivered by Finland on behalf of 42 other participating States condemned Russia’s atrocities in Ukraine and called for perpetrators to be held accountable. OSCE Parliamentary Assembly President Margareta Cederfelt advocated establishing a high-level body to assess reparations from Russia. Two other aspects of the Ministerial were unique. Absent were the annual negotiations among participating States on decisions designed to enhance existing commitments on cooperative security, which the Polish Chair assessed as unfeasible due to Russian intransigence. Also absent was Russian Foreign Minister Lavrov, against whom Poland took a principled stand to exclude from attending. OSCE Continued Work in 2022, Despite Russia’s Objections States also used their interventions to welcome OSCE’s development of new approaches in 2022 with regard to sustaining its human rights work and presence in Ukraine to overcome Russia’s attempts to undermine the Organization. In the years leading up to the Ministerial, Russia had increased its abuse of OSCE’s consensus-decision making to block the Organization’s budget, to close OSCE’s three field missions in Ukraine, and to prevent the convening of OSCE’s signature, annual human rights conference, the Human Dimension Implementation Meeting (HDIM). Yet despite its concerted efforts, Russia failed to block OSCE’s human rights work or eradicate its work in Ukraine. “On the contrary,” as U.S. delegation head, Undersecretary of State Victoria Nuland observed in Lodz, the OSCE “has said no to Moscow’s efforts to divide it, to paralyze it, to destroy it.” Nuland added, the Organization has emerged “even stronger, more flexible, more resilient” under Poland’s stewardship and that of Secretary General Helga Maria Schmid. After Russia blocked the HDIM, the Polish Chairmanship convened the Warsaw Human Dimension Conference (WHDC) in September, conducting a full review of human rights commitments with the participation of more than one thousand governmental and civil society representatives in attendance. In November, the Secretariat stood up a donor-funded “Support Programme Ukraine” which reestablished an OSCE presence in the country. These are examples of how the OSCE has continued to promote Helsinki principles and deliver programming in spite of Russia’s attempts to undermine it. Side Events, Civil Society Parallel Conference Seek to Close Russia’s “Accountability Gap” A range of side events amplified concerns of participating States and civil society regarding the terrible human toll of Russia’s war and the need for accountability. The first side event explored the increased risk of human trafficking among Ukrainian citizens fleeing the conflict and the illegal abduction and forced adoption of Ukrainian children in Russia. The establishment of a Group of Friends on Children in Armed Conflict was also announced. A side event moderated by Ukrainian Foreign Minister Dmytro Kuleba outlined various means to hold Russia accountable for atrocities committed in Ukraine, including providing support to the Ukrainian Prosecutor General’s Office and to the International Criminal Court through the collection evidence of crimes and aiding in investigations. Minister Kuleba strongly advocated for the establishment of a Special Tribunal to prosecute Russia’s crime of aggression and received broad support. An event featuring Belarusian opposition leader, Sviatlana Tsikhanouskaya and other activists drew renewed attention to the plight of thousands of political prisoners in Belarus and called for the invocation of another Moscow Mechanism report to document ongoing human rights violations by the government of Belarus. Civic Solidarity Platform (CSP), a regional association of human rights civil society organizations, hosted its annual Parallel Civil Society Conference on November 30 which likewise called on participating States to ensure accountability for perpetrators of war crimes and other atrocities in Ukraine. In response to CSP’s long-standing call for closer collaboration between the OSCE and civil society, North Macedonia, which assumes the Chairmanship of OSCE in 2023, committed to appoint a Special Representative on Civil Society Organizations. Looking Ahead to 2023: North Macedonia Despite Russia’s isolation, its war against Ukraine continues even as Poland plans to pass the leadership of the Organization to North Macedonia as of January 1, 2023. As the incoming Chairman-in-Office, Foreign Minister Bujar Osmani pledged that North Macedonia’s tenure “will be guided by strict observance of OSCE principles and commitments.” He further stressed the cooperative nature of regional security, noting, “Safeguarding OSCE values and respect for international law must be a shared priority. This is of utmost importance. Rebuilding trust and engaging in meaningful dialogue presupposes full compliance with the agreed OSCE commitments and principles. We all have to be accountable for our actions. This is the formula for the way forward.”

The Case for Getting Tough on Hungary
Monday, November 28, 2022Sixty-six years ago, ordinary Hungarians bravely stood up to Moscow’s empire of oppression. Yet, on its anniversary, Hungarian Prime Minister Viktor Orbán took aim at Europe, a curious choice given Russia’s imperialist war against Ukraine right at Hungary’s doorstep. “Let’s not bother with those who shoot at Hungary from the shadows or from the heights of Brussels. They will end up where their predecessors did,” Orbán told crowds in Western Hungary last Sunday. Since Russia’s full-scale invasion of Ukraine on Feb. 24, European solidarity and the transatlantic alliance have been put to the ultimate test. Amid the horrors of Russia’s genocidal war, many nations have risen to the occasion. But Hungary’s Orbán has shown his stripes: He has openly aligned himself with Vladimir Putin, and his government has demonstrated itself as an unreliable partner to the West, even as it happily avails itself of the West’s military protection and economic might. In March, Ukrainian President Volodymyr Zelensky made a direct appeal to Orbán in front of European Union leaders, saying, “You hesitate whether to impose sanctions or not? You hesitate whether to let weapons through or not? And you hesitate whether to trade with Russia or not? It’s time to decide already.” Since then, Orbán has given Zelensky his answer: On every count, Hungary stands with Russia. A member of NATO since 1999, and the EU since 2004, Hungary has bitterly opposed stronger Western sanctions against Russia, strengthened energy ties with Russia, banned lethal aid from passing through its territory to Ukraine, and is dragging its feet on NATO expansion to Finland and Sweden — the only NATO ally aside from Turkey to do so. Even more glaringly, Orbán has publicly blamed the West for provoking Russia’s actions in Ukraine, an utterly indefensible position given the genocidal war Russia has waged without provocation. In a July 23 speech, Orbán told a Hungarian-minority audience in Romania that his Russian counterpart’s justification for the war in Ukraine “does make sense, and it is worth taking seriously.” In the same speech, he made abject claims that Ukraine cannot win the war; that NATO expansion is to blame for Russian aggression; that the United States is using energy as a foreign policy weapon; and that Russia will continue to push the front line as long as NATO countries supply heavy weapons to Ukraine. Hungary’s defense of Russia’s brutal repression abroad is a natural extension of its growing authoritarianism at home. Orbán has transformed Hungary into an illiberal autocracy. Fidesz, the country’s ruling party, has systematically eroded democratic freedoms in Hungary since it came to power in 2010. Orbán has manipulated election laws to benefit Fidesz, packed the Constitutional Court with cronies, and consolidated media control to amplify his party’s propaganda. Civil society is unable to function freely due to restrictive laws, and many individuals and groups are subject to smear campaigns. It’s time to get tough on Hungary. Hungary has caused a fracture in NATO’s united front against Russia, which is a grave security and credibility risk for the organization. Hungary acts as Russia’s best advocate in Europe with impunity, which not only undermines transatlantic unity, but signals NATO weakness. As a result, members of the alliance should consider downgrading relations with Hungary, especially since NATO is founded on the principles of “democracy, individual liberty and the rule of law,” principles that Orbán has been intentionally eroding. Bilaterally, the United States cannot sit back silently while a NATO ally aligns itself with Putin’s Russia under thinly-veiled claims of “neutrality,” and simultaneously dismantles democracy domestically. It is important that the United States speaks with a united voice — Democrats and Republicans alike — to condemn Hungary’s allegiance to Russia. We should ramp up support for independent journalism and civil society in Hungary, as well as consider other tools to limit our economic investment and military partnership with Hungary if the government’s belligerence continues. Decolonizing the Russian Empire

But the Kremlin’s violent designs in Ukraine, and other military adventures in the Caucasus and Eastern Europe, are part of a larger and longer legacy of Russian imperialism that directly threaten its neighbors and imprison a multitude of nations within its authoritarian empire. This side event explores the destructive effects of Russian imperialism and how the unfolding genocide in Ukraine is a natural outgrowth of these colonial policies. Drawing on regional perspectives of those victimized by Russia’s brutal empire, the panel will highlight the realities of Russian colonialism and what a process of decolonization—elevating marginalized voices and providing for their full political and civic self-expression—would mean for Russia and for its neighbors.

Helsinki Commission Deeply Concerned Over Latest Electoral Reform Initiative in Bosnia and Herzegovina
Wednesday, July 27, 2022WASHINGTON—Helsinki Commission Chairman Sen. Ben Cardin (MD) and Co-Chairman Rep. Steve Cohen (TN-09) today expressed deep concern about an effort by the international community’s High Representative in Bosnia to impose changes on the country’s electoral system barely two months prior to general elections in early October. They issued the following joint statement: “We share the concerns of members of civil society, academia, and the political community in Bosnia and Herzegovina about the current proposal of the international community’s High Representative to make changes to Bosnia’s electoral system shortly before the upcoming general elections. These changes effectively only benefit the leading ethnically-based political party among Bosnia’s Croats and further entrench the divisive force of ethnicity in Bosnian politics as a whole. They fail to tackle the broader issues of citizen-based democracy that so obviously need to be addressed for the country to overcome destabilizing impasse and move forward. The timing of their introduction also is problematic. “The Helsinki Commission has long supported electoral reforms in Bosnia and Herzegovina that remove ethnicity from governance. Such reforms should be designed to give citizens a wider range of truly democratic choices, an ability to hold their elected official accountable, a deserved sense of stability, and needed hope for European integration. We also have supported a more assertive role for the international community and its representatives in the country, including the Office of the High Representative, in responding to the lack of democracy and stability in Bosnia and Herzegovina. However, we believe that this specific action, if imposed now, will not represent the true progress Bosnia needs and may effectively make things worse.”

Wicker and Romanian Foreign Minister Bogdan Aurescu co-chaired the first-ever congressionally-organized Black Sea Security Summit to underscore the critical importance of the Black Sea region to European peace and security, and to establish a sustainable, collective approach to ending Russian aggression and enhancing mutual cooperation. “Given Russia’s monstrous war on Ukraine and its wider aggression in the region, it is not an exaggeration to say that the Black Sea is currently the epicenter of Euro-Atlantic security and global peace,” said Sen. Deputy Secretary General of NATO, General Mircea Geoanӑ, emphasized the importance of the Black Sea to Euro-Atlantic security, stating that the region reflects “broader competition between revisionist and brutal and aggressive Russia and our democratic world.” According to General Geoanӑ, NATO is committed to supporting Ukraine through military, financial, and humanitarian means and providing security in the Black Sea littoral that reestablishes freedom of movement, shipping, and navigation. Bulgarian Deputy Minister of Defense, Yordan Bozhilov noted that the Russian invasion of Ukraine “has far-reaching destabilization implications at the regional level and beyond,” including the resulting energy and food crises. Georgian First Deputy Minister of Foreign Affairs, Lasha Darsalia, emphasized the political, economic, and security importance of the Black Sea region to Georgia and highlighted increased security in the region as an opportunity to increase “international cooperation and connectivity.” He recalled Georgia’s support for Ukraine in the face of Russian aggression, characterizing the invasion of Ukraine as another step in Russia’s malign attempt to control the Black Sea region. U.S. Representative August Pfluger stressed the importance of the Black Sea region to energy security in the pursuit of decreasing dependence on Russian energy. Confronting Russian Aggression Throughout the summit, participants called for increased unity to confront Russian aggression. Ukrainian Member of Parliament, Alexander Goncharenko, requested a stronger NATO and US presence in Ukraine, after powerfully highlighting Ukrainian bravery in the face of Russian hostility. In reference to Russia’s weaponization of Ukrainian grain supply and the expansion of NATO, Gonchareko stated, “It is very good that the free world is finally uniting, but we must show strength. The first place we must show strength is in the Black Sea, as a humanitarian mission, to save millions of people. Thousands are killed in Ukraine, but millions will die from starvation.” Turkish Ambassador to Romania Füsun Aramaz underscored her country’s support of Ukrainian sovereignty. She acknowledged the common security goals of all participants at the summit and desires close alignment with NATO, but warned against over-militarization of the region, citing a potential to violate the Montreux Convention. “More vessels at sea or more fighter aircraft in the air alone do not mean more deterrence or stronger defense,” she stated. U.S. Major General Jessica Meyeraan of the United States European Command explained that the United States is supporting Ukraine by increasing understanding of Ukrainian security assistance requirements and “collaborating across over 40 nations to understand how we can quickly and effectively satisfy those security cooperation requirements.” Minister Aurescu explained that the projects that maintain regional security structures are the result of bilateral relationships between the United States and various littoral states and are essential in the face of Russian aggression and illiberalism that has resulted in regional and global crises. He also called to “increase the scale and visibility of the U.S. presence in the region,” beyond just a military presence through the creation of a multifaceted strategy based on strategic resilience. Rep. Hudson noted that “NATO stands ready” in the face of increasing threats in the region. In addition, Rep. Gallego emphasized the importance of deterrence by denial, clarifying that this sort of offensive is only possible through a completely integrated defensive approach.

The Helsinki Process: An Overview
Friday, June 24, 2022In August 1975, the heads of state or government of 35 countries – the Soviet Union and all of Europe except Albania, plus the United States and Canada – held a historic summit in Helsinki, Finland, where they signed the Final Act of the Conference on Security and Cooperation in Europe. This document is known as the Helsinki Final Act or the Helsinki Accords. The Conference, known as the CSCE, continued with follow-up meetings and is today institutionalized as the Organization for Security and Cooperation in Europe, or OSCE, based in Vienna, Austria. European Energy Security Post-Russia
Tuesday, June 07, 2022Russia is weaponizing energy to prolong its unlawful invasion of Ukraine. Unfortunately, the sanctions that Europe and the United States have put in place have not been enough to curb Russian aggression thus far and the European Union pays Russia almost a billion euros a day for energy resources—mostly gas— that fund the Russian war machine. Germany, in particular, has struggled to move away from its dependence on Russian gas. At the start of the Russian invasion of Ukraine, Germany imported 55 percent of its gas from Russia. As of June 2022, Russian gas imports had decreased to 35 percent, with a goal to decrease to 10 percent by 2024, but progress is slow and buying any energy from Russia means that Germany continues to fund their unlawful invasion. Dr. Benjamin Schmitt, Research Associate at Harvard University and Senior Fellow at the Center for European Policy Analysis, pointed to the resurgence of Ostpolitik, a German diplomatic theory which seeks to build relationships and spread good governance through trade. First introduced in the Cold War era, Ostpolitik was put into action once more in the early 2000s by former Chancellor Gerhard Schroeder, who became infamous for lobbying for Kremlin-backed projects in office and for sitting on the board of the Russian state-owned energy company, Gazprom, after leaving office. However, Russia attempted to leverage such projects, including the Nord Stream 1 project and its ultimately bankrupted predecessor, Nord Stream 2, to increase the vulnerability of Western Europe toward Russia. According to Dr. Constanze Stelzenmüller, Senior Fellow at Brookings Institution, domestic political will exists in Germany to diversify energy sources, even if most are wary of making those changes immediately. German polling shows that one-third of Germans are willing to cut off Russian gas immediately, while two-thirds would prefer a slow gradual decrease in gas. Dr. Stelzenmüller explained that if Germany were to immediately cut off Russian gas supplies, it is likely that a recession would affect not only Germany, but also many surrounding Eastern European countries, most of which have less capacity to manage a recession. She stated, “Much of [Germany’s] manufacturing supply chains go deep into Eastern Europe. So, a recession in Germany would absolutely produce a massive, and perhaps worse, recession in our neighboring economies.” Any actions taken against Russia should ensure that sanctions hit Russia harder than those countries imposing the sanctions. Mr. Yuriy Vitrenko, CEO of Naftogaz Ukraine, and Dr. Schmitt also emphasized the importance of the following recommendations outlined in the REPowerEU plan, the European Commission’s plan to make Europe independent from Russian energy before 2030, and the International Working Group on Russia Sanctions Energy Roadmap: Full European/US embargos on Russian gas. Creation of a special escrow account that will hold net proceeds due to Russia until the Kremlin ceases all hostilities. Diversification of energy dependance away from Russia through energy diplomacy that identifies other potential suppliers, like Qatar. Funding and construction of energy infrastructure around Europe. Termination of Gazprom ownership of all critical energy infrastructure in Europe. Designation of Russia as a state sponsor of terrorism, which would automatically trigger secondary sanctions on any country that imports Russian goods. Sanctioning of all Russian banks. Strengthening of Ukrainian capacity to participate in the energy sector through the creation of modern energy infrastructure during the post-war reconstruction period. Pass the Stop Helping America’s Malign Enemies (SHAME) Act, banning former U.S. government officials from seeking employment by Russian state-owned-enterprises, or Schroederization. Co-Chairman Cohen Condemns Lavrov’s Antisemitic Comments
Tuesday, May 03, 2022WASHINGTON—In response to Russian Foreign Minister Sergei Lavrov's recent antisemitic comments regarding Ukraine’s president and the people of Ukraine more generally, Helsinki Commission Co-Chairman Rep. Steve Cohen (TN-09) issued the following statement: “In a despicable attempt to justify Russia’s war crimes in Ukraine, including well-documented indiscriminate murders of civilians, including children; torture; and rape of women, children and also men, Lavrov stooped to the basest antisemitism by claiming that Hitler had Jewish heritage and President Zelensky, although Jewish, can still be a Nazi and Ukraine a Nazi state. “By outrageously restating the false and offensive tropes of Holocaust denial and claiming that Jews are the worst antisemites—all while Russian forces commit genocide against the Ukrainian people at the behest of Vladimir Putin—Lavrov and the state he represents show that they are clearly disconnected from reality, morality, humanity, and sensitivity, and that they have no problem embracing the very ideology they claim to rebuke so long as it serves their propaganda. “Comparing President Zelensky to Hitler should be shocking. Unfortunately, this level of depravity is consistent with the reprehensible, repugnant, and reptilian conduct of Putin’s government. Such comments are no longer surprising as we witness Putin’s bloody attempt to destroy the people of Ukraine.” Co-Chairman Cohen, in his capacity as Head of the U.S. Delegation to the OSCE Parliamentary Assembly (PA), along with other Helsinki Commission leaders, recently urged the OSCE PA to adopt a declaration by the parliament of Ukraine that recognizes Russia’s actions in Ukraine as genocide.

Following in the Footsteps of Tsar Nicholas II
Wednesday, April 27, 2022As Vladimir Putin attempts to turn back the clock to the Russian Empire of the pre-Soviet era, he also adopts a tool of political manipulation used in Imperial Russia—fostering violent extremist organizations as a means to a political end. Tsar Nicholas II used this technique with terrorist organizations like the Union of the Russian People and the Black Hundreds, and Putin follows his example today with the Russian Imperial Movement and Imperial Legion. The Russian Imperial Movement Putin advances his political agenda by allowing the Russian Imperial Movement (RIM)—a white supremacist extremist organization based in St. Petersburg—to freely exist and operate in Russia and beyond. RIM holds ultranationalist and monarchist views and believes in two pillars of authority: the political power of the tsar and the spiritual power of the Russian Orthodox Church. The U.S. State Department labeled RIM a Specially Designated Global Terrorist entity in April of 2020, making them the first white supremacist extremist organization to receive the title. RIM received the designation due, in part, to their paramilitary training course, Partizan. The course—ostensibly teaching survival skills, marksmanship, and hand-to-hand combat—functions as RIM’s citizen-to-terrorist pipeline. Attendees have gone on to join RIM’s paramilitary unit, the Imperial Legion, and fight alongside pro-Russian separatists in Ukraine. And Russians are not the only ones enrolling. In 2016, two members of Sweden’s largest neo-Nazi organization, the Nordic Resistance Movement, bombed a café and a migrant center and attempted to bomb a refugee center in Gothenburg, Sweden. The subsequent investigation discovered that the bombers were trained at Partizan. RIM has attempted to broaden its network beyond Europe. American neo-Nazi Matthew Heimbach, former head of the Traditionalist Workers Party, met with RIM representatives, and RIM offered paramilitary training to organizers of the 2017 “Unite the Right” rally in Charlottesville, Virginia. There are also reports that members of the Imperial Legion fought in conflict areas in Syria and Libya. The Russian Imperial Movement is vocally anti-Putin, decrying him and his regime. Despite this criticism and RIM’s monarchist beliefs, Putin has been lenient toward the group and allows it to operate as long as its attention remains turned away from domestic politics. Though reinstatement of a tsar remains a foundational pillar of RIM’s doctrine, it is not their main selling point. Dr. Anna Kruglova, a lecturer in Terrorism Studies at the University of Salford, finds RIM’s large web following surprising “since the group has a relatively narrow agenda—monarchist ideas are not particularly popular in Russia as only 8 percent of Russian people would want monarchy restored, according to one poll.” RIM’s appeal for potential members and Putin himself lies in its vicious ethno-nationalism. RIM demands that Russia maintain influence over all territories where ethnic Russians reside, particularly in Ukraine. For instance, Partizan-trained Russians fought alongside pro-Russian separatists in Ukraine in 2014 as members of the Imperial Legion. In the words of Denis Gariev, an instructor at Partizan, “We see Ukrainian-ness as rabies. A person is sick. Either quarantine, liquidation, or he’ll infect everyone.” Putin also values RIM as a tool to sow discord in the West. RIM supports and collaborates with other white supremacist extremist organizations, even in the United States, and trains individuals like the Swedish NRM bombers. RIM is convenient for Putin: it poses no real threat as a monarchist organization yet benefits his attempts to colonize Ukraine and destabilize the West. The Union of the Russian People The Union of the Russian People (Soyuz russkovo naroda, or SRN) was a right-wing, fanatically anti-Semitic political movement active in the 1900s. They came to prominence in the wake of the Russo-Japanese war. After the Russian Empire’s devastating defeat, there was such discontent and domestic unrest that strikes and mutinies flooded the empire, forcing Tsar Nicholas II to enact constitutional reforms. This moment, known as the 1905 Revolution, left the Russian Empire shaken and greatly polarized. Fears that the imperial system would collapse led to a rise in reactionary extreme right-wing ideologies and groups, one of which was SRN. Members of SRN and its paramilitary branch, the Black Hundred, were fervent monarchists and bore the colors of the Romanov family—the reigning imperial dynasty in Russia from 1613 to 1917—as their insignia. They also had deep ideological connections with the Russian Orthodox Church and identified Jews as the source of all evil in Russia. From 1905 to 1906, the Black Hundred carried out relentless pogroms, killing hundreds of Jews across the Russian Empire. The ruling class at the time held mixed opinions on SRN, ranging from hesitance to fanaticism. Lower-ranking officials viewed the Black Hundred’s pogroms as a convenient way to keep Jewish and ethnic minority populations in their place. The tsar called them a “shining example of justice and order to all men.” SRN was a convenient political tool for the tsar. Tsar Nicholas II believed anti-Semitism united people behind the government, and that Jewish capitalism and Jewish socialism were revolutionary forces that threatened his regime. In this way, SRN and the Black Hundred, while too radical for many members of the Duma and the public, served the tsar’s political interests. Utilizing extremism as a political weapon is not a new tool in Russia’s repertoire. As Putin harkens back to a grand Imperial history and conducts brutal military invasions into former Soviet states, like Ukraine, and political invasions of others, like Belarus, he demands comparison to the power-grasping techniques of the past. As Tsar Nicholas II’s grip on power loosened with civil unrest in the Russian Empire, he supported extremism to preserve his regime. Putin repeats this pattern today as he lets the Russian Imperial Movement and the Imperial Legion train neo-Nazis to wreak havoc and terror in the West.

Debunking “Denazification”
Thursday, April 21, 2022By Worth Talley, Max Kampelman Fellow On February 24, 2022, Russian dictator Vladimir Putin announced a “special military operation” to “demilitarize and denazify” Ukraine—in reality, a Russian invasion designed to subjugate the democratic, peaceful people of Ukraine. When the news broke, Helsinki Commission Co-Chairman Rep. Steve Cohen immediately decried the statement. “Like Mr. Zelensky, I am Jewish; Nazis kill Jews,” he said. Putin’s claim of “denazification,” not only patently false, borders on incoherent to a Western audience, which immediately links Nazism with antisemitism and the Holocaust and thus understands the “denazification” of a country led by a Jewish president to be impossible. The real nature of Putin’s claim is clear: it is a fallacious attempt to drum up domestic support for his war of aggression in Ukraine designed to resonate with a Russian audience. Putin draws on the Soviet myth of the Great Patriotic War in an attempt to validate his invasion and to obscure the true nature of his war—an attack on Ukrainian identity—under the guise of a mission against Nazism. Within this historical footing, Russians can accept the “denazification” of Ukraine precisely because the myth, like other holdovers from Soviet policy, deemphasizes antisemitism’s connection to Nazism and reimagines Nazism primarily as an attack on Soviet and Russian identities, not Jewish ethnicity. The Great Patriotic War World War II occupies a central place in Russian historical memory. The Russian conception of the Great Patriotic War has existed in multiple formulations since the defeat of Nazi Germany, but it consistently centers the role of the Soviet people in defeating Nazism, placing equal emphasis on Soviet victory and on the suffering and sacrifices of the Soviet people. In fact, the Great Patriotic War begins in 1941—rather than 1939—with Nazi Germany’s invasion of the USSR under Operation Barbarossa. The fact that the Great Patriotic War is the term commonly used for World War II by Russians obscures the nature of Russian involvement in the war prior to 1941. This state-sponsored narrative eschews a nuanced understanding of Soviet participation in the Second World War, particularly of the Molotov-Ribbentrop Pact and of the Soviet atrocities committed in Poland and the Baltics during that period of non-aggression between the 1939 pact and the 1941 Nazi invasion of the Soviet Union. The Law Against the Rehabilitation of Nazism, signed into law by Putin in 2014, effectively criminalizes speech regarding these Soviet actions. As the Great Patriotic War emphasizes Soviet anguish, it glosses over the suffering of Jews and other minorities and even the Holocaust itself. Soviet policy historically downplayed the centrality of the Holocaust by centering a collective, Soviet suffering over a particular, Jewish one. Furthermore, denouncing the antisemitic core of Nazism would have directly contradicted the Soviet Union’s own state-sponsored antisemitism. The Holocaust, particularly the millions of deaths that occurred in Soviet territory, was written off in Soviet historical narratives as a crime against the (ethnically ambiguous) Soviet citizenry. For example, the Soviet memorial at Babyn Yar—a site in Kyiv, formerly in the Soviet Union, where 33,000 Jews were murdered by Nazi troops and Ukrainian collaborators over the course of two days—featured an inscription to the “peaceful Soviet citizens” that died there, insinuating that the site formed part of a collective, Soviet suffering rather than acknowledging it as a site of antisemitic genocide. The myth of the Great Patriotic War thus classifies the actions of Ukrainians who collaborated with the Nazis—such as Stepan Bandera and the Organization of Ukrainian Nationalists—primarily as a crime against the Soviet people, with the antisemitic actions and beliefs of these Ukrainians nationalists occupying a secondary—or altogether irrelevant—level of importance. Nonetheless, the collaboration of some Ukrainian nationalists with Nazis during World War II has allowed the Kremlin, through a peculiar melding of myth and reality, to conflate Nazism with the very development of Ukrainian national identity (though, of course, Ukrainian national identity is not synonymous with Nazism, nor did it only begin to develop during the Second World War). Language Laws and Russian Rhetoric As Ukraine has distanced itself from Russian political influence, establishing a distinct national identity has become of a question of greater importance—particularly considering the stifled development of such an identity under the Soviet Union. Putin’s current, baseless, claims of genocide against Russian speakers in Donetsk and Luhansk occur against the backdrop of Ukrainian language laws, which make Ukrainian the country’s sole official language and set forth requirements for the use of Ukrainian in education and media. The most recent of these laws, passed in 2019, was met with harsh criticism from Maria Zakharova, a spokeswoman of the Russian Ministry of Foreign Affairs, who termed it “a law of forced Ukrainization,” and with skepticism from Volodymyr Zelensky, then the president-elect of Ukraine and himself a native Russian speaker. In an earlier reaction to such legislation, Zakharova claimed that “Ukraine uses language genocide on a state level,” echoing the rhetoric of genocide now used by the Kremlin to justify its invasion. Zakharova’s statements recall Soviet policy against Ukrainian national identity. Her use of the term “Ukrainization” echoes the use of the same term under Stalin in a 1932 decree to combat the growth of Ukrainian language and culture (i.e. “Ukrainization”). This decree was issued during the beginning of Holodomor—the genocide against Ukrainians, which began as an unintentional famine yet was retooled by Stalin to deliberately kill millions of Ukrainians. In this sense, contemporary Kremlin claims of “Ukrainization” and “language genocide” toward Russian speakers in Ukraine recall Stalin’s policies of both cultural and literal genocide directed at Ukrainians and Ukrainian national identity. Now, through the distorted lens of the Great Patriotic War and other Soviet policy, the Kremlin misrepresents the development of Ukrainian national identity as a crime against Russian speakers. Analysis of this historical manipulation, however, lays bare the reality of the war as an act of flagrant aggression committed against Ukrainians intended to destroy their culture and identity.

Thank you for that kind introduction, and for inviting me here tonight. It is a true honor to sit on this panel with three proven leaders in the global fight against anti-Semitism.
The ADL is a one of the premier human and civil rights organizations in the world. I do not need to tell you what you have in Abe Foxman. He is a dear friend of mine and to countless others worldwide. When he speaks, I listen.
I also want to welcome the more than 20 activists from South Florida with us tonight. Make sure to thank them for bringing the warm weather.
I have been asked to keep my remarks brief. So please forgive me if I am a bit cryptic, and do not hesitate to ask me questions later.
Elected officials have a unique platform from which to address anti-Semitism and other forms of intolerance. In fact, we have a moral obligation to do so.
As Chairman of the Helsinki Commission and the immediate past President of the Organization for Security and Cooperation in Europe’s Parliamentary Assembly, I been working to improve trans-Atlantic relations to combat anti-Semitism and other forms of intolerance for years. Both organizations have provided an invaluable political impetus for this issue to receive the attention which it deserves by all 56 OSCE countries.
The reality is that we are seeing a resurgence not only of anti-Semitism, but all forms of intolerance, throughout the entire world. The need for us to combat these evils is growing every day.
In Romania, for example, the courts are attempting to rehabilitate the reputation of General Ion Antonescu, an individual responsible for the killing of between 280,000 and 380,000 Jews during the Holocaust.
In Hungary, the U.S Holocaust Museum is being denied access to Holocaust archives.
And, in Bad Arolson, Germany, one of the largest Holocaust-era archives in the world remains closed to the public because four countries – Italy, Greece, France, and Belgium – have not yet ratified certain amendments to the Bonn Accords.
Realize, had it not been for the actions of the Helsinki Commission and others, including the ADL, the situation in Bad Arolson would be worse today than it already is.
The Commission first acted on the issue last year with a public briefing. And just last week, the House of Representatives unanimously approved a resolution I authored calling on European countries to expedite the opening of these archives.
Indeed, we will not be successful in this and other endeavors unless we work together.
Almost every day, I meet with various senior officials, ambassadors, parliamentarians and other dignitaries. Hardly a meeting passes without me engaging my colleagues on common concerns of justice and fairness.
Essential aspects of such dialogue are an acknowledgement that we don’t have all the answers, and when it comes to anti-Semitism, no country is immune.
It is, therefore, critical that we partner with those who share our awareness, concern, and passion to confront and combat these evils.
But let me not sugar coat the issue. Time and time again, I am met with resistance from certain quarters of the international community to these efforts. Some want to talk about the problem and its manifestation, while others refuse that a problem even exists.
Institutions built to combat anti-Semitism and protect human rights are key to refuting the deniers. As such, countries would be wise to create their own Helsinki Commissions to serve as a mechanism under which these issues can be addressed.
Further, I can not stress enough the importance of face-to-face dialogue.
In early June, I will travel first to Warsaw to keynote a conference on the U.S.-Polish-Israeli relationship, then to Israel with the current President of the OSCE PA. My journey will end in Bucharest, Romania at the next OSCE conference on anti-Semitism and other forms of intolerance and discrimination – a conference which I and other legislators helped create almost five years ago.
High-level government officials will be there with NGO’s, including the ADL, and it is my sincere hope that Secretary Rice will be among them. Her presence would send a very powerful message.
Friends, we can no longer live in a world which encourages and fosters the manifestation of racism, xenophobia, anti-Semitism, and all other forms of bigotry.
Our shared dream for justice and fair treatment of all citizens alike is attainable with continued commitment to working together and a willingness to confront anything that comes our way.
