Hearing Addresses Genocide, War Crimes Driving Refugee Crisis in OSCE

Witnesses Unanimously Champion Smith Legislation Providing Relief to Victims, Accountability for Perpetrators

WASHINGTON—At a hearing convened today by Helsinki Commission Chairman Rep. Chris Smith (NJ-04), witnesses unanimously expressed support for Chairman Smith’s recently introduced Iraq and Syria Genocide Relief and Accountability Act of 2016 (H.R. 5961), bipartisan legislation that provides relief to victims of genocide, crimes against humanity, and war crimes in Iraq and Syria, and accountability for perpetrators.  

“The atrocities in Iraq and Syria have been so horrible, for so long, with so little action from the Administration, that it has been difficult to hope. Nevertheless, when [Secretary Kerry] declared genocide, we dared to hope that finally the Administration would hear the voices of the victims and act. Instead, the Administration has said the right words and done the wrong things,” said Chairman Smith.

“Displaced genocide survivors cannot pay for food, medicine, or shelter with words from Washington,” Chairman Smith continued.  “When the Executive Branch fails to acts, then Congress must require it to act. That is why I recently authored and introduced the bipartisan Iraq and Syria Genocide Relief and Accountability Act of 2016, with Representative Anna Eshoo as my lead cosponsor.”

Witnesses discussed ways to support religious and ethnic communities that have survived such atrocities. In addition, they encouraged the U.S. to fund the criminal investigation, prosecution, and conviction of the perpetrators, and identified gaps in U.S. criminal statutes that make it difficult to prosecute Americans or foreigners in the U.S. who have committed such crimes.

Former U.S. Ambassador-at-Large for War Crimes Issues David Scheffer said, “H.R. 5961 demonstrates an undeniable logic: the survivors of genocide, crimes against humanity, and war crimes in Iraq and Syria merit the fullest possible assistance of our government, including consideration of admission of victim refugees to the United States.”

“The perpetrators of atrocity crimes not only in Iraq and Syria but elsewhere in the world should be subject to investigation and prosecution,” Scheffer continued. “Federal jurisdiction over crimes against humanity and war crimes remains non-existent or very limited…it is a raw fact that the United States is currently a sanctuary for alien perpetrators of crimes against humanity or war crimes.”

“The Iraq and Syria Genocide Relief Act [is] a much needed, not to mention overdue, piece of legislation,” said Chris Engels, deputy director of the Commission for International Justice and Accountability. “Criminal investigations done contemporaneously with the criminal acts are essential to ensuring later accountability. Otherwise, as we have seen in the past, evidence is lost and those responsible for these mass human rights violations go unpunished.”

Witnesses also highlighted the humanitarian vulnerabilities and lack of assistance that force the survivors to flee their homes and recommended ways to support entities effectively serving genocide survivors in-country, including faith-based organizations.

Steve Rasche, legal counsel and director of resettlement programs for the Chaldean Catholic Archdiocese of Erbil, noted, “Since August 2014, other than initial supplies of tents and tarps, the Christian community in Iraq has received nothing in aid from any U.S. aid agencies or the UN. When we have approached any of these entities regarding the provision of aid assistance …we have been told that we have done too well in our private efforts…every morning we wake up and rob six Peters to pay 12 Pauls.”

“The current policy prioritizes individual needs but does not consider the needs of vulnerable communities,” said Carl Anderson, Supreme Knight, Knights of Columbus. “On one hand, we have the unanimous policy of the elected branches of the United States Government stating that a genocide is occurring. On the other hand we have an aid bureaucracy that is allowing the intended consequence of the genocide to continue, even though it is in our power to stop it.”

“There is nothing unconstitutional, illegal, unethical or unprofessional about prioritizing their right to survival as a community,” Anderson added, referring to Christian and other communities that face extinction in Iraq and Syria.

Bill Canny, executive director for migration and refugee services at the United States Conference of Catholic Bishops (USCCB), said, “We are gravely concerned by the small number of religious minorities who have been resettled in the United States during the current fiscal year.”

“It is unclear at the time of this writing precisely why the percentage of Syrian Christians, who have been registered as refugees or resettled in the United States as refugees, is so low,” Canny continued. “It is clear, however, that Christians and other religious minorities have become a target for brutality at the hands of the non-state actor ISIS, and that they are fleeing for their lives, and that far too few of them have been attaining U.S. resettlement.” USCCB resettles more refugees annually in the U.S. than any other agency.

Chairman Smith was joined at the hearing by a bipartisan group of lawmakers, including Helsinki Commission Co-Chair Senator Roger Wicker (MS), Ranking Commissioner Senator Ben Cardin (MD), and Commissioners Rep. Joe Pitts (PA-16) and Rep. Alan Grayson (FL-09).

In 2013, ISIS began its brutal campaign of extermination and expulsion in Syria, expanding to Iraq in 2014. Many of those who survived these atrocities have been joining the flood of refugees streaming out of the region to Europe and other areas of safety. Resolving their plight is a key component to helping address the refugee crisis and has been of intense interest to countries in the OSCE region.

  • OSCE Human Dimension Implementation Meeting 2015

    “The Human Dimension” is OSCE-speak for human rights, democracy, and humanitarian concerns.  When the Helsinki Final Act (HFA) was signed in Helsinki, Finland in 1975, it enshrined among its ten Principles Guiding Relations between participating States (the Decalogue) a commitment to "respect human rights and fundamental freedoms, including the freedom of thought, conscience religion or belief, for all without distinction as to race, sex, language or religion" (Principle VII). In addition, the HFA included a section on cooperation regarding humanitarian issues that provided an umbrella for addressing (among other things) family reunification and working conditions for journalists. "The Human Dimension" was a term coined during the drafting of the 1989 Vienna Concluding Document to serve as shorthand to describe the human rights and humanitarian provisions of the agreements concluded within the framework of the Helsinki process. Today, it has come to include the OSCE’s watershed commitments on democracy, the rule of law, and free and fair elections. In any given year, the OSCE participating States address human dimension issues in multiple fora.  The Human Dimension Implementation Meeting – HDIM – attracts the largest number of participants, covers the greatest range of issues, and is open to participation by civil society. That work includes formal sessions on the full range of human rights  issues as well as rule of law, free elections, and democracy-building issues. National minorities, Roma, and tolerance and nondiscrimination are also on the agenda.  U.S. Delegation Led by David Kramer The 2015 HDIM was held September 21 to October 2 and drew 1,386 participants.  The U.S. delegation was led by David J. Kramer, Senior Director for Human Rights and Human Freedoms at the McCain Institute and former Assistant Secretary of State for Democracy, Human Rights, and Labor.  It also included U.S. Ambassador to the OSCE Daniel Baer; Deputy Assistant Secretary of State for Democracy, Human Rights and Labor Robert Berschinksi; Department of State Special Advisor for International Rights Judith Heumann; and Helsinki Commission Senior Senate Staff Representative Ambassador David T. Killion.  Helsinki Commission staff participated in all aspects of the delegation’s work. In addition to active engagement in the formal sessions, the United States participated in side events focused on specific countries or issues organized by civil society, OSCE participating States, or international organizations, and held numerous bilateral meetings with other delegations to raise and discuss human rights.  Special Advisor Heumann led a panel highlighting the importance of disability rights for OSCE countries as part of a U.S. side event cosponsored with Finland. Russia: External Aggression and Internal Repression During the HDIM, Russia’s aggression in and against Ukraine was raised in connection with almost every agenda item for the meeting.  The OSCE Office for Democratic Institutions and Human Rights (ODIHR) also issued a joint report prepared with the OSCE High Commissioner on National Minorities detailing widespread human rights violations in Russian-occupied Crimea.  Increasing levels of repression within Russia also were raised throughout the HDIM and served to highlight the relationship between external aggression and internal repression. In early 2015, Boris Nemtsov, an advocate for the rule of law and accountability in Russia and an outspoken Russian critic of the Russian government’s war against Ukraine, was gunned down just outside the Kremlin.  Russia’s increasingly repressive government has eroded the democratic institutions that ensure a government’s accountability to its people. A free and independent media is virtually nonexistent and the remaining state-controlled media is used to propagandize disinformation, fear, bigotry, and aggression. Azerbaijan’s Record Draws Sharp Criticism In 2015 Azerbaijan unilaterally shuttered the OSCE Mission in Baku, effectively blocked the OSCE’s independent election observation in October, and sentenced journalist-heroine Khadija Ismayilova to 7 ½ years in prison for reporting on government corruption.  The government of Azerbaijan has also escalated pressure against the family members of its critics, in a further effort to stifle dissent.  As a consequence, throughout the HDIM, Azerbaijan was the subject of singular attention and criticism. In one particularly sharp exchange with the moderator during the discussion of fundamental freedoms in the digital age, Azerbaijan challenged its critics to name at least 25 of an estimated 100 political prisoners.  A partial list – 25 names – is below. Abilov, Abdul Aliyev, Intigam Aliyev, Nijat Akhundov, Rashadat Guliyev, Araz Hasanov, Nasimi Hashimli, Parviz Hazi, Seymur Ismayilova, Khadija Jabrayilova, Valida Jafarov, Rasul Karimov, Fara Mammadli, Anar Mammadov, Hilal Mammadov, Igar Mammadov, Omar Mirkadirov, Rauf Ramazanov, Rashad Rustamov, Aliabbas Rustamzada, Ilkin Seyidov, Elnur Yagublu, Tofig Yunusov, Arif** Yunus, Leyla** Zakharchenko, Irina **Leyla and Arif Yunus have been released from prison since the HDIM but remain under house arrest.

  • Serbia Concludes Year-Long OSCE Chairmanship

    Four decades after the signature of the Helsinki Final Act, Serbian Foreign Minister Ivica Dacic presided over a Serbian chairmanship of the Organization for Security and Cooperation in Europe (OSCE) that kicked off with high expectations.  As a successor to the only participating State ever suspended from OSCE decision-making for egregious violation of Helsinki standards (1992 to 2000), the ability of Serbia to chair the organization was a credit not only to the country, but also to the OSCE which provided significant guidance and engagement through the transition.  Throughout Serbia’s chairmanship, the situation in Ukraine dominated the work of the OSCE participating States, including at the annual OSCE Parliamentary Assembly meeting.  This overshadowed efforts to commemorate the Helsinki Final Act’s 40th anniversary, as the OSCE’s future was considered to hinge on the Minsk agreements and its response to the crisis in and around Ukraine. Ukraine Russia’s egregious violations of the Minsk agreement led to its collapse in January 2015.  Minsk II, adopted in February 2015, represents a further attempt to de-escalate the war in the Donbas. After six months of non-implementation, a September 1 cease-fire has largely held, with considerably fewer casualties than earlier, although there has been an uptick in recent weeks.  Heavy weapons are slowly being withdrawn from the line of contact.  Nevertheless, the agreement remains extremely tentative as Russia and its separatist proxies continue to disregard the majority of its provisions:  Special Monitoring Mission (SMM) access remains blocked in large portions of the Russian-led separatist-controlled territory; Russian forces and equipment remain on Ukrainian territory; Ukrainian control over its borders with Russia has not been restored.  Furthermore, restrictions continue on humanitarian aid and Ukrainian hostages remain in Russian custody.  Terrorism 2015 was also scarred by numerous terrorist attacks in the OSCE region, including incidents targeting Jewish institutions and free speech in Paris and Copenhagen in January and February; the bombing of a Russian civilian airliner over the Sinai Peninsula in October; an attack in Turkey just three weeks before November 1 snap elections; and multiple, simultaneous attacks again in Paris in November.  On November 17, the Permanent Council adopted a declaration on the need to combat by all means, in accordance with the Charter of the United Nations and international law–including applicable international human rights, refugee and humanitarian law–threats to international peace and security caused by terrorist acts. Refugee Crisis Issues relating to the refugee crisis became more acute over the course of the year.  In early June, the Serbian Chairmanship held a special human dimension event on refugees and internally displaced persons.  On October 6, following significant increases of migrant flows into Europe, the Serbian Chairmanship convened an unprecedented joint meeting of the Permanent Council’s three committees (on military-security, economic and environmental cooperation, and the human dimension) to focus on the refugee-migrant crisis. Finally, many hoped that Serbia’s positive experience hosting a field mission would serve as an example to other participating States cooperating with OSCE field activity.  Unfortunately, turned out not to be the case, as illustrated by the abrupt closure of the mission in Baku. In addition, Serbia – missed an opportunity in 2015 to more strongly exemplify OSCE norms by providing justice for the 1999 execution-style murders of the three Kosovar-American Bytyqi brothers, a key issue in U.S.-Serbian relations.

    In Ukraine, the OSCE monitors the cease-fire, weapons withdrawal, and overall security situation in eastern Ukraine. In addition, the OSCE has observed local elections and reports on widespread human rights violations in Russian-occupied Crimea.   • It's Time to Hold the Azerbaijan Regime Accountable

    Azerbaijani President Ilham Aliyev's habit of brutally silencing dissent may be finally catching up with him. A new bill introduced in Congress last month would require the U.S. State Department to deny visas to senior members of Aliyev's government until the country can prove it has ceased harassment of independent media and NGOs and made significant progress toward freeing its political prisoners. Despite facing long odds, the Azerbaijan Democracy Act of 2015 marks a major turning point. For years, the United States has struggled to muster any real condemnation of Azerbaijan's government, one of the most corrupt and repressive in the world. U.S. officials and lawmakers still routinely refer to their Azerbaijani counterparts as "friends" despite the fact that the former Soviet country's latest crackdown has been accompanied by a general turn away from the West. Or should we say partial turn. Azerbaijan wants to be at the table with Western nations when money is up for grabs, but it hasn't acquired the same taste for values about human rights and dignity. This juxtaposition was perhaps most apparent earlier this year when the country hosted the inaugural European Games, a 17-day competition featuring 6,000 athletes from 50 countries. The capital city of Baku spared no expense to project a modern, glamorous image during the event--even flying in Lady Gaga for a surprise performance. For many people, it was a first glimpse of Azerbaijan. But that glimpse was carefully choreographed. Foreign reporters who agreed to play by the government's rules were rewarded with access to the games; others,including Guardian sports correspondent Owen Gibson, were banned from attending after calling out human rights abuses in the country. What the cameras did not capture that night was the escape of Emin Huseynov, the founder of the Institute for Reporters' Freedom and Safety, who fled Azerbaijan for Switzerland on the private plane of the Swiss foreign minister. Huseynov first sought refuge at the Swiss embassy ten months earlier after Azerbaijani authorities raided his office. Other human rights advocates and journalists have not been as fortunate. Within a 10-day period in August 2014, Intigam Aliyev, Rasul Jafarov, and Leyla and Arif Yunus all were arrested. They were later subjected to speedy show trials resulting in lengthy prison sentences for crimes they did not commit. Leyla and Arif, both seriously ill, have recently been released to serve suspended sentences but still face charges of treason. Employees of Meydan TV, whose founder reported receiving a high-level threat during the European Games, have been barred from leaving Azerbaijan, repeatedly questioned at the prosecutor's office, and detained without cause. Their families have also faced pressure. Two brothers of editor Gunel Movlud are currently being held on bogus drug charges. Most tragically, in August, Rasim Aliyev, a journalist and chairman of the Institute for Reporters' Freedom and Safety, died after he was severely beaten by attackers. Although the assault was reportedly connected to a criticism Aliyev made of a soccer player on Facebook, Aliyev had previously experienced threats against his life. The attack was one of hundreds against Azerbaijan's journalists in the past decade, including at least two other murders. Quiet diplomacy from the United States and the European Union has failed to reverse Azerbaijan's relentless pursuit of critics and civil society groups. The State Department called Leyla Yunus' release earlier this month a "welcome" development and a "positive step." Meanwhile, the deputy chairman of the opposition Popular Front Party, was arrested the day before, and the treason trial of dissident journalist Rauf Mirqadirov is still underway. But perhaps President Aliyev's luck is running out. In November, in an unprecedented step, the Organization for Security and Co-Operation in Europe's Office for Democratic Institutions and Human Rights, its Parliamentary Assembly, and the European Parliament all canceled monitoring missions to Azerbaijan to protest the irregularity of the country's parliamentary elections. Last month, Thorbjørn Jagland, secretary general of the Council of Europe, made a bold move of his own, announcing an inquiry into Azerbaijan's implementation of the European Convention on Human Rights. And on the same day, U.S. Congressman Chris Smith, chairman of the Helsinki Commission, introduced the Azerbaijan Democracy Act and held a hearing on the case of Khadija Ismayilova, one of the few journalists in Azerbaijan who dared to report on corruption among the country's ruling elite. Ismayilova was arrested last year and is now serving a seven and a half-year prison sentence. Ismayilova has kept up the pressure on her country even from behind bars. On the eve of the European Games, with the help of Sport for Rights, a coalition of international press freedom groups that recently published a report on Azerbaijan's human rights record, she managed to get a letter out of jail to The New York Times. "The truth is that Azerbaijan is in the midst of a human rights crisis. Things have never been worse," she wrote, urging the international community: "Do not let the government of Azerbaijan distract your attention from its record of corruption and abuse." Maybe now the world is ready to listen.

  • Helsinki Commission Chair Acts to End Human Rights Violations in Azerbaijan

    WASHINGTON—Following years of systematic efforts by the Government of Azerbaijan to eliminate the voices of independent journalists, opposition politicians, and civil society groups, Helsinki Commission Chair Rep. Chris Smith (NJ-04) today introduced H.R. 4264, the Azerbaijan Democracy Act of 2015, a landmark bill that will deny U.S. visas to senior members of the Azerbaijani government. “We recognize that there are important national security and economic ties that exist between our two countries, but the United States can no longer remain blind to the appalling human rights violations that are taking place in Azerbaijan,” said Rep. Smith. “Journalists and activists are routinely arrested and imprisoned; opposition politicians are in jail and elections are not free and fair; human rights lawyers have been harassed and disbarred; and religious freedom is under attack.  The Azerbaijan Democracy Act demonstrates that the United States takes human rights and fundamental freedoms seriously, and that we will not compromise when faced by a government that represses the political opposition, the media, and religious minorities.” In addition to denying U.S. visas to senior leaders of the Government of Azerbaijan, those who derive significant financial benefit from business dealings with senior leadership, and members of the security or judicial branches, the Azerbaijan Democracy Act also expresses the sense of Congress that financial penalties should be considered. Sanctions could be lifted when the Azerbaijani government shows substantial progress toward releasing political prisoners, ending its harassment of civil society, and holding free and fair elections. “It is unacceptable that senior members of the Azerbaijani government are free to visit the United States while courageous women and men like investigative journalist Khadija Ismayilova, attorney Intigam Aliyev, opposition politician Ilgar Mammadov, and activist Anar Mammadli are locked away in prisons with inadequate access to legal or even medical assistance,” Rep. Smith said. “If they can pay the price for standing up for human rights, the least we can do is to stand with them.” Rep. Smith is a long-standing advocate for human rights in Azerbaijan. Following the introduction of today’s legislation he will chair a 2PM hearing to examine Azerbaijan’s persecution of Ms. Ismayilova, who was sentenced to 7.5 years in prison in early September.

  • U.S. Bill Seeks Sanctions On Azerbaijani Officials For 'Appalling' Rights Record

    A U.S. lawmaker has introduced legislation that would deny U.S. visas to senior Azerbaijani officials due to what he calls Baku's "appalling human rights violations." U.S. Representative Chris Smith (Republican-New Jersey) introduced the bill, titled the Azerbaijan Democracy Act of 2015, in the House of Representatives on December 16. "The human rights situation has seriously deteriorated in Azerbaijan, causing damage to its relations with the United States and other countries, and has damaged its own society by imprisoning or exiling some of its best and brightest citizens," Smith told a hearing of Congress's Helsinki Commission held in conjunction with the announcement of the legislation.

    From October 20-21, 2015, the OSCE held its annual Mediterranean Conference focused on “Security in the Mediterranean Region – Challenges and Opportunities.” It included four distinctive themes: Session I: Common Security in the Mediterranean Region; Session II: Addressing Violent Extremism and Radicalization that Lead to Terrorism; Session III: The Role of Interfaith/Intercultural Dialogue; and Session IV: Irregular Migration, Refugee Protection, Migrant Smuggling and Human Trafficking in the Mediterranean.

  • Helsinki Commission Chair Honored by Voices of the Bosnian Genocide

    WASHINGTON—Voices of the Bosnian Genocide honored Helsinki Commission Chair Rep. Chris Smith (NJ-04) on Thursday with an award recognizing his efforts to ensure that the genocide at Srebrenica is acknowledged. “It is moving to receive this award from young people, many of whom are survivors of the genocide or lost relatives at Srebrenica and are now working to promote human rights,” said Rep. Smith. “Today the international community is nearly unanimous when it proclaims that the Srebrenica massacre was a genocide, although shockingly, there are those who continue to deny that the policies of aggression and ethnic cleansing implemented by Serb forces meet that criteria.” For more than 20 years, Rep. Smith has worked tirelessly to see that the perpetrators of the horrific acts at Srebrenica and elsewhere in Bosnia-Herzegovina are punished and that closure is provided to survivors and victims’ families. In July 2015, Rep. Smith authored H. Res. 310 defining the Srebrenica massacre as a genocide, which was passed unanimously by the U.S. House of Representatives.   Voices of the Bosnian Genocide is a Seattle-based nonprofit organization devoted to raising awareness and educating the public about the genocide that took place in Bosnia-Herzegovina in the 1990s and the ongoing effects that the genocide is having on Bosnia and the world. The group is made up of individuals who are passionate about genocide education and prevention and human rights.

  • Taking Action on Europe’s Worst Refugee Crisis Since World War II

    Mr. Speaker, on Tuesday I convened a Helsinki Commission hearing to scrutinize the European refugee crisis and help determine the most effective ways in which the U.S., the European Union, and the OSCE can and should respond.  The Syrian displacement crisis that has consumed seven countries in the Middle East has become the biggest refugee crisis in Europe since World War II. At least 250,000 people have been killed in Syria’s civil war, many of them civilians.  The security forces of Syrian dictator Bashar al-Assad’s security forces have been responsible for many of these killings, targeting neighborhoods with barrel bombs and shooting civilians point-blank. ISIS has committed genocide, mass atrocities, and war crimes, against Christians and other minorities, and likewise targeted, brutalized and killed Shia and Sunni Muslims who reject its ideology and brutality.  Fleeing for safety, more than four million Syrians are refugees, the largest refugee population in the world, and another 7.6 million Syrians are displaced inside their home country.  Syria’s neighbors—Jordan, Lebanon, Turkey, Iraq, and Egypt—are hosting most of these refugees. Before the Syria crisis, these countries struggled with high rates of unemployment, strained public services, and a range of other domestic challenges. Since the conflict began, Syrian refugees have become a quarter of Lebanon’s population, and Iraq, which has been beset by ISIS and sectarian conflict, is hosting almost 250,000 refugees from Syria.  Until this past summer, few Syrian refugees went beyond countries that border their homeland. Syrian refugees and migrants from a range of countries have since come to Europe in such large numbers, and so quickly, that many European countries, especially front-line entry points like Greece, transit countries like Serbia, and destination countries like Germany, have been challenged to respond.  The UN High Commission for Refugees, UNHCR, reports that more than 635,000 refugees and migrants have arrived in Europe by sea in 2015. Fifty three percent of these people are from Syria, sixteen percent from Afghanistan, six percent from Eritrea, and five percent from Iraq. Notably, only fourteen percent of them are women, twenty percent are children, and the remaining sixty-five percent are men.  The European crisis requires a response that is European, national, and international, and the United States is essential to it. There must be effective coordination and communication directly between countries as well as through and with entities like the OSCE and European Union. Individual countries also must have the flexibility to respond best to the particular circumstances in their own countries.  The response must address ‘‘push’’ factors, like economic challenges and aid short-falls in countries like Syria’s neighbors that have been hosting refugees. It must also address ‘‘pull’’ factors, like decisions individual European countries have made that have attracted refugees.  There is real human need and desperation. Refugees are entrusting themselves to smugglers and where there is human smuggling there is a higher risk of human trafficking. I am especially concerned about the risk of abuse, exploitation, and enslavement, of women and children. Already we are hearing reports that some European countries are failing to protect women and girls from sexual assault and forced prostitution. The lack of separate bathroom facilities for males and females, rooms that can be locked, and other basic measures, enable such attacks. There is no excuse for such failures and everything must be done to ensure that women and children are safe.  There is also the real threat that terrorist groups like ISIS will infiltrate these massive movements of people to kill civilians in Europe and beyond. I am deeply concerned that the screening at many European borders is inadequate and putting lives at risk. All of us must be responsive to the humanitarian needs without compromising one iota on security. European response plans should include specifics about strengthening security screening throughout the European region.  During the conflict in Kosovo, I travelled to Stenkovec refugee camp in Macedonia and was at the McGuire Air Force Base in New Jersey to welcome some of the 4,400 people brought from there to the United States. A refugee—Agron Abdullahu—was apprehended and sent to jail in 2008 for supplying guns and ammunition to the ‘‘Fort Dix 5’’—a group of terrorists who were also sent to prison for plotting to kill American soldiers at the Fort Dix military installation. Given Secretary Kerry’s announcement in September that the United States intends to resettle at least 85,000 refugees in fiscal year 2016, including at least 10,000 Syrians, and at least 100,000 refugees in fiscal year 2017, the United States and Europe must be on high alert to weed out terrorists from real refugees.  Because religious and ethnic minorities often have additional risks and vulnerabilities even as refugees, they should be prioritized for resettlement. Tuesday’s hearing examined the ‘‘who’’ is arriving, the ‘‘why’’ they are coming to Europe, and the ‘‘what’’ has been done and should be done in response. European governments, entities like the OSCE and the EU, and civil society all have critical roles to play.  The United States has been the leading donor to the humanitarian crisis inside Syria and refugee crisis in the region. We also have the largest refugee admissions program in the world. However, according to Tuesday’s testimony from Shelly Pitterman, Regional Representative for the UN High Commission for Refugees, ‘‘The current inter-agency Syrian Regional Refugee and Resilience (3RP) plan for 2015 is only 41 percent funded, which has meant cuts in food aid for thousands of refugees.’’  Globally, he warned, ‘‘the humanitarian system is financially broke. We are no longer able to meet even the absolute minimum requirements of core protection and lifesaving assistance to preserve the human dignity of the people we care for. The current funding level for the 33 UN appeals to provide humanitarian  assistance to 82 million people around the world is only 42 percent. UNHCR expects to receive just 47 percent of the funding we need this year.’’  At the hearing, Sean Callahan, Chief Operating Officer of Catholic Relief Services, said, ‘‘As global leaders in the international humanitarian and refugee response, the U.S. and Europe must heed Pope Francis’ call and find new ways to alleviate the suffering and protect the vulnerable.’’ I could not agree more. In the 20th and 21th centuries, the United States and Europe have come together to address the great challenges of our time and this is an opportunity to do so again.

  • Europe's Refugee Crisis: How Should the US, EU and OSCE Respond?

    This hearing, held on October 20, 2015, discussed possible responses to the Syrian refugee crisis.  Witnesses, including representatives from the American and Serbian governments, the UNHCR, the European Union, and non-profit groups working with refugees, highlighted the scale and intensity of the crisis.  Many of the witnesses also emphasized the need for cooperation among governments and between governments and non-profit organizations in addressing this crisis.

  • Smith Calls for Action on Worst Refugee Crisis in Europe since WWII

    WASHINGTON—At a hearing convened today by the Commission on Security and Cooperation in Europe, also known as the Helsinki Commission, Chairman Chris Smith (NJ-04) and other lawmakers scrutinized actions being taken to deal with Europe’s largest refugee crisis since World War II by the United States, European governments, regional bodies like the OSCE and the EU, and civil society. The Commission also reviewed recommendations on developing a long-term solution to the crisis. “The European crisis requires a response that is European, national, and international. There must be effective coordination and communication directly between countries as well as through and with entities like the OSCE and European Union,” said Rep. Smith, who called today’s hearing. “There is real human need and desperation. Refugees are entrusting themselves to smugglers and where there is human smuggling there is a higher risk of human trafficking,” he continued. “There is also the real threat that terrorist groups like ISIS will infiltrate these massive movements of people to kill civilians in Europe and beyond. In addition, witnesses emphasized the importance of a shared and coordinated response by all actors involved to ensure a long-term solution to the crisis. “It’s a very challenging situation,” said Anne Richard, Assistant Secretary of State for Population, Refugees, and Migration. “The scale of this migration is much bigger than before.” “The US government has a three-pronged approach: strong levels of humanitarian assistance; active diplomacy; and expanded refugee resettlement,” she continued. “Without our support, more people would be making the dangerous journey to the north.” “Europe is facing its biggest refugee influx in decades. UNHCR is calling upon the European Union to provide an immediate and life-saving response to the thousands of refugees as they are crossing the Mediterranean and making their way through Europe,” said Shelly Pitterman, Regional Representative to the United States and Caribbean, Office of the United Nations High Commissioner for Refugees. “Europe can no longer afford to continue with this fragmented approach that undermines efforts to rebuild responsibility, solidarity and trust among states, and is creating chaos and desperation among thousands of refugee women, men and children. After the many gestures by governments and citizens across Europe to welcome refugees, the focus now needs to be on a robust, joint European response.” “The ongoing refugee crisis is not a European crisis. It is a global crisis, fueled by conflicts, inequality and poverty, the consequences of which unfolded in Europe but the roots of which are far away from our continent,” noted EU Ambassador to the United States David O’Sullivan. “The EU and its Member States are firmly committed to the promotion and protection of the human rights of migrants. Despite the influx, we do not remove or return genuine refugees, we respect the fundamental rights of all persons arriving in the EU, and we invest major resources in saving lives at sea.” Djerdj Matkovic, Ambassador of the Republic of Serbia to the United States, said, “The OSCE region is witnessing the largest refugee influx in decades. Apart from being a significant economic challenge, this is a process with potentially very serious security implications and the cause of concern in regards to the respect for human rights… As the presiding country [of the OSCE] Serbia recognizes the importance of this issue and is trying to provide more active and concrete approach of the OSCE in addressing it. In light of this bleak security situation and looming instability, it is paramount that all the mechanisms that were designed and adopted by the participating States to oversee the implementation of commitments are strong and functioning.” Sean Callahan, chief operating officer of Catholic Relief Services, observed, “As global leaders in international humanitarian and refugee response, the US and Europe must find new and creative ways to help to alleviate this suffering and protect the vulnerable.  Pope Francis has led in this effort to do more by asking every Catholic parish in Europe to reach out and assist the refugees; he reminds us of our moral obligation to help the stranger... Despite efforts by [international NGOs] like CRS, local civil societies, governments, and non-traditional donors, the despair of so many refugees indicates that assistance must move beyond short-term band-aids to longer-term solutions.” Chairman Smith was joined at the hearing by a bipartisan group of lawmakers, including Senator John Boozman (AR), Senator Jeanne Shaheen (NH), Representative Michael Burgess (TX-26), Representative Randy Hultgren (IL-14), and Representative Joe Pitts (PA-16).

  • Helsinki Commission Announces Hearing to Examine Europe's Refugee Crisis

    Europe is experiencing an enormous refugee crisis. An estimated half a million migrants and refugees have crossed the Mediterranean to Europe so far in 2015; as many as 50 percent are Syrian refugees.  Thousands more join them each day, and many of the European nations of the Organization for Security and Cooperation in Europe (OSCE) are struggling to cope.

    As the regional security organization in Europe, how can the OSCE use its tools, standards, and commitments to help manage the humanitarian crisis and ensure that security and economic challenges are addressed? What has the US government done, and what should it be doing? The hearing will examine the reasons for the current crisis; relevant OSCE and other European agreements, commitments, and structures; the response of the OSCE, the EU, and the US; potential security issues related to the ability of extremists to infiltrate the refugee stream; and the potential for refugees to become victims of human trafficking.

  • Bipartisan Congressional Delegation Represents US at OSCE Parliamentary Assembly; Also Visits Ukraine, Czech Republic

    Forty years after the signing of the Helsinki Final Act established the precursor to today’s Organization for Security and Cooperation in Europe (OSCE), five members of the Helsinki Commission and four other members of Congress traveled to the OSCE Parliamentary Assembly Annual Session in Helsinki to demonstrate the U.S. commitment to confronting Russian aggression in Ukraine and elsewhere. Led by Commission Co-Chairman Senator Roger F. Wicker (MS), the bicameral, bipartisan delegation organized by the Helsinki Commission included Commission Chairman Representative Chris Smith (NJ- 04); House Commissioners Robert B. Aderholt (AL-04), Steve Cohen (TN-09) and Alan Grayson (FL-09); and Representatives Gwen Moore (WI-04), Michael Fitzpatrick (PA-08), Richard Hudson (NC-08) and Ruben Gallego (AZ-07). Before attending the Annual Session from July 5 to 7, several members of the delegation also visited Ukraine and the Czech Republic. A central concern to the delegation throughout the trip was Russia’s restrictions on democracy at home and aggression in Ukraine, along with Russia’s threat to European security.

  • Helsinki Commission Chair Deplores Attack on Serbian Prime Minister during Srebrenica Commemoration

    WASHINGTON—Following the stone-throwing attack on Serbian Prime Minister Aleksandar Vucic at Saturday’s ceremony commemorating the 20th anniversary of the Srebrenica genocide, Helsinki Commission Chair Rep. Chris Smith (NJ-04) issued the following statement: “Such violence is unworthy of the memory of the thousands of innocent civilians who were massacred in the genocide 20 years ago. Prime Minister Vucic’s attendance at the ceremony demonstrated a willingness to seek reconciliation and learn from the past.  I add my voice to those who have condemned the mob attack in the strongest possible terms and I urge the Bosnian authorities to take the necessary steps to apprehend and prosecute those responsible.” Rep. Smith is the author of the recently passed H. Res. 310, which affirms that the policies of aggression and ethnic cleansing implemented by Serb forces at Srebrenica constituted genocide, and condemns statements denying that the massacres meet the definition of genocide. Since 1995, Rep. Smith has worked to see that the perpetrators of the horrific acts at Srebrenica are punished and that closure is provided to survivors and victims’ families.

  • Urging Passage of H. Res. 310

    Madam Speaker, this week, the world pauses to remember and reflect on the Srebrenica genocide, horrific acts of brutality, wanton cruelty, and mass murder committed in Srebrenica beginning July 11, 20 years ago. This week, we pause to honor those brave Bosniaks who suffered and died, victims of genocide. This week, the people in the United States and men and women of goodwill throughout the world again extend our deepest condolences and respect to the mothers and surviving family members who have endured unspeakable sorrow and loss that time will never abate. And this week, the international community must recommit itself to justice, once and for all, for those who perpetrated these heinous crimes. Today, Ratko Mladic and Radovan Karadzic are incarcerated, awaiting final disposition of their cases before the International Tribunal for the former Yugoslavia for multiple counts of genocide, crimes against humanity, and violations of laws and customs of war. Twenty years ago, Madam Speaker, an estimated 8,000 people were systematically slaughtered by Bosnian Serb soldiers in the United Nations-designated “safe haven” area of Srebrenica. They killed Muslim women and children, but especially sought out and murdered adult males in that area. These brutal killings were not committed in battle. They were committed against people who were unarmed and helpless and who had been repeatedly assured by Dutch peacekeepers that they would not be harmed if they surrendered. The evidence is overwhelming that the executions were committed with the specific intention of destroying the Bosnian Muslim population of that area. This intention is the central element in the crime of genocide. The U.N. peacekeeping forces in Srebrenica were charged with enforcing Security Council Resolution 836, which had pledged to defend the safe areas with “all necessary means, including the use of force.” But when the moment of truth came, the U.N. forces offered only token resistance to the Serb offensive. Their military and political commanders had redefined their primary mission not as the protection of the people of Srebrenica, but as the safety of the U.N. forces themselves. When Bosnian Serb Commander Ratko Mladic threatened violence against the blue- helmeted soldiers here is the way one of those soldiers described the reaction. And I quote him: ‘‘everybody got a fright. You could easily get killed in such an operation. As far as I knew, we had not been sent to Srebrenica to defend the enclave, but, rather, as some kind of spruced-up observers.’’ So that is what the peacekeepers became: observers to genocide. Soon they became something more than observers: enablers. On July 13, the Dutch blue-helmet battalion handed Bosnian Muslims who had sought safety within the U.N. compound over to the Serbs. They watched as the men were separated from the women and children, a process which was already well known in Bosnia—it was at the time—as a sign that the men were in imminent danger of being executed. These men were never heard from again. At one congressional hearing I chaired in March of 1998—and I had six of them— Hasan Nuhanovic, the indigenous translator working for the U.N. peacekeepers in Srebrenica, testified. He was there in the room. Hasan lost his family in the genocide. He was there when Mladic and the commanders of the Dutch peacekeepers talked about the terms. Here is what he told my panel, in part: “On July 12, the day before the fall of Srebrenica, the Bosnian Serb Army commander, General Ratko Mladic, requested a meeting with the Dutchbat commander, Lieutenant Colonel Karemans, and local representatives of Srebrenica in the nearby town of Bratunac outside the enclave . . . During the meeting, Mladic assured the Dutch and local delegation that no harm would come to the refugees in Potocari . . . “Upon returning to the camp, three local representatives are ordered by Dutchbat deputy commander, Major Franken, to prepare a list of all males, all men and boys between the ages of 16 and 65 among the refugees inside and outside the camp. The list of the males among the 6,000 inside the camp was completed the same day . . . “On July 13, the Dutch ordered 6,000 refugees out of the Potocari camp. The Serbs were waiting at the gate, separating all males from the women and children. Major Franken stated that all the males whose names were on the list would be safe . . . I watched my parents and my brother being handed over to the Serbs at the gate. None of them have been seen since. “I want to explain here that the people hoped that the Dutch were going to protect them, the U.N. peacekeeping troops and all other members of all other organization who were present in Srebrenica who were inside the camp, the people hoped that they would be protected, but the Dutch soldiers and officer gave no other option to the refugees but to leave. So the refugees inside were told to leave without any other choice. My family was told on the evening of 13 July that they should leave. About 6 p.m., there were no more refugees inside the camp. “I don’t know if this is the topic of the meeting or hearing, but the same night the Dutch soldiers had a party inside the camp because they received two or three trucks full of beer and cigarettes. They played music while I was sitting, not knowing what happened to my family.” As he went on to say later, they had all been slaughtered. In July of 2007, Madam Speaker, I visited Srebrenica, where, together with my good friends President Haris Silajdzic and the Grand Mufti of Bosnia, Reis Ceric, I spoke at a solemn memorial service and witnessed the internment of hundreds of wooden coffins of newly discovered victims of the genocide. It was a deeply moving experience to see 12 years then after the genocide— now it is 20 years—families still grieving loved ones whose bodies were being identified, often miles from the killing sites, as Serb forces, trying to hide the evidence of their crimes, moved the bodies of their victims. For the record, 10 years ago—in 2005— the House of Representatives overwhelmingly passed H. Res. 199, which I authored, which clearly and unambiguously condemned the Srebrenica massacre for what it was: genocide. That resolution was a landmark in the recognition of the Srebrenica massacre as a genocide. Two years later the verdict of the International Court of Justice found the same, in confirming the ruling of the International Criminal Tribunal for the former Yugoslavia. Today the international community is nearly unanimous when it proclaims that the Srebrenica massacre was a genocide. The resolution today, of course, supports that as well. Astonishingly, Madam Speaker, there are some genocide deniers. That is why this resolution condemns statements that deny that the massacre at Srebrenica constituted genocide. Just last weekend Milorad Dodik, the president of Republika Srpska, asserted that the Srebrenica genocide is a lie. Madam Speaker, just as it is doing in Ukraine, Russia is utilizing misinformation and historical revisionism in an attempt to destabilize Bosnia and the Balkan region. Today Russia vetoed a British U.N. Security Council resolution that reaffirms that Srebrenica was a genocide. Russia has encouraged Serbia itself to protest the resolution and emboldened genocide denialism in the Republika Srpska, one of Bosnia’s two constituent entities. Madam Speaker, this resolution also encourages the administration to fulfill other neglected responsibilities. In particular, it urges the Atrocities Prevention Board to study the lessons of Srebrenica and issue informed guidance on how to prevent similar incidents from recurring in the future. As you may know, the Atrocities Prevention Board is a U.S. interagency committee established by the administration in 2012 to flag potential atrocities. However, since its creation, the board has been marked by inaction and a complete lack of transparency. This is unacceptable, especially as conflicts with disturbing parallels to Bosnia before the genocide continue to fester in Syria, the Central African Republic, Burma, and in Burundi. Africa, in particular, would stand to benefit from a more active board. The conflict in Burundi is currently at a tipping point, and it absolutely needs attention.  Madam Speaker, despite the need for much greater atrocities prevention in U.S. policy, there have been many promising developments in the Balkan region, and this needs to be underscored. In particular, I would note that Serbia today is not the Serbia of the Slobodan Milosevic era. That era was marked by nationalist aggression against neighboring countries and peoples, as well as considerable repression at home. One of those who testified at one of my hearings on Serbia, Curuvija, a great young leader, was murdered on the second day after our bombing began by Serbian people. And the persons who did that have now been held to account. So what has happened there—thankfully, there have now been significant changes in Serbia. I want to thank my colleagues. I do hope we will have a strong show of support for this resolution. I reserve the balance of my time.

  • Helsinki Commission Chair Introduces Resolution Marking 20th Anniversary of Srebrenica Genocide

    WASHINGTON—Ahead of the 20th anniversary of the atrocity committed at Srebrenica in Bosnia and Herzegovina in July, Helsinki Commission Chair Rep. Chris Smith (NJ-04) today introduced a resolution to affirm that the policies of aggression and ethnic cleansing implemented by Serb forces in that country constituted genocide as well as to condemn statements denying that the massacres meet the definition of genocide. The resolution has 28 original co-sponsors, 14 Republicans and 14 Democrats. H. Res. 310 urges the Atrocities Prevention Board—an interagency organization charged with helping the U.S. government identify and address atrocity threats—to issue guidance on preventing future genocides, and encourages the United States to continue to support the independence and territorial integrity of Bosnia and Herzegovina, as well as peace and stability in southeastern Europe as a whole. This comes as part of a broader effort to push the Obama Administration to take atrocities prevention seriously. “The thousands of innocents who were brutally slaughtered at Srebrenica deserve our remembrance of the tragedy for what it was: genocide,” said Rep. Smith. “The international community must ensure the perpetrators are held accountable for their actions, and study the lessons of Srebrenica with the aim of preventing future atrocities, particularly in current conflicts in the Central African Republic, Burundi, and Syria. In addition, we must continue to uphold the right of all people in Bosnia and Herzegovina and throughout the Balkans today—no matter their ethnic or religious background—to enjoy the benefits of democracy, the rule of law, and economic opportunity.” The July 1995 massacre at Srebrenica was one of the worst atrocities to occur in the conflict in Bosnia and Herzegovina between April 1992 and November 1995, during which period more than 2,000,000 people were displaced, more than 100,000 were killed, and tens of thousands were raped or otherwise tortured and abused. In addition to being the primary victims at Srebrenica, individuals with Bosniak heritage comprise the vast majority of the victims during the conflict in Bosnia and Herzegovina as a whole, especially among the civilian population.

  • Central Asia Becomes New Target for ISIS Recruiters

    Thousands of fighters have fled their home countries to join the Islamic State group in Iraq and Syria, including the chief of the counter-terrorism program in a Central Asian country. Col. Gulmurod Khalimov, who was highly trained by the U.S., left his post in Tajikistan, posting a video online last week as proof. While perhaps the most notable example, Khalimov is only one of an estimated 4,000 people who have left nations in central Asia to join ISIS, according to the International Crisis Group. “What does this say about the current effort to stop terror-minded men and women from volunteering and traveling to the Middle East?” Rep. Chris Smith, R-N.J., asked at a hearing about the recruitment of foreign fighters from Central Asia. The hearing took place on the anniversary of ISIS’ capture of Mosul, Iraq. “Clearly, our government – working with others …  must take stronger action to combat radicalization beyond our borders.” In a step toward this goal, the Commission on Security and Cooperation in Europe, of which Smith is a co-chairman, held a hearing to discuss recruitment of foreign fighters from Central Asia countries. The commission, also known as the Helsinki Commission, focused on the five countries in the region: Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan and Uzbekistan.

  • Rep. Smith Chairs Helsinki Commission Hearing on Armenian Genocide

    WASHINGTON—At a hearing convened today by the Commission on Security and Cooperation in Europe, also known as the Helsinki Commission, Chairman Chris Smith (NJ-04) and other lawmakers examined denialism of the Armenian Genocide by the Government of Turkey and the decades-long effort to seek accountability.  “The Armenian genocide is the only genocide of the 20th century in which a nation that was decimated by genocide has been subject to the ongoing outrage of a massive campaign of genocide denial, openly sustained by state authority,” said Smith, who called today’s hearing and chaired Congress’s first-ever hearing on the Armenian Genocide in 2000. “Sadly, the Turkish government has driven this campaign of denial, and has done so over a course of decades.” Smith continued, “I must respond to President Obama. On Tuesday his aides met with Armenian leaders and made it clear that once again he will not recognize the Armenian genocide. This is in direct contradiction to the promises he made before becoming president—and in order to become president.  “While a candidate, in 2008 the President made passionate statements in support of genocide recognition… these are beautiful words which echo hollowly today,” Smith said. “The president’s abandonment of this commitment is unconscionable and cynical. With Germany and the EU lining up to do the right thing, our government needs to do likewise. Sadly, after the President’s powerful promise, he is following, not leading – or rather, we are not even following.” Witnesses testifying at the hearing focused on the sustained campaign of the Turkish government to deny the Armenian genocide and its impact on Armenian-Turkish relations and foreign policy in the region. “Turkey’s denialism of its past and making it an essential part of its foreign policy is not simply a moral abomination; it represents a threat to democracy, stability and security, not only in Turkey but in the region too,” testified Dr. Taner Akçam, a Turkish scholar who holds the chair in Armenian Genocide Studies at Clark University. “The refusal [of the U.S.] to recognize past injustices is fundamentally undemocratic and contributes to the destabilization of Turkey and the region. How can the United States, which prides itself on its exceptionalism in supporting liberal values and human rights at home and across the world, justify a position at odds with its own democratic values?” “Far too often, over the past several decades, under Turkey's arm-twisting here in Washington, DC, official discussions of the Armenian Genocide were framed in denialist terms, on the basis of Ankara's artificially contrived ‘debate’ about whether there was an Armenian Genocide,” said Kenneth Hachikian, chairman of the Armenian National Committee of America. “Turkey's denial of truth and justice for the Armenian Genocide remains the central issue between Turks and Armenians, the one that must be openly acknowledged, honestly discussed, and fairly resolved for there to be real, sustained progress in relations between these two nations.”  “How did denial start and how did it last as long as it has?  The answer is simple—successive Turkish governments have used the issue to instill fear, promote racism, distract their population from the truth, and avoid progress,” said Van Krikorian, co-chairman of the board of trustees of the Armenian Assembly of America. “Having re-written their own history, they are now afraid to tell the truth as they will lose votes and risk power. Tragically, this pattern has found accomplices, as Turkish leaders have openly threatened countries which do not deny the Armenian Genocide.  Those who bend to bullying continue to be bullied. Those who do not, show honor and backbone.” Additional witnesses who testified at the hearing, “A Century of Denial: Armenian Genocide and the Ongoing Quest for Justice,” included Dr. Elizabeth H. Prodromou, visiting associate professor of conflict resolution at Tufts University’s Fletcher School, and Mrs. Karine Shnorhokian, representative of the Genocide Education Project.

    At this hearing, Chairman Chris Smith and other lawmakers examined denialism of the Armenian Genocide by the Government of Turkey and the decades-long effort to seek accountability. The hearing also provided an opportunity to assess potential countercurrents in Turkish society that could move the Government of Turkey toward recognition, and explore what the United States and other countries can do to help bring about recognition and eventually, reconciliation. Witnesses testifying at the hearing focused on the sustained campaign of the Turkish government to deny the Armenian genocide and its impact on Armenian-Turkish relations and foreign policy in the region. Turkey’s denialism of its past and making it an essential part of its foreign policy was identified as a threat to democracy, stability, and security in the entire region.

  • Smith: U.S. Must End Its Denial of Armenian Genocide

    Genocide is the most terrible crime a people can undergo, or another people can commit. It must never be forgotten. To forget it would be to dull our consciences and diminish our own humanity. It must never be denied, but fully acknowledged. Otherwise, any meaningful attempt at reconciliation will be thwarted. Brookdale College, the Center for Holocaust, Human Rights, and Genocide Education (Chhange), and everyone who contributed to making exhibits the center unveiled April 12 a reality, has performed a great service to our community, not only to Armenian-Americans, but to everyone, including those who deny the genocide. They are opening paths to the truth, and therefore to a better future. In September 2000, I had put together and chaired a hearing on the Armenian genocide and legislation to finally put the United States on record officially acknowledging it. It was a four-hour hearing, the first hearing the House of Representatives ever held on it. The testimony I heard that day, and accounts of the atrocities I have read in the articles and books over the years, have shocked me deeply. A related resolution on the genocide, H. Res. 398 — vigorously opposed by the Clinton administration — never got a vote. But just as shocking then is what we still see today: a completely political and callous campaign to deny the Armenian genocide. In 1915, there were about 2 million Armenians living in what was then the Ottoman Empire. They were living in a region that they inhabited for 2,500 years. By 1923, well over 90 percent of these Armenians had disappeared. Most of them, as many as 1.5 million were dead. The remainder had been forced into exile. There is no lack of historical record. In fact, we only have to listen to the words of the U.S. Ambassador to Turkey at the time, Henry Morgenthau, who called it a "campaign of race extermination." We only have to listen to the British, French, and Russian governments who said the Young Turks committed a "crime against humanity," the first time in history that charge was ever made by one state against another. And we only have to listen to the government of Turkey itself, which tried and convicted a number of high-ranking Young Turk officials for their role in what the Turkish government's indictment called, "the massacre and destruction of the Armenians." When the term genocide was invented in 1944 to describe the systematic destruction of an entire people, its author Raphael Lemkin explained the term by saying it was "the sort of thing Hitler did to the Jews and the Turks did to the Armenians." The campaign to deny this genocide, often driven by the Turkish government, is repulsive. It is a slap in the face to Armenians everywhere. It is this denial that keeps the Armenian genocide a burning issue and prevents much needed healing of old wounds. Armenians are unfortunately not alone in suffering the hurt and pain that stems from the denial of truth. The international community failed the victims of the Holocaust, China, the Soviet Union, Eastern Europe, Ethiopia, Rwanda, Bosnia, DRC, Darfur and Syria, to name a few. That means that we here in the United States, and that means not only the Congress but also the president, have the responsibility to speak truthfully and to speak boldly about the past in order to secure our future. We must write and speak the truth so that generations to come will not repeat the mistakes of the past. Only 20 nations around the world have recognized the Armenian genocide. That includes Canada as well as eleven EU countries including France, Germany Italy, Sweden, Belgium, the Netherlands, Lithuania, Poland, Slovakia, Greece and Cypress. Conspicuously absent from the list of nations that have officially recognized it is the United States. For my part, I am preparing to chair a congressional hearing on April 23 — the day before Armenian Remembrance Day (April 24) — which this year marks the 100th anniversary of the genocide. When political leaders fail to lead or denounce violence, the void is not only demoralizing to the victims but silence actually enables the wrongdoing. Silence by elected officials in particular conveys approval — or at least acquiescence —and can contribute to a climate of fear and a sense of vulnerability. History has taught us that silence is not an option. We must do more.
